OGLETHORPE AVENUE SAVANNAH, GEORGIA 31401-3640 R E P LY T O March 30, 2012 ATT E NT IO N O F : PUBLIC NOTICE Savannah District 2012 Nationwide Permit Regional Conditions (RCs) On February 21, 2012, the U.S. Army Corps of Engineers (USACE) published the notice in the Federal Register (76 FR 9174) announcing the reissuance of 48 of the 49 existing Nationwide Permits (NWPs), general conditions, and definitions with some modifications. The USACE also issued two new NWPs, three new general conditions, and three new definitions. The NWPs will be effective on March 19, 2012, and will expire on March 18, 2017. On March 30, 2012, the USACE South Atlantic Division Commander approved Savannah District’s RCs (Encl 1). All uses of a NWP in Georgia must comply with all applicable NWP general conditions and RCs. The RCs are available at http://www.sas.usace.army.mil/regulatory/index.html. By letter dated March 12, 2012, (Encl 2), the Georgia Department of Natural Resources, Environmental Protection Division (Georgia EPD) issued a conditional Water Quality Certification for all of the NWPs, pursuant to Section 401 of the Clean Water Act. By letter dated March 13, 2012, (Encl 3), the Georgia Department of Natural Resources, Coastal Resources Division (Georgia CRD) concurred with the USACE’s Federal Consistency Determination for the NWPs pursuant to the Coastal Zone Management Act (CZMA). The Georgia CRD area includes Bryan, Brantley, Camden, Charlton, Chatham, Effingham, Glynn, Liberty, Long, McIntosh and Wayne Counties. Enclosed is an index of the final NWPs, general conditions and definitions (Encl 4).
