THE EFFECT OF BREXIT ON MARINE ENVIRONMENT PROTECTION AND THE EXPANSION OF MARITIME SPACES AROUND GIBRALTAR: THE SPANISH-BRITISH MEMORANDUM OF UNDERSTANDING OF 2018 ON ENVIRONMENTAL COOPERATION – IV. FINAL CONSIDERATIONS. ABSTRACT. The implementation of EU environmental legislation in Gibraltar will be analyzed in this Paper. An study strongly affected by the historical Anglo-Spanish dispute concerning sove- reignty over Gibraltar (Rock and Isthmus), which also extends to the surrounding maritime spaces, the airspace over the territory and the internal waters of the port of Gibraltar. Since environmental matters are the responsibility of the Government of Gibraltar, this latter is also responsible for transposing environmental directives, whereas the UK is answerable to the EU for compliance with them. It also will be analyzed the lack of cooperation between the States, that is evidenced by the over- lapping of spaces protected surrounding Gibraltar, as Sites of Community Importance (SCI) and Special Areas of Conservation (SAC), for which the adoption of conservation measures is envisa- ged, including regulation of fishing activity and navigation, environmental impact assessment of projects with transboundary effects that may derive from the practice of land reclamation (in accor- dance with the Environmental Impact Assessment Directive), pollution prevention, bunkering and 1 INDESS (University Institute for Sustainable Social Development), University of Cádiz, Spain. 2 Associate Professor (Profesora Titular) in International Law and International Relations at the University of Cádiz. For several years, these activities have been challenged at the European level by the NGO ‘Campo de Gibraltar Verdemar-Ecologists in Action Association’, and have also been the subject of complaints and protests on the part of the Spanish Government to the UK. Finally, the effect of Brexit on marine environment protection and the expansion of maritime spaces around Gibraltar will be studied, specially the Spanish-British Memorandum of Understanding of 2018 on environmental cooperation which was referenced by the Protocol on Gibraltar included in the Agreement on the Withdrawal of the UK from the EU. GIBRALTAR, LOS RELLENOS Y EL MEDIO AMBIENTE ANTE EL BREXIT RESUMEN. En este estudio analizaremos la aplicación de la legislación medioambiental europea en Gibraltar, que se ve fuertemente condicionada por la controversia histórica hispano-británica sobre la soberanía del territorio (Peñón e Istmo). Una controversia que se proyecta asimismo sobre los espacios marítimos que le rodean y sobre el espacio aéreo que se superpone al territorio y a las aguas interiores del puerto de Gibraltar. Siendo el medio ambiente competencia del Gobierno de Gibraltar, éste asume la transposición de las Directivas en la materia, mientras que es el RU el responsable de su cumplimiento ante la UE. Destacaremos, por lo tanto, la falta de cooperación entre los Estados con la superposición de espa- cios protegidos en torno a Gibraltar, como son los Lugares de Importancia Comunitaria (LIC) y las Zonas Especiales de Conservación (ZEC), en las que se prevé la adopción de medidas de conserva- ción que incluyen, entre otras, la regulación de la actividad pesquera, la navegación, la evaluación del impacto ambiental de los proyectos con efectos transfronterizos que pudieran derivar de la práctica de los rellenos (de conformidad con la Directiva de Evaluación del Impacto Ambiental), la prevención de la contaminación, el bunkering o la investigación científica. Y estas activida- des vienen siendo denunciadas desde hace años ante instancias europeas por la ONG ‘Asociación Verdemar-Ecologistas en Acción del Campo de Gibraltar’, siendo igualmente motivo de quejas y protestas por parte del Gobierno español ante el RU. Finalmente, analizaremos la incidencia del Brexit en la protección del medio ambiente marino y en la ampliación de espacios marítimos en torno a Gibraltar, en concreto, el memorando de en- tendimiento hispano-británico de 2018 en materia de cooperación medioambiental, que aparece referenciado en el Protocolo sobre Gibraltar anexo al Acuerdo sobre la Retirada del RU de la UE. THE ANGLO-SPANISH DISPUTE OVER THE WATERS OF GIBRALTAR AND APPLICATION OF EUROPEAN ENVIRONMENTAL LEGISLATION IN SAID WATERS The European Union’s Integrated Maritime Policy (IMP) has generated considerable advances in marine environment protection3, in particular the adoption of the Marine Strategy Framework Directive4, which seeks to ensu- re cooperation between Member States when these border the same region or sub-region (for which a marine strategy must be established) and when the state of the sea is so critical that it requires urgent measures and a common plan of action. However, such cooperation has not been achieved in the ma- ritime area of the Strait and Alboran, which includes the Bay of Algeciras, due to the historical Anglo-Spanish dispute over the waters surrounding Gibral- tar5, as shall be discussed below. This lack of cooperation between Spain and the United Kingdom (UK) is evident in the overlapping spaces protected under European environmental legislation (Habitats Directive)6 and included in the European Natura 2000 network of protected areas as Sites of Community Importance (SCI) and Special Areas of Conservation (SAC).     Environment Protection Engineering Vol. 44 2018 No. 4 DOI: 10.37190/epe180402 JOSE LUIS FUENTES-BARGUES1 REVIEW OF THE ENVIRONMENTAL IMPACT ASSESSMENT PROCESS OF WASTEWATER TREATMENT PLANTS IN SPAIN The environmental impact over natural water systems, both marine and land, of the sewage is minimized with the treatment at Wastewater Treatment Plants (WWTPs), but these facilities also gen- erate environmental impacts during the construction period and during the operation period. A review of the environmental impact assessment (EIA) process of WWTPs in Spain through the analysis of records of decision (RODs) between 2000 and 2016 has been performed in this work. The major envi- ronmental impacts during the construction period are noise, land use and disturbance of the air and water’s quality. During the operation period, the major environmental impacts are noise, odors from the depuration process and the visual impact of the facilities. About the EIA process, results show the processing time is too long, scoping phase has a success rate about 57.2% and regional public admin- istrations are the most participative, both at scoping phase and at public participation phase. In general, public participation during period of exhibition is very low, in twelve of the RODs nobody submitted any report. The role of environmental project manager and the work environmental journal must be strengthened. 1. Introduction This report analyses the process of elaboration of the Special Plan for the Upper Guadiana basin as a planning instrument aiming at managing water resources in the basin, providing water to the population and economic uses and preventing deterioration of valuable wetlands, helping achieve good ecological status of surface and groundwater. The traditional conflict between the development of agriculture and the protection of the wetlands in the Upper Guadiana basin is a case of special interest from a technical, economic and social perspectives due to three main reasons: (1) the large area it covers (16000 Km2 aprox.), (2) the large population affected (3) the importance of funding from the national and European level that have been invested in the area since the beginning of the nineties to mitigate the problem (Cruces de Abia et al., 1998). This case illustrates at least four key aspects related to participation, social learning and decision making in water planning: a) It illustrates planning processes carried out according to the dominant paradigm of technical determinism and administrative decision making, that requires instruments for imposing decisions made from above.

Doñana National Park is the largest natural reserve in Spain. It has a wide variety of ecosystems and plays host to numerous species of wildlife. Throughout history, the ecosystem has been constantly under threat from the drainage of marshlands, use of water for intensive agriculture and water pollution. The Doñana Natural Park is a member of the Natura 2000 network (ES0000024, ES6150009 and ES6180005) and is therefore protected under Directives 92/43/EEC and 2009/147/EC on habitats and birds. The petitions oppose projects that aim to extract, store and transport gas in the area, as well as to illegally use groundwater for intensive agriculture, which would be incompatible with EU environmental legislation. It is the driest region in Europe and the most impacted by climate change. Further, it is the first and foremost bearer of fruits and vegetables to the rest of Europe. The region of Murcia, accounting for over 50 per cent of the Segura Basin District in South- eastern Spain, already exceeds its water resource availability by 200 per cent. Whilst the agricultural sector drinks 85 per cent of ground water, the rest of the city runs off reused waste water and desalinated sea water.     Appeal to the Greenlandic and Danish Governments and the European Union to Help Protect the Greenlandic and Arctic Environment Nuuk, Narsaq, Qaqortoq, Copenhagen, Aarhus, Brussels, Amsterdam and Berlin, February 10th 2021 The following statement has been signed by 141 NGOs: New Arctic strategies are underway in the Danish Realm1 and the European Union. By encouraging large- scale mining and oil and gas extraction, the existing strategies have a negative impact on Greenland’s pristine environment. Unfortunately, there are no signs that the new strategies will be any different. Greenland possesses some of the world’s largest oil and gas and mineral reserves and currently, there are about 70 active large-scale exploration and exploitation licenses in Greenland, covering thousands of square kilometres, and almost all related to surface mining projects. Most of them are located in Southern Greenland, which has the country’s richest biodiversity and all of Greenland’s farm land. Recently, the big rare earth elements mining project at Kringlerne has been approved, which is described by its owner as the probably largest deposit in the world. And in a few months, the controversial rare earth elements and uranium project at Kvanefjeld is expected to get an exploitation license. In addition to containing the second biggest uranium and by far the largest thorium deposits, the Ilimaussaq-complex, of which Kvanefjeld is a part, has the second largest deposits of rare earth elements in the world. WE CALL on the Greenlandic and Danish governments, the European Union, and everybody else who take an interest, to help establish an Arctic sanctuary.

The GPA attendance is part of an ongoing promotional business drive by Her Majesty’s Government of Gibraltar to ensure that the Rock retains its internationally recognised position as the most important bunker port in the Mediterranean and one of the most important bunker hubs in the world. The Gibraltar Port Authority will be represented by Bunkering Superintendent John Ghio, who will be one of the speakers at the event. The GPA has been extremely busy attending various major global bunkering conferences, among them, the IBIA (International Bunker Industry Association), which was held in London in February 2014, in conjunction with the prestigious industry trade fair ‘IP Week’. The GPA also attended the 35th International Bunker conference in Copenhagen in April 2014, IBIA Annual Convention held in Hong Kong in November 2013, Platt Mediterranean Bunker Conference held in Barcelona in December 2013 and ARACON held in Rotterdam in October 2013. Minister for Tourism, Commercial Affairs, Public Transport and the Port, Neil Costa MP said that the Port had doubled its marketing strategy efforts in order to attract new business and were constantly promoting the range of excellent services with articles and advertising in some of the leading industry publications in UK and Europe, such as Bunkerworld, Bunkerspot and Cruise and Ferry Review.
