*73 Minutes The Chairman advised Members of a correction to the Schedule for the Development Management Committee meeting held on 25 March. The Committee had agreed the following recommendation in respect of application 13/2447/MOUT (Pinn Court Farm, Pinn Court Lane, ) which had been omitted from the Schedule:

 that the Development Management Committee agrees to reason 1 for refusal (highways) in respect of determined application 12/0795/MOUT not being determined at the current appeal.

With the inclusion of the above resolution in the Schedule for the meeting of the 25 March, the minutes of the Development Management Committee meetings held on 25 March, 1 April and 3 April 2014 were agreed and signed as a true record.

*74 Annual Appeals Status Report The Committee considered the Development Manager’s report which provided an overview of the results of planning appeals for the year from April 2013 to March 2014.

The Committee Members noted that of 57 appeals decided in the last year (up from 40 decisions the previous year) only 26.3% had been allowed, compared with the national average of 35%. 73.7% of appeals had been dismissed. The Committee considered that this reflected the consistency and the quality of the decision making process.

The Development Manager advised that the majority of planning appeals were dealt with by written representations. One appeal dealt with by Public Inquiry was dismissed. Six appeals were dealt with by means of a Hearing of which four were dismissed and two were allowed.

The importance of analysing Inspector’s decisions and the implementation of any necessary changes in policy in accordance with the National Planning Policy Framework, during the decision making process was highlighted. Reason given to refuse a planning application needed to be both justified and defendable – if an appeal was lodged and a reason could not be justified it was likely that an application for an award of costs against the Council would be successful. The financial implications related to cases where application for costs had been made and granted were outlined.

In response to questions from Committee members the Development Manager advised that: Of the 15 appeals allowed, 12 were delegated decisions and 3 were Committee decisions. Of the 3 Committee decisions, 2 were refused against officer recommendation. The total cost, including officer time, for dealing with appeals was not calculated. The Committee was advised that limited officer resource was required for appeals dealt with through written representations compared with those that were dealt with through a Hearing or Public Inquiry which could involve officers for days. Inspector’s decisions were noted and lessons were learnt from those cases that had been allowed on appeal.

RESOLVED: that the Development Management Committee notes the Annual Appeals Status report.

*75 Planning appeal statistics The Committee received and noted the report of the Development Manager setting out appeals recently lodged and appeal decisions notified.

The Development Manager advised that of the 6 appeals decided, 2 had been allowed and 4 had been dismissed. The Committee had noted the outcome of the Public Inquiry for the 4 appeals for major housing developments in at the last meeting; Members were encouraged to read the decision.

The Committee’s attention was drawn to the appeal allowed in Ebford for the construction of a detached dwelling. The Inspector had overruled the countryside protection and sustainability reasons for refusal. An application of costs had been dismissed.

The Committee also noted that an appeal to vary a condition to allow the provision of 6 additional residential pitches at Hawkwell Park in Hawkchurch was dismissed. The Inspector had upheld sustainability reasons.

76 Sustainable Communities Act Proposals 2013 The Committee considered the Community Engagement and Funding Officer’s report outlining a proposal submitted under the Sustainable Communities Act and inviting the Committee to consider recommending to Council that the proposal be submitted to national government for consideration.

The Sustainable Communities Act offered communities the opportunity to put forward proposals which contributed to the sustainability and wellbeing of local areas. Having taken part in this opportunity in 2009, the Council had decided to take part again in 2013. Members were advised that of the two eligible proposals put forward by East Devon communities, one had been approved by the East Devon Community Panel. The proposal sought to ask national government to consider setting a maximum amount the Council and appellant could spend on a planning appeal – the amount to be determined by an independent review. The aim of the proposal, which was set out in detail in the Committee report, was to rebalance the planning system and save the Council money. The Principal Solicitor and Development Manager’s views on the proposal were contained within the Committee report.

Points raised during discussion on the proposal included: Costs associated with individual appeals varied – appeals dealt with through written representation generally did not require significant officer resource whereas a public inquiry could involve a number of officers. There was no fee for making an appeal, however the applicant had to cover their own costs. The current appeal system was considered to be undemocratic. If a developer had acted unreasonably the Council had the ability to submit an application for costs. The Council had made successful applications in the past. Any decision for refusal needed to be robust and defendable – the risk of costs should not inform decision making.

76 Sustainable Communities Act Proposals 2013 cont...

Applicants legally had the right to appeal and that it should be their choice as to who represented them. There was an opportunity to limit the costs awarded against either Council or the appellant for unreasonable behaviour rather the total amount that could be spent of a planning appeal. The Council should submit the communities’ proposal as written.

RECOMMENDATION: that the Development Management Committee recommends to Council that the proposal around planning appeal costs outlined in the Committee report be submitted to government using the Sustainable Communities Act, subject to an amendment that the limitation on costs should apply to cost awards for unreasonable behaviour only.

78 East Devon Local Plan – Inspector’s letter and future action The Committee considered the Planning Policy Manager’s report outlining proposed further actions arising from the Local Plan Inspector’s letter dated 31 March 2014 and seeking a recommendation to Council to adopt a Devon wide Duty to Cooperate Protocol. The report also included an update on the East Devon Villages Development Plan Document.

The Planning Policy Manager drew the Committee’s attention to the action plan within the report, highlighting the main issues raised by the Inspector and action or consideration proposed in response.

In respect of questions raised by Members during debate, the Planning Policy Manager advised:  It would be premature to progress further with the production of the Villages Development Plan Document, including discussions with the parishes, until the outcomes of the Strategic Housing Market Assessment (SHMA) were known.  Five year housing land supply figures were currently calculated on a bi-annual basis and involved significant officer resource to calculate. Regular updates would be less critical when the Council was in a position where it could demonstrate that it had a five year supply (plus 20%).  The type and length of further public consultations required would be dependent on the outcomes of the SHMA and gypsy and traveller study.  Trends over the last 50 years had shown that household sizes were decreasing and therefore there would be a need for more housing even if the population remained the same. East Devon had a growing population.  Further work was required on sustainability. The Inspector’s reports in respect of recent appeals would inform this work.  The Council had a duty to cooperate; discussions were ongoing with neighbouring authorities on each of the district’s ability to accommodate growth. Analysis and assessment of the options available were required.  Local Plan Examination Oral Hearings were hoped to resume in October with a target of adopting the Local Plan in early 2015. Increasing weight could be afforded to the Plan as it progressed through examination.  The Council would continue to remain vulnerable to unplanned development until it could demonstrate a five year housing land supply (plus 20%). There were some National Planning Policy Framework policies that could not be applied without a five year land supply, however the Council had successfully defended appeals on other grounds. It would not be possible to update the Development Management Committee on the latest position in respect of the five year land supply before each Committee meeting due to the work involved, however a steer could be given in light of significant permissions granted.  Plan period – looking forward a possible option could be for the Local Plan to have a start date of 2014.

The Chairman’s thanks, echoed by the Committee, were extended to Planning Policy Manager for his detailed report.

Purpose of report: The Open Space Study was endorsed by this Council in June 2012 for use as evidence in determining planning applications and for the standards to be incorporated into the New Local Plan. This review updates that study to a current position by removing obsolete open space sites, adding in new or previously missed out sites, and reclassifying others. Endorsement of the review will ensure that the most up to date evidence is used in determining planning applications and help in directing investment of S106 and potentially Council and other funds. The review would supersede elements of the Open Space Study and its appendices C and D but need to be read alongside the original study for context and other evidence which has not been superseded.

Recommendation: 1. That the Open Space Study Review 2014 is endorsed by Committee for use as evidence in determining planning applications. It may of course leave the Council open to costs applications for unreasonable behaviour in pursuing contributions based on out of date evidence. Accordingly the Committee is advised to endorse the Open Space Study Review 2014 for the purposes of decision making on planning applications as per the Recommendation. 1 What does the Open Space Study Review 2014 update? 1.1 The Open Space Study Review 2014 will update and supersede elements of the Open Space Study 2012. 2 Why is the review required? 2.1 Paragraph 73 of the NPPF requires planning policies to be “based on robust and up-to- date assessments of the needs for open space, sports and recreation facilities and opportunities for new provision”. Without conducting a review, it may have been considered that the evidence was not robust or up-to-date. 2.2 Naturally, a number of changes have occurred to the supply of sites including new open space sites being created and others being removed. In addition to this, comments were made about certain sites and the suitability of their classification. It is important to have an accurate and robust record of sites.

3 What impact will endorsing the review have? 3.1 Planning applications for net new dwellings are required to make contributions towards open space based on a calculator derived from Table 1 in the Open Space Study’s Appendix A where there is a demonstrable need. Where there is above the quantity standard for a particular open space typology in the Parish in which the proposed development will take place, then contributions can only be sought if there is a quality deficiency of any sites of that typology within the access standard of the site, or if there are no sites of that typology within the access standard of the site. In many cases, this means that if there is sufficient supply for the Parish as demonstrated in the table on pages 86-87 of the Open Space Study 2012 then contributions will not be sought on that typology.

3.2 The Open Space Study Review 2014 updates this table and this means that some settlements that showed an undersupply of certain typologies now show sufficient supply. This means that development in that Parish may not need to provide open space contributions towards that typology. The box below shows an example of the supply in Sidmouth Parish as per the 2012 study and the 2014 review.

4 What next? 4.1 Now that the evidence base has been brought up to date, it is the intention in due course to write an online calculator for use by applicants/agents or officers to get a clear understanding of what the open space requirements of a planning application will be. 4.2 This calculator will require the user to input just the site address/UPRN and the net number of dwellings proposed and will then show what a development of that scale in that specific location will be required to contribute in terms of open space, whether any of it should be delivered on-site and the justification behind asking for this. The calculator will draw on data from the open space GIS mapping and the quality audit to justify the contributions.

Agenda 32 Introduction 1.1 This report updates the East Devon Open Space Study 2012. It brings the study up to date by taking account of new open space sites, sites which have been removed since the study’s production, sites which have been upgraded/changed, and amending some classifications to be more appropriate to their use/management. 1.2 The report does not seek to change the general thrust of the study, the methodology used or the open space standards. The updates and amendments proposed by the report are considered to be appropriate, essential and necessary to keep the Open Space Study up to date and robust as evidence. 1.3 Key outputs of this report are an up to date and error-corrected Appendix C (Quality Audit), Appendix D (List of sites by Parish) and table showing the supply of open space against the requirements on a Parish by Parish basis. 1.4 The report should be read alongside and in addition to the Open Space Study 2012 and will form evidence in deciding planning applications, negotiating Section 106 Agreements and investment in open spaces.

Justification for the Open Space Study Review 2.1 Since June 2012, the Open Space Study has been used as evidence in deciding planning applications, negotiating Section 106 Agreements and to an extent influenced investment in open spaces. Through this process, naturally, a number of changes have occurred to the supply of sites including new open space sites being created and others being removed. In addition to this, comments were made about certain sites and the suitability of their classification. 2.2 Paragraph 73 of the NPPF requires planning policies to be “based on robust and up- to-date assessments of the needs for open space, sports and recreation facilities and opportunities for new provision”. Without conducting a review, it may have been considered that the evidence was not robust or up-to-date. 2.3 In response to this it was deemed appropriate to conduct a full review of the Open Space Study rather than simply make a number of changes that were initially known to be needed.

Methodology 3.1 In order to get a full picture of the possible changes to be made, a survey was sent out to all Parish Councils in the District. The survey, (example shown below), listed all of the sites currently making up the supply of open space for the Parish in the first table, and any sites that we thought ought to be listed in the second table. There were comments about specific existing sites as well to state where sites had been refurbished or removed since the original assessment. Parish Councils were asked to respond to three questions: 1) Do we have the full range of facilities within your area listed? 2) Have we marked down where facilities have been updated/refurbished since November 2011? 3) Are there any facilities listed that are no longer in use? 3.2 The received responses varied in detail but provided the necessary information in most cases. 45/65 Parish Councils responded to the survey, providing a number of open space sites that had been previously missed out during the original assessment as well as new sites and letting us know about changes to and removals of existing sites.

Agenda 34 3.3 Following receipt of the responses an officer visited each of the sites that had been suggested or commented on by Parish Councils. These site visits were to confirm whether such changes should be made or not and to conduct new quality audits where necessary. 3.4 The definitions of the different open space typologies as detailed in Section 3 of the Open Space Study were applied to all of the sites being assessed to ensure consistency. Some sites which had previously been assessed were re-classified through the review process as it was the opinion of the officer and/or Parish Council that the site better fitted a different typology. In some cases, areas of grass with one or two football goals but no formal pitch had been classified as outdoor sport – pitches, however it was considered that due to the informal nature of these sites they were more akin to the parks and recreation grounds typology. Similarly, some sites of informal accessible grassland had been classified as parks and recreation grounds, however it was considered that they were more akin to natural and semi-natural green space due to their management and usage. 3.5 Quality audits were conducted for each new site and any sites which had previously been missed out, and new quality audits were conducted for sites which had been refurbished / changed since the original assessment. The same matrix was used to assess the sites as was used in the initial assessment to ensure consistency.

The Supply of Open Space 4.1 Paragraph 3.3 of the Open Space Study contains a table showing the existing provision of open space across the District. The table below replaces that table at 3.3 with up to date data and to the 2012 PPSA population estimate for East Devon (136,484).

Agenda 65 Assessing Planning Applications 6.1 This Open Space Study Review should be used in conjunction with the original study and the forthcoming Playing Pitch Strategy as evidence in assessing the open space requirements and contributions for planning applications. 6.2 In due course, the Council hopes to implement an online calculator tool which will make it easier to understand exactly what the open space requirements for a development would be in a specific location. Until this point, applicants should consult the above listed documents. 6.3 Open Space contributions (on-site or through financial contribution) will be sought on all open space typologies unless it is demonstrated that: a. There is sufficient existing supply of a given typology as illustrated by the “Open Space Supply by Parish” table above; AND b. The application site is within the accessibility standard distance from an open space site of that specific typology (as illustrated by the maps above); AND c. There are no quality deficiencies (as illustrated by the quality audit) in any open space sites of that typology within the relevant accessibility standard. This ensures that the impact of new development on existing open space sites is adequately mitigated against. 6.4 Calculation of requirements will be based on the standards and costs of providing open space as per the original study including its Appendix A. Land costs are over and above these costs.

On-site / Off-site 7.1 As a guide, developments will be expected to provide open space on-site through a Section 106 Agreement in line with the following thresholds (this is an adaptation and slight variation of Table 5 in Appendix A to the Open Space Study): • 9 dwellings or less will not be required to provide any specific open space typologies on-site, however developers may choose to make such provision. • 10 – 49 dwellings will be required to provide amenity open space on-site as per the open space standards. • 50 – 199 dwellings will be required to provide amenity open space, and children’s and youth play space on-site as per the open space standards. • 200+ dwellings will be required to provide for all open space typologies on-site as per the open space standards. 7.2 It may be necessary or desirable to provide more of certain typologies and subsequently less of others depending on site specifics. In some cases the Council may consider it reasonable to have no open space provision on-site so long as an adequate off-site contribution is provided. 7.3 Where financial contributions are made through Section 106 Agreements/Unilateral Undertakings towards off-site open space then they will be pooled with money from other developments and spent on relevant open space projects within the Parish that the development has taken place.

Agenda 66 APPENDIX D - April 2014 Review

This Appendix details the which sites contribute towards the open space provision for each Parish. The sites listed below are used to calculate the existing provision in a Parish against the standards set out by the Open Space Study and therefore do not include school/college sites, MOD sites, or other sites not considered to be available for public use. Whilst some school/college facilities are known to be available for community use, for the purposes of this exercise they are excluded. Please note that whilst cemeteries and churchyards, civic spaces, outdoor sport - fixed and outdoor sport - fixed (LA) are listed below, the Open Space Study does not set quantity standards for these typologies.

Table 1 shows allotments; amenity open space; cemeteries and churchyards; civic space; education (play); education (sport); outdoor sports - fixed; outdoor sport - fixed (LA); outdoor sport - pitches; outdoor sport - pitches (LA); parks and recreation grounds; play space - children; and play space - youth.

Table 2 shows Natural and Semi-Natural Greenspace. Not all of these sites are accessible. Where a site covers more than one Parish, the entire site is lited under just one Parish (for example East Hill Strips covers parts of both Sidmouth and Ottery St Mary Parishes but is only listed under Ottery St Mary below). The key standard for natural and semi-natural greenspace is access to accessible sites.

Subject: Delegated powers for deeds of variation and minor post resolution changes

Purpose of report: This report is designed to highlight a number of issues that have arisen with regard to the processing of deeds of variation which are commonly used to enable a signed and engrossed Section 106 agreement or unilateral undertaking to be varied. The authority is regularly asked to consider requests for deeds of variation, however they are not explicitly addressed in the constitution and so this report is seeking to clarify the delegated powers and the process for consideration of these requests. The report also seeks to address some issues that have arisen where minor changes to the wording of conditions and heads of terms imposed as part of a resolution of the Development Management Committee are required and the need to establish delegated authority for such changes where they are inconsequential.

Recommendation: 1. That requests for a deed of variation be delegated to the Head of Economy where the change complies with the adopted policy of the Council unless a ward member takes a contrary view to the officers within 3 working days of receipt of a draft report detailing officer’s views. In the event of a contrary view being taken the matter to be reported to a Chairman’s Delegation Meeting for a decision. Where any change included in a deed of variation does not comply with policy the change to be considered at the level of the original decision on the application. 2. That delegated authority be given to the Head of Economy to amend and add to the conditions and heads of terms contained within any report on an application considered by the Development Management Committee or the Chairmans Delegation Meeting where such changes do not conflict with the purpose of the draft condition or heads of terms.

Legal implications: The basis for seeking these delegated powers is clearly set out in the report. Firstly, it is to formalise the process for dealing with deeds of

It provides a clear process for how these matters will be dealt with going forward and thereby creates certainty in the way they are handled. In light of two recent experiences this is a positive step to ensure a transparent and robust process is in place for dealing with deeds of variation. Secondly, it is to allow minor necessary amendments to conditions / heads of terms post committee resolution or Chairman’s sign-off. This will save officer and Member time in dealing with minor / inconsequential changes to conditions / heads of terms which are necessary to ensure that the most robust decision is made / issued. Given the basis upon which these requests are made there are no legal implications arising.

Equalities impact: Low Impact The proposed changes would not impact on any equalities issues. Risk: Low Risk All delegated decisions on changes to open space contributions would be made having had due regard to adopted planning policies and the adopted open space study. Deeds of Variation

In recent months the authority has received a number of deeds of variation which have primarily sought to amend Section 106 agreements and unilateral undertakings (UU) attached to permissions for new dwellings granted over the last few years. These often relate to open space contributions which are calculated using a standardised calculator. In light of the new open space study the calculator has been updated to ensure that when calculating open space contributions we take account of current provision within the settlement and therefore only ask for contributions where the development would lead to a shortfall in provision in one or more of the open space categories identified in the open space study. Historically the calculation was simply based on the demands that the development itself would place on open space provision. As a result of this change in methodology (which is necessary to comply with the legislation) in settlements that are well served in terms of open space provision the contribution that would now be required is

substantially lower than that previously sought. As a result a number of developers have been requesting that we accept a deed of variation to reduce the open space contribution to that which would now be required. Such requests are perfectly reasonable given that if the applicants could

Agenda 82 reapply for the same form of development today and only have to commit to paying the lower open space contribution. The alternative therefore becomes a choice between accepting a deed of variation or requiring the developer to reapply. The latter option generates a significantly greater amount of work for the same end result and therefore such deeds of variation are a pragmatic solution to this issue.

Requests for a deed of variation are also common in relation to changes to the wording of Section 106 agreements in relation to matters such as the affordable housing provision where a registered provider may have issues with specific wording which requires amending to satisfy them or their lender. These changes do not change the level or type of affordable housing provision and are simply a technical legal change to the document but still technically require approval. Other deeds of variation may simply link a previous agreement to a new application which seeks minor changes to the form of development.

There are two routes by which a deed of variation would be considered these are: 1. Stand alone submission of a deed of variation unconnected to any planning application 2. Submission of a deed of variation as part of a planning application to alter the original consent

Under route 1 because there is no specific application and the deed is simply a change to a previous obligation a report has historically been taken through whichever route the original application was determined. If it was a committee decision then a report on the deed of variation has come to committee. If it was a delegated decision then a report has been taken through the delegated process.

Under route 2 because there is an application accompanying the deed of variation there has been some confusion over why the deed of variation has not formed part of the consultation on the application. It is also the case that ward members can call the application to committee where it is classified as a major or minor application under the constitution thereby in effect deciding which route the deed of variation is determined as well. This has happened with a case that appears elsewhere on this agenda for the Former Marist Convent in Ottery St Mary where a straight forward application for some minor changes to the proposed development has been brought to the committee under the constitution because there is an accompanying deed of variation which has raised concern for the ward member. The deed of variation is not however part of the application. There is no requirement to consult on a deed of variation indeed it is a largely administrative process of considering the requirements of the original obligation against current policy and seeing if the requirements would be the same if consent was sought today. If not then a deed should be entered into to amend the requirement accordingly. There is no real judgement to be made and there is therefore a strong argument for dealing with them seperately from the application.

Clearly there is an inconsistency between the two routes which needs to be addressed. Historically there have been very few requests for a deed of variation and so there has been no need for there to be an express process for handling these requests and hence the above

Agenda 83 approach has seemed reasonable. However changes to the open space study and contribution calculator have significantly increased the number of requests.

It is therefore considered that any deed of variation should as a principle be a delegated matter and that the process for dealing with them should be similar to that used for processing applications that are classified as ‘others’. While there would be no initial consultation exercise it is considered appropriate that officers should prepare a brief report explaining why the deed of variation is sought, evaluating the justification for it against planning policies and considerations and then the report should be sent to the ward members. Where the ward members disagree with the officers recommendation the matter to be reported to the chairman’s delegation meeting and only referred to the committee if the chairman feels this is necessary or approriate.

Experience with the Marist Convent site and a further site in Ottery St Mary has shown that the community are often interested when such changes are proposed and therefore it is also proposed that when the officers report is sent to the ward member that this be copied to the town or parish clerk. The town or parish council will then be aware of the proposed change and the reasons for it and can liase with the ward member on any response. This is only considered appropriate on deeds of variation because they will not have previously been the subject of consultation.

It is considered that this arrangement would clear up any uncertainty over the process, ensure that committee time is not taken up unnecessarily with variations which are policy compliant and all parties agree on. The arrangement would however enable ward member involvement and proper debate of any disagreement between officers and ward members at the chairman’s delegation meeting. Other matters such as where the developers are looking to vary an agreement due to viability or other issues such that the planning obligations do no comply with the policies of the Council then these would not be delegated and would continue to be considered by whichever level of decision making (committee, chairmans delegation or delegated to officers) that applied to the original application. In these circumstances a full consultation with the relevant town or parish council would be carried out.

Minor Post Resolution Changes

Under the current arrangements any decision made by the Development Management Committee has to be issued in the exact form laid out in the agenda papers unless Members resolve to amend or change the recommendation. There have been a few instances where an error in the wording of a condition or heads of terms has been noted after the resolution has been taken or subsequent discussions with the developer has led to a need to amend the wording of a condition.

This was notably the case with the large housing development at Tythe Barn Green where the wording of the proposed conditions was amended following further discussions with the developer. Although these changes did not change the intent of the conditions or what was sought the change in wording clarified a few concerns for the developers. In such circumstances it has been necessary to take a further report either via the committee or chairmans delegation meeting depending on the significance of the change to make the necessary alteration before the decision

Agenda 84 is issued. Such changes have always been in accordance with the intent of Members resolution and have not changed what was decided by the committee.

It is considered that officer and Member time could be saved by allowing officers to make such minor changes to amend the wording (but not the purpose) of conditions/heads of terms and add in further conditions/heads of terms as is necessary. It is considered that this could be included as a change to the constitution but with the power limited to changes that do not conflict with the purpose of the condition/heads of terms considered by Members.
