WELCH, JIM FORREST, ) and STEPHEN TRAISTER, ) ) Defendants. ) __________ ) COMPLAINT Plaintiff David Flynn, by counsel and pursuant to 42 U.S.C. § 1983, brings this action against Defendants Michael J. Welch, Jim Forrest, and Stephen Traister for violating his First Amendment rights and seeks compensatory and punitive damages, attorneys' fees, and all other appropriate relief. JURISDICTION AND VENUE 1. The Court has jurisdiction of this lawsuit under 28 U.S.C. §§ 1331 and 1343(a)(3). 2. Venue is proper under 28 U.S.C. § 1391(b)(2). PARTIES 3. Plaintiff David Flynn is an individual and resident of the Commonwealth of Massachusetts. 4. Defendant Michael J. Welch is the Superintendent of the Dedham Public Schools. Defendant Jim Fonest is the Principal of Dedham High School. As principal, Fon-est may hire and fire athletic coaches at Dedham High School with prior approval by the superintendent. Gen. Laws ch. 71, § 59B (2018). 6. Defendant Stephen Traister is the Director of Athletics of Dedham High School. As athletic director, Traister oversees the day-to-day operations of Dedham High School's athletic teams and all athletic coaches report to him. 7. -

Guidance and counseling services at DHS are available to all students to assist in academic, college, career, and personal matters. Services are provided both in a planned, programmatic manner (developmental guidance program) as well as by request or referral. Parents/guardians are urged to consult with their student’s counselor at any time. They may do so by contacting the counselor directly for an appointment. Students are encouraged to schedule appointments with their counselor before or after school and during x-block. The transition from the middle school to ninth grade at the high school is facilitated by collaboration between the guidance department staff in both buildings. All ninth grade students enroll in a full program, including five academic subjects, health and physical education and an elective course(s). -

Franklin Public Schools Office of the Superintendent 355 East Central Street; Suite 3 Franklin, Massachusetts 02038 Phone: 508-553-4819 Superintendent’s Report to School Committee April 14, 2020 School Committee Meeting FHS Principal Search Update Process I would like to thank the Interview Committee, Chaired by Assistant Superintendent Lucas Giguere and Director of Human Resources Lisa Trainor, for their work in interviewing semi-finalists for the position of Franklin High School Principal. This committee was composed of teachers and staff, administrators, parents/guardians, students, and two School Committee members. They spent many hours interviewing candidates and deliberating. We are most grateful to their work. They have forwarded three names to me, which I am announcing tonight. The detailed biographies will not be read at the School Committee meeting but will be posted with this update. Mr. Rick Arena: Currently the Assistant Principal at Groton-Dunstable Regional High School(G-D), Rick Arena has served the students of those communities for most of his career. A graduate of Bowdoin College with a master’s from Simmons, he was a high school teacher for fifteen years, innovative travel and club advisor, coach, a Dean and an Assistant Principal. He has been involved in significant scheduling and curriculum changes, created and taught several courses and served as G-D’s first football and lacrosse coach. The one constant is his focus on having students place a high value on individual progress and the contributions they can make beyond the classroom. He has a lifetime record of serving the common good through organizations such as the Kidney Transplant/Dialysis Association, elected Town Meeting, Cub Scouts, youth sports and civic and social groups. -
