Thanks be to God, source of every grace, and to Our Lady. iv ABSTRACT In 1905, Catholic Bishop Thomas Sebastian Byrne of Nashville, Tennessee announced that the Sisters of the Blessed Sacrament would open an academy and industrial school for black girls in a recently purchased mansion formerly inhabited by wealthy white Nashville banker Samuel J. Keith. Keith and hundreds of white Nashvillians protested the move, but Bishop Byrne and his collaborators refused to give up their plan and established Immaculate Mother Academy. Many black Nashvillians supported the new school, seeing Byrne’s efforts as a challenge to racial prejudice. This study tells the story of the establishment of the first stable black Catholic institutions in Nashville and their reception by white and black Nashvillians. The history of Immaculate Mother Academy shows the complex interconnection of race, religion, segregation, education, and urbanization in Nashville in the late nineteenth and early twentieth centuries. The school’s establishment was one step towards remedying the double bind in which black Catholics found themselves—required as Catholics by the Catholic bishops to educate their children in Catholic schools, they found the doors of most Catholic schools closed to black students. The school’s founding took place at a time of serious discussion in Nashville and throughout the U.S. of models of black education and dispute as to whether black students should be denied avenues to higher education. It likewise took place at a time of rapid demographic change in the city of Nashville, as the city center was changed by the expansion of railroads, industry, and the advent of electric streetcars, while segregation became more pronounced. This study demonstrates that while anti-black prejudice trumped anti-Catholicism as a motivating factor for white Nashvillians such as Keith, Catholic efforts in the face of such prejudice served as an invitation to black leaders to consider the merits of the Catholic position, and to see Catholics as allies in challenging racial prejudice. Drexel had come to join Nashville’s bishop, Thomas Sebastian Byrne, in evaluating a bit of South Nashville property she and Byrne wished to secure for the establishment of an academy for black girls.

The main celebrant for the Mass was Archbishop Charles Chaput, Archbishop of Philadelphia. This year’s award was presented to Rev. Wayne Paysse. As Executive Director of the Black and Indian Mission Office (2007 –2015), Father Paysse served as an advocate on the national scene for African American, Native American, and Alaska Native people of God. He coordinated three organizations within its scope of administration: Bureau of Catholic Indian Missions (established 1874), Commission for the Catholic Missions (established 1884) and Catholic Negro-American Mission Board (established 1907). In most Reconstruction literature, the question of black American freedom and citizenship was the central issue of Reconstruction, but not to the Republicans. The question of black American freedom and citizenship was the most salient issue to them, but they set that issue within a larger problem: the political regime of the antebellum slave South had deviated from the plan of the American Founders long before secession in 1860-1861.

Abstract National measures of student achievement, such as the National Assessment of Educational Progress (NAEP), provide evidence of the gap in success between African- American and white students. Despite national calls for increased school accountability and focus on achievement gaps, many African-American children continue to struggle in school academically, as compared to their white peers. Ladson-Billings (2006) argues that a deeper understanding of the legacy of disparity in funding for schools serving primarily African- American students, shutting out African-American parents from civic participation, and unfair treatment of African-Americans despite their contributions to the United States is necessary to complicate the discourse about African-American student performance. The deficit model that uses student snapshots of achievement such as the NAEP and other national assessments to explain the achievement gap suggests that there is something wrong with African-American children.     1 The “Doctrine of Discovery” and Terra Nullius: A Catholic Response The following text considers and repudiates illegitimate concepts and principles used by Europeans to justify the seizure of land previously held by Indigenous Peoples and often identified by the terms Doctrine of Discovery and terra nullius. An appendix provides an historical overview of the development of these concepts vis-a-vis Catholic teaching and of their repudiation. The presuppositions behind these concepts also undergirded the deeply regrettable policy of the removal of Indigenous children from their families and cultures in order to place them in residential schools. The text includes commitments which are recommended as a better way of walking together with Indigenous Peoples. Preamble The Truth and Reconciliation process of recent years has helped us to recognize anew the historical abuses perpetrated against Indigenous peoples in our land. We have also listened to and been humbled by courageous testimonies detailing abuse, inhuman treatment, and cultural denigration committed through the residential school system. In this brief note, which is an expression of our determination to collaborate with First Nations, Inuit and Métis in moving forward, and also in part a response to the Calls to Action of the Truth and Reconciliation Commission, we would like to reflect in particular on how land was often seized from its Indigenous inhabitants without their consent or any legal justification. The Canadian Conference of Catholic Bishops (CCCB), the Canadian Catholic Aboriginal Council and other Catholic organizations have been reflecting on the concepts of the Doctrine of Discovery and terra nullius for some time (a more detailed historical analysis is included in the attached Appendix).

MORELAND† Christian Legal Thought is a much-anticipated contribution from Patrick Brennan and William Brewbaker that brings the resources of the Christian intellectual tradition to bear on law and legal education. Among its many strengths, the book deftly combines Catholic and Protestant contributions and scholarly material with more widely accessible sources such as sermons and newspaper columns. But no project aiming at a crisp and manageably-sized presentation of Christianity’s contribution to law could hope to offer a comprehensive treatment of particular themes. And so, in this brief essay, I seek to elaborate upon the treatment of the principle of subsidiarity in Catholic social thought. Subsidiarity is mentioned a handful of times in Christian Legal Thought, most squarely with a lengthy quotation from Pius XI’s articulation of the principle in Quadragesimo Anno.1 In this proposed elaboration of subsidiarity, I wish to broaden the discussion of subsidiarity historically (back a few decades from Quadragesimo Anno to the pontificate of Leo XIII) and philosophically (most especially its relation to Leo XIII’s revival of Thomism).2 Statements of the principle have historically been terse and straightforward even if the application of subsidiarity to particular legal questions has not.

In order to better address challenges posed by World War I, the American Catholic hierarchy in chose to meet collectively for the first time since Penn imposed restrictions on the rights of Catholics. Carey details the rich and varied involvement Roman Catholics have had in American political, cultural, and family life. Though a majority of Catholics have agreed with the hierarchy in their insistence on legal protection of the unborn, some—including prominent politicians—have not, leading to perennial controversies concerning the responsibilities of Catholics in American public life. Churches that were not established were tolerated and governed themselves; they functioned with private funds. The Society of Jesus owned a large number of slaves who worked on the community's farms. Catholics in revolutionary America tended to be wealthy, English speaking, and more focused on private devotions than on public displays of their faith. The mandate of the newly formed organization included the promotion of Catholic participation in the war, through chaplains, literature, and care for the morale of the troops, as well as for the first time lobbying for Catholic interests in the nation's capital. The Church stands by its doctrines on sexual intercourse as defined by the Natural law : intercourse must at once be both the renewal of the consummation of marriage and open to procreation. Catholics became prominent in the officer corps, including over fifty generals and a half-dozen admirals.

These two important books by faculty members of the American and New England Studies Program at the University of Southern Maine provide significant insights into the New England past and how it has been interpreted through the centuries. For those focusing on Maine history as part of the New England historical dynamic, there is much to be learned and analyzed here. In Landscape with Figures, Kent Ryden has conducted a personal tour of selected transitions in the world we associate with New England. His work is strongly influenced by that of William Cronon regarding the meaning of wilderness, virgin land, and the level of human influence upon the natural.
