Senate Bill No. 2728 by Senator Hensley. Giles County -- Subject to local approval, authorizes an advisory referendum relative to debt issue for the construction and renovation of schools in the county.

Senate Bill No. 2729 by Senator Hensley. Lewis County -- Subject to local approval, changes, from $40 per day to $50 per month, the compensation for members of the County Highway Advisory Commission; reduces, from $300 to $200 per month, the compensation for the chairman of the County Highway Advisory Commission. Amends Chapter 395 of the Private Acts of 1937; as amended.

Senate Bill No. 2730 by Senator Hensley. Perry County -- Subject to local approval, authorizes the establishment of salary policies and scales for departments of the county; authorizes the appointment of a chief accountant and a budget director.

Senate Bill No. 2731 by Senator Gresham. Decatur County -- Subject to local approval, abolishes the Decatur County Democratic Party Executive Committee. Repeals Chapter 335 of the Private Acts of 1957; as amended.

Senate Bill No. 2732 by Senator Stevens. McKenzie -- Subject to local approval, requires newly elected council members to receive certification from the MTAS Newly Elected Officials Class within 12 months of being elected; requires council members to receive any state-mandated certifications; changes how many absences by a council member that will result in a vacancy in the office; makes the council member's compensation contingent upon attendance at meetings. Amends Chapter 128 of the Private Acts of 1990; as amended.

House Bill No. 167 -- Juries and Jurors -- As introduced, exempts from jury service persons 72 years of age or older upon request and sufficient proof of age. Amends TCA Title 22.

House Bill No. 1735 -- Taxes, Ad Valorem -- As introduced, directs TACIR to study how to make nontax-producing property held by state and local governments productive. Amends TCA Title 67, Chapter 5.

House Bill No. 1947 -- Sexual Offenders -- As introduced, defines "playground" for purposes of sexual offender restrictions as any outdoor facility that is intended for recreation of children and owned by the state, a local government, or a not-for-profit organization. Amends TCA Title 39 and Title 40.

House Bill No. 1970 -- Naming and Designating -- As introduced, designates new department of agriculture building in Davidson County as "Julius T. Johnson Metrology Laboratory.".

House Bill No. 2002 -- Controlled Substances -- As introduced, permits the direct administration of buprenorphine mono or buprenorphine without the use of naloxone as a treatment for substance use disorder under certain circumstances. Amends TCA Title 53, Chapter 10; Title 53, Chapter 11 and Title 63.

House Bill No. 2035 -- Water Authorities -- As introduced, removes the requirement that water and wastewater treatment authority boards include a person in the field of law. Amends TCA Section 68-221-605.

House Bill No. 2123 -- Tennessee Higher Education Commission -- As introduced, clarifies certain code references to account for the state university boards established by the FOCUS Act; reduces the number of student members on the higher education commission to a single voting member and revises the nominating process for that student member; removes the alumni requirement for appointments to the board of regents. Amends TCA Section 8-30-102; Section 8-36- 714; Section 8-50-809; Section 49-7-206; Section 49-7-211; Section 49-8-201; Title 49, Chapter 7, Part 1; Section 49-7-1003 and Section 49-7-204.

House Bill No. 2235 -- Museums -- As introduced, revises various provisions concerning the state museum and the Douglas Henry State Museum Commission, including adding the new facility located at 1000 Rosa L. Parks Boulevard. Amends TCA Title 4.

House Bill No. 2294 -- Local Government, General -- As introduced, allows a municipal legislative body to authorize, by ordinance passed by 2/3 vote, a member of the body who is deployed for under one year while serving as a member to attend and vote in sessions through the

use of two-way electronic audio-video communication during the deployment. Amends TCA Title 5; Title 6; Title 7 and Title 8.

House Bill No. 2586 -- Criminal Offenses -- As introduced, changes, from 500 feet to 150 meters, the distance within which a person must commit a disorderly or offensive act for a person to commit the Class B misdemeanor offense of interfering with a funeral or burial. Amends TCA Title 39 and Title 40.

House Bill No. 2642 -- Motor Vehicles -- As introduced, requires that the identification carried by reserve or auxiliary officers operating authorized law enforcement vehicles that display flashing red, white, or blue lights bear the officer's photograph and identifying information. Amends TCA Title 55, Chapter 8 and Title 55, Chapter 9, Part 4.

House Bill No. 2688 -- Public Funds and Financing -- As introduced, authorizes obligations guaranteed as to principal and interest by Freddie Mac, Fannie Mae, Sallie Mae, and other similar organizations as instruments for investment to be made by the treasurer. Amends TCA Section 9-4- 612.

AMEND by deleting all language after the enacting clause and substituting instead the following:

SECTION 1. Tennessee Code Annotated, Section 63-10-207, is amended by adding the following as a new subsection (d):

(d)(1) For the purpose of this subsection (d) only, "patient" means a patient from this state, or another state or territory, who was displaced by a disaster, as defined in § 58-2-101, when the patient is present in this state.

(2) A pharmacist in this state may, in good faith, dispense to a patient without proper authorization or a valid prescription the number of dosages of a prescription drug necessary to allow the patient to secure proper authorization or a valid prescription from the patient's prescriber.

(3) The amount of a prescription drug dispensed under this subsection (d) shall not exceed a twenty-day supply.

(4) Prescription information may be obtained from a prescription label, verbal medical order, verbal prescription order, or any other means determined to be legitimate in the professional judgment of the pharmacist.

SECTION 2. This act shall take effect July 1, 2018, the public welfare requiring it.

Senate Bill No. 2030 -- Criminal Offenses -- As introduced, creates Class A misdemeanor offense of criminal impersonation of a member or veteran of uniformed service when person pretends to be member or veteran for purpose of obtaining money, services, property, or other tangible benefit. Amends TCA Title 39, Chapter 16, Part 3 and Section 58-1-602.

Senator Kelsey moved to amend as follows:

AMENDMENT NO. 1

AMEND by deleting all language after the enacting clause and substituting instead the following:

SECTION 1. Tennessee Code Annotated, Section 39-16-301, is amended by deleting subsection (c) and substituting instead the following:

(c) A person commits criminal impersonation who, with the intent to obtain money, property, services, or any other tangible benefit, pretends to be an active duty member or veteran of uniformed service by:

(1) Wearing the uniform, rank, medals, devices, or insignia of a uniformed service of which the person is not a member or veteran or to which the person has not earned or been awarded; or

(2) Presenting false identification, documentation, or certification to include, without limitation:

(A) department of defense identification cards;

(B) Military forms showing release or discharge from active duty, including department of defense form 214 (DD 214) or equivalent forms;

(C) United States department of veteran affairs identification cards; or

(D) Certifications or qualifications indicating uniformed service training or education; and

(3) This subsection (c) shall not be construed to prevent members of organizations known as the Boy Scouts of America, or the naval militia, or such other organizations as the secretary of defense may designate, from

wearing their prescribed uniforms; nor to prevent persons who in time of war have served honorably in the armed forces of the United States, from wearing the uniform as may be prescribed by the laws of the United States; nor to prevent other duly designated organizations, schools, colleges, universities, cadet corps, military societies, or instructors, from wearing the uniform as prescribed by the laws of the United States; nor to prevent the wearing of the uniform in playhouses, theaters, or motion pictures, as may be prescribed by the laws of the United States; and provided further, that the members of the military societies and instructors and members of the cadet corps mentioned in this subdivision (c)(3) shall not wear the insignia of rank prescribed to be worn by officers of the armed forces of the United States, or any similar insignia of rank.

(d)(1) Criminal impersonation under subsection (a) is a Class B misdemeanor. However, if the criminal impersonation was committed to falsely obtain a driver license or photo identification license, the maximum fine of five hundred dollars ($500) shall be imposed. If any person commits the offense of criminal impersonation under subsection (a) while pretending to be a firefighter, medical fire responder, paramedic, emergency medical technician, or any other first responder and while operating a motor vehicle pursuant to § 55-9- 201(d), § 55-9-402(g), or § 55-9-414(f), then the offense is a Class A misdemeanor.

(2) Criminal impersonation under subsection (b) or (c) is a Class A misdemeanor. However, if any person commits criminal impersonation of a law enforcement officer under subsection (b) while operating a motor vehicle pursuant to § 55-9-201(d), § 55-9-402(g), or § 55-9-414(f), then the maximum fine for the offense shall be five thousand dollars ($5,000).

(3) All revenue collected from the fines imposed for a conviction of subsection (c) must be paid into to the general fund. It is the intent of the general assembly that an amount equal to the revenue collected from the fines imposed for a conviction under subsection (c) be allocated to assist in veteran property tax relief, subject to the general appropriations act.

(e) For purposes of this section, "uniformed service" means:

(1) Active and reserve components of the army, navy, air force, marine corps, or coast guard of the United States;

(2) The commissioned corps of the United States public health service;

(3) The commissioned corps of the national oceanic and atmospheric administration of the United States; or

(4) The national guard of a state.

SECTION 2. Tennessee Code Annotated, Section 58-1-602, is amended by deleting the section in its entirety.

SECTION 1. Tennessee Code Annotated, Section 2-7-114(c), is amended by deleting this subdivision in its entirety and substituting instead the following:

(c)(1) The voter shall state the voter's name and present the folded ballot to the judge assigned to receive and deposit the ballots. The judge shall compare the ballot number on the stub with the ballot number on the voter's ballot application. If the ballot numbers are the same, the judge shall tear off the stub, attach the ballot stub to the voter's application for ballot and direct the voter to deposit the ballot in the ballot box, unless the voter is successfully challenged. The judge shall file all ballot applications and ballot stubs in the order in which they are received. Notwithstanding any other law, the procedure described herein shall govern the voting process in counties using the optical scan voting system.

(2) In counties using a ballot marking device, or any other electronic ballot marking system, after the voter completes the application for ballot and the election official records the ballot stub number on the application for ballot, the election official shall attach the ballot stub to the voter's application for ballot. The election official shall file all ballot applications and ballot stubs in the order in which they are received.

(3) If the voter is voting a provisional ballot pursuant to § 2-7-112(a)(3) and (e), the voter shall state the voter's name and present the folded ballot to the judge assigned to receive and deposit the provisional ballots. The judge shall compare the provisional ballot number on the stub with the provisional ballot number on the voter's ballot application. If the provisional ballot numbers are the same, the judge shall tear off the stub and attach the ballot stub to the voter's application for ballot. The judge shall file all ballot applications and ballot stubs in the order in which they are received. Unless the voter is successfully challenged, the judge shall direct the voter to deposit the provisional ballot into the provisional ballot envelope that contains the provisional ballot affidavit. The judge shall ensure that the provisional ballot affidavit has been completed and signed by the voter and direct the voter to deposit the provisional ballot, in its envelope, in an absentee ballot box that satisfies the requirements for absentee ballot boxes and that has been locked pursuant to § 2-6-311.

SECTION 2. This act shall take effect May 2, 2018, the public welfare requiring it.

Any person subject to regulation under this part must notify the Tennessee emergency medical services board of all convictions and pending charges, including arrests, citations, and indictments, for commission of a felony or misdemeanor in any jurisdiction within ten (10) business days of the occurrence of such actions. This subsection shall apply to persons whose licenses are active, inactive, or suspended on the date of the conviction or the date the charges were filed. Failure to timely notify the Tennessee emergency medical services board of the occurrence of such actions shall result in the suspension of active and inactive licenses.

SECTION 2. This act shall take effect July 1, 2018, and shall apply to all convictions and charges filed against persons subject to the requirements of this act on and after July 1, 2018, the public welfare requiring it.
