S e m p a t m u n c u l w a c a n a perpanjangan jabatan Kapolri Jenderal Pol Badrodin Haiti yang a k a n p u r n a b a k t i pada akhir Juli 2016 mendatang, namun wacana pergantiannya sesuai jalur ‘normal’ juga kian mengemuka. Keputusan akhir apakah akan dilakukan perpanjangan masa pensiun Jenderal Pol Badrodin Haiti, atau menunjuk Kapolri baru, sepenuhnya berada di tangan Presiden Joko Widodo. Jika Presiden akhirnya memilih jalur normal – memperpanjang usia pensiun anggota Polri yang sedang menjabat sebagai Kapolri itu tidak ada presedennya, siapa calon Kapolri pengganti Badrodin Haiti? Menteri Koordinator Politik, Hukum, dan Keamanan Luhut Binsar Pandjaitan yang juga Ketua Komisi Kepolisian Nasional (Kompolnas), menyatakan paling lambat pada Juli 2016 Presiden sudah memutuskan tentang posisi Kapolri. Saat ini Presiden masih menunggu usulan nama calon dari Kompolnas maupun Dewan Jabatan dan Kepangkatan Tinggi (Wanjakti). Era Reformasi Setiap berbicara tentang calon Kapolri ideal, publik biasanya selalu ingat satu nama legendaris satu ini: Jenderal (Pol) Huegeng Iman Santoso. Kapolri era 1968-1971 ini dipandang sebagai pemimpin teladan karena ketegasan dan kesederhanaannya. Mencari sosok Kapolri seperti Hoegeng jelas tidak ada salahnya. Hingga kini problem atau kelemahan Polri sesungguhnya, setidaknya sebagian, masih sama seperti era Hoegeng dulu. Persoalan itu adalah citra buruk di masyarakat, oknum polisi penerima suap, dan berjarak dengan masyarakat yang seharusnya diayomi. Ta p i , m e n c a r i sosok seperti Hoegeng di era Polri sekarang ini jelas teramat sulit. Polisi yang sederhana tentu ada, misalnya Bripka Seladi, yang kini sedang jadi buah bibir di masyarakat karena kejujuran dan kesederhanaannya. Tapi, mencari petinggi Polri yang benar-benar hidup sederhana itu tidak mudah. Karena itu, dalam sebuah diskusi di sebuah televisi swasta, kami menyatakan tidak perlu figur seperti Hoegeng, seperempat Hoegeng saja sudah bisa membawa Polri ke arah lebih baik. Ukuran lain untuk mencari sosok Kapolri ideal adalah dengan melihat sosok Kapolri di era reformasi. Selain masih belum terlalu lama untuk ditelusuri rekam jejaknya, juga di era ini mulai berlakunya UU Nomor 2 Tahun 2002 tentang Polri. Di era reformasi ada enam kapolri. Yang pertama Jenderal (Pol) Da’i Bachtiar yang menjabat dari 29 November 2001 sampai 7 Juli 2005. Ia digantikan Jenderal (Pol) Sutanto yang menjabat dari 8 Juli 2005 sampai 30 September 2008. Kapolri selanjutnya Jenderal (Pol) Bambang Hendarso Danuri yang menjabat sampai 22 Oktober 2010. Kemudian, berturut-turut, Jenderal (Pol) Timur Pradopo (22 Oktober 2010-25 Oktober 2013), Jenderal (Pol) Sutarman (25 Oktober 2013-16 Januari 2015), dan Jenderal Pol Badrodin Haiti yang diangkat sebagai Plt Kapolri pada 16 Januari 2015 dan kemudian menjadi Kapolri pada 17 April 2015. Dari enam Kapolri tersebut, kami terlibat dalam seluruh proses uji kelayakan dan kepatutan yang dilakukan Komisi III DPR, kecuali untuk Da’i Bachtiar. Untuk uji kelayakan dan kepatutan terhadap Sutanto dan Bambang Hendarso Danuri, kami memimpin proses itu selaku Ketua Komisi III DPR. Sutanto memiliki visi-misi untuk menindak empat jenis kejahatan, yaitu kejahatan yang merugikan kekayaan negara (korupsi, illegal logging, illegal m i n i n g , p e n y e l u n d u p a n ) ; kejahatan yang berdampak luas terhadap masyarakat (judi dan narkoba); kejahatan yang meresahkan masyarakat (kejahatan jalanan dan kejahatan oleh kawanan bandit); dan segala pelanggaran lalu lintas yang mengakibatkan kecelakaan lalu lintas, ketidaktertiban dan kemacetan. K a p o l r i s e l a n j u t n y a , Bambang Hendarso Danuri lebih menekankan pada keberlanjutan program atau meneruskan visi-misi Sutanto. Ia ingin menampilkan wajah Polri yang tegas dan humanis. Timur Pradopo memaparkan visi dan misi yang tertuang dalam 10 program prioritas. Dua program yang menjadi prioritas utama adalah pengungkapan kasus-kasus yang paling menonjol dan pemberantasan preman, narkoba, illegal mining, dan illegal logging. S e d a n g k a n S u t a r m a n memiliki visi mewujudkan polisi sebagai pelayan, sahabat dan penegak hukum yang jujur, adil serta transparan dalam menjaga pembangunan nasional. Ia memiliki visi, antara lain, meningkatkan intregasi Polri dan bebas korupsi, kolusi, dan nepotisme (KKN); meningkatkan k e a m a n a n d a n k e t e r t i b a n masyarakat (kamtibmas), dan meningkatkan profesionalisme Polri dalam pengamanan. Kapolri saat ini, Badrodin Haiti, memiliki visi pemantapan soliditas, profesionalisme Polri yang berkualitas, mandiri dan bergotong royong. Sedang misinya, antara lain, pemantapan soliditas dengan pemantapan keorganisasian. Ia juga memfokuskan pemberantasan dan pencegahan korupsi akan difokuskan di internal Polri. Selain lima calon Kapolri di atas, kami juga melakukan uji kelayakan dan kepatutan terhadap Komjen (Pol) Budi Gunawan. Ia memiliki visi mewujudkan karakter Polri yang bagus dan berbasis Gotong Royong. Salah satu misinya memperkuat sumber daya manusia di institusi Polri untuk memberantas korupsi dan terorisme. Komisi III DPR secara bulat menyetujui Budi Gunawan sebagai Kapolri karena melihatnya sebagai sosok yang tegas. Tapi, sebagaimana diketahui, Presiden memutuskan untuk tidak melantiknya karena terjadi polemik di tengah masyarakat. Dari pengamatan kami, visi dan misi calon Kapolri itu bagus-bagus, tapi kelemahannya adalah dalam implementasinya. Maka yang kita bisa lakukan adalah melihat jejak rekam para calon Kapolri. Dari jejak rekam bisa dilihat konsistensi antara pernyataan dan realisasi dan pernyataan itu. Dari lima Kapolri yang kami ikuti uji kelayakan dan kepatutannya, Sutanto termasuk yang menonjol kinerjanya. Mantan Kepala Pelaksana Harian Badan Narkotika Nasional ini cukup berhasil melaksanakan visimisinya. Ia dikenal tegas dan tidak kenal kompromi dalam memberantas perjudian, premanisme, dan narkoba. Jadi, kalau mencari sosok seperti Hoegeng terlalu sulit, sosok yang mendekati Sutanto bisa jadi pilihan. Calon Kapolri Saat ini belum ada nama resmi calon Kapolri. Tapi, merujuk UU Nomor 2 Tahun 2002 tentang Polri yang menyebutkan calon Kapolri adalah perwira tinggi Polri yang masih aktif dengan memperhatikan jenjang kepangkatan dan karier, bisa dilihat siapa saja perwira tinggi Polri yang memiliki peluang untuk dicalonkan sebagai orang nomor satu di jajaran baju coklat ini. Dilihat dari kepangkatan, para perwira tinggi berpangkat komisaris jenderal (komjen pol) bisa menjadi calon Kapolri. Saat ini ada sembilan jabatan di lingkungan Mabes Polri dan di luar struktural yang diisi para jenderal bintang tiga. Kesembilan jabatan itu adalah Wakil Kapolri Komjen Pol Budi Gunawan, Inspektur Pengawasan Umum Komjen Pol Dwi Priyatno, Kepala Badan Pemeliharaan dan Keamanan (Kabaharkam) Komjen Pol Putut Eko Bayuseno, Kepala Badan Reserse Kriminal (Kabareskrim) Irjen Pol Ari Dono (akan menjadi bintang tiga sesuai jabatannya), Kepala Badan Intelijen dan Keamanan Polri (Kabaintelkam) Komjen Pol Noer Ali, Kepala Lembaga Pendidikan Kepolisian (Kalemdikpol) Polri Komjen Pol Syafruddin, Kepala Badan Nasional Narkotika (BNN) Komjen Pol Budi Waseso, Kepala Badan Nasional Penanggulangan Terorisme (BNPT) Komjen Pol Tito Karnavian, dan Sekretaris Utama Lembaga Ketahanan Nasional (Lemhanas) Komjen Pol Suhardi Alius. Calon Kapolri bisa dibilang sudah mengerucut ke dua nama, yakni Wakapolri Komjen Pol. Budi Gunawan dan Kepala BNN Komjen Pol. Budi Waseso. Indikatornya, dua nama itu kerap menghiasi pemberitaan di media massa lantaran sepak terjang dan pro kontra yang menyertainya. Dan, di antara para calon Kapolri, Budi Gunawan memiliki posisi khusus. Ia pernah menjalani uji kelayakan dan kepatutan di Komisi III DPR RI dan disetujui dengan suara bulat. Siapa yang akan dipilih Presiden? Kita tunggu saja. Reflections on the State of Elite Politics in Indonesia By Max Lane* EXECUTIVE SUMMARY • President Widodo’s handling of the tensions between the Corruption Eradication Commission (KPK) and the National Police (Polri) was initially explained in terms of his lack of independence from the parties that nominated him for the Presidency, in particular, the Indonesian Democratic Party – Struggle (PDIP). • One response to this has been the re-affirmation of support for him by the bloc of non- party relawan organisations, which served as encouragement for him to be more independent. • This response also briefly provoked public comment on the prospect of Widodo eventually forming a party of his own, which Puan Maharani, a PDIP leader and daughter of Megawati Sukarnoputri, noted both that it was his right but that as a PDIP cadre he would not do. • Tactical realpolitik issues make the formation of a Jokowi party in the near term unlikely. The Commission for the Disappeared and Victims of Violence (KontraS) and Asia Justice and Rights (AJAR) submit this report for the Universal Periodic Review (UPR) of Indonesia that will take place in May 2017. 2. KontraS is a national human rights non-governmental organization based in Jakarta, Indonesia. Its main activities are geared towards support for the victims of human rights violations. It seeks to improve respect and protection for human rights within Indonesia through advocacy, investigations, campaigns, and lobbying activities. KontraS monitors several issues such as enforced disappearances, torture, impunity, and violations of civil, political, economic, social, and cultural rights. 3. Working together with partner organizations in these countries, AJAR strives to build cultures based on accountability, justice, and a willingness to learn from the root causes of mass human rights violations to help prevent the recurrgence of state-sanctioned human rights violations. 4. KontraS and AJAR have evaluated the implementation of recommendations made to Indonesia during its previous UPR in 2012, in particular recomendations related to impunity in Indonesia. Jokowi yang bukan berasal dari elit politik dan bukan ketua partai politik tampak tidak mampu melawan kepentingan oligarki dan elit politik yang mendukungnya. Akhirnya Jokowi menempatkan Budi Gunawan sebagai Wakapolri walaupun telah ditetapkan sebagai tersangka oleh KPK dan membiarkan kriminalisasi KPK terus berjalan. Pemberantasan korupsi sesungguhnya adalah perang melawan kepentingan korup yang ada di kekuasaan. Korupsi tidak bisa diberantas mengandalkan orang baik. Di dalam struktur politik, orang baik sesungguhnya tidak ada. Jokowi dan siapa pun yang memegang kekuasaan menjadi 269 “orang baik” karena keberhasilan gerakan anti korupsi memaksa mereka untuk menjadi orang baik dengan memberantas korupsi. Terpilihnya Jokowi sebagai Presiden yang didukung oleh aktivis anti- korupsi bukan keberhasilan gerakan anti-korupsi, justru awal bagi pemberantasan korupsi di medan politik yang berbeda.     BAB I PENDAHULUAN A. Latar Belakang Negara Kesatuan Republik Indonesia menganut Sistem Pemerintahan Presidensial sejak dari awal kemerdekaannya. Berdasarkan UUD 1945, kedudukan kepala negara dan kepala pemerintahan menyatu dalam jabatan Presiden, dengan demikian Presiden memimpin penyelenggaraan pemerintahan sehari-hari.1Pada Sistem Pemerintahan Presidensial, tidak terdapat pembedaan atau tidak perlu diadakannya pembedaan antara Presiden selaku kedudukan Kepala Negara dan Presiden selaku kepala pemerintahan.2 Kekuasaan pemerintah yang ada di Presiden atau yang disebut dengan Kekuasaan Eksekutif merupakan konsekuensi atas dianutnya Sistem Pemerintahan Presidensial oleh Undang-Undang Dasar 1945 sebagaimana yang diatur dalam Pasal 4 (1) UUD 1945. Sistem ketatanegaraan menurut Undang- Undang Dasar 1945 memberi pengaturan yang dominan terhadap kekuasaan pemerintahan negara. Bab III Undang-Undang Dasar 1945 menyebut istilah „Kekuasaan Pemerintahan Negara‟, meliputi Pasal 4 sampai Pasal 163. Pasal 4 ayat 1 secara tegas menyebut bahwa „Presiden Republik Indonesia memegang kekuasaan pemerintahan menurut Undang-Undang Dasar‟. Ayat 2 nya menyebutkan bahwa “dalam melakukan kewajibannya Presiden dibantu oleh Satu Wakil Presiden”.     The Political Influence of the Military Before and After Democratic Transition: Experiences from Indonesia – An Assessment on Myanmar Benjamin H. Beets A dissertation submitted to Victoria University of Wellington in partial fulfilment of the requirements for the degree of Master in Strategic Studies Victoria University of Wellington 2015 2 ABSTRACT Historically, the Indonesian National Armed Forces (TNI) and Myanmar’s Armed Forces (Tatmadaw) held tremendous levels of domestic political influence. Following independence in the 1940s, both countries experienced a short and unstable democratic period. Largely due to the weakness of civilian institutions, and the special place of the TNI and the Tatmadaw in society, both militaries became the most dominant political actors in their respective countries. In 1998, President Suharto’s government fell, which instigated a period of political reform whereby the TNI removed itself from the political realm. It would seem as if democratisation has seen the TNI lose significant political clout. However, is it this simple? Does democratisation mean a total loss of political influence for the military? This paper seeks to understand to what extent the TNI lost political influence in the democratic era and whether similar developments are likely for Myanmar’s Tatmadaw. To answer this question, this paper will review literature on influence, democracy and civil- military relations in order to produce a thematic framework of indicators that can be used for further analysis on the TNI and the Tatmadaw. Once a framework has been laid, this paper will investigate the Indonesian experience, focusing on pre-democracy (1945-1998), before shifting to see how influential the TNI is in the democratic era (1998-2015).
