    Government of Meghalaya Addendum to the MEMORANDUM Submitted to the Thirteenth Finance Commission FINANCE DEPARTMENT 0 5. Up-gradation of Administration and Special Problems of Meghalaya 5.1. Introduction With a view to removing the inter-regional imbalances and disparities in provision of services by the States, it is important that the requisite funds are made available to enable them to provide for a reasonable standard of social, economic and administrative services to their subjects. In this context, the Finance Commission is empowered constitutionally to help the States in this regard by recommending grants- in-aid from the revenue in the Consolidated Fund of India. Various Finance Commissions have, in the past, recommended under Article 275 grants-in-aid to the States for a variety of purposes irrespective of the Terms of Reference for the granting of such aid. The Seventh Finance Commission, in this regard, laid down the following principles: Grants-in-aid may be given to narrow down disparities in the available administrative and social services between the developed and the backward States. Such grants are called up-gradation grants; and Grants-in-aid may be given to individual States to enable them to mitigate special problems on account of their peculiar circumstances or for matters of national importance, the financial burden of which the State finances may not be able to sustain. Such grants are special problem grants. Although, it was not specifically mentioned in the Terms of Reference, some of the earlier Finance Commissions did recommend grants-in-aid under Article 275, for the up-gradation of standards of administration and for the special problems of the States in one form or the other.

Consequent upon the decision of the Government on the recommendation of the Fifth Meghalaya Pay Commission at Item 3.6 of its Resolution, the Governor of Meghalaya is pleased to sanction Winter Allowance at the rate of `600/- p.m. to all categories of State Government employees, pensioners/family pension holders including members of the All India Service stationed at places with an elevation of 1000 metres above Mean Sea Level. The Allowance shall also be admissible to pensioners/family pension holders whose residence is located in a station where the allowance is drawn by the government employees, subject to production of residential certificate. The Allowance shall be admissible for a period of four month commencing from the month of November to the month of February. The expenditure on account of payment of Winter Allowance shall be debited to the head of account from which the Government employees draw their salaries and the pensioners/family pension holders draw their pension. This order shall take effect from 1st December, 2017. The list of stations where Winter Allowance is admissible is given in the Annexure to this Office Memorandum. Sd/- R. V. The undersigned is directed to say that consequent upon the decision of the Government on the recommendation of the Fifth Meghalaya Pay Commission at Item 3.3 of its Resolution, the Governor of Meghalaya is pleased to sanction the grant of House Rent Allowance to all State Government employees at the rates indicated below:- Classification of cities/towns Rate of House Rent Allowance and other areas (i) Greater Shillong Area 15% of basic pay subject to a maximum of `8,000/- p.m. (ii) District Headquarters 12½ % of basic pay subject to a maximum of `6,000/- p.m. (iii) (iii) Other Areas 10% of basic pay subject to a maximum of `5,000/- p.m. Note : * Rates prescribed for Shillong will be applicable for Shillong and Urban Agglomeration as per areas notified by the State Urban Affairs Department. 2. (1) These Rules may be called the Rules of Execution Business of the Government of the State of Meghalaya. (2) They shall come into force at once. 2. In these Rules unless the context otherwise requires – (a) “Article” means an Article of the Constitution of India; (b) “Cabinet” means the Committee of the Council consisting of the Minister appointed as such by the Governor. (c) “Chief Minister” means the Minister appointed as such by the Governor under Article 164 (1) of the Constitution; (d) “Chief Secretary” means the Chief Secretary to the Government of Meghalaya. (e) “Constitution” means the constitution of India; (f) “Council” ,means the Council of Ministers consisting under Article 163 of the Constitution; (g) “Department” means a Department of the Government of the State of Meghalaya as specified in the First Scheduled. (h) “Minister” means a Minister appointed as such by the Governor and includes a Minister of State and a Deputy Minister. (ha) “Parliamentary Secretary” means a Parliamentary Secretary appointed as such by the Chief Minister. (i) “Secretary” means a Secretary to the Government of Meghalaya and include Chief Secretary, Principal Secretary, Commissioner and Secretary, a Joint Secretary, a Deputy Secretary and an Under Secretary; and (j) “Schedule” means the Schedule appended to these Rules.
