The Crisis in Libya
APRIL 2011 ISSUE BRIEF # 28 THE CRISIS IN LIBYA Ajish P Joy Introduction Libya, in the throes of a civil war, now represents the ugly facet of the much-hyped Arab Spring. The country, located in North Africa, shares its borders with the two leading Arab-Spring states, Egypt and Tunisia, along with Sudan, Tunisia, Chad, Niger and Algeria. It is also not too far from Europe. Italy lies to its north just across the Mediterranean. With an area of 1.8 million sq km, Libya is the fourth largest country in Africa, yet its population is only about 6.4 million, one of the lowest in the continent. Libya has nearly 42 billion barrels of oil in proven reserves, the ninth largest in the world. With a reasonably good per capita income of $14000, Libya also has the highest HDI (Human Development Index) in the African continent. However, Libya’s unemployment rate is high at 30 percent, taking some sheen off its economic credentials. Libya, a Roman colony for several centuries, was conquered by the Arab forces in AD 647 during the Caliphate of Utman bin Affan. Following this, Libya was ruled by the Abbasids and the Shite Fatimids till the Ottoman Empire asserted its control in 1551. Ottoman rule lasted for nearly four centuries ending with the Ottoman defeat in the Italian-Ottoman war. Consequently, Italy assumed control of Libya under the Treaty of 1 Lausanne (1912). The Italians ruled till their defeat in the Second World War. The Libyan constitution was enacted in 1949 and two years later under Mohammed Idris (who declared himself as Libya’s first King), Libya became an independent state. -

WINNERSdateline OF THE OVERSEAS PRESS CLUB AWARDS 2011 Wanting, Not Waiting 2012 Another Year of Uprisings SPECIAL EDITION dateline 2012 1 letter from the president ne year ago, at our last OPC Awards gala, paying tribute to two of our most courageous fallen heroes, I hardly imagined that I would be standing in the same position again with the identical burden. While last year, we faced the sad task of recognizing the lives and careers of two Oincomparable photographers, Tim Hetherington and Chris Hondros, this year our attention turns to two writers — The New York Times’ Anthony Shadid and Marie Colvin of The Sunday Times of London. While our focus then was on the horrors of Gadhafi’s Libya, it is now the Syria of Bashar al- Assad. All four of these giants of our profession gave their lives in the service of an ideal and a mission that we consider so vital to our way of life — a full, complete and objective understanding of a world that is so all too often contemptuous or ignorant of these values. Theirs are the same talents and accomplishments to which we pay tribute in each of our awards tonight — and that the Overseas Press Club represents every day throughout the year. For our mission, like theirs, does not stop as we file from this room. The OPC has moved resolutely into the digital age but our winners and their skills remain grounded in the most fundamental tenets expressed through words and pictures — unwavering objectivity, unceasing curiosity, vivid story- telling, thought-provoking commentary. -

Media in North Africa: the Case of Egypt 10 Lourdes Pullicino In May 2011, Freedom House issued a press release announcing the findings of a survey recording the state of media freedom worldwide. It reported that the number of people worldwide with access to free and independent media had declined to its lowest level in over a decade.1 The survey recorded a substantial deterioration in the Middle East and North Africa region. In this region, Egypt suffered the greatest set-back, slipping into the Not Free category in 2010 as a result of a severe crackdown preceding the November 2010 parliamentary elections. In Tunisia, traditional media were also censored and tightly controlled by government while internet restriction increased extensively in 2009 and 2010 as Tunisians sought to use it as an alternative field for public debate.2 Furthermore Libya was included in the report as one of the world’s worst ten countries where independent media are considered either non-existent or barely able to operate and where dissent is crushed through imprisonment, torture and other forms of repression.3 The United Nations Development Programme’s (UNDP) Arab Knowledge Report published in 2009 corroborates these findings and view the prospects of a dynamic, free space for freedom of thought and expression in Arab states as particularly dismal. 1 Freedom House, (2011): World Freedom Report, Press Release dated May 2, 2011. Libya: The ICC and Saif al-Islam Gaddafi Questions and Answers January 2012 The International Criminal Court (ICC) judges granted arrest warrants on June 27, 2011, for Muammar Gaddafi, his son Saif al-Islam, and former intelligence chief Abdullah Sanussi in an investigation authorized by United Nations Security Council Resolution 1970. The three were wanted on charges of crimes against humanity for their roles in attacks on civilians, including peaceful demonstrators, in Tripoli, Benghazi, Misrata, and other locations in Libya. Consistent with Resolution 1970, the ICC warrants apply only to events in Libya beginning on February 15, 2011. While the ICC's proceeding against Muammar Gaddafi was terminated following his death on October 20, anti-Gaddafi forces apprehended Saif al-Islam Gaddafi on November 19 in southern Libya and are holding him in the town of Zintan. While initial reports suggested that a militia also had captured Sanussi, his whereabouts remain unknown. Libya’s general prosecutor told Human Rights Watch on December 10: “Officially we don’t have him.” Following Saif al-Islam Gaddafi's apprehension in November, some representatives of Libya's transitional government and National Transitional Council (NTC) declared that he would be tried in Libya. The chairman of the NTC, the justice minister, and the general prosecutor subsequently reiterated this stance to Human Rights Watch. In December the ICC judges requested further information from the Libyan authorities regarding Saif al-Islam Gaddafi’s status, including whether and when Libya intends to surrender him to the court. Libya was supposed to provide that information by January 10, 2012, but it requested a three-week extension due to the security situation in Libya. -

The Egyptian revolution received widespread media coverage during the Arab Spring not only because of Egypt’s position as a main political hub in the Middle East and North Africa, but also because activists were using different forms of media to communicate the events of the movement to the world. While the Egyptian government employed numerous tactics to suppress the uprising’s roots online—including by shutting down internet connectivity, cutting off mobile communications, imprisoning dissenters, blocking media websites, confiscating newspapers, and disrupting satellite signals in a desperate measure to limit media coverage—online dissidents were able to evade government pressure and spread their cause through social- networking websites. This led many to label the Egyptian revolution the Facebook or Twitter Revolution. Since the introduction of the internet in 1993, the Egyptian government has invested in internet infrastructure as part of its strategy to boost the economy and create job opportunities. The Telecommunication Act was passed in 2003 to liberalize the private sector while keeping government supervision and control over information and communication technologies (ICTs) in place. -
