No. 1 TUESDAY 19 MARCH 2019 a SESSION of the PARLIAMENT No. 1 TUESDAY 19 MARCH 2019 A SESSION OF THE PARLIAMENT OF TASMANIA, CONVENED AND HOLDEN IN THE CITY OF HOBART ON TUESDAY THE NINETEENTH DAY OF MARCH IN THE SIXTY- EIGHTH YEAR OF OUR SOVEREIGN LADY, QUEEN ELIZABETH II AND IN THE YEAR OF OUR LORD TWO THOUSAND AND NINETEEN 1 PARLIAMENT MEETS. - On which day, being the first day of the meeting of the Parliament for the despatch of business, pursuant to the Proclamation hereunder annexed, Shane Gerard Donnelly, Esquire, Clerk of the House of Assembly, attending in the House according to his duty at Eleven o’clock a.m. the said Clerk of the House read the Proclamation of Her Excellency the Governor as follows: - PARLIAMENT OF TASMANIA A PROCLAMATION WHEREAS it is expedient that the Parliament of Tasmania be prorogued, I, Professor the Honourable Kate Warner, Companion of the Order of Australia, Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, exercising the power and authority vested in me by the Constitution Act 1934, hereby prorogue the Parliament effective from 6.00 pm this day. And I hereby fix 11.00 am on Tuesday 19 March 2019 in the Houses of Parliament situated in the City of Hobart in Tasmania as the time and place for the next Session of Parliament. GIVEN under my hand at Hobart in Tasmania on 26 February 2019. C. A. WARNER, Governor. By Her Excellency’s Command, WILLIAM E. F. HODGMAN, Premier. 2 ACKNOWLEDGEMENT OF TRADITIONAL PEOPLE. - The Speaker made a statement acknowledging the traditional people of the land. 3 PRAYERS AND REFLECTION. – The Speaker read Prayers. 4 MESSAGE TO ATTEND THE GOVERNOR’S COMMISSIONERS. - A Message was delivered by Stuart MacGregor Wright, Usher of the Black Rod, who, being admitted advanced to the Bar and said: “Madam Speaker, Her Excellency the Governor’s Commissioners have commanded me to inform this Honourable House it is their pleasure that they attend them immediately in the Legislative Council Chamber.” Accordingly, the Speaker, with the Members, proceeded to the Chamber of the Legislative Council, and being returned, the Speaker resumed the Chair at nine minutes past Eleven o’clock. 5 RESIGNATION OF MEMBER. – The Speaker informed the House that the following communication had been received from Her Excellency the Governor:- Government House, Hobart, Tasmania 12 February 2019 The Honourable Sue Hickey MP Speaker of the House of Assembly, Parliament House, Hobart 7000 Dear Madam Speaker, I have today received a letter dated 11 February 2019 from Mr Adam Brooks MP tendering his resignation as a Member for Braddon in the House of Assembly effective from Tuesday 12 February 2019. I have instructed the Electoral Commissioner to proceed in accordance with the provisions of Part 9 of the Electoral Act 2004. Yours sincerely, C. A. (The Premier) 13 CHRISTCHURCH SHOOTINGS. – Resolved, nemine contradicente, - That the House:- (1) Condemns the shocking act of terrorism in Christchurch, New Zealand on Friday, 15 March 2019 that resulted in the death of fifty innocent people, and injured at least fifty more. (2) Extends our deepest condolences to the families of those killed, and all impacted by this hateful act. (3) Extends our support to the Government and the people of New Zealand in dealing with the tragic aftermath of this act of terror. (4) Affirms our resolve to unite against intolerance, racism, violence and instead promote harmony, multi-culturalism and peace in our community. (2) Ombudsman Tasmania: Investigation into a public interest disclosure concerning the sale of a property by the Meander Valley Council to recover unpaid rates - 16 October 2018. 22 DEPUTY-CHAIRS OF COMMITTEES: APPOINTMENT OF. - The Speaker read the following Warrant: - HOUSE OF ASSEMBLY SPEAKER'S WARRANT Pursuant to Standing Order No. 14, I hereby nominate - Mrs Rylah MP; and Mr Tucker MP to act as Deputy-Chairs of Committees in the absence of, or when requested so to do by the Chair of Committees. ATDC chief executive Alison Lai said she was looking forward to the discussions as an opportunity to speak directly to the Premier and his parliamentary team. “I recently had the opportunity to directly brief Minister Jeremy Rockliff and answer his questions on how pill testing services operates as a health service, and this was a highly productive discussion,” Ms Lai said. “It will be incredibly beneficial to have all the relevant Ministers in the room alongside the Premier to receive information direct from Pill Testing Australia. “Tasmania did not have a parliamentary representative at the pill testing demonstration provided by the ACT Government in April this year, so we’re grateful for opportunities like this, particularly given the current level of national attention pill testing is receiving.” Mr Vumbaca said that he would focus on explaining how pill testing services operate, and the evidence supporting the outcomes it could provide for Tasmania. “For many, using pill testing services will be the first opportunity for them to talk to a health professional about their drug use and in some cases will lead to them deciding not to consume the drug or moderate their behavior to reduce the likelihood of harm, “Mr Vumbaca said.

INTRODUCTION While the outcome of the March 2018 Tasmanian State Election was predictable,1 the controversies that dogged the campaign were not. Yet it was the aftermath of the election that was most astonishing—not only to the public but also to members of Cabinet. Tasmania is different. Its parliamentary institutions are unusual and its electoral system is distinctive. So were the issues on which the March 2018 state election was fought. In the lead up to the election both major parties campaigned to govern alone or not at all—neither in minority nor in coalition with the Greens. As well as this apparently overarching concern, there were three other major issues prominent during the campaign—an acute housing shortage, the thousands of poker machines in pubs and clubs, and the surprise matter of gun control. QUESTIONS Brittany Higgins - Comments made by Senator Eric Abetz - Premier's Position Ms WHITE to PREMIER, Mr GUTWEIN [10.00 a.m.] In your Address last week, you told Tasmanian women and I quote: 'I see you, I hear you'. Do you believe women when they make allegations of bad behaviour by men? Who are you choosing to believe in the matter raised with you weeks ago by the Speaker, and again yesterday in this parliament, the independent member for Clark, Sue Hickey, or Senator Eric Abetz? ANSWER Madam Speaker, I thank the Leader of the Opposition for that question. I stand by what I said regarding those who rallied around the country. There is a paradigm shift that is occurring in this country, a paradigm shift that is long overdue. Obviously, the Speaker feels very strongly about the conversation that she had with Senator Abetz. Likewise, he has made a very strong statement of denial; in fact, categorically denying that he said those things. A few weeks ago, I make the point, that if the Speaker had raised with me a complaint as a Liberal party member we had a process that could have been entered into for those two Liberal party members to air their grievances and for these matters to be heard. As of this week, that process does not exist, which is why I have referred the matter to the Prime Minister, as this is a matter that involves a federal member of the federal parliament, and a matter that involves the federal parliament.

QUESTIONS Ms Sarah Courtney - Alleged Breach of Ministerial Code of Conduct Ms WHITE question to PREMIER, Mr HODGMAN [10.04 a.m.] Yesterday you refused to answer a very simple but pertinent and important question that goes to the heart of the breach of the ministerial code of conduct for your former primary industries minister. I will give you another opportunity. When did the relationship between former minister, Ms Courtney, and her department head, Dr Whittington, begin? ANSWER Madam Speaker, as I said yesterday very clearly, Ms Courtney has stood down from her responsibilities pending the outcome of the independent inquiry into the conflict that has arisen in relation to a personal relationship that I am advised has developed over a recent and short period of time. The process I have undertaken, by swiftly and appropriately engaging independent individuals to inquire into this matter, will assess the issue of a conflict and the issue of any decisions made during this time. At the heart of this matter is ensuring good process is followed. The first thing needed to be done was for Ms Courtney to step down from her responsibilities and for these matters to be investigated appropriately, not with anyone making pre-emptive judgments about their outcome. I will respond in due course once that process is completed.     Tasmanian Election 2021 On 1 May 2021, Tasmania will go to an early general election for the Legislative Assembly. The Gutwein Liberal Government currently holds 12 of the 25 seats in the House of Assembly. Premier Peter Gutwein called the election a year earlier than required (22nd of May 2022) after losing majority Government following the defection of then-Liberal Speaker of the Assembly, Sue Hickey, to the crossbench. Hickey left the Liberals after failing to secure pre- selection for the next election. Both Liberal Leader Peter Gutwein and Labor Leader Rebecca White have ruled out forming a minority Government. Political landscape There are seven parties registered to contest the election, including: Australian Labor Party; The Liberal Party of Australia, Tasmania Division; Tasmanian Greens; Animal Justice Party; Australian Federation Party Tasmania; Jacqui Lambie Network; Shooters, Fishers and Farmers Party Tasmania. Legislative Assembly Party Seats Liberal 12 Labor 9 Greens 2 Independent 2 Premier Peter Gutwein holds a high approval rating, in part because of his handling of the State’s COVID response which may continue the trend of support for the incumbent government as seen in the 2021 Western Australian, 2020 Australian Capital Territory, 2020 Northern Territory and 2020 Queensland state elections. The latest polling indicates strong support for the Liberals, with a primary vote of 52% to Labor’s 27%, the Greens lead the other parties with 14%. Given Tasmania’s Hare-Clark voting system, a high primary vote historically doesn’t equate to a large parliamentary majority. This was demonstrated at the 2018 Tasmanian State election, where although the Liberal Party won the contest, with 50% of the vote to Labor’s 32% and the Greens 10.3%, the seats won didn’t reflect the Liberal’s strong primary vote, winning only 13 seats in the House of Assembly.

Despite being down two seats to 13 Lower House MPs, the size of the Cabinet has been returned to nine after it was reduced in the last reshuffle. Mr Hodgman said he made the decisions about who would do which jobs. "This is an opportunity for us to refresh, to put new blood, new experiences, new perspectives into important roles," he said.
