I refer to your recent request for information which has been handled in accordance with the Freedom of Information (Scotland) Act 2002.

For ease of reference, your request is replicated below together with the response.

How many motorists have been caught speeding in the West area, broken down by month for 2018 and 2019, and town name. The total amount of money in fines issued to drivers in West Dunbartonshire for speeding offences, broken down by month for 2018 and 2019. What is the top speed someone has been caught driving in West Dunbartonshire in a) 20mph, b) 30mph, c) 40mph, d) 50mph, e) 60mph and f) 70mph zone, broken down by year for 2018 and 2019 and the street name. (I know the police force is Argyll and West Dunbartonshire but if it could be broken down to just West Dunbartonshire, that would be great, but if not, Argyll and West Dunbartonshire is fine).

It is necessary to respond to your request in terms of two different data sets:

Speeding detected by safety cameras

The information requested can be found at Appendix 1.

You should note however that in respect of fines, neither the Safety Camera Unit nor collect fine money and so section 17 of the Act, information not held, applies. It should also be noted that not all safety camera detected offences are ultimately issued with a fine or reported to the Procurator Fiscal.

Speeding detected by police officers - roadside detected

You will note that unlike the other crime statistics published, we are unable to provide any further location details due to the limitations of the systems used for recording road traffic offences. That means that to provide any further information - such as the locus and/ or the speed travelled - would require case by case assessment of the records associated

scotland.police.uk @PoliceScotland PoliceScotland OFFICIAL with each offence - an exercise which I estimate would far exceed the cost limit set out in the Fees Regulations given the numbers involved.

I therefore regret to inform you that I am unable to provide you with the information you have requested, as it would prove too costly to do so within the context of the fee regulations.

As you may be aware the current cost threshold is £600 and I estimate that it would cost well in excess of this amount to process your request.

As such, and in terms of Section 16(4) of the Freedom of Information (Scotland) Act 2002 where Section 12(1) of the Act (Excessive Cost of Compliance) has been applied, this represents a refusal notice for the information sought.

If you are dissatisfied with the way in which Police Scotland has dealt with your request, you are entitled, in the first instance, to request a review of our actions and decisions.

Should you wish to appeal against the Office of the Scottish Information Commissioner's decision, there is an appeal to the Court of Session on a point of law only.
