All students have the right to:

A Make a report to local law enforcement and/or state police. B Have disclosures of domestic violence, dating violence, stalking, and sexual assault treated seriously.

C Make a decision about whether or not to disclose a crime or violation and participate in the judicial or conduct process and/or criminal justice process free from pressures from the institution.

D Participate in a process that is fair, impartial, and provides adequate notice and a meaningful opportunity to be heard.

E Be treated with dignity and to receive from the institution courteous, fair and respectful health care and counseling services where available.

F Be free from any suggestion that the reporting individual is at fault when these crimes and violations are committed, or should have acted in a different manner to avoid such crimes or violations.

G Describe the incident to as few institutional representatives as practicable and not to be required to unnecessarily repeat a description of the incident.

H Be free from retaliation by the institution, the accused and/or the respondent, and/or their friends, family and acquaintances within the jurisdiction of the institution.

I Access to at least one level of appeal of a determination. J Be accompanied by an advisor of choice who may assist and advise a reporting individual, accused, or respondent throughout the judicial or conduct process including during all meetings and hearings related to such process.

5.3 Legal Context Members of the College community are responsible for complying with federal, state, and local laws, as well as with College regulations. Paul Smith’s College is not responsible for any violation of state, federal or local laws perpetrated by its students, though it does reserve the right to investigate and adjudicate any reports of such violations. If a conduct hearing is required, the decision of the conduct designee may be different than any decision made by federal, state or local courts.

From the Conduct of Conduct, located within the Community Guide: Paul Smith’s College students accept their responsibility as role models. Behavior that violates this standard includes but is not limited to: (1). Use, possession, or distribution of alcoholic beverages, except as expressly permitted by law and the College’s Alcohol Policy. This includes being in the presence of and/or the possession/consumption of alcohol by those under the age of 21, providing alcohol to those under the age of 21, the consumption of alcohol while in the presence of a minor, possession of a common source container (empty or full) and/or participating in “drinking games” that aid in the mass consumption of alcohol, driving under the influence, and public intoxication by persons of any age; (2). Under the influence and/or use, possession, in the presence of, or distribution of narcotic, other controlled substances, or the use of general products as intoxicants, as well as drug paraphernalia;

Possible sanctions if found responsible for a substance violation: • SAFE Educational Program through the Counseling Center The SAFE program is a prevention and education program only, and not considered a treatment program. • Letter sent to Parents if under 21 years of age • Community Restitution • Educational Sanctioning, posters, written narratives, assisting in educating our community via programming • Residence Hall Probation • Multiple violations may result in being removed from the residence halls AFFIRMATIVE CONSENT 15 Defined by State

Sexual misconduct or contact in the absence of affirmative consent violates the College’s policies. Sexual misconduct includes any sexual act perpetrated against someone’s will. Sexual violence includes rape, an attempted nonconsensual sex act, abusive sexual contact (i.e., unwanted touching), non-contact sexual abuse (e.g. threatened sexual violence, exhibitionism, verbal sexual harassment), dating violence, domestic violence and stalking. All types involve victims who do not consent, or who are unable to consent due to incapacitation.

Affirmative Consent is a knowing, voluntary and mutualdecision among all participants to engage in sexual activity. Consent can be given by words or actions, as long as those words or actions create clear permission regarding willingness to engage in the sexual activity. Silence or lack of resistance, in and of itself, does not demonstrate consent. The definition of consent does not vary based upon a participant’s sex, sexual orientation, gender identity or gender expression.

A Consent to any sexual act or prior consensual activity between or with any party does not necessarily constitute consent to any other sexual act.

B Consent is required regardless of whether the person initiating the act is under the influence of drugs and/or alcohol.

C Consent may be initially given but withdrawn at any time.

D Consent cannot be given when a person is incapacitated, which occurs when an individual lacks the ability to knowingly choose to participate in sexual activity. Incapacitation may be caused by lack of consciousness or being asleep, being involuntarily restrained, or if an individual otherwise cannot consent. Depending on the degree of intoxication, someone who is under the influence of alcohol, drugs, or intoxicants may be incapacitated and therefore unable to consent.

E Consent cannot be given when it is the result of any coercion, intimidation, force or threat of harm.

F When consent is withdrawn or can no longer be given, sexual activity must stop. The health and safety of every student at Paul Smith’s College are of utmost importance. Paul Smith’s strongly encourages students to report domestic violence, dating violence, stalking or sexual assault to college officials. A bystander acting in good faith or a reporting individual acting in good faith that discloses any incident of domestic violence, dating violence, stalking or sexual assault to PSC’s officials or law enforcement will not be subject to PSC’s code of conduct action for violations of alcohol and/or drug use policies occurring at or near the time of the commission of the domestic violence, dating violence, stalking or sexual assault.
