Not withstanding anything stated above, the APEPDCL reserves the right to assess bidder’s capability and capacity to perform the contract should circumstances warrant such as assessment in the overall interest of the Department 23 Procedure for Bid Submission 1. Bids shall be submitted online on www.eprocurement.gov.in platform. 2. The participating bidders in the tender should register themselves free of cost on e-procurement platform in the website www.eprocurement.gov.in. 3. 12 . After uploading the documents, copies of the uploaded statement, certificates, documents, original Demand Drafts in respect of Bid Security (except the Price bid / offer / break-up of taxes) are to be submitted by the bidder to the Superintending Engineer/ Operation / APEPDCL so as to reach before the date and time of opening of the technical bid. The Department shall not hold any risk on account of postal delay. Similarly, if any of the certificates, documents, etc., furnished by the tenderer are found to be false / fabricated / bogus, the bidder will be disqualified, blacklisted, action will be initiated as deemed fit and the Bid Security will be forfeited.

13. The bidder has to upload the breakup of taxes for the unit rates in the excel sheets attached to the document. In case of discrepancies between the unit rate in the Vayam Technologies price bid format of e-tendering platform and in the excel sheet attachment, the rate quoted in the prescribed price bid format of e-procurement platform will be taken into consideration for evaluation of bids

14. The department will not hold any risk and responsibility regulating non-visibility of the scanned and uploaded documents.

1. FILLING OF SCHEDULE : The Work contract will be awarded to valid Registered contractors having Registration with A.P.E.P.D.C.Ltd., in carrying out the above work with valid ‘A’ Grade 33KV Electrical license and above from Chief Electrical Inspector of Government of A.P. They only are eligible to participate in tenders. 2. a) Technical Bid: The envelope containing Technical Bid must be super scribed as follows:

A. GENERAL

1. SCOPE OF BID

“Carrying out Operation and Maintenance of 8Nos 33/11KV Sub Stations round the clock on Work Contract Basis as per scope of work in Bobbili Operation Sub Division in Operation Division, Bobbili of Operation Circle, Vizianagaram”

2. ELIGIBLE BIDDERS:

2.1 The Invitation for Bids is open to all eligible bidders. Any materials, equipment, and services to be used in the performance of the Contract shall have their origin in India.

2.2 Government-owned enterprises in the Employer’s country may only participate if they are legally and financially autonomous, operate under commercial law and are not a dependent agency of the Employer.

2.3 Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices in accordance with sub-clause 27.1.

3. QUALIFICATION OF THE BIDDER:

3.1 All bidders shall provide as in Annexure-3, Qualification Information, a preliminary description of the proposed work method and schedule, including drawings and charts, as necessary.

3.2 All bidders shall include the following information and documents with their bids:

(a) Copies of original documents defining the constitution or legal status, place of registration, and principal place of business, written power of attorney of the signatory of the Bid to commit the Bidder.

b) Total monetary value of the work performed for each of the last five years

c) Experience in works of a similar nature and size for each of the last five years, preceding to the date of bid opening and details of works under way or contractually committed; and clients who may be contacted for further information on those contract

d) Qualifications and experience of the personnel proposed for the Contract

e) Reports on the financial standing of the Bidder, such as profit and loss statements and auditor’s reports for the past five years

f) Information regarding any litigation, current or during the last five years, in which the Bidder is involved, the parties concerned, and disputed amount

g) Financial turnover should be supported by Income Tax return submitted to the Income Tax Department by the contractor.

4.1 Technical Eligibility criteria :

The following eligibility criteria are included in the bid document to qualify the bidders.

a) To qualify for award of the contract, each bidder should submit satisfactory performance Certificate issued by an Engineer not below the cadre of Divisional Engineer along with supporting Xerox copies along with the TECHNICAL BID only.

b) The contractor should have valid contract registration with APEPDCL

c) The bidder shall have valid ‘A’ grade 33KV license issued by A.P. Electrical License Board.

d) The bidders who have failed to claim the bill for more than three months for payment of wages to the contract labour engaged by him are not eligible. The certificate to that effect shall be obtained from the concerned officer not below the rank of the Divisional Engineer.

e) The bidders who have not paid the wages to the contract labour engaged by him for more than three months are not eligible. The certificate to that effect shall be obtained from the concerned officer not below the rank of the Divisional Engineer.

f) The bidders who are already carrying out the said work in APEPDCL has to submit the proof of payment of revised wages to the contract labour engaged by him from the date of sanction of the estimate.

4.2 Financial Eligibility criteria : a) The Bidder should have achieved a minimum annual financial turnover of 50% of Bid value during any one year of the last five financial years.

b) Liquid assets and credit facilities of not less than 20% of the bid value (credit lines/letter of credit/solvency certificates from Banks, etc – usually the equivalent of the estimated cash flow for 12 months in peak construction period ).

4.3 Sub-contractor’s experience and resources shall not be taken into account in Determining the bidder’s compliance with the qualifying criteria.

4.4 Even though the bidders meet the above qualifying criteria, they are subject to be disqualified if they have made misleading or false representations in the forms, Statements and attachments submitted in proof of the qualification requirements, and Or Record of poor performance such as abandoning the works, not properly completing the contract, inordinate delays in completions, litigation history, or financial failures etc. in earlier works executed with EPDCL or any other company.

If they have been executing similar nature of work in APEPDCL and have not been completing the work as per the work programme i.e. as per the milestones of the agreement.

Been black listed by APEPDCL/APTRANSCO/APGENCO or Government or any other Government body.

5.0 COST OF BIDDING:

5.1 The bidder shall bear all costs associated with the preparation and submission of his Bid, and the Employer will in no case be responsible and liable for those costs.

B. BIDDING DOCUMENTS

6 CLARIFICATION OF BIDDING DOCUMENTS

6.0 A prospective bidder requiring any clarification of the bidding documents may notify the Employer in writing or by e-mail or by fax (hereinafter “cable” includes telegram) at the Employer’s address indicated in the invitation to bid. The Employer will respond to any request for clarification, which he received earlier than 15 days prior to the deadline for submission of bids. Copies of the Employer’s response will be forwarded to all employers of the bidding documents, including a description of the enquiry but without identifying its source.

7 AMENDEMENT OF BIDDING DOCUMENTS

7.1 Before the deadline for submission of bids, the Employer may modify the Bidding documents by issuing addenda will be posted in e-procurement platform.

7.2 Any addendum thus issued shall be part of the bidding documents and shall be uploaded in e-procurement platform in www.eprocurement.gov.in website.

7.3 To give prospective bidder reasonable time in which to take an addendum into account in preparing their bids, the Employer shall extend as necessary the deadline for submission of bids, in accordance with Sub-Clause 17.2.

C. PREPARATION OF BIDS

8. LANGUAGE OF THE BID

All documents relating to the bid shall be in the English language

9 DOCUMENTS COMPRISING THE BID

The bid submitted by bidder shall be of double packet comprising of the following:

(a) Technical Bid : Technical bid consists of bid security and qualification information.

(b) Price Bid : Price bid consists of the bid document.

10 (i) The Bidder shall fill in rates and prices for all items described in the schedule of Quantities. (ii) The rates and prices quoted by the bidder shall be fixed.

11. CURRENCIES OF BID AND PAYMENT

11.1 The unit rates and the prices shall be quoted by the bidder entirely in Indian Rupees.

12. BID VALIDITY

12.1 Bids shall remain valid for a period not less than 120 days after the deadline date of bid submission specified in Clause 17. A bid valid for a shorter period shall be rejected by the Employer as non-responsive.

12.2 In exceptional circumstances, prior to expiry of the original time limit, the Employer may request that the bidders may extend the period of validity for a specified additional period. The request and the bidder’s responses shall be made in writing or by cable. A bidder may refuse the request without forfeiting his bid security. A bidder agreeing to the request will not be required or permitted to modify his bid, but will be required to extend the validity of his bid security for a period of the extension, and in compliance with Clause 13 in all respects.

13. BID SECURITY

13.1 The Bidder shall furnish, as part of his Bid, a Bid security for an amount of 2% of ECV (Estimated Contract Value) as shown in Item (8), Annexure-1(b) for this particular work. This bid security shall be in favour of Accounts Officer/Expenditure / Circle Office / APEPDCL / Vizianagaram payable at Vizianagaram and may be in one of the following forms:

a. A bank guarantee issued by a nationalized / scheduled bank located in India in the form given in Annexure-5 OR b. Bank draft in favour of Accounts Officer/Expenditure / Circle Office / APEPDCL / Vizianagaram Payable at Vizianagaram drawn on any nationalized bank. 13.2 Bank guarantees (and other instruments having fixed validity) issued as surety for the bid shall be valid for the period of bid validity.

13.3 Any bid, not accompanied by an acceptable Bid Security and not secured as indicated in Sub-Clauses 13.1 and 13.2 above shall be rejected by the Employer as non-responsive.

13.4 The Bid Security of the unsuccessful bidder will be returned within 28 days of the end of the bid validity period specified in Sub-Clause 12.1.

13.5 The Bid Security of the Successful bidder will be discharged when the bidder has signed the Agreement and furnished the required Performance Security.

13.6 The Bid Security may be forfeited (a) If the Bidder withdraws the Bid after Bid opening during the period of Bid validity: (b) In the case of successful Bidder, if the Bidder fails within the specified time limit to (i) sign the Agreement or (ii) Furnish the required Performance Security.

14. ALTERNATIVE PROPOSALS BY BIDDERS

14.1 Bidder shall submit offers that comply exactly with the requirements of the bidding documents, including the basic technical design as indicated in the drawings and specifications. Alternative offers with any conditions will not be considered.

15. FORMAT AND SIGNING OF PRICE BID

15.1 The Bidder shall prepare one original and one copy of the documents comprising the bid as described in Clause 10.1 of these Instructions to Bidders.

15.2 The Bidder shall furnish information as described in the form of Bid on commissions or gratuities, if any, paid or to be paid to agents relating to the Bid and to contract execution if the Bidder is awarded the contract.

17. DEADLINE FOR SUBMISSION OF THE BIDS 17.1 In the event of the specified date for the submission of bids declared a holiday for the Employer, the Bids will be received up to the appointed time on the next working day.

17.2 The employer may extend the deadline for submission of bids by issuing an amendment in accordance with Clause 9, in which case all rights and obligations of the Employer and the bidder previously subject to the original deadline will then be subject to the new deadline.

E. BID OPENING AND EVALUATION

18. BID OPENING

The Employer will open all the Technical Bids received in time. In the event of the specified date of Bid opening being declared a holiday for the Employer, the Technical Bids will be opened at the appointed time and location on the next working day and evaluation of the Technical bid will be taken up.

19. PROCESS TO BE CONFIDENTIAL

Information relating to the examination, clarification, evaluation, and comparison of Bids and recommendations for the award of a contract shall not be disclosed to Bidders or any other persons not officially concerned with such process until the award to the successful Bidder has been announced. Any effort by a Bidder to influence the Employer’s processing of Bids or award decisions may result in the rejection of his Bid.

20. CLARIFICTION OF BIDS

20.1 To assist in the examination, evaluation, and comparison of Bids, the Employer may, at his discretion, ask any Bidder for clarification of his Bid, including breakdowns of unit rates. The request for clarification and the responses shall be in writing or by e-mail or by fax, but no change in the price or substance of the Bid shall be sought, offered, or permitted.

20.2 Subject to Sub-Clause 20.1, no Bidder shall contact the Employer on any matter relating to its bid from the time of the bidding opening to the time the contract is awarded. If the Bidder wishes to bring additional information to the notice of the Employer, he should do so in writing. 20.3 Any effort by the Bidder to influence the Employer in the Employer’s bid evaluation, bid comparison or contract award decisions may result in the rejection of the Bidder’s bid.

21 EXAMINATION OF BIDS AND DETERMINATION OF RESPONSIVENESS

21.1 Prior to the detailed evaluation of Bids, the Employer will determine whether each Bid (a) meets the eligibility criteria defined in Clause 3; (b) has been properly signed; (c) is accompanied by the required securities and; (d) is substantially responsive to the requirements of the Bidding documents.

21.1 A substantially responsive Bid is one which conforms to all the terms, conditions, and specifications of the Bidding documents, without material deviation or reservation. A material deviation or reservation is one (a) which affects in any substantial way the scope, quality, or performance of the Works (b) which limits in any substantial way, inconsistent with the Bidding documents, the Employer’s rights or the Bidder’s obligations under the Contract, or (c) whose rectification would affect unfairly the competitive position of other Bidders presenting substantially responsive Bids.

21.2 If a Bid is not substantially responsive, it will be rejected by the Employer, and may not subsequently be made responsive by correction or withdrawal of the non- confirming deviation or reservation.

21.3 Where the unit rates quoted by the bidder are absurd when compared to the market rates/purchase rates of APEPDCL, the bid will be treated as disqualified.

21.5 The bidder has to upload the breakup of taxes for the unit rates in the excel sheets attached to the document. In case of discrepancies between the unit rate in the Vayam Technology price bid format of e-tendering platform and in the excel sheet attachment, the rate quoted in the prescribed price bid format of e-procurement platform will be taken into consideration for evaluation of bids.

22 VALUATION AND COMPARISION OF BIDS

22.1 The Employer will evaluate and compare only the Bids determined to be substantially responsive in accordance with Clause 21.

22.2 The Employer reserves the right to accept or reject any variation, deviation, or alternative offer. Variation, deviations, and alternative offers and other factors which are in excess of the requirements of the Bidding documents or otherwise result in unsolicited benefits for the Employer shall not be taken into account in Bid evaluation.

22.3 If the Bid of the successful Bidder is seriously unbalanced in relation to the Engineer’s estimate of the cost of work to be performed under the contract, the Employer may require the Bidder to produce detailed price analysis for any or all items of the Bill of Quantities, to demonstrate the internal consistency of those prices with the construction methods and schedule proposed. After evaluation of the price analyses, the Employer may require that the amount of the performance security set forth in Clause 26 be increased at the expense of the successful Bidder to a level sufficient to protect the Employer against financial loss in the event of default of the successful Bidder under the Contract.

F. AWARD OF CONTRACT

23. AWARD CRITERIA

Subject to Clause 21 & 24, the Employer will award the Contract to the Bidder whose Bid has been determined to be substantially responsive to the Bidding documents and who has offered the lowest evaluated Bid Price, provided that such Bidder has been determined to be (a) eligible in accordance with the provisions of Clause 3, and (b) qualified in accordance with the provisions of Clause 4.

24. EMPLOYER’S RIGHT TO ACCEPT ANY BID TO REJECT ANY OR ALL BIDS

Notwithstanding Clause 23, the Employer reserves the right to accept or reject any Bid, and to cancel the Bidding process and reject all Bids, at any time prior to the award of Contract, without thereby incurring any liability to the affected Bidder or Bidders or any obligation to inform the affected Bidder or Bidders of the grounds for the Employer’s action.

25. NOTIFICATION OF AWARD AND SIGNING OF AGREEMENT

25.1 The Bidder whose Bid has been accepted will be notified of the award by the Employer prior to expiration of Bid validity period by writing or by e-mail or by fax by registered letter. This letter (hereinafter in the Conditions of Contract called the “Letter of Acceptance”) will state the sum that the Employer will pay the Contractor in consideration of the execution, completion, and maintenance of the works by the Contractor as prescribed by the Contract (hereinafter and in the Contract called the “Contract Price”).

25.2 The notification of award will constitute the formation of the Contract, subject only to the furnishing of a performance security in accordance with the provisions of Clause 26.

25.3 The Agreement will incorporate all agreements between the Employer and the successful Bidder. The agreement will be signed by the successful bidder and the employer within 28 days after receipt of the letter of acceptance (Notification of Award) by the successful Bidder.

26 PERFORMANCE SECURITY

26.1 Within 21 days of receipt of the Letter of Acceptance, the Successful Bidder shall deliver to the employer a Performance Security in any of the forms given below for an amount equivalent to 5% of the Contract price plus additional security for unbalanced Bids, Annexure-6, General Conditions of Contract: a bank guarantee in the form given in Annexure - 5; or Bank draft, in favour of Accounts Officer / Expenditure / Circle Office / APEPDCL / Vizianagaram payable at Vizianagaram drawn on any Nationalized / Scheduled bank.

26.2 If the performance security is provided by the successful Bidder in the form of a Bank Guarantee, it shall be issued either (a) at the Bidder’s option, by Nationalized/ Scheduled Indian Bank.

26.3 Failure of the successful Bidder to comply with the requirements of Sub-Clause 26.1 shall constitute sufficient grounds for cancellation of the award and forfeiture of the Bid Security.

27. CORRUPT OR FRAUDULENT PRACTICES.

27.1 Employer expects that Bidders/Suppliers/Contractors observe the highest standard of ethics during the procurement and execution of such contracts. In Pursuance of this policy, the Employer.

(a) Defines, for the purposes of this provision, the terms set forth below as follows: (i) “Corrupt practice” means the offering, giving, receiving or soliciting of anything of value to influence the action of a public official in the procurement process or in contract execution, and (ii) “Fraudulent practice” means a misrepresentation of facts in order to influence a procurement process or the execution of a contract to the detriment of the Employer, and includes collusive practice among Bidders (prior to or after bid submission) designed to establish bid prices at artificial non-competitive levels and to deprive the Employer of the benefits of free and open competition.

(b) Will reject a proposal for award if it is determined that the Bidder recommended for award has engaged in corrupt or fraudulent practices in competing for the contract in question.

(c) Will declare a firm ineligible, either indefinitely or for a stated period of time, if Employer at any time determines that the firm has engaged in corrupt or fraudulent practices in competing for, or in executing APEPDCL contract.

27.2 Furthermore, Bidders shall be aware of the provision stated of the General Conditions of Contract.

SUPERINTENDING ENGINEER CONTRACTOR OPERATION::VIZIANAGARAM

TERMS AND CONDITIONS

1. Bid Security : Each tender must pay as Bid security a sum of Rs.1,84,338/- (Rupees One lakh eighty four thousand three hundred thirty eight only) in the form of demand draft drawn in favour of Accounts Officer, Expenditure, Circle Office, Vizianagaram payable at Vizianagaram. In case of successful tenders the Bid security will be retained and adjusted towards Performance Security. Tenders not accompanied with full Bid security will be rejected summarily. The Bid security or Performance Security will not carry any interest.

2. The Bid security will be forfeited in the following cases . i) If the successful tenderer does not take possession of the Sub-station and start operations within stipulated time on issuing of the direction by the Filed Engineer of APEPDCL and further action will be taken to award the work to the other successful qualified Tenderer. ii) When the successful tenderers does not accept the order after issue of letter of intent/ acceptance letter iii) When the successful tenderer fails to furnish the performance security within specified period after issue of letter of intent/ acceptance letter iv) When the tenderer alters his prices or withdraws his offers during the validity period v) APEPDCL reserves the right to decide and award the work to the other successful qualified Tenderer in the exigency under (1) to (4).

3. ACCEPTANCE: It is not binding on the APEPDCL to accept the lowest or any other tender. The Superintending Engineer, Operation Circle, Vizianagaram reserves the right for acceptance, rejection or cancellation of any particulars or any tenders without giving the reasons there of to the tenders. The successful tenderer will be asked to enter into an Agreement and commence the work without any delay. Failure to enter in to Agreement and take up the work before the due date fixed shall cause forfeit the Bid security paid.

*Tenders with less quoted amounts will be liable for out right rejection.

4. REJECTION OF TENDER : Superintending Engineer, Operation Circle, Vizianagaram reserves the right either to reject or cancel any of all the tenders without assigning any reasons thereof.

APEPDCL has got full powers to decide the tenders and is not bound to accept the lowest tender. APEPDCL also reserves the right to cancel or reject all or any of the Tender (s) without assigning any reason thereof and without being liable to refund the cost of Tender document there upon.

5. INCOME TAX CLEARANCE : Tenderer must also enclose the Income Tax clearance certificate issued by the appropriate Income Tax authority in the form prescribed therefore. The certificate will be valid for one year from the date of issue of all tenders submitted during the period. In the case of proprietary or partnership firm it will be necessary from each of the partner as the case may be furnished. If certificate had already been produced by the Tenderer during the calendar year in which the tender is made in respect of a previous occasion when the certificates was produced. No part of contract shall be altered /modified without written permission of the Superintending Engineer, Operation Circle, Vizianagaram or shall transfer be made by power of attorney authorizing other to receive payments on behalf of the contracts.

6. VALIDITY OF TENDER : The tender should be made valid for 120 days (one hundred and twenty days only) from the date of opening of tender. The period of validity shall be counted from the date of opening of the tender. The tenderers withdrawing the tender within the validity period shall forfeit the Bid Security.

7. UNSUCCESSFUL TENDERS : In case in un-successful tenderer the Bid Security will be authorised for refund by Superintending Engineer, Operation Circle, Vizianagaram only after finalization of the tender.

8. PERFORMANCE SECURITY : On intimation of acceptance of the tender the successful tenderer shall pay the balance amount deducting the Bid Security towards additional performance security deposit which amounts to 5% of total tender cost in the form of DD/Bank Guarantee and attend the office of the Superintending Engineer, Operation Circle, Vizianagaram during the office working hours for signing the agreement on a stamped paper Rs.100/- (Rupees one hundred only) (to be borne by the tenderer) and other relevant documents. In case of failure to comply with the above, the Superintending Engineer, Operation Circle, Vizianagaram reserves the right to forfeit the Bid Security and rejection of Offer of such tenderer. Tenderers shall follow carefully the instructions pertaining to terms and conditions of the Standard LS agreement form and all other relevant documents before tendering.

9. TERMINATION OF THE CONTRACT: If in view of the Superintending Engineer, Operation Circle, Vizianagaram during the period of Contract, if the performance is not being satisfactory as per the terms and conditions of the contract, the Superintending Engineer, Operation Circle, Vizianagaram reserves the right to terminate the contract and recover the extra expenditure and loss if any incurred by the APEPDCL due to such termination and carrying out the work either departmentally, or by other agency. The Superintending Engineer, Operation Circle, Vizianagaram shall terminate the agreement by giving 7 days (seven days) notice in writing. If the contractor fails to execute the contract either in full or if the conduct of the contractor or any of the persons employed by him and working on behalf of the contractor is such that in opinion of Superintending Engineer, Operation Circle, Vizianagaram is undesirable to continue the contract. The Superintending Engineer, Operation Circle, Vizianagaram shall recover from the contractor any loss and or expenditure incurred by the APEPDCL to avoid any inconvenience caused out of such termination of the contract.

The contractor shall be responsible for any accident, damage caused to the property or personnel or any other person arising out of carelessness and negligence on the part of himself or his employees or his authorised agents during the period of Contract. The contractor is under an obligation to indemnify the Superintending Engineer / Operation / Vizianagaram to the cost of damages for such incidents. 10. DECLARATION OF RELATIONSHIP:

The tenderer shall declare their relationship, if any with the officers/ Directors of APEPDCL along with the Bids/ tenders. The bids not accompanying the above certificate will be rejected. The declaration must be furnished in the format given in the Annexure-I, any false information furnished in the declaration/ disclosure, if found later the contract is liable for termination as well as recovery of damages.

11. AGREEMENT (a) The successful Tenderer should enter into an Agreement on Non-Judicial stamped paper of value specified by the APEPDCL with in 15 days after receipt of letter of intent failing which his Offer will be rejected and the Bid security shall be forfeited.

(c) The period of Contract shall be 2years and further extension shall be at the sole discretion of APEPDCL.

12. RATES:

The approved rates are firm and are inclusive of VAT and all other taxes, duties and other legally possible duties and levies wherever applicable. The payment of Wages to the manpower engaged by the agency and consequent statutory EPF, ESI etc. shall be made by the agency in accordance with the applicable law from time to time.

13.Terms of Payment:

13.1 Payment to the agency for the work done shall be made on monthly basis and generally with in 15 days from the date of submission of bill and Satisfactory Performance Certificates (SPCs) issued.

13.2 No interest will be paid for late payments in case of delay in Administrative procedures.

13.3 The agency shall pay the Service tax and all other taxes, duties and other legally possible duties and levies and other impositions levied under applicable law.

13.4 The payment of Wages to the manpower engaged by the agency and consequent statutory EPF, ESI etc. shall be made by the agency in accordance with the applicable law from time to time.

13.5 The ESI, Service Tax paid by the agency will be reimbursed on submission of original receipt of the same.

13.6 The EPF paid by the agency will be reimbursed on submission of proof of payment of the same for all the manpower deployed along with individual EPF Account numbers.

13.7 The agency shall intimate the EPF Code No. allotted by the P.F. Authorities to the Accounts Officer / Expenditure / Circle Office / APEPDCL / Vizianagaram

13.8 The proof of payment of EPF, ESI and Service Tax shall be submitted with the bill for the succeeding month invariably, failing which the bill of the succeeding month will not be admitted.

13.9 The payment to the manpower engaged by the agency shall be made through electronic transfer of funds to the respective bank accounts of each of the personnel and the proof of the same shall be furnished along with the succeeding month’s bill. If not the bill for the succeeding month will not be admitted.

13.10 The agency shall obtain Clearance certificate from the EPF authorities to the effect that agency has fully remitted the EPF contribution to the PF authorities and complied with all the statutory obligations under the EPF and Misc. Act.1952 and shall submit the same along with the bill for the last month of the agreement, failing which last month bill and deposits will not be released. This includes handing over of EPF slips to the persons employed. 14. PENALTY

Operation & Maintenance of Sub-stations have to be carried out effectively and efficiently. Any lapse will attract a penalty to an extent of 5 % of Contract value at the discretion of DE (Operation) concerned and recoverable in the monthly bills.

15. STATUTORY RULES, ACT & REGULATIONS.

The sole responsibility against all claims which are arising out of this contract by anybody including the personnel employed by him rests with the Contractor only. 16 Force Majeure

16.1 Force Majeure is herein defined as any cause which is beyond the control of the Agency or the owner/Purchaser, as the case may be, which they could not foresee or with a reasonable amount of diligence could not have been foreseen and which substantially affect the performance of the contract, such as: 1. Acts of God, natural calamities, including but not limited to floods, droughts, earthquakes and epidemics; 2. Acts of any Government, domestic foreign, including but not limited to war, declared or undeclared priorities, quarantines, embargoes; 3. Acts of public enemy, accidents and disruptions including but not limited to fires, explosions, breakdowns of essential machinery or equipment. 4. Transportation delay due to force Majeure accidents. 5. Strikes lockouts and sabotages; 6. Riots and civil commotions ;

Provided the Agency shall within fifteen (15) days from the occurrence of such a cause notify the other in writing of such causes.

17 Compliance with labour regulations:

17.1 During continuance of the Contract, the agency shall abide at all times by all existing labour enactments and rules made there under, regulations, notifications and bye laws including all statutory amendments and reenactments of the State or Central Government or local authority and any other labour law (including rules), regulations, byelaws that may be passed or notification that may be issued under any labour law in future either by the State or the Central Government or the local authority and related acts passed from time to time and also applicable Labour Regulations, Insurance and other benefits. 17.2 The agency shall keep the APEPDCL indemnified in case any action is taken against the APEPDCL by the competent authority on account of contravention of any of the provisions of any Act or rules made there under, regulations or notifications including amendments. 18. The rates and prices quoted by the tenderer while submitting the tender shall be firm till the Contract is completed.

19. The Tenderer has to enclose the following documents along with Tender.

a) An attested copy of valid ‘A’ Grade 33KV Electrical License issued by Electrical Inspectorate b) Solvency Certificate issued by Bank/ Revenue authority or Sales Tax Clearance Certificate. c) If the Tenderer is a partnership concern, an attested copy of partnership deed and From ‘C’ Certificate or certified copy of Form ‘A’ showing all the names of partners obtained from the Registrar of Firms. d) Credentials of similar nature of work undertaken previously, if any e) Postal Address and telephone numbers. The name & postal address shall exactly match with the name & address as mentioned in the ‘A’ Grade Electrical Certificate. f) Copy of E.P.F Account No. allotted by the concerned authority. g) Annual Turn Over of the company shall be minimum of Rs.50Lakhs duly certified by Chartered Accountant h) Copy of Valid Labour License, i) Copy of Service tax registration j) Documentary evidence of past experience

20. The Tenderer has to obtain necessary license and competency certificate from the Electrical Inspectorate to handle the lines, equipment by the workers employed by him. The Contractor shall employ technically qualified persons with a minimum of ITI (Electrician/Wireman) qualification.

21. The Contractor is responsible for any accident caused to the personnel and damage to equipment during the period of contract. The contractor is personally and legally responsible for the loss sustained by APEPDCL due to damage to equipment. The Contractor shall reimburse the APEPDC Ltd, the cost of damages, in regard to equipment provided at 33/11 KV Sub-station for any damage caused due to mal-operation or any lapse on the part of contractor.

22. The Contractor has to make Insurance coverage of accidents that may arise while carrying out the Operation and Maintenance activities of the Sub-station.

23. The Contractor should acquaint himself towards the safety rules, regulations, and prevailing instructions of the Company, from time to time and follow all Statutory Rules, Acts and Regulations that are applicable and necessary for carrying out the Operation and Maintenance activities of the Sub-stations.

24. The Contractor shall be responsible for payment of compensation in case of accident while carrying out the Operation and Maintenance activities at Sub- station. The APEPDCL is in no way responsible of any of the accidents.

25. For any failure of implementing the statutory rules and Regulations by the Contractor the APEPDCL will be at liberty to recover such amounts from the bill or security deposits of the Contractor.

26. The Contract is liable for termination if the work is not carried out satisfactorily and not in accordance with Rules, regulations and prevailing instructions of the Company.

27. The Contractor shall note that in case of carrying out the work in the vicinity of equipment in service, care must be taken to avoid any accidents. If any work is to be done on any of the equipment, the Contractor shall ensure that such works will be carried out only after taking proper line clear. It may clearly be noted in no case the APEPDCL will be responsible for any accidents that may occur and for any compensation to be paid arising out of accidents.

28. No child labour should be employed

29. The Contractor is under an obligation to engage such personnel for carrying out Operation and Maintenance activities of the Sub-station such as breakers, isolators, issuing of line clear, etc,. At times the department Engineer would test the Contractor personnel about their competency level of O&M operations.

30. The personnel engaged by the Contractor shall be courteous, obedient and sincere to the APEPDCL Engineers while discharging the duties entrusted to them. In case of any misbehavior by any of the Person engaged, the Contractor shall take full responsibility in replacing the concerned with a suitable trained person.

31. The Contractor shall maintain at all times the premises clean and neat to have better appearance of the Sub- station and watering of the plants from withering away and also removal of grass rooting etc., from the SS yard and also watering regularly to earth pits also. The contractor is responsible for the loss of material, equipment of the department available within the premises of the substation. The contractor has to perform the shift duties in accordance with the labour rules.

32. All disputes arising out of this contract should be decided in the courts situated in the District jurisdiction only.

33 The contractor will be provided with some important safety appliances by APEPDCL and shall ensure safety measures to follow in attending the work by the personnel of Contractor.

34. The Performance of the Contractor will be reviewed by Divisional Engineer and Superintending Engineer per every three months or earlier and if found unsatisfactory the agreement will be terminated with a notice of 7 days.

35. At the end of the every month the contractor shall give the following reports for which the formats will be given from time to time by APEPDCL.

1) Maximum/ Minimum voltage during the months will date and time on 33 KV/ 11 KV 2) Maximum/Minimum load in each feeder during the month with date and time on 33 KV/ 11KV. 3) Unbalanced load noticed on 11 KV feeders, if any 4) Break downs on 11 KV Feeders during the months 5) Momentary trippings in the month 6) Any other reports in vogue

SUPERINTENDING ENGINEER CONTRACTOR OPERATION::VIZIANAGARAM

SCOPE OF WORK The following works are to be carried out by the Contractor in the Sub- station during the period of contract.

Responsibility of the Contractor :

1) The sub-station is to be maintained round the clock with qualified person through out the period of Contract.

2) Such candidates engaged by the Contractor should be minimum ITI (Electrician/ Wireman) qualified and properly trained to meet the working conditions/operations of Sub-stations.

3) The contractor should provide ID Cards to all his work men. 4) The Sub-station shall be maintained as per ISO 9001:2000 standards.

5) It is the sole responsibility of the Contractor to comply to the provisions/rules of Contract Labour Act/G.Os/Notifications etc.,/ Commissioner of Labour/Relevant Authority applicable to this contract from time to time and APEPDCL is not at all responsible for any dispute arising out of non compliance of the contractor to the above.

6) The following are the rules to be adopted by bidder for the computation of salaries of the staff mentioned in the tender document:

a. EPF @12% subjected to a maximum of Rs.780/- b. EPF Administrative Charges @1.61% subjected to a maximum of Rs.105/- c. GIS is as per actuals paid by the firm/agency and on production of proof of payment subjected to a maximum of 2% of the basic salary of the contract employee. d. Gratuity @4.11% of the basic pay (15 days salary for every year). e. Bidder commission on the basic salary of the staff. f. Service tax @12.36% on Gross salary (Base Salary + EPF + Administrative Charges + GIS + Gratuity + Bidders Service Charges). 7) All persons employed for this work contract shall be insured invariably. 8) For any violation of operational emergencies by the operators in Sub- Stations the contractors will be held responsible. 9) For any mal operation of equipment causing damages to the equipment the contractor is liable to pay the cost of the damages. 10) In case of violation of R&C measures the loss incurred by the company due to excess over supply will be recovered from the contractor. 11) It is the responsibility of the contractor for payment of compensation/damages etc., in case the accidents caused to the persons on the duty and also to the persons affected due to mal operation by the operator in the substation.

12) The contractor shall ensure that the Operation & Maintenance work at all times shall be carried out under the supervision of ‘A’ Grade 33KV Electrical license holder as required under the conditions stipulated by Electrical Inspectorate.

Responsibility of the person in the Sub-station engaged by the Contractor:

1) Recording the hourly and at periodical interval readings as prescribed by the Divisional Electrical Engineer and record them in log book with timings.

2) Recording all trippings of breakers and other events occurred in the order of sequence correctly and note them in log book.

3) All operations are to be carried out correctly and accurately and are to be recorded in the log book.

4) Shall note all operations carried out correctly and accurately in log book. 5) Shall follow strictly operating instructions given by Divisional Electrical Engineer to carryout the operations like charging VCBs and other equipment, renewal of HG fuses issues of LC’s etc.

6) Must observe all safety precautions and ensure safety to men materials and the equipment during the contract period.

7) Must attend all emergencies that may arise during the contract period such as equipment failures, fire accidents, etc., shall acquaint with all operations such as isolating transformers and other equipment etc.,

8) Shall attend all telephone calls and issue messages promptly.

9) Shall politely and promptly answer the consumer calls.

10) Shall prepare daily reports in the prescribed Proforma in quadruplicate and submit to concerned section officers. The forms will be supplied by the Divisional Electrical Engineers.

11) Shall be responsible for the security /safeguarding the equipment and other materials kept at the sub-station area.

12) Shall be held responsible for any damage occurred due to mal-operation and Non-operation of equipment and shall make good the loss suffered by the A.P.E.P.D.C.Ltd.,

13) Shall be alert and promptly attend all operations and events properly without any delay.

14) He shall give a report on Break downs and Momentary interruptions occurred on all 11 KV feeders in the month on 2 nd of every succeeding month duly furnishing Cause analysis of each and every interruption.

A part from the above, the contractor shall perform the following checks/special maintenance works during the contract period. 6) Check up operation of cooler fans and oil pump of PTR daily 7) Shall replace any loose terminations/jumpers at PTRs / Station Transformer under the supervision of concerned AE as and when required. Required material shall be procured by the contractor only 8) IR values shall be measured quarterly and shall be reported to the DE/O concerned. 9) Replacement of Silica Gel in breathers as and when required shall be carried out. 10) PTR oil Acidity, D.E Strength shall be measured quarterly and shall be reported to the DE/O B) 33/11 KV BREAKERS :

1. Checking of healthiness of trip circuits, SF6 Gas pressure, pneumatic and hydraulic pressures and its leakage if any daily. 2. Leakage of oil from CTs daily 3. Shall replace any loose terminations/jumpers when required under the supervision of concerned AE. Required material shall be procured by the contractor only

C) SWITCH YARD: 1. Checking the yard at hourly intervals and note down any unusual observations, defects, sparks, loose contacts, red hot spots and loose bolts and nuts etc, informing the concerned AAE/AE/ADE 2. Shall maintain the yard free from debris, grass etc., all the time 3. Required Yard Lighting shall be provided by the contractor all the time.

D) BATTERIES: 1) Taking specific gravity and voltage of pilot cells daily during morning shift and for all cells weekly once 2) Checking for DC earth leakage and Cleaning of battery cells weekly once 3) Topping up distilled water etc., for proper maintaining the batteries shall be carried out by the contractor.

E) EARTHPITS: 1. All the earth pits are to be watered daily 2. Earth Resistance shall be measured every month and prescribed Earth Resistance both individual/combined shall be maintained scrupulously and inform the concerned AE/Operation if the Earth Resistance is found beyond permissible limits.

F) A.B. Switches & H.G. Fuse Sets 1. Proper Operation of all A.B. Switches shall be ensured. 2. Specified gap between the horns shall be ensured and rated HG fuse shall be placed. 3. Any damaged parts shall be procured and replaced under the supervision of AE/Operation concerned

G) Insulators 1. Cleaning of insulators shall be carried out monthly and they shall be verified for any cracks 2. Defective insulators/failed insulators shall be replaced immediately.

H) Capacitor Banks In the occurrence of low power factor, the Capacitor banks shall be switched on/off, timely to maintain normal power factor.

I) GENERAL VISUAL CHECKS/ MAINTENANCE :

To be carried out in each shift, as per operating instructions given by the DE/Operation and as per check list enclosed herein

J) Any other minor works allotted by the concerned maintenance Engineer of APEPDCL at site

K) Submission of technical reports monthly in the proforma such as interruptions, maximum/. Minimum loads voltage etc. Shall report to the concerned AAE/AE and ADE on important occurrences of Breakdowns and Defects observed. The above works are to be done by contractor including submission of monthly report to Concerned AE/O. This does not constitute a part of special maintenance.

L) CONTROL ROOM : Surrounding of the control room and SS yard should be kept clean daily to have better appearance and gardening shall be done by proper watering etc., including ensuring the cleanliness of toilets.

MAINTENACE OF SUBSTATION: DAILY MAINTENANCE : The daily maintenance of the Sub-station has to be maintained as per the standards. The consumable required for maintenance shall be procured by the contractor.

Any other maintenance works or changes in the above schedule as per the directions of the Divisional Engineer/ Engineer at site of APEPDCL.

All replacement/maintenance works shall be carried out under the supervision of the AE/O concerned

The contractor shall ensure that Safety equipment/Consumables regarding Maintenance of Sub-stations be maintained at all times to meet the exigencies in the Substations.

Main Consumables list: AB Switch spares, HG fuse wire, Pad Clamps, insulators, Silica gel, petroleum jelly, Distilled water, all types of termination Clamps which are used in the Substation.

CHECK-LIST FOR SCOPE OF WORK

1. 33/11 KV Bus Voltages, Frequency and Station load. 2. Check for the healthy trip of all the breakers. 3. Check Battery voltages, D.C. Leakage, Charger conditions. Switch off the Charger and note down battery voltage. 4. Check whether the battery is in boost or Trickle charge condition. 5. Check the wireless and P&T phones for proper working and intimate incase of trouble to the concerned officer. 6. Check the annunciation panels. Press the lamp test and report the failure of lamps to maintenance wing 7. Check the load and amperage in all phases on each feeder. 8. Check the Power Transformer physically. Note the oil and winding temperatures, load and tap position, cooling fans condition and oil levels in the conservator, tap changer diverter switch, bushing and dehydrating breather. 9. Check the entire yard for any unusual sounds. 10.During night shift, check for sparking at joints/ jumpers. 11.Check for any sparking or flashover marks at the earth pit connections and intimate to the concerned Assistant Engineer/Operation 12.Check for proper watering of earth pits. 13.Check whether all the energy meters of the feeders are working or not, report to AE/O on any defect noticed. 14.Activate protection whenever L.C is issued on any feeder/transformer besides ensuring hand tripping. 15.Check the fire fighting appliances availability at assigned locations. 16.Ensure that all the relevant relays flags are in “RESET” position. 17.Note down the OLTC counter. 18.Whenever a feeder tripping occurs, contact the other end station and note down the relay indications. 19.To keep inform the concerned Assistant Engineer/Operation regarding tripping or breakdown or any other unusual observation.
