DE65 6AD Tel: 0771 9599132 MINUTES OF THE FINDERN PARISH COUNCIL MEETING HELD ON THURSDAY 13 TH OCTOBER 2016 AT FINDERN PARISH ROOMS COMMENCING AT 6.30PM Present: Cllr M Goodall (in the Chair) Cllr R Brook, Cllr S Brook, Cllr B Goodall, Cllr Johnson, Cllr Woodhouse, Cllr Rose and Cllr Smith There were no Members of the Public in attendance at the meeting. AGENDA 1. Minute Number 3006/16 - To receive apologies for absence There were no apologies for absence. 2. Minute Number 3007/16 - Variation of the Order of Business There were no Variations to the Order of Business. 3. Minute Number 3008/16 - Declaration of Members Interests. Resolved: Cllr Smith declared a Pecuniary Interest in item 8, Website Contract and item 9, Findern Parish Room Lease Agreement, repairs to ceiling upstairs and new signage 4. Minute Number 3009/16 - Public Speaking – (10 Minutes) Minute Number 3009/16/A – Public Speaking There were no members of the public present at the meeting and there was nothing to report. Minute Number 3009/16/B – Police Representatives Report There were no Police Representatives present at the meeting and there was nothing to report. Minute Number 3009/16/C – District Council Representatives Report There was no District Council Representative present at the meeting and there was nothing to report. Minute Number 3009/16D – County Council Representatives Report There was no County Council Representative present at the meeting and there was nothing to report. 5. Minute Number 3010/16 - To consider a resolution under the Public Bodies (Admission to Meetings Act 1960) to exclude members of the Public. 585 Resolved: In view of the confidential nature of the business to be transacted, it was advisable in the public interest, that the press and public be temporarily excluded and were instructed to withdraw from the meeting. 6. Minute Number 3011/16 - Internet Banking – Previously reported under minute number 1945/16, 1957/16, 2008/16, 2084/16 The Clerk reported that she had received a call from Nat West Bank on Tuesday 11.10.2016 stating that she needed to go back into the branch to have her ID verified as this had not been completed. The Clerk reported that she would pop back to the bank at Repton sometime next week. 7. Minute Number 3012/16 - Update on the purchase of Stanhope Hole and Stanhope Wood – Previously reported under minute number 1416/15, 1638/15, 1655/15, 1683/15, 1699/15, 1716/15, 1747/15, 1765/15, 1782/15, 1782/15, 1785/15, 1909/16, 1946/16, 1958/16, 2009/16, 2085/16 Resolved: Findern Parish Council agreed that this matter should go back out to public consultation on what the Parish Council should do next. It was agreed that a questionnaire would be sent to every household in the Village in the New Year. 8. Minute Number 3013/16 - Website Contract – Previously reported under minute number 2087/16 Resolved: Findern Parish Council agreed to put this matter on hold until the New Year. 9. Minute Number 3014/16 - Findern Parish Room Lease Agreement, repairs to ceiling upstairs, New signage – Previously reported under minute number 2088/16 The Clerk reported that the ceiling in the Parish Rooms had now been repaired and plastered. Resolved: Findern Parish Council agreed to the new signage to be installed for the tea rooms where the current Parish Rooms sign is and the Parish Rooms sign will be moved to the other side of the building. Resolved: Findern Parish Council agreed to another post box being installed at the front of the Parish Rooms, one for The Tea Rooms Post and the other for the Parish Council’s post. 10. Minute Number 3015/16 - Clerk issues – emails The Clerk explained that she was being attacked via email and on Social Media by particular residents of Findern which was unacceptable. 11. Minute Number 3016/16 - Hire of the Village Hall The Chair explained that a place for a comfort break was required for the Payback Team and suggested that the Village Hall be booked. If this is on use they could use Brook Close. The Chair explained that the Village Hall are allowing the Payback Team to use it until December free of charge but after this there may be a charge. The Chair asked the Parish Council if they would be happy to pay for this hire. Resolved: The Chair to speak to the Village Hall Committee to see if an arrangement could be struck on the charges. 586 12. Minute Number 3017/16 - Date of the next Parish Council Meeting to be confirmed Resolved: The next meeting of Findern Parish Council was confirmed as 10 th November 2016 venue to be confirmed, commencing at 6.30pm for the exempt part of the Monthly Meeting. DE65 6AD Tel: 0771 9599132 MINUTES OF THE FINDERN PARISH COUNCIL MEETING HELD ON THURSDAY 13 TH OCTOBER 2016 AT FINDERN PARISH ROOMS COMMENCING AT 6.30PM The Chair gave the following report prior to the meeting as follows: Before we start tonight’s meeting, there is something I would like to ask the Parish Councillors to do, assuming they are in agreement with my request. You will be aware that there is a lot going on in the village at the moment, in particular the change of use of the Parish Rooms and the proposed improvements on Hillside Playing Field and over the past few weeks Clare has had to deal with criticism from some residents regarding the practices of herself and the Parish Council. It is only when you take the chair that you are fully aware of just how much work a clerk does behind the scenes and we all know how lucky we are to have a clerk of Clare’s ability and experience and that she would never let the Council do anything which contravenes Codes of Good Practice I would ask you to show her your support in my vote of confidence. Can I please have a show of hands on this? Resolved: The Parish Council unanimously supported the Parish Council Clerk. The Chair then explained the rules of Public Speaking to Members of the Public present at the meeting and explained that once Public Speaking was finished Members of the public would not be able to join in on items being discussed and resolved. Present: Cllr M Goodall (in the Chair) Cllr R Brook, Cllr S Brook, Cllr B Goodall, Cllr Johnson, Cllr Woodhouse, Cllr Rose and Cllr Smith 1 District Council Representative, 1 County Council Representative and 22 Members of the Public were in attendance at the meeting. AGENDA 1. Minute Number 3018/16 - To receive apologies for absence There were no apologies for absence. 2. Minute Number 3019/16 - Co-Option of 2 Councillors Resolved: Tammy Brown was co-opted onto Findern Parish Council with immediate effect. Resolved: In accordance with the Local Government Act 1972 Cllr Tammy Brown signed the Declaration of Acceptance of Office before the Clerk. 3. Minute Number 3020/16 - Variation of the Order of Business There were no Variations to the Order of Business. 588 4. Minute Number 3021/16 - Declaration of Members Interests. Resolved: Cllr Smith declared a Pecuniary Interest in item 7, Findern Parish Room Management, item a) Quotation Remedial work to be carried out from the Fault Condition Report 5. Minute Number 3022/16 - Public Speaking – (10 Minutes) Minute Number 3022/16/A – Public Speaking Members of the Public raised the following matters: • The people from Derby illegally occupying the late Mr Hodgkinson’s land who have horses and other animals including a cockerel which are treated terribly, RSPCA have been involved. • Illegal parking of vehicles on the land. • Anti-social behaviour from the people illegally occupying the land including threatening people, swearing, shouting and revving up vehicles. Some residents are frightened and intimidated by them. • The Parish Council were told that it was their duty to listen to the residents to resolve this problem. The Chair explained that the Parish Council were on the side of the residents and would support them but this was not a Parish Council Matter. Cllr Ford replied that Environmental Health had visited the site, but as the Land was not owned by SDDC there was not a lot that they could do either. However the Planning Enforcement Officer at SDDC was now in conversations with the Executer of the Will and he could inform residents that the owners were moving towards selling the land. Cllr Ford explained that to remove the current occupiers, this would be down to the landowner. Cllr Ford was asked if they would have squatter’s rights. Cllr Ford replied that they would but all the landowner needed to do would be to call in the bailiffs to have them removed. A resident stated that if this situation was not resolved by Christmas the residents may take matters into their own hands. Cllr Ford advised against this course of action and asked that they contact the Police if they had any issues. A resident asked that this item be placed on the agenda of the November Parish Council Meeting. The Clerk was asked to contact DALC to see if they could offer any advice. The Clerk replied that she would speak with DALC but she doubted that they could give any advice on this matter as it was not a Parish Council matter. Cllr Ford said that he would update the Parish Council with any news when it was available to report in the minutes going forward.
