Disclosing an enabling description of a technology to the public, in order to establish the innovation as prior art in the via the “Prior Art” Database. This eliminates the competition’s ability (as well as your own), to obtain a on said technology or invention.

Why Defensively Publish?

• Offensive tactical strategy to block competitor’s emerging technologies from becoming a patent while at the same time providing freedom to operate for that technology space.

• Cost-effective, defensive approach to prevent eroding the value of core/foundational patents from competitor’s “fencing”

• Decrease unnecessary expenses for non- core/non-commercial technology.

• Decrease Freedom to Operate (FTO) risk in non-core but essential technology areas that you depend on operationally.

The Decision Process

? Exposure of Defensive Publications

• All defensive publication in IP.com’s prior art database are full-text indexed by the leading search engines Google, Bing, and Yahoo, in addition the USPTO receives a direct feed of the defensive publication data and it is listed in the examiners search template. The USPTO has been searching the IP.com Prior Art Database since 2000.

• Since 2013 the USPTO has had access to the Prior Art Database through IP.com’s semantic discovery platform InnovationQ where they also can search the worlds patents semantically indexed by our Semantic Gist algorithm. On average the number of searches conducted against the prior art database by the USPTO is 6000/per month.

• In addition to the USPTO, the EPO also receives a direct data feed of the documents in the prior art database. All other PTOs receive our monthly bound publication “The IP.com Journal”

Validity of The Process

• IP.com uses a sophisticated, time-tested publishing process that packages documents for long-term availability.

• The process includes providing rock-solid proof of electronic publishing by obtaining an electronic date notarization secured from a neutral third-party.

• The process also includes publications in the twice-monthly IP.com Journal which is widely distributed to institutions and libraries throughout the world. (Full page prints of documents may be included in our journal for an additional per-page fee.)

Types of Documents Published

• Invention Disclosures • Provisional Patent Applications • Abandon Patent Applications • User Manuals • Marketing Collateral • Maintenance Manuals • Drawings • Archived back files of almost any kind

Editing Services

• Create publish-worthy documents • Publish in bulk managed by IP.com (great for back-file publishing) • Offered as an add-on service • Typically provided for volume customers

9 Valuable content is buried deep in complex patent documents

• Terms are used to describe and protect through obfuscation

• Documents are often complex, and contain repetitive information

• Information is scattered across over 100 million+ documents

TRADITIONAL SEARCH METHODS ARE NOT DESIGNED FOR DISCOVERY

• Sophisticated search skills are needed to look for known components, not to discover. • Traditional tools are designed to find content, not analyze • Business Insight cannot be applied because a full picture of the data cannot be seen

IP Discovery for Business People

Query: ALL= (ubiquitous OR pervasive OR universal) AND resonant AND (((wireless OR microwave OR electromagnetic OR induction OR inductive) NEAR5 (power OR energy)) SAME (transmission OR trans*)) AND (remote OR distance*1) AND DP>=(19930101) AND IC=(H01L 39/02 OR H01L 39/12 OR H01F 38/14)

REDUCE SEARCH TIMES BY AN ORDER OF MAGNITUDE

• Simple to use interface places expert IP discovery and analysis in the hands of the business professional • Find the needles in a haystack quickly, efficiently, without complex queries • Increases IP productivity, efficiency, and effectiveness
