This has reference to your application No.1013j 1j2kjEnv.j 163 dated, ' 20.05.2015 and subsequent letters dated 04.12.2015, 23.03.2016 and 28.06.2016, submitting the above proposal to this Ministry for grant of Environment and CRZ Clearance in term of the provisions of the Environment Impact Assessment (EIA) Notification, 2006 and Coastal Regulation Zone (CRZ) Notification, 2011 under the Environment (Protection) Act, 1986. 2. The proposal for 'Widening and Improvement of existing 2 lane Highway to 4/ 6 lane of Bhavnagar - Pipavav - Porbandar - Dwarka Section of NH-SE' in Gujarat by National Highways Authority of India, was considered by the Expert Appraisal Committee (EAC) in the Ministry for Infrastructure ~ Development, Coastal Regulation Zone, Buildingj Construction and Miscellaneous projects, in its meetings held on 24-26 June, 2015, 22-23 December, 2015,29-30 August, 2015 and 9th September, 2016.

3. The details of the project, as per the documents submitted by the project proponent, and also as informed during the above said EAC meetings, are reported to be as under:-

(i) The ToR was accorded to the project vide letter No.10-12j2012-IA-III dated 27.04.2012. (ii) The proposal involves widening and improvement of existing 2 lane Highway to 4j 6 lane of Bhavnagar - Pipavav - Porbandar - Dwarka Section of' NH-8E from km 3.200 to km 473.000 i.e. 469.800 km long stretch in Gujarat by: National Highways Authority of India. The proposed road starts at km 3.200 near Adhewada village in Bhavnagar, passes through Talaja, Mahuva, Una, Kodinar, Veravel, Chorwad, Mangrol, Madhavpur, Porbandar, Kalyanpur and ends at Dwarka. (iii) Total 469.800 km long stretch falls in six districts namely, Bhavnagar, Amreli, Gir-Somnath, , Porbandar and Dev-bhoomi Dwarka. (iv) The road stretch passes mainly through plainj rolling terrain. The existing road has 7 m carriageway, shoulder varying from 1 to 2.5 m on either side and

Proposal No. IA/GJ/MIS/116/2012 ~ Page 10f9 ROW from 30-45 m. With the proposed widening/improvement, the RoW would be increased to 30 m to 60 m. (v) The project would cover 37 major bridges (16 proposed for widening, 9 for reconstruction and 12 new construction), and 159 minor bridges. Also, 340 nos. of culverts shall be improved/widened to 4 lane, and additional 626 nos. to be newly constructed. 5 nos of ROB and 6 nos. of flyover are proposed to be constructed along the project corridor. The proposed length of service road in built up areas is 20.20 km at 12 locations. 20 nos. of cattle underpasses and 9 pedestrian underpasses are proposed to be constructed. 7 nos. of toll plazas, 34 nos. of bus bays with bus shelter and 3 truck lay-bye will be constructed. (vi) Total 1875 KLDwater will be extracted from surface and groundwater. (vii) The proposed alignment passes through CRZ-IA(340 m), CRZ-IB (3492 m), CRZ-III(23703 m) and CRZ-IVB(896 m) i.e. the total stretch of 28.431 km.

CRZ-III 23703 202532 -Minor Bridge @ 122+271 km - 27.0m length is proposed at existing Major Bridge location and existing bridge will be reconstructed. -Existing Major Bridge @ 362+365 km - 480m CRZ-IVB 896 4017 length to be retained after repairs to crash barrier

(viii) The CRZ demarcation study has been done by IRS, Anna University Chennai. The project alignment will pass through mangroves area in Gadu to Dwarka section. Turtle habitant locations are marked in CRZ maps. All habitants are on sea Phase. However, there will be n? impact on turtle nesting. Proposal No. IA/GJ /MIS/ 116/20 12 gt Page 2 of 9 ~ (ix) Forest land: The total land required includes 653.13 ha of agricultural! land and 808.619 ha of forest land. (x) Trees cutting: 15,299 nos. of trees exists within the proposed 60m RoW, however tree felling will be restricted to 15000 nos. by restricting tree cutting within 45 m RoW. 45000 trees shall be planted as avenue plantation as per norms of Gujarat Government in lieu of felling of 15000 trees. In addition, compensatory afforestation shall be carried out by the Forest Department as per statu tory requirement. (xi) Total 2805 nos. of residential structures and 1596 nos. of commercial structures shall be completely/partially affected. 71 religious structures, 24 nos. of educational/ institutional buildings and 1 no. of Health Centres will be affected partially / completely. The affected families/ structures shall be compensated as per the National Rehabilitation Policy. (xii) Water bodies: There are 54 water bodies (9 rivers & 45 ponds) along the pr~ectroad. . (xiii) SCZMAApproval: The Gujarat Coastal Zone Management Authority has, recommended the project vide their letter No.ENY-10-2015-53-E dated 21st May, 2015 (xiv) Wildlife issues: The proposed road does not pass through any National Park, Wildlife Sanctuary, and Eco-Sensitive Zones. (xv) Investment/Cost: The budget for environment management is Rs.31.605 Crores and Resettlement & Rehabilitation cost is approximately Rs.35.15 Crores. The total cost of the project is Rs.2650.96 crores. (xvi) Public Hearing: Public Hearing was held on 18.10.2013 in , 04.10.2013 in , 05.10.2013 in , 11.10.2013 in , 25.10.2013 in and on 15.11.2013 in . (xvii) Employment potential: Providing better connectivity will ensure that goods and people from areas covered by the road can move in and out of the' areas quicker and save time. Increased trade and commerce activity are expected.' It has a very good tourism potential due to famous religious and tourist places. The industrial activity will be getting a good boost due to this upgradation of the existing road to Gujarat Government plan of developing industrial region. The industrial activity will give rise to employment potential for people in and around: the region. There will be employment potential during the Construction activities! related to the upgradation of the existing road. (xviii)Benefits of the project: The widening/ upgradation of the project highway have direct benefits and are indicated below: a) Improved quality of living in the project area b) Economic benefits to the local population c) Provide Employment d) Easy accesses to Agricultural Marketing e) School, Health facilities f) Enhance Environmental measures for aesthetic impacts g) Better traffic facilities provided to public and decrease road accidents! due to traffic growth. h) To promote truism as this road is joined two famous class religious places i.e. Somnath and Dwarka . i) Bhavnagar Porbandar Dwarka is joined many Industries and, ports and this corridor will improved facilities to goods transport as welt as export facilities. Proposal No. lA/OJ /MISj116/20 12 Page 3 of9 4. The EAC in its 154th meeting held on 22-23 December, 2015, has recommended the project for grant of Environmental and CRZ Clearance. As per recommendations of the EAC, the Ministry of Environment, Forest and Climate Change hereby accords Environmental and CRZ Clearance to the above project 'Widening and Improvement of existing 2 lane Highway to 4/ 6 lane of Bhavnagar - Pipavav - Porbandar - Dwarka Section of NH-SE' in Gujarat by National Highways Authority of India under the provisions of the EIA Notification, 2006 and CRZ Notification, 2011 and amendments thereto, subject to the compliance of the specific and general conditions as under:-

PART A - SPECIFIC CONDITIONS (i) Since roadside trees have to be felled for road widening, adequate compensatory plantation shall be carried out up to the satisfaction of the concerned forest department. A monitoring of the effectiveness of the pollution attenuating barriers shall be taken up after 5 years from the planting of roadside trees. The results, of the monitoring programme shall be conveyed to the concerned forest department/ State Pollution Control Board. (ii) All mandatory clearances under the applicable law including the Forest Clearance under the Forest (Conservation) Act, 1980 shall be obtained for diversion of 808.619 ha of forest land and cutting of roadside trees notified as protected forest. (iii) The proposal involves diversion of 808.619 ha of forest land, for which the proponent shall obtain the stage-I Forest Clearance as required under the Forest (Conservation) Act, 1980. As per the undertaking submitted by the project proponent vide letter No.1013/ 1/2k/GM(Env.)/323 dated 28th June, 2016, the project shall be executed on the entire stretch located in non- forest land, and execution of work on non-forest land shall not be cited as a reason for grant of approval under the Act and in case approval under the Act for diversion of forest land is declined, width of the portion of road falling in the forest land will be maintained at its existing level. (iv) Commencement of work in non-forest land will not confer any right on the user agency with regard to grant of approval under the Forest (Conservation) Act, 1980. (v) All the recommendations/ conditions stipulated by Gujarat Coastal Zone Management Authority vide their letter No.ENV-10-2015-53-E dated 21st May, 2015, shall be strictly complied with.

(vi) Blasting shall be carried out during fixed hours (preferably during mid-day) or as permitted by the concerned authority. The timing shall be made known to all the people within 1000 m (200 m for pre-splitting) from the blasting site in all directions. (vii) Locations for stockyards for construction materials and labour camps shall be away from the CRZ. Movement of machinery, workforce shall be restricted around the water body and no waste from construction camps or sites shall be disposed into it. (viii) Cut and fill works shall be carried out strictly in accordance with the design drawings. ~ .s-: Proposal No. IA/GJ/MIS/ 116/2012 Page 4 of9 (ix) The coastal stretches shall be protected with suitable protection measure: from coastal erosion. (x) The CRZ stretch of 1.236 km, rich in turtle nesting, shall be provided wit] trespass proof and corrosion proof barrier/fencing along these stretches and marking these zones as no stay/halting or camping zone.

(xi) The effective barriers shall be provided along the eco-sensitive an. vulnerable portions of the highway facing the sea with no habitation, ani also to be protected from aesthetic and other forms of destruction.

(xii) The bridge elevation shall be decided based on highest flood level, analysin Tsunami and storm surge. (xiii) Appropriate provisions through pipe/box culvert shall be provided to ensur free flow of tidal water. The size of opening shall be decided on the basis ( the site conditions. (xiv) The NHAI shall use the fly ash for the proposed project to comply with th Fly Ash Notification, 1999, as amended. (xv) The development shall strictly be as per the provisions of CRZ Notificatior 2011 in the CRZ area. The project shall not affect the coastal ecology of th area including flora and fauna. (xvi) The NHAI shall have to carry out mangrove plantation in consultation wit Gujarat Ecology Commission/Forest Department. There shall be n dressing or alteration of the sand dunes, natural features includin landscape changes for beautification, recreation and other such purpose.

(xvii) There shall no ground water drawl within the CRZ areas. (xviii)The project proponent shall obtain necessary permission from concerne authorities for their proposed construction. (xix) Rehabilitation of project affected families shall be carried out as per tl extant policy of the Central/ State Government, as provided under the law. (xx) Allentry / exit/ access points on this highway shall be appropriately designe and preferably frozen to avoid traffic congestion and pollution, defeating tl very purpose of this expensive project. (xxi) Minimum of three times the number of trees to be cut shall be planted. shall be ensured that the trees planted as a part of the afforestation shall 1 looked after by NHAI. Tree plantation shall be of the same species /Ioc species and survival shall be monitored. Transplantation of trees shall 1 carried out wherever possible. The tree plantation shall be taken up on tl extreme end of the road. (xxii) Rain water harvesting including oil and grease trap shall be provided. Wat harvesting structures shall be located at every 500m along the roa Vertical drain type rainwater harvesting structures shall be set up minimize surface runoff losses of rainwater. (xxiii)IRC guidelines shall be followed for widening & up-gradation of road. All the mitigation measures submitted in the EIA report shall be prepared in a matrix format and the compliance for each mitigation plan shall be submitted to MoEFCC along with half yearly compliance report to MoEFCC-RO. (xxv) Green belt development shall be undertaken as suggested in EMP. (xxvi)The seismic nature of the area shall be taken into account while designing the project. (xxvii)The project proponent shall obtain necessary permission from the State Irrigation Department before drawing water from the river sources for the purpose of the proposed construction activity. (xxviii)Longitudinal drains shall be provided all along the project road to ensure proper drainage of the area. In addition, adequate number of under passes and culverts to act as cross drainage structures shall also be provided. (xxix) The solid waste generated shall be used for rehabilitating the borrow areas. (xxx) For providing safety to the crossing animals and avoid road accidents speed breakers/rumbled strips shall be constructed at the identified locations of the animal movements. Enough hoardings and signages shall also be put up for the public and vehicles convenience. (xxxi)Necessary clearance from the State Government shall be obtained for extraction of sand from the rivers. (xxxii) Proper signage shall be installed at appropriate locations for the convenience of the traffic movement. (xxxiii)The embankments/ slopes and the slopes left after cutting shall be provided with vegetative turning to avoid soil erosion. (xxxiv)The hot mix plant shall be located at least 500m away from habitation and on the barren land to avoid its adverse impact on the human population. (xxxv) Noise barriers shall be provided at appropriate locations particularly in the areas where the alignment passes through inhabited areas so as to ensure that the noise levels do not exceed the prescribed standards. (xxxvi) For road safety, IRC guidelines in respect of road signages, service roads, bus bays, inter-sections, pedestrians crossings, etc. shall be strictly adhered to. (xxxvii)The responses/ commitments made to the issues raised during public hearing shall be complied with in letter and spirit. A hard copy of the action taken shall be submitted to the Ministry. (xxxviii)Corporate Environment Responsibility: a. The Company shall have a well laid down Environment Policy approved by the Board of Directors. b. The Environment Policy shall prescribe for standard operating process/ procedures to bring into focus any infringements/ deviation/violation of the environmental or forest norm~ conditions.

The hierarchical system or Administrative Order of the company to deal: with environmental issues and for ensuring compliance with the environmental clearance conditions shall be furnished. d. To have proper checks and balances, the company shall have a well laid: down system of reporting of non -compliances / violations of! environmental norms to the Board of Directors of the company and Zor shareholders or stakeholders at large. '

PART B - GENERAL CONDITIONS

(i) Adequate provision for infrastructure facilities including water supply, fuel and sanitation must be ensured for construction workers during the

construction phase of the project to avoid any damage to the environment. I

(ii) Appropriate measures must be taken while undertaking digging activities to avoid any likely degradation of water quality.

(iii) Borrow sites for each quarry sites for road construction material and dumj sites must be identified keeping in view the following: (a) No excavation or dumping on private property is carried out withotr written consent of the owner.

(b)No excavation or dumping shall be allowed on wetlands, forest areas 0:1 other ecologically valuable or sensitive locations. (c) Excavation work shall be done in close consultation with the Soil Conservation and Watershed Development Agencies working in the area and (d)Construction spoils including bituminous material and other hazardou' materials must not be allowed to contaminate water courses and th. dump sites for such materials must be secured so that they shall no leach into the ground water.

(iv) The construction material shall be obtained only from approved quarries In case new quarries are to be opened, specific approvals from th competent authority shall be obtained in this regard.

(v] Adequate precautions shall be taken during transportation construction material so that it does not affect the environment adversely..

(vi) Borrow pits and other scars created during the road construction shall b properly levelled and treated.

(vii) Adequate financial provision must be made in the project to implement th aforesaid safeguards. (viii) The project proponent will set up separate environmental management ce for effective implementation of the stipulated environmental safeguard under the supervision of a Senior Executive. .

(ix) Full support shall be extended to the officers of this Ministry / Region: Office by the project proponent during inspection of the project f

~ : Page 7 of9 Proposal No. IA/OJ/MIS/ 116/2012 (x) A six-Monthly monitoring report shall need to be submitted by the project proponents to the Regional Office of this Ministry regarding the implementation of the stipulated conditions. (xi) Ministry of Environment, Forest and Climate Change (MoEFCC) or any other competent authority may stipulate any additional conditions or modify the existing ones, if necessary in the interest of environment and the same shall be complied with. (xii) The Ministry reserves the right to revoke this clearance if any of the conditions stipulated are not complied with the satisfaction of the Ministry. (xiii) In the event of a change in project profile or change in the implementation agency, a fresh reference shall be made to the MoEFCC. (xiv) The project proponents shall inform the Regional Office as well as the Ministry, the date of financial closure and final approval of the project by the concerned authorities and the date of start of land development work. (xv) A copy of the clearance letter shall be marked to concerned Panchayat / local NGO, if any, from whom any suggestion/representation has been made received while processing the proposal. (xvi) Safety provision such as bus bays, service roads intersection improvement etc., will be carried out by the project proponent. The project proponent shall provide adequate facilities as per IRC norms/ guidelines. (xvii) A copy of the environmental clearance letter shall also be displayed on the website of the concerned State Pollution Control Board. The EC letter shall also be displayed at the Regional Office, District Industries centre and Collector's Office/ Tehsildar's office for 30 days. (xviii)The funds earmarked for environmental protection measures shall be kept in separate account and shall not be diverted for other purpose. Year-wise expendi ture shall be reported to this Ministry and its concerned Regional Office.

5. The above stipulations would be enforced among others under the provisions of the Water (Prevention and Control of Pollution) Act 1974, the Air (Prevention and Control of Pollution) Act 1981, the Environment (Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and the EIA Notification 2006, including the amendments and rules made thereafter.

6. All other statutory clearances such as the approvals for storage of diesel from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, as applicable by project proponents from the respective competent authorities.

7. The project proponent shall advertise in at least two local Newspapers widely circulated in the region, one of which shall be in the vernacular language informing that the project has been accorded Environmental and CRZ Clearance and copies of clearance letters are available with the State Pollution Control Board and may also be seen on the website of the Ministry of Environment, Forest and Climate Change at http://www.envfor.nic.in. The advertisement shall be made jL Proposal No. IA/GJ /MISj116/20 12 Page 8 of9 within Seven days from the date of receipt of the Clearance letter and a copy of th I same should be forwarded to the Regional Office of this Ministry.

8. Any appeal against this clearance shall lie with the National Green Tribunal, if preferred, within a period of 30 days as prescribed under Section of the National Green Tribunal Act, 2010.

9. This Clearance is subject to final order of the Hon'ble Supreme Court (I India in the matter of Goa Foundation Vs Union of India in Writ Petition No.460 of 2004 as may be applicable to this project.

10. Status of compliance to the various stipulated environmental condition and environmental safeguards will be uploaded by the project proponent in it! website.

11. The project proponent shall also submit six monthly reports on the statu of compliance of the stipulated Clearance conditions including results (I monitored data (both in hard copies as well as bye-mail) to the respectiv Regional Office of MoEFCC, the respective Zonal Office of CPCB and the SPCB.

12. The environmental statement for each financial year ending 31st March i Form-Vas is mandated to be submitted by the project proponent to the concerne State Pollution Control Board as prescribed under the Environment [Protectior Rules, 1986, as amended subsequently, shall also be put on the website of ttl company along with the status of compliance of Clearance conditions and sha also be sent to the respective Regional Office of MoEFCC bye-mail. ,..1 ..! ~\lol1.GI' (S.K.
