ORDER Sri Y. Srinivas has filed 2nd appeal dated 21-08-2017 & 16-10-2017 which was received by this Commission on 21-08-2017 & 16-10-2017 for not getting the information sought by him from the Public Information Officer/ The Head Master, Z.P. High School, Kondapuram (Village), Bethavolu (Post), Chilkur (Mandal), Suryapet District and the First Appellate Authority/ The District Educational Officer, Suryapet District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 10-04-2017 before the Public Information Officer requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application: The Public Information Officer vide Lr. No. D1/ZPHS/KPM/RTI-2005 dated 02-05-2017 furnished the information to the appellant. The appellant stated that he has not satisfied with the reply of the Public Information Officer, he filed 1st appeal dated 23-05-2017 U/s 19(1) of the RTI Act before the First Appellate Authority requesting to furnish the information sought. The appellant stated that as he did not get correct information from the 1st Appellate Authority, even after 30 days of filing his 1st appeal, he preferred this 2nd appeal u/s 19(3) of act before this Commission requesting to arrange to furnish the information sought by him. Basing on the material papers available on record, the appeal was taken on file and notices were sent to the parties concerned directing them to appear before this Commission for hearing on 09-05-2018 at Hyderabad. The case called on 09-05-2018. The appellant is present. The Public Information Officer/ A. Naga Rani, Head Master, ZPHS, Kondapuram Village, Chilkur Mandal, Suryapet District is present. The First Appellate Authority/ Shri J. Chaitanya, District Educational Officer, Suryapet District is present. (P.T.O) -2- Heard both the parties and perused the records. Sri Y. Srinivas appellant stated that the information sought by him has not been furnished. Ms. A. Naga Rani, Head Master, ZPHS, Kondapuram Village, Chilkur Mandal, Suryapet District stated that the information sought by appellant was rejected through Letter No. 01/ZPHS/KPM/2017 dated 02-05-2017. The application dated 10-04-2017 filed before the Head Master, ZPHS, Kondapuram Village, Chilkur Mandal is verified. The appellant is seeking the details of the students written in the admission register from 220 to 231 pages. The Public Information Officer rejected the request U/Sec.8 (1)(j) of RTI Act 2005. The Public Information Officer by citing the said section rejected. Mere quoting the bare clause or section of the Act does not imply that the reasons have been given. The Public Information Officer shall give conclusion that Sec. 8(1)(j) applicable. Clear cut replies have to be given to information seeker is required. Here the appellant wants some of the copies of the admission register. The public authority shall clearly indicate whether the admission register is public domain or not. The Commission is of the view that the details of the students are entered in that register and there is every possibility to see the details which are available in the register. As such rejecting the request of the appellant with a plea unwarranted invasion of the privacy of the individual is not reasonable. Hence, the Public Information Officer/ public authority is directed to issue a specific order keeping in view of the above discussion within (30) days of receipt of the order under intimation to this Commission.
