Organization of the CMI Comité Maritime International CONSTITUTION 20011 PART I - GENERAL Article 1 Name and Object The name of this organization is “Comité Maritime International.” It is a non-governmental not-for-profit international organization established in Antwerp in 1897, the object of which is to contribute by all appropriate means and activities to the unification of maritime law in all its aspects. To this end it shall promote the establishment of national associations of maritime law and shall co-operate with other international organizations. Article 2 Existence and Domicile The juridical personality of the Comité Maritime International is established under the law of Belgium of 25th October 1919, as later amended.

Drapeau' Ottawa The Canadian Charter ofRights and Freedoms recognizes the existence of the militaryjustice system and its own tribunals operating in parallel to the Canadian criminal law system. Yet, there continues to be an absolutepaucity of any reference works on military law and members of the Canadian military bar are seldom heard or read. This article aims atfilling the void, at least in part. In writing this article, the author, who servedfor 34 years in general staff and command positions in the Canadian Forces, had two general purposes in mind: a) to present the general reader with a general overview ofthe history, customs, organization, and structure ofthe military personnel system, and b) to provide a reference work presenting a detailed view ofthe Code ofMilitary Discipline, both in its contents and its workings. Finally, in light ofthe extensive changes in 1999 to the National Defence Act and the accompanying regulations, the author concludes by reviewing the nature and impact of each of the punishments that may be imposed by a military tribunal or the Court Martial Appeal Court ofCanada to those who are subject to the Code ofService Discipline. The Trial Judge also concluded that Easton induced a third party manufacturer, Les Chaussures Rock Forest Inc. (Rock Forest), to infringe the ‘953 Patent. INTRODUCTION: [1] Plavix is a very successful anti-coagulant drug which was developed, patented, and marketed by the appellant, Sanofi-Aventis (Sanofi). Apotex Inc. (Apotex), a well known manufacturer and distributor of generic drugs, attempted to create and market its own version of the active ingredient in Plavix, clopidogrel bisulfate (clopidogrel). It applied for a Notice of Compliance from the Minister of Health, alleging that its version of clopidogrel did not infringe Sanofi’s patent which, it alleged, was invalid in any event for a number of reasons, including obviousness. Sanofi responded by applying to the Federal Court for an order prohibiting the Minister from issuing the Notice of Compliance to Apotex.

Page: 2 [2] The applicant raised several issues which, for reasons described below, are not founded, such as: a. That the Board erred by imposing a penalty pursuant to subsection 83(2) of the Act , b. That it fettered its discretion by relying blindly upon the Compendium of Guidelines, Policies and Procedures [the Guidelines] and past Board decisions with respect to the offsetting of excess revenues in the context of subsection 83(2) of the Act . [3] It also argued that the Board had abused its power under subsection 83(2) of the Act by ignoring the evidence and the particular circumstances of its case and making findings that are based on pure speculation. It was agreed that these issues are to be reviewed on the reasonableness standard.

INTRODUCTION: [1] Plavix is a very successful anti-coagulant drug which was developed, patented, and marketed by the appellant, Sanofi-Aventis (Sanofi). Apotex Inc. (Apotex), a well known manufacturer and distributor of generic drugs, attempted to create and market its own version of the active ingredient in Plavix, clopidogrel bisulfate (clopidogrel). It applied for a Notice of Compliance from the Minister of Health, alleging that its version of clopidogrel did not infringe Sanofi’s patent which, it alleged, was invalid in any event for a number of reasons, including obviousness. Sanofi responded by applying to the Federal Court for an order prohibiting the Minister from issuing the Notice of Compliance to Apotex.
