    USING AN ERUVTO UNTANGLE THE BOUNDARIES OF THE SUPREME COURT'S RELIGION-CLAUSE JURISPRUDENCE Shiraj.Schlaff* INTRODUCTION "[T]he Court's religion-clause jurisprudence . has been de- scribed by scholars of all persuasions, and even by the justices them- selves, as unprincipled, incoherent, and unworkable."1 Lower courts await instruction from the Supreme Court on the ambiguities in relig- ion clause jurisprudence. Controversies that have arisen regarding a procedure that enables Orthodox Jews to carry and push objects out- side on the Sabbath, elucidate many of the holes and incoherencies in First Amendment jurisprudence. This comment uses the creation of an eruv, the name of this procedure, as a case-study to display the ambiguities of current First Amendment law and the need for more specific guidance from the Supreme Court on what the Establish- ment Clause permits and forbids and what the Free Exercise Clause requires. In order to understand the constitutional issues surrounding an eruv, it is important to first grasp the concept of an eruv and its func- tion in Jewish law. According to Jewish law, the Bible prohibits carry- ing from a private domain to a public domain and carrying more than a few feet within a public domain on the Sabbath.     “My Children Have Prevailed Over Me” (A re-editing of the talks delivered by Rabbi Haskel Lookstein on Rosh Hashana and Yom Kippur 5771) Introduction I This past summer, one of the great Torah scholars and religious leaders in Israel, Rav Yehuda Amital, died at the age of 86. A survivor of the Holocaust, he studied at Yeshivat Hevron and he married the granddaughter of the great Rav Isser Zalman Meltzer. In 1969, he founded Yeshivat Har Etzion. Two years later he invited Rav Ahron Lichtenstein, the protégé and son-in-law of the Rav, to join him as Co-Rosh Yeshiva. For almost 40 years these two spiritual giants shared the same crown of Torah in love, harmony, and mutual respect. It was quite literally, a marriage made in heaven and a glorious tribute to the character, idealism, loyalty and menschlichkeit of both Rabbis. As great a Talmid Chacham as Rav Lichtenstein is – arguably the greatest in the world today – Rav Amital carved out his own special place in the Torah world of modern Orthodoxy. Brilliant and insightful in all aspects of Torah, he was most revered for his human qualities. Respected as he was for his knowledge and the ability to communicate it, he was even more beloved by the students at the Yeshiva because of his humanity, humility, simcha shel mitzva and fearless leadership in ensuring that the Orthodox community in Israel served as a Kiddush HaShem in its connection to the State of Israel and the general population of Israelis. This summer, we lost Rav Amital, but not his ideas or the model of Judaism that he represented.

    Rabbi Hershel Schachter Heritage and Rosh Yeshiva and Rosh Kollel, RIETS Rabbi Schachter, a noted Talmudic scholar, has had a distinguished career with RIETS for over 40 years. He joined the Innovation faculty in 1967 at the age of 26, the youngest rosh yeshiva at RIETS. Since 1971, Rabbi Schachter has been rosh kollel in the Marcos and Adina Katz Kollel (Institute for Advanced Research in Rabbinics) and also holds the Nathan and Vivian Fink Distinguished Professorial Chair in Talmud. In addition to his teaching duties, Rabbi Schachter lectures, writes and serves as a world renowned decisor of Jewish law. A prolific author, he has written more than 100 articles, in Hebrew and English for such scholarly publications as HaPardes, Hadarom, Beth Yitzchak and Hamizrach. His books include Eretz HaTzvi, B’ikvei HaTzon, Nefesh HaRav, MiPninei HaRav and Ginat Egoz. At age 22, Rabbi Schachter was appointed assistant to the renowned Rabbi Joseph B. Soloveitchik. With regard to Mechiras Chametz (the sale of chametz) and appointing a Rav through a Shtar Harsha’a (authorization document), if they are unable to be face-to-face. Can this be done via email, or on a phone call, if there is a Kinyan (act of acquisition) involved? The Rambam1 in Hilchos Mechira says that there are some things that do not require a kinyan (act of acquisition), and he gives the example of appointing a shaliach. Both the Chazon Ish and the Steipler did not insist on a kinyan when they did Mechiras Chametz, because the Rambam does not require a kinyan when appointing a shaliach, and the rabbi is a shaliach when he sells your chametz. Rav Soloveitchik thought that the Rambam initially says that it does not make sense to have a kinyan – but afterward he explains it. In fact, Rav Soloveitchik gave a whole beautiful shiur on the nature of Kinyan Chalipin (acquisition of exchange), of “Sudar,” and he explained why it does make sense to have a kinyan when appointing a shaliach. As Rav Soloveitchik says, every rabbi knows that on Erev Pesach, just before he is about to go and sell the chametz to the nochri (gentile), some guy will call him up at the very last minute and say “Rabbi I forgot to come to ask you to sell the chametz – can I appoint you as my shaliach over the phone?” In such a case, Rav Soloveitchik said we should at least try to fulfill the minhag even on a phone call.
