Proposed Civil Court Rules.Pdf FORWARD Having come into existence of our own High Court under section 25 of the Bihar Re-organisation Act 2000 the rules as framed by High Court Of Judicature At Patna for Jharkhand High Court and Civil Courts in the state continued to follow by implication of section 29 of the Bihar Re- organisation Act 2000 .The separate Rule for the Jharkhand High Court has already been framed but no separate rule for Civil Courts in the state of Jharkhand could have been framed. Though the existing Civil Court Rules (civil) and (criminal) are very exhaustive, but it was felt as need of the hour that amendment/improvement in aforesaid Rules has become necessary in view of the territorial division, amendment in C.P.C, Cr. P.C, Evidence Act, introduction of several new enactments, and General Letters of Jharkhand High Court etc. Earlier an endeavor was made in this regard. The Then Hon’ble The Acting Chief Justice, M. Y. Eqbal held a meeting with all the Principal District Judges and D J. Rank Officers on 02.07.2006, who actively participated and reiterated for several amendments in the existing Rules. Thereafter, a proposed draft was prepared under the able guidance of Hon’ble Mr. Justice R.R. Prasad, the team effort of Rajeev Kumar Sinha Assistant Registrar (Judicial) in compiling the rules, editing and proof by Chandra Mauleshwar Singh, the then Assistant Registrar is commendable. How ever the rules so framed could not see the light of the day. At the instance of E-committee of Hon’ble the Supreme Court to make the rules more litigant friendly and I.T compatible, a direction was given to the In-charge of the E-committee of the Hon’ble Court of Jharkhand, the then Hon'ble the Acting Chief Justice D. N. Patel to constituted a committee whereafter under the chairmanship of Hon'ble Mr. Justice Vikramaditya Prasad (Retired) was constituted. The 2 committee consisting of Sri Ravi Nath Verma, Director, Judicial Academy Jharkhand, Ranchi, Sri Ambuj Nath, the then Registrar (Administration), Sri Manoranjan Kavi, Coordinator, E-Courts Project, Sri Baxi Ayodhya Prasad, Advocate, Sri Biswajeet Mukherjee, Advocate and two local experts as guests considered the proposed draft earlier prepared under the able guidance of Hon’ble Mr. Justice R.R. Prasad. The committee after several sittings suggested necessary changes considering the amendment in various Acts, and advent of information and communication technology to make the rules simple and I.T. Compatible. The efforts of the members of the committee in suggesting amendments in existing rules are commendable. Last but not the least, the tireless effort of Sri Suraj of High Court of Jharkhand in typing the earlier proposed draft and the effort of Sri Panchanan Singh, Judicial Academy Jharkhand in typing the present amended proposed draft of Civil Court Rules are also appreciated. REPORTABLE IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION SPECIAL LEAVE PETITION (CRIMINAL) Nos. 6219-6220 OF 2012 Kamlesh Kumar & Ors. … Petitioners Versus The State of Jharkhand & Ors. … Respondents J U D G E M E N T H.L. GOKHALE, J These Special Leave Petitions (Criminal) seek to challenge the judgment and order dated 19.7.2012, whereby a Learned Single Judge of the Jharkhand High Court dismissed the two Writ Petitions bearing Nos. Writ Petition Nos.95 & 112 of 2003 filed by Shri Kamlesh Kumar and three others, all children of one Dr. K.M. Prasad who worked earlier as the Director of Animal Husbandry department in Government of Page 1 2 Bihar. They are being prosecuted under the provisions of Foreign Exchange Regulation Act, 1973 (in short FERA), and those cases have been transferred to the Special Judge hearing the Fodder scam cases. In the above referred Criminal Writ Petitions they had challenged the transfer of those cases to the Special Court by contending that the transfer order was bad on various grounds, the principal amongst them being that the State Government had no jurisdiction to authorise the Special Judge to try these cases under FERA. Those Criminal Writ Petitions have been rejected, and hence these Special Leave Petitions (Criminal) have been filed. Facts leading this Criminal Petition are as follows:- 2. The above referred Dr. K.M. Prasad, father of the petitioners, was working earlier as the Director of Animal Husbandry department, Government of Bihar. He is being prosecuted along with some others by the Central Bureau of Investigation (C.B.I.) in the Court of Special Judge at Ranchi for conspiracy to defraud the State Government to the extent of Rs.7,09,92,000/- during 1980-90 on the basis of fake Page 2 3 allotment letters purportedly issued by him for the purchase of medicines.

Justice delayed is Justice Denied Ref :- Lalu Prasad fodder scam conspiracy case in Supreme Court Lalu Prasad is prime accuse in fodder scam in which trial has been completed in 45 out of 52 cases in jharkhand . out of remaining 7 cases Lalu Prasad is accuse in 5 cases. Till now above 950 persons including 2 former ministers, one ex MLA and ex mp have been convicted with 5 to 10 years and fine of Rs.10 lakhs. Lalu Prasad is deliberately delaying the completion of trial in the cases against him by various means including approaching superior courts with truffling complains, not making appearance of his witnesses, making his advocates absent time and again. Now when arguments has been completed on behalf of other 44 accused persons and also of himself mr Lalu Prasad is trying that the CBI special judge be removed and prohibited from delivering the judgement for which he has already announced the date in case no. RC 20 A. When the special CBI court judge announced that he would pronounce judgement on 15 July 2013 Lalu Prasad approached Jharkhand High court to transfer this case from the court of the judge on the plea that the judge is a close relative of Mr. P K Shahi, a cabinet minister in Nitish Kumar Govt., who was defeated by the candidate of his party in the parliament bye election a few months back. Hence the judge will be influenced by Mr. Shahi to defeat him in the court and hence pass judgement against him in this case.
