ark Berman is a partner in the firm’s Commercial Litigation practice group M as well as in its other litigation practice groups. He co-heads the firm’s Complex Title Insurance Litigation practice. Mr. Berman is a member of the firm’s Cooperative and Condominium Housing Practice Group. He has extensive experience in representing private and public companies, as well as partnerships and individuals, as plaintiffs and defendants, in complex commercial matters with an emphasis on real estate disputes, electronic discovery conflicts, and complex title insurance issues. Mr. Berman is experienced in all phases of litigation in both state and federal courts as well as in arbitral forums. He is a seasoned appellate attorney, having argued many cases before both the First and Second Departments. Mr. Berman is also a trained mediator. He has also been appointed as a discovery master by a New York Commercial Division Justice. Jeremy R. Feinberg is a Special Referee of the New York County Supreme Court, Civil Division. His docket includes referred matters from the Commercial Division, New York County, as well as matrimonial and general IAS Part cases. He issues reports and gives recommendations (or, in some instances, issues determinations) on referred matters ranging from attorneys’ fees awards to e-discovery issues to personal jurisdiction challenges.

He worked at the Office of Court Administration from 2006-2013, serving on the staff of the Chief Administrative Judge, before becoming a Special Referee in 2013. Prior to joining the court system in 2006, Special Referee Feinberg was associated with Proskauer, where he served the firm and its clients on sports law, professional responsibility, and commercial litigation matters. Dr. Michael L. Fox is an Assistant Professor of Business Law in the School of Business at Mount Saint Mary College, in Orange County, New York. He teaches courses in the undergraduate business program, and in the MBA program. He also serves as the College’s Pre-Law Advisor.

Professor Fox received his Bachelor of Arts (B.A.) degree, Phi Beta Kappa and summa cum laude, from Bucknell University, in Lewisburg, PA, with a major in Economics and minor in Biology. He was elected to Phi Beta Kappa in his junior year. At graduation, he received the award for the highest standing in Economics, and he was active throughout his college career, among other things serving as a member of the Middle States Period Review Report Committee for Bucknell, and as a member of the University Judicial Boards.

Dr. Fox received his Doctor of Law (J.D.) degree from Columbia University School of Law, in New York City, where he was a Harlan Fiske Stone Scholar and an Articles Editor on the Columbia Business Law Review.

Professor Fox served as a law clerk to the Hon. Lawrence E. Kahn, U.S. District Judge, in the Northern District of New York, in Albany. He has been rated AV-Preeminent by Martindale-Hubbell since 2015, and has been selected to the Upstate New York Super Lawyers list in 2013, 2014, 2015 and 2016. He is admitted to practice in New York State, as well as in the Southern, Eastern and Northern Districts of New York, the Second Circuit U.S. Court of Appeals, and the United States Supreme Court. Professor Fox previously worked as an associate in the litigation department of Stroock & Stroock & Lavan LLP, in Manhattan; and was, sequentially, an associate, senior counsel, and then partner, and the litigation managing attorney at Jacobowitz & Gubits, LLP, in New York’s Hudson Valley. From February 2014 to November 2016, he served as Deputy Corporation Counsel and special labor counsel for the City of Port Jervis.

Professor Fox has been very active with the American Bar Association, New York State Bar Association, and Orange County Bar Association. He is presently the Vice President for the Ninth Judicial District of the NYSBA, and a member of the NYSBA Executive Committee and House of Delegates. He is also a former Delegate to the ABA House of Delegates (2008-2014), and previously served as a Delegate to the NYSBA House of Delegates from 2008 to 2014, and as a Member-at-Large of the Executive Committee from 2015 to 2017. He is also a member of the Commercial & Federal Litigation Section and Trial Lawyers Section of NYSBA, and is a past Chairperson of the Young Lawyers Section (one of the largest NYSBA Sections), and is a past Secretary and Treasurer of that Section. As of June 2016, Maura R. Grossman is a Research Professor in the David R. Cheriton School of Computer Science at the University of Waterloo, in Ontario, Canada, as well as an eDiscovery attorney and consultant in New York City. Previously, Maura was Of Counsel at Wachtell, Lipton, Rosen & Katz, in New York, where for 16½ years, she represented Fortune 100 companies and major financial services institutions in corporate and securities litigation, including civil actions and white collar criminal and regulatory investigations, and advised lawyers and clients on legal, technical, and strategic issues involving eDiscovery and information governance, both domestically and abroad.

Maura is a well-known and influential eDiscovery lawyer. Since 2010, Maura has served as co-chair of the eDiscovery Working Group advising the New York State Unified Court System. She has served as a court-appointed special master, neutral/mediator, and eDiscovery expert to the court in multiple high-profile federal cases. She has provided eDiscovery training to federal and state court judges, by invitation of the court, and has testified, on several occasions, before the Advisory Committee on the Federal Rules of Civil Procedure and the Advisory Committee on Evidence Rules, at their invitation. Maura is an adjunct professor at Columbia Law School and the Georgetown University Law Center, where she teaches courses on eDiscovery. General Biography

Hon. Shirley Werner Kornreich (Ret.) joins JAMS after serving as a judge in New York State for nearly 24 years, including nine years in the Commercial Division of Supreme Court, New York County. Judge Kornreich presided over both bench and jury trials, and oversaw complex litigation, including the Bextra/Celebrex New York State cases (coordinated with the federal MDL/Judge Charles Breyer) and the New York State Bausch & Lomb ReNu cases (coordinated with the federal MDL /Judge David Norton). She also handled asbestos cases, numerous class actions, securities, real estate and employment litigation and corporate and contract actions. Prior to her service on the bench, Judge Kornreich worked as an appellate attorney for The Legal Aid Society, Criminal Defense Division, in both Nassau County and New York County, arguing cases in the Appellate Divisions, First and Second Departments, and the New York Court of Appeals. Kerri Ann Law is an experienced trial lawyer and counselor with a diverse practice representing clients, including Fortune 500 companies, in complex commercial litigation in both state and federal courts, as well as in domestic and international arbitration forums. Among her more notable representations, Kerri Ann secured a multimillion-dollar jury victory for a manufacturing company in an unfair competition case. The jury found that the defendant had stolen trade secrets relating to unique and state-of-the-art manufacturing processes that the plaintiff had developed over decades. Kerri Ann represented Bear Stearns in several shareholder derivative actions and class actions arising out of the collapse of two hedge funds in 2007. She also represented an individual in a putative class action alleging manipulation of the platinum and palladium markets, including the trading of futures contracts, in violation of the Commodity Exchange Act, the Sherman Antitrust Act, and the Racketeer Influenced and Corrupt Organizations Act.

Kerri Ann has litigated numerous false advertising matters for pharmaceutical and other companies. Legal 500, which ranked Kramer Levin’s advertising practice “in the top tier,” designated Kerri Ann as a “highly recommended” counsel in this area. Among other representations, Kerri Ann successfully defended AstraZeneca in a false advertising suit related to the company’s Nexium product.

Legal 500 also designated Kerri Ann as a “recommended” counsel for her employment litigation practice, which includes representing and advising companies in employment disputes alleging discrimination, sexual harassment and retaliation, and violations of the Fair Labor Standards Act, as well as those arising from employment contracts. Kerri Ann undertakes many pro bono matters, with a particular focus on human rights. She successfully obtained asylum for a woman who had been repeatedly persecuted in Kosovo and Montenegro because of her nationality and her religious and political opinions.

NAD recommended that B&L discontinue its claims to eye care professionals that ULTRA lenses “have significantly more PVP (4x as much of the wetting agent) than [ACUVUE OASYS lenses]”; that ULTRA lenses have “best-in-class properties for best-in-class performance”; and that ULTRA lenses are “Patient preferred for end-of-day comfort over the leading silicone hydrogel lenses ... 2 to 1 vs. ACUVUE OASYS.” NAD also recommended that B&L discontinue related “better comfort” and “better vision” claims that were based on a contact lens “refit” study that NAD determined to be “materially flawed” and “insufficiently reliable to support the advertiser’s comparative performance and preference claims.”

Hon. Frank Maas (Ret.) served for 17 years as a United States Magistrate Judge for the Southern District of New York, including a two-year term as Chief Magistrate Judge. Before his appointment to the bench, Judge Maas was a federal prosecutor in the Southern District of New York, a partner in the New York City office of a large commercial litigation law firm headquartered in upstate New York, and First Deputy Commissioner of the New York City Department of Investigation. As First Deputy Commissioner, he was responsible for the day-to-day operations of an internal affairs agency and oversaw the City’s internet security efforts. Judge Maas is nationally known for his expertise in electronic discovery issues. He is a frequent speaker at the Conference on Preservation Excellence, E-Discovery Institute Leadership Summit, and other venues. Judge Maas is a member of the Federal Bar Association S.D.N.Y. Chapter Executive Committee; the Federal Bar Council; the Federal Magistrate Judges Association; the Association of the Bar of the City of New York; and, the New York State Bar Association. Roger Juan Maldonado is a Partner in the Litigation Practice of Smith, Gambrell & Russell, LLP. He is a trial lawyer, commercial litigator, and leader of the organized bar with more than 35 years’ experience.

Mr. Maldonado represents musicians, publishers, and record labels in litigation to enforce their copyrights and contractual rights. He also assists corporate and commercial institutions in litigation involving claims arising from software development/license disputes, lease agreements, and contract disputes. Mr. Maldonado has a great deal of experience litigating, arbitrating, and mediating claims involving employment discrimination, employment contracts, and restrictive covenants on behalf of professionals, partnerships, and corporations.
