Juggalos, prepare to enter a wondrous realm of adventure as you embark on a journey of your imagination, freeing you to explore everything from the depths of an ancient dungeon to the shimmering clouds of Shangri-La! It is here where the truth of a die never lies, as you discover every fantasy and live out your every dream. It is a place where renowned champions will be forged through cunning, experience, brutality, and unmatched strategy. It is a time where the mundane will fade, as we escape with our family into the wonderful world of games. So come join us…as we begin our epic quest together! So what can you expect at the DCG Con? EVERYTHING!!! Get ready for 3 days of nonstop gaming action held at the 30,000 sq. ft. indoor show space at the Gibraltar Trade Center. Here you will find plenty of official tournaments to win dope prizes for all your favorite Dark Carnival games, including Into the Echoside, Quest for Shangri-La, Morton’s List, and the new hilar- ious debut of Juggalos Against Sanity! Make sure to stop by the Games Library, where you can check out and play hundreds of different games, as well as the Demo Gaming area, where ninjas will show you how to play all the newest games on the market. There are also tons of other gaming events, including roleplaying games (such as D&D and Pendulum’s Promise); giant supersized games (chess, Connect Four, Jenga, etc.); as well as Texas Hold’em, War Machine, and Magic: The Gathering Tournaments; and so much more! Along with all the tabletop gaming, there is also the BattleTech Center, where you can enter an enclosed cockpit to experi- ence virtual combat against other players as you pilot a fully armed giant mech, or race through the narrow mining shafts of Mars using a vector thrust hovercraft! You can also battle your homies in the ring during Gladiatorial Combat, using an array of foam weapons or inflatable sumo suits! As if that wasn’t enough, come check out the Autograph Signings, featuring the entire Psychopathic Records roster and the Dark Carnival Game designers; a Movie Tent (with all the anime, comedy, and Juggalo favorites you love); the Juggalo Catch 21 Trivia Gameshow; Juggalo Family Feud; Dark Carnival Tarot Readings; an Art Contest; a Costume Contest; a Dark Carnival Games Seminar; old school free-play video games; the Morton’s List Lounge; as well as literally hundreds and hundreds of vendors!!! Then as each day’s gaming events begin to wind down, it’s time to get live at the DCG Con After Parties being held Friday and Saturday night from 8pm to 2am at the Diesel Concert Lounge (only a few miles away), with performances by Insane Clown Posse, ABK, Lyte, Big Hoodoo, Blahzay Roze, DJ Clay, DJ Carlito, and more! Clemens, MI 48043 New Baltimore, MI 48047 April 21st, 22nd, & 23rd, 2017 April 21st & 22nd 10am–Mid (Friday & Saturday) 8pm–2am (Friday & Saturday) 10am–6pm (Sunday) All ages for DCG Con and After Parties 1 DCG CON INFO The DCG Con is being held at the Gibraltar Trade Center (237 N. River Road, Mt. Clemens, MI 48043 / 586-465- 6440) in its 30,000 sq. ft. show space (a.k.a. the Main Hall). The Con hours are from 10am to Midnight on Friday & Saturday, and 10am to 6pm on Sunday. This is an all ages event. DCG BADGES To get your DCG Badge, you can either redeem your pre-bought ticket at the ticket booth on site (located just outside the Main Hall) or purchase one there. 3-day badges ($40) will be available for purchase online at www.dcgcon.com up until 10 April 2017, after which they will be available on site only. 1-day passes ($25) are also available, but only on site. All purchases are nonrefundable. All children ages 6 and under will be admitted for free. Once you have your badge (or pass), you will be able get into the Main Hall during its opening hours, where you will be able to participate in every game, tournament, show, event, and video game at no additional charge, with the exception of the Magic: The Gathering Tournaments and the ticketed events that include a meal (i.e., all roleplaying events and the Morton’s List Twilight Lord Tournament). Your badge must always be visible, and you are free to come and go as you please. If you lose your badge, it will not be replaced, so please make sure to safeguard it. TICKETED EVENTS All roleplaying events and the Morton’s List Twilight Lord Tournament are ticketed events because they include a meal (and have a very limited capacity). More than likely, they will sell out in advance through online sales. To check availability and buy tickets for these events, you can either go to the ticket link at www.dcgcon.com or the ticket booth on site. DCG AFTER PARTIES There are DCG After Parties taking place on Friday and Saturday night (8pm–2am) at the Diesel Concert Lounge (33151 23 Mile Road, New Baltimore, MI 48047 / 586-725-2228), only a few miles from the venue. ICP, ABK, Big Hoodoo, Blahzay Roze, Lyte, DJ Clay, DJ Carlito, and more will be performing at the After Parties. When you purchase a 3-day badge either online or on site, you will also receive a free ticket for both of these After Parties while supplies last (i.e., until the venue sells out), at which point you can still purchase a 3-day badge but will not receive the After Party tickets. Keep in mind that you do not get tickets into either of the After Parties with the purchase of a 1-day pass. The Diesel Concert Lounge features a full arcade and bowling alley, which are not free of charge. The DCG After Parties are all ages. DCG HQ Have a question or need some help? Please stop by the DCG HQ located inside the Main Hall, where staff will be on hand to assist you. Also, you will find the following: • Maps and timelines • Lost and found items • Display of the prizes you can win at the various tournaments • A promotional area to leave flyers and CDs • Volunteer opportunities 3 PARKING Normally there is a $2 daily parking fee at the Gibraltar Trade Center; however, if you bought your ticket online, just show it (or a DCG badge) to the gate attendant to park for free. If you are buying your ticket on site, you will have to pay for parking the first time entering, and then just show your DCG badge or pass afterwards to park for free. SHUTTLE VAN Did your homies leave you while you were in the middle of a game? No worries. From 7pm to 3am there will be a complimentary 15-passenger shuttle van running in a loop from the Gibraltar Trade Center (Tan #7 Entrance) to the Diesel Concert Lounge (where the After Parties are being held) and the ConCorde Inn of Clinton Township (the official DCG Con hotel). But try to use this flavor if you have no other choice, because space is very limited. GIBRALTAR TRADE CENTER POLICIES The following is a list of the Gibraltar Trade Center policies. Failure to follow these policies or acting in a disrup- tive manner could result in getting the boot. • All children must be accompanied by an adult. • No animals except service animals (i.e., animals that are trained to perform tasks for people with disabilities) • No outside food and beverages • Alcohol purchased must stay within the Main Hall. • No smoking (You may smoke outside.) • No selling of any items or services • No weapons VENDORS Located in the Main Hall you will find Psychopathic’s HatchetGear Booth, featuring a huge display of merch as well as every Dark Carnival Game currently available. Of special note is the official DCG Con merchandise, the debut of the Juggalos Against Sanity game, and the return of Morton’s List and the 360 Degrees of the Inner Cir- cle, which were taken from the game creators’ personal stash, to be sold exclusively at the DCG Con. Also, check out the Big Kidz Games booth, where they will be selling the most popular and current games on the market, from Tsuro to Star Trek Catan. Aside from this is the 600,000 sq. ft. Gibraltar Trade Center market, where you will find literally hundreds of vendors selling just about everything you can imagine at a great price! FOOD COURT There is a food court located right in the Main Hall, as well as others throughout the Gibraltar Trade Center market, offering food, beverages, and alcohol. DCG OFFICIAL HOTEL The ConCorde Inn of Clinton Township (44315 N. Gratiot Ave, Clinton Township, MI 48036 / 586-493-7300), which is 3 miles from the Gibraltar Trade Center, is the official DCG Con hotel and offers a special discounted room rate of $89.99 per night for attendees.

Insane Clown Posse's first national release, Riddle Box, failed to expand the Detroit shock rock/rap duo's audience, which probably came as no surprise to anyone, especially ICP. Success never came easy to Violent J and Shaggy Two Dope, so the tenuous marketing commitment from Jive Records did nothing to dampen the act's spirits. Setting off a series of record-label conflicts, ICP soon left Jive, and due mostly to their own marketing and touring campaigns, there were other labels willing to literally risk millions in an attempt to tap the rappers' commercial potential. Later decisions to follow a Kiss-like publicity and merchandising program proved fruitful, but at the time, music was all ICP had to promote. "Unconvincing" is the first word that comes to mind when attempting to describe the stiff, humorless rhymes and bland beats that fill Riddle Box. The gangsta put-ons and misogynistic boasting are impossible to take seriously, and unlike even mediocre hip-hop, this music offers little insight into urban existence. Perhaps ICP's more dynamic delivery and second-rate Cypress Hill aesthetic elevates Riddle Box just above its predecessors, but all of the group's musical work is so far below any reasonable rap/rock standard that it hardly matters. This 1995 effort shouldn't disappoint fans of the group, but serious hip-hop and metal listeners -- unimpressed with ICP's extra-musical theatrics -- should avoid Riddle Box like every other episode in the "dark carnival." Kiss had more than a few legitimate pop/rock hooks, Gwar and Green Jelly can be creative and humorous in their delivery, but the appeal of Insane Clown Posse is based solely on marketing savvy and prurient appeal.

OF JUSTICE, et. al., Defendants. / OPINION AND ORDER GRANTING DEFENDANTS’ MOTION TO DISMISS Now before the court is a Motion to Dismiss filed by Defendants United States Department of Justice (“DOJ”) and Federal Bureau of Investigation (“FBI”). (Dkt. # 37.) The matter is fully briefed, and the court finds that a hearing is unnecessary. See E.D. LR 7.1(f)(2). For the reasons discussed below, the court will grant Defendants’ Motion. I. BACKGROUND As alleged in the complaint, “Juggalos” are “fans of the musical group Insane Clown Posse (“ICP”)[1] and other bands on ICP’s independent record label, Psychopathic Records.” (Dkt. # 1, Pg. ID 2.) ICP’s music is generally referred to as “horrorcore hip hop” which “uses very harsh language to tell nightmare-like stories . .” (Id.) Juggalos often paint their faces to look like clowns, and wear distinctive symbols, including the “hatchetman” logo, which depicts a person with wild hair wielding a butcher’s meat cleaver. (Id.) The complaint alleges that “[m]any Juggalos embrace ‘Juggaloism’ as a philosophy, an identity, [and] a way of life. ICP’s lyrics, through their description of a ‘Dark Carnival,’ address themes of good and evil, heaven and hell, and acceptance and tolerance of others.” (Id. at Pg. ID 6.) These Juggalos observe “the moral code” of the Carnival, and see themselves as social outcasts, seeking support from one another. (Id. at Pg. ID 7.) “Based on these shared values, Juggalos strongly identify with one another and often refer to themselves as a ‘family.’” (Id.) According to Plaintiffs, Juggalos gather to listen to ICP’s performances, share ideas expressed in the ICP performances, and express their support for the band.
