It is an honor to testify before you today. In particular, it is an honor to be invited here by Chairman Engel given his long-standing commitment to peace and justice in Kosovo. It is also a privilege to share this platform with the other individuals testifying before the committee, each of whom have poignant, direct, and personal experiences and insight relating to the quest for justice for Kosovo’s wartime victims. I have been asked by Chairman Engel to discuss the international legal violations committed during the Kosovo War of 1999. In particular, I have been asked to speak from the perspective of an international lawyer with experience in designing accountability mechanisms. I will address the remedies which have been made available to victims and potential claimants, including families of those murdered and victims of rape and conflict-related sexual violence, whose cases derive from the Kosovo conflict. I have been asked to assess the degree to which these mechanisms have effectively served the purpose of justice, accountability and reconciliation for the people of Kosovo.

    BALKAN January 28, 2004 Page 6 VIEW FROM THE HAGUE TRIBUNAL INDICTMENT AGAINST THE KLA In Serbia and Montenegro, people often accuse the Tribunal of only indicting Serbs. This is a baseless accusation. The Tribunal has indicted individuals who are Croats, Serbs, Bosnian Muslims and Kosovo Albanians, including high-level political, military and police officials. While certain indictments against high-level Serbian officials receive a great deal of publicity in Serbia, people are often surprised to learn that the Tribunal has issued an indictment against three former members of the Kosovo Liberation Army (KLA). On 24 January 2003, the Tribunal issued a sealed indictment against three former KLA officials. Fatmir Limaj, Haradin Bala and Isak Musliu stand accused of imprisoning, torturing and murdering Serbian and Albanian civilians from Kosovo. The indictment alleges that KLA forces under Limaj's command seized at least thirty-five Serb and Albanian civilians from Kosovo and forcibly brought them to a prison camp called Lapusnik, located in the municipality of Glogovac. The indictment states that at the camp, KLA forces under Limaj's command, including Bala and Musliu, held the Serb and Albanian civilians in brutal and inhumane conditions, failing to give them adequate food or medical care. The indictment also states that they tortured, beat, and murdered a number those detainees. It further alleges that the three KLA members repeatedly interrogated the Albanian civilians about alleged "collaboration" with Serbs. The indictment states that their evidence of "collaboration" was based on interaction with Serb civilians that was not military in nature. All three accused are charged with directly participating in these crimes.

    Country Summary January 2005 Serbia and Montenegro Serbia and Montenegro is taking some small steps to promote human rights, however, its progress is limited by continued impunity for those who committed war crimes. The government is unwilling to cooperate fully with the International Criminal Tribunal for the former Yugoslavia and efforts to prosecute war criminals before domestic courts are inadequate. Additionally, the government has failed to respond effectively to attacks against ethnic minorities. International Criminal Tribunal for the former Yugoslavia (ICTY) Serbia and Montenegro’s cooperation with the ICTY took a marked turn for the worse after the December 2003 parliamentary elections and the establishment of a new Serbian government dominated by the nationalistic Democratic Party of Serbia (DSS). Serbian Prime Minster Vojislav Kostunica openly opposes the arrests of suspects indicted by the ICTY, arguing that they should surrender voluntarily. On October 9, 2004, former Bosnian Serb army general Ljubisa Beara, charged with genocide for crimes committed against Bosnian Muslims in Srebrenica in 1995, was transferred to the ICTY. Serbian officials insisted that Beara surrendered voluntarily, notwithstanding the claims by the ICTY Office of the Prosecutor that Beara was arrested. As many as fifteen ICTY indictees remain at large in Serbia and Montenegro, or traveling back and forth between Serbia and Montenegro and Republika Srpska (Bosnia and Herzegovina). They include Ratko Mladic, the former general of the Bosnian Serb army, and Bosnian Serb wartime leader Radovan Karadzic. The government has been particularly obstinate in its refusal to transfer to ICTY custody three former army and police generals—Nebojsa Pavkovic, Vladimir Lazarevic, and Sreten Lukic—indicted for war crimes in Kosovo in 1999.
