Fraternal Order Of Police FORMER REP LAKE REP. CLAY LEGISLATIVE UPDATE RAY YARBOROUGH SENATOR GIBSON WEEK 4 AGREES TO SUPPORT MEETING WITH CONTINUED SUPPORT PTSD LOCALS ON PTSD OF FOP LEGISLATIVE

PTSD/Workers Comp The Florida State Fraternal Order Of Police and it’s Legislative Committee Members have been pushing to get movement in the House of Representatives on PTSD/Workerscomp legislation. Last week we joined forces with NAMI, the National Alliance on Mental Illness and they had over 200 volunteers at the Capital bringing attention to the issue of suicide and 1st Responders. With the support of NAMI, the focus of visiting FOP members, and Cabinet members like Agriculture Commissioner Adam Putnam and Chief Financial Officer Jimmy Patronis we were able to get movement from the House Of Representatives. House Bill 227 by Representative Willhite was heard in it’s first house committee of reference on January 30th, 2018 at 8:30 am in 17 House Office Building. The committee had 39 speakers supporting the legislation. NAMI continued their support and testified with our members to support the bill. Brother Michael Saxe, Chairman Holderfield, and Director Harris all testified to support the bill and it passed out with a unanimous vote. Chairwoman Sullivan spoke at the close of the meeting on the sacrifices that 1st Responders make and our need to make sure that they get the care and assistance that they need. Senate Bill 376 1st Responders Worker Compensation for PTSD has two remaining committees in the Senate before it will be ready for consideration on the senate floor. Senate Appropriations is the next stop and that committee is chaired by Senator Rob Bradley and Jacksonville Lodge 5-30 will be attending next week to try and get the bill pushed through these last committees and Pictured; ready for the floor. The next committee after Appropriations is the Senate Rules committee and it is chaired by Senator Lizbeth Benaquisto. We have met with both FOP Lodge 31 President Mike Tucker, NRA President Marion Senators and are encouraged by their response to the legislation. This Week With the fourth week complete, the budget process will move into high gear. The House and Senate have released their proposed budgets. The Senate and House will now hold meetings to amend the proposed budgets and they will continue to move through the process.The House will be hosting the budget negotiations this session, and is proposing just under $87.2 billion. The Senate is recommending about $100 million more, but still less than the $87.4 billion proposed by the Governor.The Governor’s budget proposal included $5.3 billion for public safety, which is $200 million more than the current budget. The Governor has announced his support for Proposal 49, which is being considered by the Constitution Revision Commission. Proposal 49 will provide free tuition to the families of fallen first responders, state law enforcement officers, and military members who have lost their lives in the line of duty. As the legislature moves into the budget process, the committee process starts shutting down. An example of this shut down, is that the House of Representatives have scheduled no meetings for Monday February 5th, 2018 and will only schedule any sub-committee meetings in rare instances. Representative has filed House Resolution , declaring February 3-10, 2018, as Mental Health Awareness Week in Florida. The Representative Matt resolution seeks to bring awareness to the over 43.6 million Americans, Willhite presenting PTSD including first responders, who experience some form of mental illness. bill, Brother Tim Morris Over 660,000 adults and 181,000 children in the State of Florida live greeting Senator Gibson with some form of serious mental illness. Controlled Substances; Prohibiting managed care plans and their fiscal agents or intermediaries from imposing certain requirements or conditions on recipients as a prerequisite to receiving medication- assisted treatment (MAT) services to treat substance abuse disorders; authorizing certain boards to require practitioners to complete a specified board-approved continuing education course to obtain authorization to prescribe controlled substances as part of biennial license renewal; authorizing disciplinary action against practitioners for violating specified provisions relating to controlled substances; prohibiting the dispensing of certain controlled substances in an amount that exceeds a 3- day supply or a medically necessary 7-day supply if certain criteria are met, etc. APPROPRIATION: $53,555,360.00 Effective Date: Except as otherwise expressly provided in this act, this act shall take effect July 1, 2018

Priorities The Florida State Fraternal Order Of Police are excited to announce that SB 376 Workers Comp/ PTSD 1st Responders passed it’s second committee of reference Tuesday, January 16th, 2018 at 1:30 in the Senate Commerce and Tourism Committee. This bill removes the requirement for an associating injury to receive PTSD treatment/workers compensation benefits. It lowers the evidentiary standard for of mental nervous injuries of first responders, defined in s. 112.1815, F.S., from clear and convincing evidence to preponderance of evidence. It requires that such an employee must have been acting within the course of employment and the person witnessed, or arrived at the scene of, a murder, suicide, fatal injury, child death, or mass casualty incident.Eliminates the requirement that such an employee must initiate mental health treatment within 15 days after the incident. Requires that the mental nervous injury of such an employee must be demonstrated by a preponderance of evidence, rather than a clear and convincing evidence, by a licensed psychiatrist to meet the criteria for PTSD as described in the Diagnostic and Statistical Manual of Mental Disorders, Fifth Edition, published by the American Psychiatric Association.
