Sentencia definitiva Juicio pro nombre de domino Mahatma.cl ROL Nº 43124-2020 Santiago, 31 de marzo de 2021 VISTOS: PRIMERO: Que con fecha 28 de diciembre de 2020 se notificó al suscrito de su designación como Árbitro en el conflicto trabado por la demanda de revocación del nombre de dominio “mahatma.cl”, Expediente Rol N° 43124-2020. SEGUNDO: Que son partes de dicho conflicto, como titular, ANANDA INDIA SPA, y como revocante Johansson & Langlois en representación de RIVIANA FOODS INC. TERCERO: Que con fecha 28 de diciembre de 2020 el suscrito aceptó el cargo para el conflicto por el nombre de dominio mahatma.cl y juró desempeñarlo fielmente y en el menor tiempo posible. CUARTO: Que con fecha 20 de enero de 2021 se dio inicio al período de demanda, y con fecha 25 de enero de 2021 la revocante, Johannson & Langlois en representación de RIVIANA FOODS INC., interpuso demanda de revocación temprana en la que manifestó que el dominio es una marca famosa y notoria de propiedad de la empresa del mismo nombre, la cual se encuentra registrada en Chile y en el extranjero, como asimismo ampliamente usada y publicitada en Chile. Que RIVIANA FOODS INC. es una subsidiaria de la mundialmente conocida empresa Ebro Foods S.A. Que cuando se fusionó con American Rice, Inc. y New World Pasta Co. en 2017, se convirtió en el mayor fabricante y comercializador de productos de arroz y el segundo más grande de productos de pasta en los Estados Unidos, siendo sus ingresos por ventas estimados en ese momento de $ 1.5 mil millones. Que Ebro Foods, S.A. es la empresa líder en el mercado español de procesamiento de alimentos y el mayor comerciante y molinero de arroz del mundo y el segundo mayor 1 productor de pasta, cuya sede se encuentra en Madrid. Que Ebro era anteriormente el mayor fabricante de productos lácteos de valor añadido de España, hasta que vendió esta unidad de negocio a Lactalis en marzo de 2010, por 630 millones de euros. Que también era el mayor productor de azúcar de España antes de la venta de esa división a la filial British Sugar de Associated British Foods en 2009. Que Ebro Foods opera en 23 países de todo el mundo y entró en el mercado estadounidense en 2004, cuando adquirió Riviana Foods, con sede en Houston, que compró American Rice en 2011 y ahora produce marcas como Mahatma, Success, Minute Rice, Water Maid y varias marcas privadas. Que en el año 2006 Ebro adquirió New World Pasta, productor de Ronzoni, San Giorgio y otros productos, y que ahora también está bajo el paraguas corporativo de Riviana. Que Riviana Foods, New World Pasta y American Rice se unieron bajo el nombre de Riviana Foods en 2017 para convertirse en el mayor fabricante de arroz y el segundo mayor fabricante de pasta en los Estados Unidos. Que Riviana se remonta a la fundación en 1911 de Louisiana State Rice Milling Company, Inc., un consorcio de treinta molinos de arroz liderado por Frank Godchaux Sr. Que en 1931, Louisiana State Rice Milling Company, Inc. introdujo envases amigables para el consumidor. Que en 1965 Louisiana State Rice Milling Company se fusionó con River Brand Rice Mills Inc. para formar Riviana Foods Inc. Que después de ser adquirida por Colgate-Palmolive en 1976, y luego vendida a la familia Godchaux en 1986, Riviana se convirtió en una empresa pública cotizada en NASDAQ. Que Riviana fue adquirida por Ebro Foods S.A en 2004. Que en 2006 Riviana adquirió Minute Rice, una marca de arroz sancochado, de Kraft Foods. Que en el año 2011 Riviana Foods Inc. adquirió American Rice, Inc., que era propietaria de varias marcas de arroz, incluidas Comet Rice y Blue Ribbon Rice. Que en el año 2017 American Rice Inc. y New World Pasta se fusionaron en Riviana Foods Inc. Que una de las principales marcas de arroz de la parte es MAHATMA. Que Riviana Foods introdujo Mahatma Rice en los Estados Unidos en 1932, durante la Gran Depresión. Que Mahatma Rice es una marca nacional de arroz que sirve a todos los Estados Unidos, mientras que su marca hermana, Carolina Rice, cubre la distribución noreste desde Maine a Washington DC. Que Mahatma Rice ofrece muchas variedades de arroz, incluido el blanco arroz, arroz sancochado, grano entero de arroz integral, Valencia arroz de grano corto, arroz orgánico, arroz amarillo, arroz silvestre, arroz basmati y arroz jazmín. Que la mayor parte del arroz de Mahatma Rice cultivado en los Estados Unidos proviene de Arkansas, California, Florida, Louisiana, Missouri, Mississippi y Texas. Que Riviana Foods comercializa otras 2 variedades de arroz que se cultivan originalmente en Tailandia (arroz jazmín) e India (arroz basmati). Que “MAHATMA” posee su propia página web www.mahatmarice.cl, por medio de la cual promociona sus productos. Que tiene registrada en Chile la marca MAHATMA, denominativa, con cobertura de Productos de la Clase C30: café, te, cacao, azúcar, arroz, tapioca, sagu, sucedaneos del café; harinas y preparaciones hechas a base de cereales, pan, productos de pastelería y confitería, helados comestibles; miel, jarabe de melaza; levadura, polvo para hornear; sal, mostaza; vinagre salsas (condimentos); especias; hielo. Que la solicitud tiene el número 880506, de fecha 7 de octubre de 2009, y el registro tiene el número 870977, de fecha 11 de octubre de 2009. Que dichos productos se venden principalmente a través del supermercado de productos saludables TREMUS, a través de su página web www.tremus.cl, pues se trata de productos sin gluten y asimismo poseen una veriedad de productos integrales. Cita los artículos 11, 14 y 18 del Reglamento de Nic Chile; el artículo 2° de la Ley N° 19.039 sobre Propiedad Industrial, en relación al artículo 19 N° 25 de la Constitución Política de la República; alega riesgos de confusiones y errores para el público consumidor. Que la parte tiene un interés preferente dada la titularidad de la marca y nombres de dominio “MAHATMA” Y “MAHATMARICE.COM”. Alega fama y notoriedad del signo. Invoca el “criterio de la identidad”, conforme al cual se debe preferir a aquella parte cuya marca, nombre u otro derecho o interés sea idéntico al SDL del dominio litigioso, y si ninguno de los derechos de las partes presenta dicha identidad, a aquella parte cuyo derecho, o el núcleo relevante o evocativo del mismo, sea idéntico al SDL del dominio litigioso o presente una mayor similitud o vinculación lógica. Cita jurisprudencia y en mérito de todo lo anterior solicita se acoja su demanda y se le asigne el dominio en definitiva. QUINTO: Que la revocante rindió las siguientes pruebas: a) copia del certificado de registro de la marca MAHATMA en Chile; b) copias de certificados de registro de la marca MAHATMA en los Estados Unidos; c) listado de solicitudes en trámite y registro de la marca MAHATMA en varios países, obtenido de la base de datos de la WIPO SEXTO: Que con fecha 27 de enero de 2021 se confirió traslado de la demanda, la que se tuvo por evacuada en rebeldía con fecha 9 de febrero de 2021. SEPTIMO: Que con fecha 18 de febrero de 2021 el árbitro citó a las partes a oír sentencia. OCTAVO: Que con fecha 10 de marzo de 2021 se decretaron las medidas para mejor resolver de consulta en el buscador Google por la expresión "mahatma" y de consulta en la red Internet por la existencia de página web para el dominio "mahatma.cl". Se dispuso que 3 en la práctica de las diligencias decretadas el árbitro podría consultar contenidos y vínculos relacionados, debiendo, en todo caso, obtener registros de lo obrado, los que debían ser acompañados a los autos con citación de las partes. NOVENO: Que las medidas para mejor resolver decretadas se llevaron a efecto con fecha 27 de marzo de 2021, obteniéndose registros de lo obrado, los que fueron acompañados a los autos con citación y no objetados. DECIMO: Que con fecha 29 de marzo de 2021 compareció a los autos la parte titular presentando argumentos, a lo que el tribunal proveyó tener presente por resolución de 30 de marzo de 2021. CONSIDERANDO: PRIMERO: Que la prueba acompañada por la revocante, referenciada en el resultando quinto, no fue objetada, razón por la cual se le atribuye valor probatorio. SEGUNDO: Que de dicha prueba, y de los argumentos de la revocante, fluye que es titular en Chile de la marca “mahatma”, para la clase 30, desde el año 2019, la que renueva al registro 549946; que es titular de marcas en Estados Unidos de una antigüedad comprobada desde el año 1963 y de marcas para la misma expresión en otros países del mundo, la más antigua de las cuales tiene fecha de solicitud 22 de junio de 1955. TERCERO: Que la titular no rindió argumentos ni pruebas en el juicio, pero goza de la presunción de mejor derecho que le otorga la calidad de primera solicitante del dominio, que se conoce como principio o criterio “first come, first served”, la que admite prueba en contrario, e implica dilucidar si ha sido suficientemente desvirtuada en la especie. CUARTO: Que las medidas para mejor resolver llevadas a efecto permitieron comprobar lo siguiente: 1) con el impreso de Wikipedia obtenido pudo establecerse que la palabra “mahatma” es una expresión hindú que se traduce como “alma grande” o “gran alma”, y que tiene un uso similar al término inglés moderno “santo” y puede traducirse como "maestro ascendido". La misma se aplica comúnmente a personas prominentes como Basaveshwara (1105-1167), Mohandas Gandhi (1869-1948), Munshiram (más tarde Swami Shraddhananda) (1856-1926), Lalon Shah (1772- 1890), Ayyankali (1863-1941) y Jyotirao Phule (1827-1890)”.

Farmers are behaving more conservatively, which is creating price tensions compared with previous years. In Southeast Asia the waning of the Thai surplus meant that specific upturns in demand in countries like Indonesia and the Philippines, etc. could not be covered so easily, and before the arrival of the second harvest prices underwent a sharp increase of 15% in just a couple of weeks. In the USA, the harvest was particularly short in important rice-producing regions (Arkansas), and this, combined with heavy sales under special treaties (Iraq/USA), is also driving prices upwards.
