Presiding Judge in Superior Court District and Limited Jurisdiction Court District
GR 29 PRESIDING JUDGE IN SUPERIOR COURT DISTRICT AND LIMITED JURISDICTION COURT DISTRICT (a) Election, Term, Vacancies, Removal and Selection Criteria--Multiple Judge Courts. (1) Election . Each superior court district and each limited jurisdiction court district (including municipalities operating municipal courts) having more than one judge shall establish a procedure, by local court rule, for election, by the judges of the district, of a Presiding Judge, who shall supervise the judicial business of the district. In the same manner, the judges shall elect an Assistant Presiding Judge of the district who shall serve as Acting Presiding Judge during the absence or upon the request of the Presiding Judge and who shall perform such further duties as the Presiding Judge, the Executive Committee, if any, or the majority of the judges shall direct. If the judges of a district fail or refuse to elect a Presiding Judge, the Supreme Court shall appoint the Presiding Judge and Assistant Presiding Judge. (2) Term . The Presiding Judge shall be elected for a term of not less than two years, subject to reelection. The term of the Presiding Judge shall commence on January 1 of the year in which the Presiding Judge’s term begins. (3) Vacancies . Interim vacancies of the office of Presiding Judge or Acting Presiding Judge shall be filled as provided in the local court rule in (a)(1). (4) Removal . The Presiding Judge may be removed by a majority vote of the judges of the district unless otherwise provided by local court rule. (5) Selection Criteria . Selection of a Presiding Judge should be based on the judge’s 1) management and administrative ability, 2) interest in serving in the position, 3) experience and familiarity with a variety of trial court assignments, and 4) ability to motivate and educate other judicial officers and court personnel. -

The argument 'has been made that the Nevada decree was defective only because Nevada had failed to give full faith and credit to the prior New York alimony decree, and -therefore -the Nevada decree denying alimony would be en- titled to credit where there was no prior decree. -

Waiver of juveniles into adult court….that is youth under 18 who end up in adult rather than juvenile court…and I am also including what we refer to as direct file case, that are actually not waivers, but another way kids get into adult court and we will talk about that more in few minutes. The different types of waivers in Indiana. I want you to understand that it is not a question of one size fits all and there are a couple of different circumstances under which a child might be waived into adult court. I will talk just a little bit about the procedure or process involved in getting kids waived Current trends or ways of thinking about this process. What I Hope To Cover Today…. U.S. Supreme Court Establishes Constitutional Rights for Juveniles….. 1. Concurrent jurisdiction laws allow prosecutors discretion on whether they file a case in juvenile or criminal court. We do not have anything like that in Indiana. 2. Statutory exclusion laws grant criminal courts original jurisdiction over certain classes of cases involving juveniles. -
A Federal Criminal Case Timeline
A Federal Criminal Case Timeline The following timeline is a very broad overview of the progress of a federal felony case. Many variables can change the speed or course of the case, including settlement negotiations and changes in law. This timeline, however, will hold true in the majority of federal felony cases in the Eastern District of Virginia. Initial appearance: Felony defendants are usually brought to federal court in the custody of federal agents. Usually, the charges against the defendant are in a criminal complaint. The criminal complaint is accompanied by an affidavit that summarizes the evidence against the defendant. At the defendant's first appearance, a defendant appears before a federal magistrate judge. This magistrate judge will preside over the first two or three appearances, but the case will ultimately be referred to a federal district court judge (more on district judges below). The prosecutor appearing for the government is called an "Assistant United States Attorney," or "AUSA." There are no District Attorney's or "DAs" in federal court. The public defender is often called the Assistant Federal Public Defender, or an "AFPD." When a defendant first appears before a magistrate judge, he or she is informed of certain constitutional rights, such as the right to remain silent. The defendant is then asked if her or she can afford counsel. If a defendant cannot afford to hire counsel, he or she is instructed to fill out a financial affidavit. This affidavit is then submitted to the magistrate judge, and, if the defendant qualifies, a public defender or CJA panel counsel is appointed. -
