For law nerds and music lovers like us, the combo has got us Crazy In Love. Here’s the lowdown on two recent cases. In 2018, Jay-Z was caught up in a US$200M trade mark dispute with clothing company Iconix. Iconix commenced arbitration proceedings with the American Arbitration Association (AAA). Under the AAA rules for arbitrator appointment, the AAA selects a list of 10 arbitrators from it’s national roster and sends the list to the parties to attempt to agree on a single arbitrator. After reviewing the AAA’s list, Jay-Z noticed that there was only one African- American arbitrator candidate. Jay-Z decided to apply to the New York courts to stay the arbitration proceedings on the basis of public policy and the risk of unconscious bias. Damian Sturzaker Partner Unfortunately for Jay-Z the Court said that arbitration is a private right, in contrast to the public right to access to justice through the courts, and that the parties chose to draft the +612 8216 3066 AAA referral clause into their contract. In other words, Jay-Z should have consulted with the Email Damian AAA and decided whether he was happy with the diversity of it’s arbitrators before agreeing to the clause. The Court did grant a temporary stay, but ultimately the AAA was able to offer five African-American candidates and Jay-Z agreed for the arbitration to continue. Sadly for fans like us, the outcome of AAA arbitrations typically remain private so it’s unlikely we’ll get to weigh in on the final outcome. In 2019, Jay-Z is back knocking the hustle in the arbitration scene. This time the dispute concerns his online music service Tidal (co-owned by other artists including Beyoncé, Kanye West, Rihanna and Madonna). Norway’s economic crime body is pursuing a fraud investigation, claiming that Tidal manipulated streaming figures in Norway to get higher royalty payouts for certain artists. Tidal applied to the Supreme Court of Norway earlier this year to prevent its offices being searched but was unsuccessful. Tidal Poland has since notified the Norwegian government that it intends to commence international arbitration Daisy von Schoenberg proceedings against it, saying the government has expropriated its property and treated it Lawyer unfavourably as a Polish investment company. The purpose of the treaty is to Email Daisy encourage foreign investment between Poland and Norway, by making certain commitments to protect investor companies and to allow for the resolution of any disputes through uniform international arbitration rules. As hip-hop continues to become commercially viable, performances of Black masculinities can be easily found on magazine covers, television shows, and popular websites. How do these representations affect the collective consciousness of Black men, while helping to construct a particular brand of masculinity that plays into the White imagination? This theoretical article explores how representations of Black masculinity vary in underground versus mainstream hip-hop, stemming directly from White patriarchal ideals of manhood. Conceptual and theoretical analyses of songs from the likes of Jay-Z and Dead Prez and Imani Perry’s Prophets of the Hood help provide an understanding of the parallels between hip-hop performances/identities and Black masculinities. He released “Spiritual” after the extrajudicial killings of Alton Sterling and Philando Castile. Jay is featured on the remix of “All the Way Up” and teamed up with DJ Khaled and Future to create “I Got the Keys.” Back in April, Mr. Carter made a cameo on his wife’s Beyoncé’s visual album, Lemonade as a family man. The last time we saw the lyricist in full rap mode (e.g. album, singles and tour) was for Magna Carta Holy Grail in 2013. The promotional On The Run trailer for the married couple’s tour stars Jay-Z and Beyoncé as bank robbers à la Bonnie and Clyde, and features all kinds of guns, ski masks, shady figures, cop chases and a line-up. In 2014, I started to think about Jay’s past criminal life as a drug dealer, and his references to it on his records. I let the thing between my eyes analyze Jay’s skills, then put it down—type Braille...you feel me? Last month, the rapper narrated the New York Times Op-Ed: “The War on Drugs Is an Epic Fail.” I went back to my study of Jay-Z and his lyrics with a more critical eye.

The study was based on the structuralist theory of Roland Barthes which claims that many times a performer’s life experiences with class struggle are directly reflected in his artistic works. Since rap music is a counter-culture invention which was started by minorities in the South Bronx borough ofNew York over dissatisfaction with their community, it is a cultural phenomenon that fits into the category of economic and political class struggle. The study recorded and interpreted the lyrics of New York artists Shawn Carter (Jay Z), Nasir Jones (Nas), and southern artists Clifford Harris II (T.I.) and Wesley Weston (Lii’ Flip). The artists were selected on the basis of geographical spread and diversity. Although Hip-Hop was again founded in New York City, it has now spread to other parts of the United States and worldwide.
