CAMPUS BARGAINING AND THE LAW: THE AAUP'S PERSPECTIVE 200 Ann H, Franke INTRODUCTION The staggering number of monumentalworld and national events of the past fiveyears, and their sometimes con- tradictory effects upon highereducation,led us at the National Center to select thetheme of "Higher Education Collective Bargaining Duringa Period of Change" for our 1994 conference. Colleges and universities have notescaped from the impact of these changes; indeed, administrators and faculty unionists have had to devotemuch of their energies in managing issues and problems unheardof just a few short years ago. Consider the following events: 1. The bnd of the Cold War, resultingfrom the collapse of Communist Party hegemony inthe former USSR, Eastern Europe, and Germany. 2. The massive cutbacks in defense andresearch monies at the federal levelin the United States, partially in response to theend of the Cold War, and partially inresponse to the nagging and persistent economic andfiscal crises which have plagued the nation throughout the 1990s. 3. Themajor restructuring ofUnited States industry which has created at thesame time large increases in productivity and a significant diminution of wages. 4. The proliferation of identity-based politics in the United States, especiallyon college and university campuses. 5. The victory of the Clinton-Gore ticketin 1992,bringing the Democratic Party to the White House for the first time inmore than a decade. 6. Severe fiscal crisis in many states whichhas caused massive cutbacks in support for public higher education institutions. 7. The continuous decline of the labor movement in the private sector, alongside thegrowth of trade unionism in the public sector. Unions continue to expand in higher education,but limited to faculty and staff members in public sector institutions. 8. The push for closer international economic cooperation among nations around the world,as evident from the passage of NAFTA inNorth American, the strength of the European Economic Community (EEC), and the rise of Japan

Nowhere is this positive trend more pronounced than New York City, where the collaboration between public schools and higher education, also known as P-16, is becoming more frequent. The P-16 model is aimed at removing obstacles in the education system that prevent students from progressing from one grade to the next. A year-long investigation of P-16 efforts in New York City revealed many accomplishments. Expansion of the College Now program, which links City University of New York (CUNY) faculty and administrators to virtually every general high school in the city, is producing more high school graduates and better prepared graduates. A teacher education "czar" has been hired to coordinate and restructure teacher education at CUNY. The New York State Regents tests have been aligned with CUNY's college placement examination, allowing students to avoid being double tested. Improved education in other areas with P-16 initiatives, notably Georgia and Texas, has resulted from these collaborative efforts.
