    Chapter 22: Response to Public Comments1 A. INTRODUCTION This chapter of the Final Environmental Impact Statement (FEIS) summarizes and responds to substantive comments received during the public comment period for the Belmont Park Redevelopment Civic and Land Use Improvement Project Draft Environmental Impact Statement (DEIS) and the draft General Project Plan (GPP), which were issued on December 6, 2018. The State Environmental Quality Review Act (SEQRA) requires a public hearing on the DEIS as part of the environmental review process. The New York State Urban Development Corporation Act (UDC Act) requires a public hearing on the GPP. The combined public hearing was held on January 8, 9, and 10, 2019, at Elmont Memorial Library, 700 Hempstead Turnpike, Elmont, NY 11003. The comment period remained open until 5:00 PM on March 1, 2019. A number of comments were submitted beyond the March 1 deadline, and were accepted and addressed by Empire State Development (ESD). Section B contains a summary of relevant comments on the DEIS and GPP, and a response to each. These summaries convey the substance of the comments made, but do not necessarily quote the comments verbatim. Comments are organized by subject matter and generally parallel the chapter structure of the EIS. Where more than one commenter expressed similar views, those comments have been grouped and addressed together. A list of organizations and individuals that provided comments relevant to the EIS can be found in Section C.     Chapter 17: Mitigation A. INTRODUCTION In the areas where significant adverse impacts are identified (transportation, and construction- period transportation and noise), mitigation measures to reduce or eliminate impacts to the maximum extent practicable are developed and evaluated. As described below, measures to further mitigate adverse impacts have been refined and evaluated between the Draft and Final Environmental Impact Statement (EIS). Therefore, this Final EIS (FEIS) includes additional measures and commitments on all practicable mitigation measures to be implemented in conjunction with the Proposed Actions. These measures are discussed below. Areas in which the Proposed Project would result in significant adverse impacts that cannot be fully mitigated are discussed in Chapter 18, “Unavoidable Adverse Impacts.” Of particular note, many members of the public and elected officials commented on the need for a new full-time Long Island Rail Road (LIRR) station to help mitigate transportation impacts identified in the DEIS by providing enhanced mass transit options to the Proposed Project. Following the public comment period, LIRR has determined that a new LIRR Elmont Station could be developed along the Main Line. Therefore, in coordination with ESD and the Applicant, LIRR has developed plans to construct in two phases a new LIRR Elmont Station adjacent to the North Lot. This LIRR Elmont Station is fully described and analyzed in this chapter. PRINCIPAL CONCLUSIONS TRANSPORTATION As discussed in Chapter 11, “Transportation,” the Proposed Project would result in significant adverse impacts on the local street network, the highway network, and bus service, as well as potential impacts to parking. Significant adverse impacts on LIRR service, pedestrian circulation and vehicular and pedestrian safety were not identified.

    STATE ENVIRONMENTAL QUALITY REVIEW FINDINGS STATEMENT BELMONT PARK REDEVELOPMENT CIVIC AND LAND USE IMPROVEMENT PROJECT THE LONG ISLAND POWER AUTHORITY The New York State Urban Development Corporation (“UDC”) d/b/a Empire State Development (“ESD”) was lead agency for the SEQRA review of the application for the Belmont Park Redevelopment Civic and Land Use Improvement Project (the “Proposed Action”). The Long Island Power Authority (“LIPA”) is an involved agency for the SEQRA review1. Per 6 CRR- NY 617.11(c), each involved agency must make its own Environmental Impact Statement (EIS) Findings for the Action that is the subject of the EIS. This document constitutes LIPA’s Findings Statement for the Proposed Action. Name of Action: Belmont Park Redevelopment Civic and Land Use Improvement Project Project Location: The proposed development encompasses approximately 43 acres of land located within Belmont Park in the unincorporated hamlet of Elmont, Town of Hempstead, Nassau County, New York. Site A is approximately 15 acres located north of Hempstead Turnpike, Site B is approximately 28 acres located south of Hempstead Turnpike (the “Project Sites”). Summary of Action: New York Belmont Partners, LLC (“NYBP” f/k/a New York Belmont Development Partners), an affiliate of New York Arena Partners (“NYAP”; NYAP and NYBP and its affiliates and sublessees collectively, “NYAP” or “the Applicant”), propose to construct a sports, hospitality, retail, and entertainment destination (the “Proposed Project”) at Belmont Park. The Project Sites are owned by the State of New York (the State) acting by and through the Franchise Oversight Board (FOB) and are leased through a ground lease (the “Ground Lease”) to The New York Racing Association, Inc.
