Service Level Agreement between the Borough Council of and Wellingborough Norse Ltd February 2012

This schedule details those services currently carried out by the Borough Council of Wellingborough that will transfer to the Wellingborough Norse partnership. It sets out the objectives of the services, the scope of services to be covered and the current council arrangements to deliver those services. It details the minimum performance indicators and standards that will need to be met.

1 Objectives of the Service Wellingborough Norse will work in partnership with the Borough Council of Wellingborough to deliver services currently carried out by the Council covering the areas of environmental services and facilities management. The overall objective will be to maintain or improve service for the same or lower cost whilst developing business growth.

Together the partnership will work to:  Comply with the Council’s statutory duties in relation to the areas covered in the agreement as a minimum, and to a higher standard where illustrated in this agreement.  Maintain the Council’s parks and open spaces to provide a clean and safe place for people to work, live and play.  Maintain the Council’s operational buildings and land to provide a clean and safe place for people to work, live and play.  Ensure that the Council’s interests are represented in discussions with outside bodies to further enhance and develop services delivered in the Borough and the wider surrounding area, be it at county or regional level.  Maintain agreed levels of performance in the service areas.

Scope of the Services This agreement will cover the services currently carried out by the ‘environmental’ and ‘facilities management’ sections of the council, broadly covering the following aspects of service:  Waste management and recycling  Fleet management  Grounds maintenance o Maintenance of parks and open spaces o Trees o Cemeteries and churchyards  Street cleansing  Public toilets  Operation of the town centre marketplace  Car parks  Winter gritting operations  Public halls  Use of parks and parks games  Environmental education and enforcement  Facilities management for operational properties and land and any such other services of a similar nature as the Council may be required to be carried out by law or Government directive. Any new services introduced by Wellingborough Norse would be in addition to this schedule. Any variation introduced will be in accordance with the provisions within the Service Agreement.

Contract Monitoring and Review The service area has several contracts for specific services which are delivered on behalf of the Council. It will be the responsibility of the partnership to ensure that these contracts are appropriate and delivered to agreed standards.

2 Policy considerations Where the Borough Council of Wellingborough has an existing policy setting out tasks or service standards, this is to be used by the Wellingborough Norse partnership as a standard. Similarly, where statutory duties are in force, it is assumed that the partnership will act to comply with those duties as a minimum requirement. Such requirements therefore, are not detailed separately in this schedule. Any future policy changes by the Council would need to be considered though the Wellingborough Norse liaison board to consider how they would be implemented on a practical basis. Practical input on policy writing and review may be required from the Wellingborough Norse management team.

Service Standards In addition to statutory requirements, Wellingborough Norse will, as a minimum, carry out duties to a level incorporating agreed maintenance schedules and inspection regimes.

Performance Indicators Performance indicators for 2012/13 are included within this schedule. They include quality measures such as complaints data as well as indicators covering the numerical data. These measures are likely to be varied from time to time as indicated in Section 10 of the Service Agreement. Performance is currently reported to the Council’s Overview and Scrutiny Committee.

Representation and Partnerships The Borough Council of Wellingborough sits on a number of bodies and partnerships with a view to enhancing services. Where these partnerships cover the services to be transferred to the management of Wellingborough Norse, it is expected that a Wellingborough Norse employee of the appropriate level will continue to represent the interests of the Borough. This would also apply to new partnerships and discussion forums, should they cover relevant services.

Representation of the service will be expected to continue at partnership contract progress meetings, such as those for outsourced services for leisure in relation to environmental services and facilities management. The practice of a manager attending Borough Council of Wellingborough committee meetings, business planning events and management meetings is to continue where attendance is appropriate and relevant to the services provided through the partnership . Emergency Planning In the event of the Borough Council of Wellingborough being required to input into a local or national emergency planning situation, people, plant, equipment and buildings will be deployed as necessary as directed through the Emergency Plan.

Section 106 Planning gain The service input into initial responses regarding Section 106 agreements covering a variety of services eg household waste management, grounds maintenance, play area provision and maintenance and tree provision. As the agreements mature, employees give practical advice and assistance to Borough officers and parish colleagues and ensure good practice in procurement and maintenance regimes eg surface improvements for play area.

3 The Service Specification

Waste management and recycling

Overview The Council has a duty to arrange for the collection of household waste in its area. This is currently undertaken by an alternate week collection of household waste and recycling from all households in the borough using wheeled bins.

Garden waste is collected from households from March to October.

Bulky household collections are also arranged on request through this function and there is a third party contract in place to collect clinical waste from a number of households.

The waste collection service is carried out in line with the BCW policy and includes sections on:  Side rubbish  Assisted collection  Requests for larger or additional household bins  Removal of unauthorised bins  Charging policy for replacement bins  Removing garden waste from residual waste  Missed waste collection bins  Contamination or unwanted material in bins

Description of Main Duties:  Average 49,500 wheeled bins emptied each week from approx 33,200 households., including 616 assisted collections  28,000 tonnes of household waste collected, including 10,500 tonnes of recyclable and compostable waste  Arrangements made for the replacement and or repair of wheeled bins – approx 1600 per annum  Arrangements made with developers to supply appropriate bins and collect household waste from areas of new housing  Arrangements made for the collection of bulky household goods on request, including transferring white goods to a recycling centre.- c. 4,000 visits per annum  Liaison with contractors providing a service to collect clinical waste and ‘sharps’ from pre-arranged addresses – collection frequency varies but averages 70 collections per week.

Performance Measures and Standards Based on the following areas:  Reduction in the number of missed bins / collection of missed bins within 1 day.  Increasing the percentage of waste recycled and composted  Complaints data (customer satisfaction)

4 Fleet Management

Overview The company will be responsible for the management of the fleet of vehicles operated currently by the Council to undertake its functions. The fleet is a mix of owned and leased vehicles and includes grounds maintenance plant and machinery as well as road vehicles.

The partnership will be responsible for the provision and maintenance of all Council vehicles – whether owned or leased - including those used by services not transferring to Wellingborough Norse. A current list of vehicles is included as a separate schedule. Wellingborough Norse will hold the Operator’s Licence and ensure that there is a suitably qualified CPC (Certificate of Professional Competence) holder on site.

Description of Main Duties  The purchase and disposal of vehicles and keeping of appropriate records  The operation and maintenance of vehicles in a roadworthy condition  Correct and accurate keeping of records in accordance with operating regulations  Ensuring that vehicle operators are properly trained and licensed  Ensuring that routine servicing is carried out by an approved contractor at appropriate intervals  Advice and guidance to other services within the Council regarding vehicle requirements and replacements, as well as driver requirements.  Look after fuel requirements by holding a small stock of oil and diesel at the Trafalgar House depot and monitoring fuel usage and spend at outside garages via fuel purchase cards

Performance Measures and Standards Based on the following areas:  Reduction in total vehicle ‘down time’  Reduction in vehicle damage/insurance claims  Operator Licence rating (red, amber, green)

Grounds Maintenance

Overview The Council is responsible for maintaining the amenity and the biodiversity of council owned land, including balancing the needs of recreation, economic land use and nature and landscape conservation. The service carries out the practical maintenance of these areas but is also responsible for several administrative booking and invoicing functions.

The types of land covered are the Borough Council’s current amenity land, retained housing land and NCC Highways land. These include general public open spaces, land linked to Council owned properties and other land including some cemeteries and churchyards.

5 The main duties are a mix of internal work and work that the Council is contracted to carry out on behalf of other organisations such as parish councils. The level of maintenance is dependent upon the land usage.

Description of Main Duties

Maintenance of parks and open spaces  Grass cutting of Borough Council amenity open space land in the towns of Wellingborough and (8-10 cuts each year between March and October, dependent on growing conditions with up to 15 in town centre areas)  Weed control on amenity open space as and when required  Winter maintenance ie shrub pruning and hedge cutting  Provision of summer bedding: ornamental bedding and hanging baskets (31 beds, 25,000 plants, 60 Hanging Baskets, 12 Mangers)  Carpet bedding; 10,000 plants  Provision of winter bedding and bulbs: (31 beds, 20,000 bulbs, 20,000 plants)  Maintenance between March and September of civic bowling greens located at: o Redwell Leisure Centre o Swanspool Gardens x2 o Finedon recreation ground  Maintenance and marking out of 9 football pitches on a weekly basis during the football season (Aug – April)  Maintenance and marking out of the cricket pitch at Redwell leisure centre  Maintenance of tennis courts and pitch & putt green at Swanspool Gardens.  Feathering of amenity trees  Grounds maintenance of closed churchyards  Grounds maintenance and cleansing of industrial estates (including tree works)  Grounds maintenance where agreed in BCW partner service delivery contracts – currently Waendel and Redwell Leisure Centres  Contracted work for others eg NCC Highways and parishes – as per current agreements listed in the schedule to the Service Agreement  Enhanced level of Highways verge mowing over and above the current NCC (up to 4 extra cuts per annum) contract  Highways weed control contractors arranged on behalf of NCC, May and August  Carry out inspections and basic maintenance and repairs to play area sites listed at Appendix 1 and keep proper inspection and maintenance records.

Trees The Borough Council owns a number of trees for which we hold responsibility. These are defined on a GIS system. The following tasks are undertaken:  Tree inspections in line with a 3-5 year programme  Recommendation of required safety works arising from the programmed inspection and liaison with contractors to carry out the necessary works  Dealing with and resolving complaints and queries relating to trees  Response to emergency tree reports  Provision of qualified specialist advice on behalf of the Borough Council of Wellingborough

6  Sourcing, delivery and planning of the mayoral tree each year in liaison with the Mayor’s secretary  Liaise with BCW colleagues and contractors to arrange transport and erection of Christmas trees in town centre There is also a current contract with NCC Highways dealing with highways trees in Wellingborough and Finedon, which is reviewed on an annual basis.

Cemeteries and churchyards The Borough Council owns or maintains open cemeteries that are managed in accordance with the Council’s Cemetery Rules and Regulations. They are based at: Doddington Road, Wellingborough Cobb’s Lane, Wollaston (maintained by Wollaston Parish Council but owned and paid for by the Borough Council) London Road, Wellingborough

The Council is also responsible for the grounds maintenance of closed churchyards at: St Mary’s Church, Grendon St Mary’s Church, St Mary’s Church, Finedon St Peter’s Church, All Saints’ Church, St Katharine’s Church, All Hallows, Wellingborough

These sites have a total area of 15.46 hectares.

The main tasks undertaken in relation to this service are:  The grounds maintenance of cemetery through grass cutting and weeding  The preparation of graves (digging, dressing, backfilling) and the subsequent maintenance by mowing in accordance with health and safety guidelines  The overseeing of burials, to ensure safety  The booking, invoicing and other administration relating to burials such as dealing with letters and deeds; maintenance of statutory burial records  Accessing and maintaining the database in relation to grave searches  The maintenance of the chapel at Doddington Road cemetery  Locking and unlocking of Doddington Road and London Road cemeteries, in accordance with byelaws.

Performance Measures and Standards Based on the following areas:  Maintaining the grass cutting frequency  Cutting grass to a standard commensurate with land usage  Adherence to the established Borough Council grounds maintenance regime  Reducing the number of complaints.

In addition, the service undertakes to inscribe names on war memorials.

7 Street Cleansing

Overview The Code of Practice for Litter and Refuse, issued under the Environmental Protection Act 1990, requires Principal Litter Authorities to categorise highways, and land for which they are responsible, into different zones according to intensity of use. The Code also sets out response times for each of these zones to restore local environmental standards for litter, etc, should they fall below prescribed standards of cleanliness. Cleansing schedules are designed to ensure that, as far as practicable, standards are maintained to an acceptable level.

In total the service is responsible for cleansing: 135 km of footways and 442 km of kerbside channels 1,032,365 m² of paved area (eg shopping precinct, car parks) 1,291,678m² of other areas

Description of Main Duties  Daily cleansing visit to all shopping precincts and school areas Monday – Friday  Daily cleansing of town centre and market areas, including weekends  Weekly cleanse of areas within the Borough Council of Wellingborough  Monthly cleanse of A roads (excluding A45)  Annual cleanse of A45  Mechanical road sweeping by rotation and area grade on all roads within the Borough with a kerbed channel  Mechanical footway sweeping and leaf clearance in autumn  The specialist removal of discarded hypodermic needles  Removal of offensive graffiti as soon as practicable, ideally within 24 hours  Removal of non-offensive graffiti on Council property as soon as practicable  Dealing with fly tipping notifications, appropriate removal and disposal and administration returns  Dealing with notification of abandoned vehicles, and appropriate removal.  The removal of dead horses abandoned on kerbsides or public open spaces.  Cleansing of routes connected to the Waendel Walk event before the event.

In addition the service deals with:  Assisting during the duration of the annual funfair visit (Bassets Park toilets)  Party in the Park cleansing  Adhoc community events that may require litter picking, sweeping or removal of collected litter offsite.  Guidance for community events eg litter picks by providing information on risk assessments, loan of litter pickers  Commercial work eg sweeping commercial customer site car park or provision of bins to charity events

Performance Measures and Standards Based on the following areas:  Performance against statutory grades of cleanliness  Time taken to remove flytipping  Percentage of abandoned vehicles removed within 24 hours

8 Public Toilets

Overview The Borough Council owns a number of public toilets in parks or town centre locations and is responsible for their upkeep and cleanliness. The town centre locations are attended.

Description of Main Duties  The opening and closing of toilets at allotted times  The cleansing and restocking of toilets  The maintenance of toilet blocks and interior fittings

Public toilets are located at the following locations:

Market Street, Wellingborough Ladies/ Gents/ Disabled Part attended – Open Monday to Saturday, 9am -5.30pm as a minimum

Swansgate Centre (multi-storey car park) Ladies/ Gents/ Disabled Part attended – Open Monday to Sunday as per the agreement with the Swansgate Centre to be open in line with the opening hours of the shopping centre

Swanspool Pavilion Ladies/ Gents Unattended – opened, closed and cleaned daily, opening hours in line with the park opening hours, but a minimum of 8am -4pm

The Embankment, Wellingborough Ladies/ Gents/ Disabled Unattended – opened, closed and cleaned daily, as a minimum 8am -4pm

Finedon Ladies/ Gents/ Disabled Closed due to repeat vandalism.

Bassetts Park, Wellingborough Ladies/ Gents Closed due to repeat vandalism. Remain closed unless event in park eg funfair

9 Operation of the Town Centre Market Place

Overview The Council works to ensure the operation of a thriving market place, in a safe, clean and welcoming environment. Traders are encouraged to take up stalls and a variety of trading is on offer to customers over the course of a week. Traders are encouraged to input into future plans and improvements concerning market issues. The market place is located in the town centre and has an on-site office for use by Council market employees. A general market takes place on Wednesday, Friday and Saturday, with a bric -a brac market on Tuesday Public opening hours are 9am-3pm but employee coverage is 6am – 4pm minimum, rising to 6am -6pm on Saturdays.

Description of Main Duties  Opening up of the market and the office  Initiation of information for billing of charges to stallholders  Control of unauthorised traders including enforcement of street trading regulations  Advice and guidance on operational aspects of market operations  Advice and guidance to potential stall holders  Liaising with colleagues regarding the cleanliness and maintenance of the market area.  Thorough cleansing of the market area and stalls on Thursday mornings

Winter gritting operations

Overview Winter gritting is the responsibility of the county council, however, in accordance with the Borough Council’s Snow Plan, operatives will be redeployed to clear snow if required from named priority areas.

Description of Main Duties  Clearance and gritting operations on Borough Council land, with particular emphasis on improving access to Council operational buildings and offices.  Priority 1 town centre footpaths are cleared as per the protocol agreement with County Council.

Car Parks

Overview The Council owns a multi-storey car park in the town centre adjacent to the Swansgate shopping Centre along with several smaller, surface car parks. These are detailed in the Council’s asset register. All tasks and actions undertaken are in compliance with the statutory car parking order governed by the Council. This order covers the control of off-street parking, including the Swansgate multi-storey car park.

Description of Main Duties  Regular cleaning of the multi-storey car park  Cleaning and maintenance of the lifts in the multi-storey car park  Emergency rescue cover in the event of persons trapped in the lifts in the multi- storey car park  Management of the multi-storey car park, including testing of alarms and overseeing maintenance contractors  Managing inappropriate behaviour or poor driving from the public within the car park  Day to day management and cleansing of surface car parks  Routine maintenance and minor repairs eg height barriers to car parks  Limited car park surface pothole repair, where resources allow.

Public Halls

Overview The Council owns a number of buildings that are available for public hire. These are:  Swanspool Pavilion, Swanspool Parade, Wellingborough  The Tithe Barn, Burystead Place, Wellingborough  Glamis Hall, Goldsmith Road, Wellingborough – available for public hire evenings and weekends only  Finedon Town Hall, Berry Green Road, Wellingborough

Glamis Hall is currently used by the Council during the day to run a day centre. The other buildings are available for hire during the day and for evenings, seven days a week. The Council is able to offer differing levels of caretaking support, depending on the needs of the hiring organisation or person and the type of event. The loft at the Tithe Barn will continue to be used by the Council for archive and equipment storage.

11 Description of Main Duties  Administration of hiring and booking of public halls, including noting requirements and collecting information to initiate invoicing of users.  Caretaking and security cover at a level agreed with the hirer including locking and unlocking  Setting out and packing away furniture and equipment,  Cleaning of halls, toilets and kitchens to a set schedule and after events  Stock control and replenishment  Dealing with health and safety considerations and routine maintenance  Assisting Council colleagues with transporting various equipment and furniture for events as and when required.

Use of Parks and Parks Games

Overview The Council has a variety of parks and open spaces that can be used under licence for events. In addition there are a range of park games available at Swanspool Gardens and summer amenities at The Embankment, including the Splash Pool.

Description of Main Duties  The daily locking and unlocking of Swanspool Gardens and toilets  Providing cover in the Summer Games office of Swanspool Gardens from 10am – dusk, May to September in relation to customers for bowls, tennis and putting.  Providing or organising cover for the Splash Pool during the summer season and cleaning and maintaining the pool in line with health and safety requirements  Monitoring the use of park facilities in relation to tennis, bowls and putting, taking bookings, collecting payments and reconciling records.  Liaison with charity contacts regarding risk site access and ensuring that gates are unlocked/locked and sites is left in a clean and tidy condition by users  Pre and post event inspection of park sites in relation to the annual funfair and other appropriate commercial ventures.

Environmental enforcement and education

Overview The Council has an important role to play through both education and enforcement in relation to environmental custodianship. It is recognised that education and enforcement are intrinsically linked and both play a part in raising environmental standards.

Description of Main Duties  Working with partners on initiatives designed to promote improved recycling rates, appropriate litter disposal, control of dog fouling, neighbourliness etc These messages are promoted through o Attendance at or supply of literature for community events o Awareness raising campaigns o School visits o Supporting community safety initiatives  Using warden patrols to raise public awareness of the consequences of actions  Issuing fixed penalty notices where appropriate for littering, dog fouling and other offences covered by the Council’s delegated statutory powers  Flytipping enforcements and prosecutions  Abandoned vehicle prosecutions  Waste enforcement, such as contaminated bins, side waste, bins left out etc

Facilities Management for Operational Land and Property

Overview The Council has a number of operational properties and land that require managing on a routine basis. Tasks are carried out either in-house or employees hire and oversee external contractors. There is a role as client contract liaison with currently outsourced leisure centres in terms of the Council’s contractual obligations regarding repairs and maintenance, including environmental maintenance.

Suggested or proposed capital projects or strategic investment will be referred to the Council’s Corporate Landlord via the Liaison Board in accordance with the Council’s timetable for approving new capital schemes.

Description of Main Duties – Council Town Centre Offices Tithe Barn Road office - ground floor and basement; Swanspool House and Annexe; 20 Sheep Street

All tasks to be carried out as per and to the frequency in the detailed schedule.  Clean public areas and arrange window cleaning  Clean employee offices, kitchens (including fridges and microwaves) and toilets  Empty bins and arrange for removal of rubbish and other general, recyclable and confidential waste.  Deal with coffee machines including restocking, reconciling and paying in of monies in line with audit requirements  Prepare rooms for meetings including microphone requirements and tidy up afterwards.  Lock and unlock buildings, check windows and set alarms  Collect and deliver newspapers and partake of post duties  Provide security for evening meetings  Wind clock, display silver, fly flags, display notices eg car park reservations  Test fire and emergency systems, carry out fire evacuation tests and ensure fire assessments are in place and reviewed as required.  Lifts in Tithe Barn Road offices: maintenance contracts reviewed and renewed, and arrangements put in place for caretakers/car park/market employees to provide rescue if required  Arrange laundry of tea towels, towels and tablecloths and recommend when replacements needed  Ensure that COSHH risk assessments related to operational facilities management are reviewed regularly, together with any safe systems of work instructions  Check that heating systems are working correctly, set timers, and switch on/off as agreed  Light furniture removals, between floors and buildings if necessary, including liaison with ICT (as lead service) for office moves  Review service contracts as required, including all statutory and safety testing, hygiene and maintenance contracts as listed in the current contract list.  Carry out meter readings and recording of energy use  Pay all bills associated with the properties: rates, energy, water etc. Recharge where necessary eg. leisure centres, Tithe Barn Road – NCC etc.  Review and renew contracts for supply of energy for main office buildings  Maintain and update Health and Safety records in accordance with statutory requirements, following the full review carried out in 2011/12  Liaise with tenants’ FM staff in shared buildings eg. Tithe Barn Road offices, Swanspool House and Finedon Town Hall  Clear paths, car parks and steps around the main offices after snow or ice

Description of Main Duties – operational land and property All tasks to be carried out as required, unless ongoing or at specified time intervals  Minor repairs and general building maintenance for all operational buildings as per the schedule of the Service Agreement eg carpentry, plumbing, electrics, decorating etc  Ensure that all statutory testing is carried out as per schedule  Arrange value for money procurement of external services.  Place works orders (external suppliers) and check that they have been completed correctly, within budget and on time  Replace equipment in operational facilities (if obsolete or faulty) in accordance with the terms agreed with the occupier  Let and monitor contracts for works/services as appropriate and in accordance with contract procedure rules  Maintain and update Health and Safety records in accordance with statutory requirements, following the full review carried out in 2011/12  Prepare budgets for approval annually (capital and revenue)  Provide records of costs, analysed by building, to inform return on investment and service charges  Act as keyholder for all operational properties, with copy keys held at Swanspool House (updated as required).
