Statutory Document No, 537106 rHE ROAD RACES ACT 1982 RALTY ISLE OF MAN ORDER 2006 Coming into Operation: 6 July 2006 In exercise of the powers conferred on the Depaftment of Transport by Sections 1 and 2 of the Road Races Act 19821, and of all other enabling powers, the following Order is hereby made:- Introductory 1. Citation and commencement This Order may be cited as the Rally Isle of Man Order 2006 and shall come into operation on 6 July 2006. 2. Interpretation (1) In this Order :- "the Act" means the Road Races Act 1982; "the Clerk of the Course" means the individual designated as Clerk of the Course by the promoter and includes any deputy or assistant Clerk of the Course so designated; "Castletown Grandstand area" means the portion of road set out and described in Schedule 3; "closure period" means any period during which an authorisation under Afticle 3 and A¡ticle 11 are in force in relation to the Course or any part of the Course; references to a constable shall be construed in accordance with section 3 of the Act (appointment of marshals); "the Course" means the roads specified in Schedule 1; "the Depaftment" means the Depaftment of Transport; "the promoter" means Rally Isle of Man Ltd.; "rally days" and "rally periods" are as specified in Schedule 1; "the senior police officer" means a member of the Isle of Man Constabulary of the rank of sergeant or above who is authorised by the Chief Constable to act as senior police officer under this Order; 'L982 c.L4 Price: €1.70 Price Code: A for the As respects any part of the Course, the Rally-_period shall be treated as completed (Z) prominent of th¡s ordei when (and only when) an official motor vehicle displaying in a àrrpor., passed along that part of the Course in iorition a notice with the words "Roads open" has accordance with Afticle 6. Exemptions from Afticle 4 (1) Article 4(a) does not apply to the following persons - (a) the Clerk of the Course; (b) persons appointed by the Clerk of the Course as officials for the purpose of the rally; (c) constables; (d) persons lawfully taking part in the rally and their attendants; (e) media representatives and photographers approved by the promoter and bearing an official badge or armlet issued by the promoter; (D any other person authorised in writing by the Department or the Chief Constable. (2) Afticle 4(b) does not apply to the following vehicles - (a) vehicles approved by the Clerk of the Course or the senior police officer for the conveyance of persons mentioned in paragraph (lxb), (c) and (e); (b) motor-cars engaged in the rally' 6. Use of the Course for a motor car rally The Course may be used for a motor car rally on the 3 August, 4 August and 5 August 2006 and during the hours specified in relation to the respective section or until that part of the rally on each partic-ular section of tf'e Course shall be officially notified as completed in accordance with Article 8, whichever shall be the earlier. 2 Administration 7. Publicity for cancellation etc. Where the senior police officer is notified of the cancellation of the rally or a section of the rally under Afticle 3(3), he shall take such measures as he considers appropriate to inform the public of the effect of it. I Notification of end of closure (1) At the end of each section of the rally for which an authorisation under Article 3 is in force - (a) the Clerk of the Course, or (b) the senior police officer after consulting the Clerk of the Course, shall arrange for a motor vehicle, marked as mentioned in Afticle 2(2), to travel that section of the Course. 9. Erection of barriers and signs (1) The promoter shall ensure that barriers, diversion signs and closure signs are erected and maintained on all roads leading on to the Course immediately before, or as soon as possible after, the beginning of every closure period, and in any event before the relevant paft of the Course is used for the rally. (2) The barriers referred to in paragraph (1) shall consist of - (a) tubular steel structures supplied by the Depaftment with suitable signs attached, in any case where the Depaftment so directs; or (b) High Visibility Traffic Tape across the road at the junction and again at a suitable point of advanced warning but no fufther than the 150 metres referred to under GENEML in Schedule 1, (3) All barriers and signs should comply as a minimum with the requirements of the General Regulations as prescribed by the Motor Spotts Association under whose permit and insurance this event is running. Where appropriate an Advance Warning Notice shall be posted at a suitable point on roads leading to the Closed Road. These notices are to be in place for at least one full week before the closure comes into effect, 10. Areas prohibited to the public On the days and during the hours specified in Schedule 1 or until that part of the rally on that particular section shall be officially notified as completed in accordance with Afticle 8, whichever shall be the earlier, no pedestrian or other traffic other than persons authorised under Article 5 shall be permitted on the following areas of land and indicated by notices bearing the words 'Prohibited Areas':- Sections: 7 &2t Greenwood Cottage, Curragh Road and adjacent land, Ballaugh Curraghs. J Sections: 6. 11, 19,29 Road; the The triangular area of land surrounding Brandywell Cottage, abutting on the Druidale area on the inside of the junctions oi tt'l" Brandywell and Druidale Roads, opposite Brandywell Cottage. Sections: 5 & 23 The forecourt of Eairy Filling Station together with its boundary walls and adjoining land. Sections: 10 & 17 The area of land at the Foxdale side of the junctions of the Shoulder and Glen Rushen Roads. 11. Supplementary road closures (a) Pit Road Area, Douglas the period The pit Road area as defined in Schedule 2 will be used in connection with the rally during from 7.00 a.m. on Saturday 29 July 2006 until 5.00 p,m. on Sunday 6 August 2006 and will be closed to all unauthorised traffic between those hours' (b) Castletown Grandstand Area/Staft Ramp The Castletown Grandstand area as defined in Schedule 3 will be used in connection with the rally from the hour of 10,00 a.m. on Thursday 3 August 2006 until not later than midnight on Friday 4 August 2006 and will be closed to all unauthorised traffic between those hours. L2. Erection of stands The promoter may cause to be erected on the Castletown Grandstand area on the day and times in accordance with Article 11(b) stands or other apparatus for the accommodation,of spectators,. such stands to be erected and d¡smantled and removed within the specified Castletown Grandstand area closure period. 13. Charge of use of stands The promoter may make charges for use by spectators of stands and other facilities which may be provided. L4. Insurance The promoter shall secure insurance and indemnities against any claims or liability against the organisers, their officials, sponsors of the event and/or associated companies, any other organisation or person, or the Depaftment arising from the conduct, promotion and.management of the rally and entrants and drivers in respect of legal liability for death of or bodily injury to persons or damage to propefi following an accident arising out of the conduct, promotion and management of, and pafticipation in the rally to a limit of f30,000,000. 15. Restriction on breaking up the Course for road works paragraph 9(t) of Schedule 4 (The Road Works Code) to the Highways Act 1986 shall apply to the Courie from 6 July 2006 to the 5 August 2006 (inclusive)' 16. Notification of the making of the Order public notice of this Order shall be given by adveftisement in two or more Isle of Man Newspapers' ¿sI 1994/1519 4 SCHEDULE 1 PART I DAY 1 THURSDAY 3 AUGUST 2006 1. CORNM, MAUGHOLD, LEWAIGUE 5.50 P.M, - 9.50 P.M. The C27 Cornaa Shore Road from its junction with the A2 Douglas to Ramsey Road to its junction with the D23 Rhenab Road. The Rhenab Road from its junction with the Cornaa Shore Road at the ford to its junction with the 415 Maughold Road, The Maughold Road from its junction with the Rhenab Road to its southern junction with the D26 Quakers Road, The Quakers Road to its nofthern junction with the Maughold Road.
