Is he a rally-starter who best fits near the top of the lineup, or a run producer who will earn his paycheck clearing the bases? All that's known is DeJesus, obtained via trade from Kansas City in November, is targeted for right field. If the A's wind up showing improvement offensively this season, figure DeJesus will be central to the effort in one way or another. "He's an all-around hitter who uses the whole field," A's manager Bob Geren said. "There are guys that hit more home runs, but when you put the numbers together, he's one of the best hitters in baseball." A .289 career hitter over seven-plus major league seasons, DeJesus, 31, has collected as many as 73 RBIs in a year (2008) and scored as many as 101 runs (2007). One notable stat for fans tired of watching A's hitters make the slow walk back to the dugout: DeJesus led the majors last season with a .287 average in two-strike counts. There's a strong chance he'll wind up as the No. 3 hitter by default -- sandwiched between table-setters Coco Crisp and Daric Barton and sluggers Josh Willingham and Hideki Matsui. Therein lies the problem that exists for the A's in the eyes of some.

Thank you. A POSITIVIST, BASEBALL-CENTRIC CRITIQUE OF ORIGINALISM William D. Blake* INTRODUCTION The1 Constitution invests the Supreme Court with two related powers: discretion and finality. The Constitution contains open-textured language, which creates disputes on which the Court typically has the last say. As Justice Robert Jackson once humbly observed, “We are not final because we are infallible, but we are infallible only because we are final.”2 The baseball rulebook provides similar powers to umpires. Judgment calls are final; they cannot form the basis for appeal or protest.3 Even with the creation of instant replay, overturning an umpire’s call requires a finding of “clear and convincing evidence,” which provides a strong presumption that the call on the field was correct.4 Umpires, like judges, have considerable power in light of the irrevocability of their decisions. For example, the Official Baseball Rules (OBR) warns players and managers that they will be ejected from the game if they quarrel over an umpire’s strike zone.5 Finality is problematic if sports officials abuse their discretion. Consider a (perhaps apocryphal) story of a rookie pitcher who experienced unfair treatment from Hall of Fame umpire Bill Klem. On a two-strike count, the pitcher’s offering to Rogers Hornsby, another Hall of Famer, caught the corner of the plate.

Find that hard to believe? Then the man who delivered both long balls will also be a shocker. With two swings of his bat, right fielder David DeJesus provided the winning margin in the A's 3-1 victory over the Cleveland Indians before 13,872 fans at Overstock.com Coliseum. A pesky contact hitter, DeJesus entered the night with just 61 homers in eight-plus big league seasons. He entered the night mired in a 55-game homerless streak dating back to last season, and he had never had a multihomer game. "Not even in Little League," DeJesus said. "I was a bunter back then." The A's snapped Cleveland's seven-game winning streak, and DeJesus' out-of-nowhere power display was needed on a very strange night for the home team. Oakland recorded just four hits, and through the first seven innings, DeJesus' homers accounted for the A's only base runners against Cleveland starter Josh Tomlin (4-1). The A's nearly became the third team since 1919 to win a nine-inning game without benefit of a single, double, triple or walk. They notched two singles in the eighth, when Coco Crisp's run-scoring hit up the middle made it 3-1. Right-hander Trevor Cahill made the bare-bones offense stand, allowing just one run over seven innings.
