Newsletter N°39 No. 39 C 2007 March 2007 –July 2007 fondée en 1909 Editor’s Farewell TER In August 2003, by appointment of the President of IVR, the late Professor Aleksander Peczenik, I took from the former Editor-in-Chief, Professor Riccardo Guibourg, the honour and responsibil- ity of publishing IVR Newsletter. Since then, eight issues of the paper have seen the light of day. First of all, I would like to thank the readers of IVR Newsletter for their continued interest. My aim during the last four years has been to provide them with a paper that would keep then àjour with the developments, scientifi c and organizational, within the diff erent national sections. Further, my sincere thanks go to the “Contacts” of the IVR National Sections, who kept sending me information on various topics. Indeed, working as editor has been rewarding in many ways. Editing and publishing the material I received from the IVR contacts gave me some insight into the developments within the fi eld of Jurisprudence practically all over the world. What is more, through my email correspondence with the IVR sections, a most valuable network of contacts has been established whic, I hope and trust, will be sustained in the future. Honestly: I enjoyed cor- responding with you all! However, the time has come to move on. Once more, I would like to express my gratitude to the IVR for having given me this opportunity to work as editor. Roman Law and the Idea of Europe 11 Roman Law as Wisdom: Justice and Truth, Honour and Disappointment in Franz Wieacker’s Ideas on Roman Law Ville Erkkilä1 Introduction Franz Wieacker’s Privatrechtsgeschichte der Neuzeit (1952) is a seminal legal–historical work on twentieth-century Europe from one of the greatest Romanists of our time. In this book Wieacker, with incomparable sophistication, knitted together his works and learning from preceding decades in order to illustrate not only the legal history of modern Europe but also the influence of Roman law in the Continent’s destiny. While preparing his magnum opus, Wieacker lived through the social and political upheaval of Germany: National Socialism, the Second World War and the ‘Point Zero’ of post-war German society. Thus,Privatrechtsgeschichte is the end result of a decades- long interaction between the scholar, the tradition of Roman law and the disarray of social structures. Wieacker’s tool for understanding and categorizing the social phenomena he personally experienced was always his ideas on Roman law.

Tal y como se indicó en el número anterior de la presente publicación periódica, en 2018 se conmemora el bicentenario del nacimiento de dos juristas en extremo relevantes, por un lado, Rudolf von Jhering (1818-1892) y, por otro, Karl Marx (1818-1883). Podríamos haber vinculado igualmente el homenaje a Rosa Luxemburgo, la gran revolucionaria nacida en Zamość, una luchadora antimonárquica, antiimperialista y defensora de los derechos de los más desprotegidos que fue asesinada en la calle el 15 de enero de 1919, teniendo en cuenta que nacida el 5 de marzo, falleció a principios de enero de 1919 y su cercanía al pensamiento marxista la vincula a él como una mujer muy reivindicativa. Junto a ellos aparecen como nacidos en 1818 otros juristas algo menos importantes, como puede ser el caso de Manuel Colmeiro (1818-1894), mientras que, en 1817, un año antes, también vinieron al mundo Otto Bähr (1817- 1895), Bernhard Windscheid, nacido el 26 de junio de ese mismo año y fallecido el 26 de octubre de 1896, y Theodor Mommsen, que evidentemente como romanista resulta difícilmente comparable con ningún otro que haya sido capaz de superarle en los siglos XIX y XX. Curiosamente, Mommsen no mantuvo mucha relación con romanistas españoles apalancados en sus cátedras universitarias, sino con un jurista local malagueño, de condición nobiliaria con el que intercambió notable correspondencia y le solicitó una transcripción de la Lex Flavia Malacitana.

As a law scholar, his writings on the great themes of legal history and on the philosophers who have dealt with them certainly deserve a reconsideration and critical evaluation. Among other things, Betti’s analysis of the role of jurists and their prudential deserves attention. These are analyses and reflections on the different eras of Roman history, both during the Republic and in subsequent eras, which are still of absolute relevance today. In particular, it is the debate on pandectics and the importance of critique of European pandectics that marks an epochal shift in the study of law. Betti is an eminent scholar of law, who has studied it in all its forms, always studying law from a historical and dynamic perspective, and has been a teacher not only of Roman law, but of various legal disciplines, and above all of subjects that had the current law as an object, in particular contemporary law. From a philosophical point of view, Betti’s hermeneutics aims to be an alternative to Rudolf Bultmann and Hans-Georg Gadamer’s approaches whom he considered as subjectivists, although it is necessary to underline the strong relationship between Betti and Dilthey’s thought, and also Gadamer’s, who are continuously cited in the Teoria generale dell’interpretazione (General Theory of Interpretation).

INTRODUCTION The purpose of this essay is to summarize the contemporary discussion of hermeneutic philosophy and to suggest some possible applications of this discussion to theological studies. To facilitate this summary, we will first clarify the general nature of hermeneutic philosophy and provide the historical background to its theological evaluation. (a) The natureof hermeneuticphilosophy The term 'hermeneutics' was originally used to designate a classical discipline that formulated rules for correctly interpreting texts. Early forms of this discipline can be found in biblical studies, philology and jurisprudence. The philosophical discussion of hermeneutics, which began in the nineteenth century, likewise initially engaged in the development of rules for proper interpretation. As the discussion developed, however, its attention shifted to themore basic question of the conditions of the very possibility of understand ing. The distinctive characteristic that emerged in this 'hermeneutic' discussion of understanding was a rejection of classical Cartesian and Kantian epistemology.' Indeed, hermeneutics has more or less taken the place of epistemology for these philosophers.
