SUMMONING, SITTINGS AND PROROGATION OF THE HARYANA VIDHAN SABHA The Twelfth Haryana Vidhan Sabhha was summoned to meet for its Seventh Session in the Hall of Haryana Vidhan Sabha, Vidhan Bhawan, Chandigarh, on the 24th August, 2012, by an order of the Governor dated the 23rd July, 201 and continued to meet till the 28th August, 2012, when it was adjourned sine-die. It was later prorogued by an order of the Governor dated the 29th August, 2012. During the Session the Sabha held 3 sittings, as may be seen from the programme observed. LEAVE OF ABSENCE (i) Leave of absence from the House of Km. Sharda Rathore, Chief Parliamentary Secretary, Home, Haryana was received on 22nd August, 2012 for her inability to attend the Session of Haryana Vidhan Sabha as she had left for UK on 19.8.2012 to attend the social ceremony in the family of anacquitance. (ii) Leave of absence from the House of Sh. Harmohinder Singh Chattha, Finance Minister, Haryana was received on 23rd August, 2012 for his inability to attend the sitting of the House on 24th August, 2012 as he was ill and taking treatment at Medanta Medicity Hospital, Gurgaon. (iii) Leave of absence from the House of Smtt. Savitri Jindal, MLA was received on 24th August, 2012 for her inability to attend the sitting of the House on 24th August, 2012 due to some urgent personal work. Bharat Bushan Batra, MLA against Sh. Om PrakaSh.Chautala, MLA who made false, misleading and incorrect statement on the floor of the House on 11th March, 2010 willfully, deliberately and knowingly stating the Haryana Urban Development Authority had not acquired a single acre of land since coming into power of the Congress Government from March, 2005 till date. He has also stated that not even a single sector of HUDA had been floated during this period, whereas the Parliamentary Affairs Minister, Sh. Randeep Singh Surjewala had pointed out the correct factual position but Sh. Om PrakaSh.Chautala again asserted that neither even a singal sector HUDA was floated nor a single acre of land was acquired by HUDA from, 2005 till date. By doing so Sh. Om PrakaSh.Chautala has tried to mislead the House willfully, knowingly and deliberately which amounts to contempt of the House/Breach of Privilege committed by him on the floor of the House. Thus, the matter of making false statement by Sh. Om PraskaSh.Chautala on the floor of the House on 11th March, 2010, involves the question of Breach of Privilege/contempt of the House. ALSO to move that the time for the presentation of the final Report to the House be extended upto the first sitting of the next Session. (iii) PRESENTATION OF PRELIMINARY REPORT OF COMMITTEE OF PRIVILEGES REGARDING PRIVILEGE ISSUE AND EXTENSION OF TIME FOR PRESENTATION OF THE FINAL REPORT. THE CHAIRPERSON to present Fifth Preliminary COMMITTEE OF PRIVILEGES Report of the Committee of Privilege with regard to the question of alleged breach of privilege given notice of by Sh. Aftab Ahmed, MLA against Sh. Om PrakaSh.Chautala, MLA who made categorically incorrect and misleading statement on the floor of the House on 11th March, 2010 stating that Reliance Company has been given 1500 acres of Government land at a cost of Rs. 370 crore in garb of giving employment, particularly when HSIIDC had acquired this land for welfare of the people. He further stated that a four acres chunk of land out of this acquired land has been auctioned for Rs. 290 crore. He consequently alleged loss to the exchequer and fraud on account thereof. He further stated that land of farmers was acquired in the name of ‘SEZ’ and they were told that they will be given bonus/annuity of Rs. 10,000/- per acre per year. He further stated that even a rupee has not been paid till date to any farmer by way of such bonus annuity. Whereas the above statement of Sh. Om PrakaSh.Chautala is factually and absolutely incorrect. Sh. Om PrakaSh.Chautala has made a false, misleading and incorrect statement in the House on both the afore-stated subjects. Sh. Om PrakaSh.Chautala made this statement willfully, deliberately and knowingly to mislead this august House.

Stating that the party would challenge the verdict after the quantum of sentence is announced on January 22, Arora said that INLD was fully prepared to face any situation, including what he described was a vilification campaign launched against it by Congress and the Kuldeep Bishnoi-led Haryana Janhit Congress. Arora said that the scam in the selection of teachers in 1999 – for which 53 others have been convicted along with the father-son duo – was set in motion by the then Bansi Lal-led Haryana Vikas Party (HVP) government before Chautala took over.

This judgment will dispose of two Special Leave Petitions, they being SLP (Crl.) No. 7384 of 2010 and SLP (Crl.) No. 7428 of 2010. While Abhay Singh Chautala is the petitioner in the first Special Leave Petition, the second one has been filed by Shri Ajay Singh Chautala. The question involved is identical in both the SLPs and hence they are being disposed of by a common judgment. 2. Leave granted in both the Special Leave Petitions. 3. Whether the sanction under Section 19 of The Prevention of Corruption Act (hereinafter called "the Act" for short) was necessary against both the appellants and, therefore, whether the trial which is in progress against both of them, a valid trial, is common question. This question was raised before the Special Judge, CBI before whom the appellants are being tried for the offences under Sections 13(1) (e) and 13(2) of the Prevention of Corruption Act read with Section 109 of Indian Penal Code in separate trials. 4. Separate charge sheets were filed against both the appellants for the aforementioned offences by the CBI. It was alleged that both the accused while working as the Members of Legislative Assembly had accumulated wealth disproportionate to their known sources of income. The charges were filed on the basis of the investigations conducted by the CBI.

Please provide an update on the results of the 2009 elections in relation to the INLD candidates in Haryana. Outcome of the National Election in May 2009 in Haryana The 2009 Indian National (Lok Sabha) election took place over five weeks with voting in different areas of India between 16 April 2009 and 13 May 2009.1 Voting for all ten of Haryana‟s Sabha seats took place on 7 May 2009.2 The INLD failed to win even a single seat in Haryana.3 The Congress Party won nine out of the ten seats except for the Hisar seat which was won by Haryana Janhit Congress (HJC) leader Bhajan Lal. 4 The Indian National Lok Dal (INLD) in Haryana is led by former chief minister Om Prakash Chautala. In order to challenge the ruling Congress party in this year‟s national election, the INLD formed a new alliance with the Bharatiya Janata Party (BJP).5 The INLD nominated five candidates for the Lok Sabha seats it would share with the BJP in Haryana.
