ABOUT THIS APPLICATION FORM

This form is for the purpose of making an application for a Waste Water Discharge Certificate of Authorisation under the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007) or for the review of an existing Waste Water Discharge Certificate of Authorisation.

The Application Form must be completed in accordance with the instructions and guidance provided in the Waste Water Discharge certificate of Authorisation Application Guidance Note. The Guidance Note gives an overview of Waste Water Certificates of Authorisation, outlines the certification application process (including the number of copies required) and speclfies the information to be submitted as part of the application. The Guidance Note and application form are available to download from the licensing page of the EPA’s website at www.epa.ie.

A valid application for a Waste Water Discharge Certificate of Authorisation must contain the information prescribed in the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007). Regulation 24 of the Regulations sets out the statutory requirements for information to accompany a Certificate of Authorisation application. The application form is designed in such a way as to set out these questions in a structured manner and not necessarily In the order presented in the Regulations. The procedure for making and processing of applications for waste water discharge Certificates of Authorisation, and for the processing of reviews of such Certificates, appears in the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007) and is summarised below. The application fees that shall accompany an application are listed in the Third Schedule to the Regulations.

An application for a Certificate of Authorisation must be submitted on the appropriate form (available from the Agency website - http://www.eDa.ie/whatwedo/licensina/wwda/) with the correct fee, and should contain relevant supporting documentation as attachments. The application should be based on responses to the form and include supporting written text and the appropriate use of tables and drawings. Where point source emissions occur, a system of unique reference numbers should be used to denote each discharge point. These should be simple, logical, and traceable throughout the application.

The application form is divided into a number of sections of related information. The purpose of these divisions is to facilitate both the applicant and the Agency in the provision of the information and its assessment. Please adhere to the format as set out in the application form and clearly number each section and associated attachment, if applicable, accordingly. Attachments should be clearly numbered, titled and paginated and must contain the required information as set out in the application form. Additional attachments may be included to supply any further information supporting the application. Any references made should be supported by a bibliography.

All questions should be answered. Where information is requested in the application form, which is not relevant to the particular application, the words "not applicable" should be clearly written on the form. abbreviation "N/A" should not be used. For inspection purposes only. Consent of copyright owner required for any other use. Additional information may need to be submitted beyond that which is explicitly requested on this form. Any references made should be supported by a bibliography. The Agency may request further information (under notices provided for in the Regulations) if it considers that its provision is material to the assessment of the application. Advice should be sought from the Agency where there is doubt about the type of information required or the level of detail.

Information supplied in this application, including supporting documentation will be put on public display and be open to inspection by any person.

Applicants should be aware that a contravention of the conditions of a waste water discharge Certificate of Authorisation is an offence under the Waste Water Discharge (Authorisation) Regulations, 2007.

The provision of information in an application for a waste water discharge Certificate of Authorisation which is false or misleading is an offence under Regulation 35 of the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007).

All drawings submitted should be titled and dated. All drawings should have a uniaue reference number and should be signed by a clearly identifiable person. All drawings should indicate a scale and the direction of north. All drawings should, generally, be to a scale of between 1:20 to 1:500, depending upon the degree of detail needed to be shown and the size of the facility. Drawings delineating the boundary can be to a smaller scale of between 1 :lo00 to 1 :10560, but must clearly and accurately present the required level of detail. Drawings showing the waste water treatment plant location, if such a plant exists, can be to a scale of between 1:50 000 to 1:126 720. All drawings should, however, be A3 or less and of an appropriate scale such that they are clearly legible. Provide legends on all drawings and maps as appropriate. In exceptional circumstances, where A3 is considered inadequate, a larger size may be requested by the Agency.

It should be noted that it will not be possible to process or determine the application until the required documents have been provided in sufficient detail and to a satisfactory standard.

Advice on completing this section is provided in the accompanying Guidance Note.

A non-technical summary of the application is to be included here. The summary should identify all environmental impacts of significance associated with the discharge of waste water associated with the waste water works. This description should also indicate, where applicable, the hours during which the waste water works is supervised or manned and days per week of this supervision.

Existing Waste Water Network

The housing scheme network and septic tank was constructed in the late 1970’s as part of the housing scheme contract to serve a population of 12.

Existing Treatment plants

The treatment plant comprises a horizontal flow-settling tank. The purpose of primary settlement tanks is to reduce the velocity of the incoming waste water stream thereby allowing the settleable solids to fall to the bottom of the tank. Typically 50-70% of suspended solids are removed in these tanks. The efficiency of the tank is dependant on a number of factors ie. The type of solids present, design criteria and sludge withdrawal from the tank.

Existing outfall

The effluent from the housing scheme discharges, via a 6” PVC pipeline, to a drain leading to the Glen River.

Storm Water Overflows There are no storm water overflows.

There is very little effective treatment of the waste water in the septic tank. Settlement of some solids, grit and heavier materials is all that can be achieved.

The WWTP inspected by the Housing Department and desludged when necessary. Waste sludge is transported to Donegal Town Sludge Hub for treatment. The Housing Department is also responsible for maintenance of the network.

Proposals for future upgrade GledCarrigart housing scheme is not listed on any development programme at present. The treated effluent from the network discharges to a drain, which leads to the Glen River.

C.1 Operational Information Requirements Provide a description of the plant, process and design capacity for the areas of the waste water works where discharges occur, to include a copy of such plans, drawings or maps (site plans and location maps, process flow diagrams) and such other particulars, reports and supporting documentation as are necessary to describe all aspects of the area of the waste water works discharging to the aquatic environment, Maps and drawings must be no larger than A3 size.

Appropriate treatment is defined as a treatment process, which after discharge allows the receiving waters to meet relevant quality objectives and the relevant provisions of the wastewater directive and of other community directives.

Article 6 assessments are required under the Habitats Directive (92/43/EEC), and are required where a plan or project may give rise to significant effects upon a Natura 2000 site. Natura 2000 sites are those identified as sites of Community importance designated under the Habitats Directive (Special Areas of Conservation, here after referred to as SACS) or the Birds Directive (Special Protection Areas, here after referred to as SPAS). In the case of the present assessment, Ramsar sites are also included by way of best practice. It is important to note that the phrase ‘Appropriate Assessment’ is sometimes used more loosely to refer to the whole process set out under Articles 6(3) and 6(4) of the Habitats Directive (Dodd et al., 2008), and therefore note that for the present assessment the term ‘Article 6 assessment’ will be used, not ‘Appropriate Assessment’ (which refers to Stage 2 in the sequence under Article 6 assessment).

Guidance on Strategic Environmental Assessment (SEA) produced by the EPA (EPA, 2008) provides a useful definition of Article 6 assessments (referred to as appropriate assessment in that document) (EPA, 2008): “An assessment based on best scientific knowledge, of the potential impacts of the plan on the conservation objectives of any Natura 2000 site (including Natura 2000 sites not situated in the area encompassed by the draj? plan or scheme) and the development, where necessary, of mitigation or avoidance measures to preclude negative efsects”. It is a protection led assessment and is carried out using the precautionary principle.

The assessment of the present proposal for licensing the Waste Water Discharge at Glen Carrigart Housing Scheme concluded the following:

The screening process has been undertaken to identify the qualifying interests and potential impacts arising from the Glen Carrigart Housing Scheme Wastewater treatment plant.

The process has shown that there are no negative effects on the Natura 2000 site arising from the discharges from the Glen Carrigart Housing Scheme agglomeration. It is unlikely that there will be ‘in combination’ negative effects from any other additional plans or developments in the catchment.

EPA Export 02-07-2011:03:48:38 Introduction

Article 6 is one of the most important articles of the Habitats Directive in determining the relationship between conservation and site use. Article 6(3) requires that “Any plan or project not directly connected with or necessary to the conservation of a site but likely to have a signifcant efSect thereon, either individually or in combination with other plans or projects, shall be subject to appropriate assessment of its implicationsfor the site in view of the site’s conservation objectives.” The purpose of this report is to describe how that Article 6 assessment was carried out, and also to detail the results and conclusions from the assessment.

Waste Water Discharge (Authorisation) Regulations

Local Authorities are required to carry out an Appropriate Assessment as per article 6 of the Habitats Directive (92/43/EEC (2000)) in relation to waste water authorisations pursuant to the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007). The specific objectives of the WWDA Regulations are contained within the regulations.

Article 6 Assessment

The Council Directive 92/43/EEC on the Conservation of Natural Habitats and of Wild Fauna and Flora better known as “The Habitats Directive” provides the framework for legal protection for habitats and species of European importance. Articles 3 to 9 provide the legislative means to protect habitats and species of Community interest through the establishment and conservation of a EU-wide network. The Habitats Directive and the Birds Directive and sites designated under them form this network of European protected sites that For inspection purposes only. Consent of copyright owner required for any other use. are better known as the Natura 2000 network. This consists of; Special Areas of Conservation (SACS) for flora, fauna and habitats of Community interest under the EU Habitats Directive;

Special Protection Areas (SPAS) for rare, vulnerable or migratory birds under the EU Birds Directive;

Sites that are being considered for designation as one of the above are referred to as cSAC (candidate) or pSPA (proposed).

Ramsar sites are wetlands of global importance, listed under the Convention on Wetlands of International Importance. Ramsar sites are contained within Natura 2000 sites and for that reason, and in line with best practice, Ramsar sites, if present would have been included in this assessment.

Article 6 sets out provisions, which govern the conservation and management of Natura 2000 sites. Article 6(3) and 6(4) of the Habitats Directive set out the decision-making tests for

EPA Export 02-07-2011:03:48:38 plans and projects likely to affect Natura 2000 sites. Article 6(3) establishes the requirement for Appropriate Assessment:

‘‘Any plan or project not directly connected with or necessary to the management of the [Natura 20001 site but likely to have a significant effect thereon, either individually or in combination with other plans and projects, shall be subjected to appropriate assessment of its implications for the site in view of the site’s conservation objectives. In light of the conclusions of the assessment of the implication for the site and subject to the provisions of paragraph 4, the competent national authorities shall agree to the plan or project only after having ascertained that it will not adversely affect the integrity of the site concerned and, if appropriate, after having obtained the opinion of the general public”

This assessment is underpinned by the precautionary principle, especially in the assessment of potential impacts and their resolution. If it is not possible to rule out a risk of harm on the evidence available then it is assumed a risk may exist and it needs to be dealt with in the appropriate assessment process.

Stages of the Article 6 assessment The stages of an Article 6 assessment are outlined in the European Commission Methodological Guidance on the provision of Article 6(3) and 6(4) of the ‘Habitats’ Directive 92/43/EEC (EC 2001) and the European Commission Guidance ‘Managing Natura 2000 Sites’. Stage 1 -Screening

Step 1: Management of the Site.

The project is a WWTP and therefore is not directly connected with or necessary for the management of the European sites involved.

Step 2: Description of Project and European Sites

Description of the Project A septic tank plant was installed in the 1979 to serve a p.e. of 12. It discharges into a marshy wetland area, which eventually drains into the Glen river. The Glen River discharges into Glen Lough.

European Natura 2000 Sites

The Glen River and Glen Lough are included in the Cloghernagore Bog and Glenveagh.Nationa1 Park SAC.-The Cloghernagore Bog and Glenveagh.Nationa1 Park SAC is an exceptionally large inland site located in the centre of northwest Donegal. It includes a rich diversity of habitats and landscape features, including mountains, exposed rock and scree, blanket bogs, dry, wet and alpine heath, upland grassland, wet grassland, rivers, lakes, scrub and woodland. The site is of great scientific and conservation value, particularly for the large areas of excellent, little damaged blanket bog it contains, including the largest intact area of blanket bog in northwest Ireland. It also includes good quality examples of semi- natural deciduous woodland, heath, oligotrophic lakes and inland cliffs. Other Discharges to Recieving Waters

There are no other discharges to the receiving waters

The potential impacts are on the quality status of the Glen River.

Cumulative, Direct, Indirect. Short& Long Term Effects

Given the low load factors involved and the attenuation available from the natural marshy wetland area no significant Cumulative, Direct, Indirect, Short& Long Term Effects are considered to be likely.

The load factors from the discharge of 12 pe, which is significantly attenuated by a natural marshy wetland area before entering the Glen River are extremely low hence the significance of the impact from this discharge is considered to be equally low

Other Policies, Plans or Pro-iects

There are no current proposals for further developments that would create discharges into receiving waters.

Conclusion

There are no Natura 2000 sites involved in the receiving waters of this discharge In conclusion the AA has determined that the discharges from the Glen Carrigart agglomeration will not adversely impact in any significant manner on the Natura 2000 site involved, the qualifying interests or conservation objectives.
