2.0 SUBJECT LAND AND LOCALITY

Subject Land

The subject land is described in Certificate of Title Volume 5686 Folio 73 as being Section 128 in Hundred Plan 441800 and is not subject to any easements or endorsements.

The subject land is a rectangular shaped allotment having a frontage to O’Halloran Street of approximately 225 metres, a depth of approximately 280 metres and an area of 6.30 hectares. The subject land and locality are shown within Figure 1 below.

The subject land is currently occupied by a range of sporting facilities and infrastructure and is utilised for football, netball, tennis and previously cricket. The subject land includes the Robe oval and a range of sporting facilities including a clubhouse, scoreboards, spectator shelters, light poles, netball courts, tennis courts, skate park and car parking areas. Vehicle access to the site is provided from O’Halloran Street located on the northern boundary of the subject land.

The subject land is relatively flat with a slight rise at the northern end up to the northern and north western boundaries. The site contains an area of dense native vegetation within the north western corner adjacent to the skate park along O’Halloran Street and a row of established pine trees along the southern boundary. There are some scattered trees along the Morphett Street boundary.

Locality

The locality consists of a mixture of residential development to the north of O’Halloran Street and a range of recreational and community uses to the south.

The residential development on the northern side of O’Halloran Street is a mixture of single and two storey detached dwellings, of a range of ages and styles. The dwellings

are generally set within well landscaped grounds and orientated to the south to overlook the sporting oval and adjacent golf course.

The residential land on the northern side of O’Halloran Street is generally higher than the lower lying recreational land to the south.

The recreational land on the southern side of O’Halloran Street includes the Robe Golf Course and clubroom, the subject land, Robe Cemetery, Ambulance Station and Country Fire Service headquarters.

Morphett Street on the eastern side of the subject land provides access to the Robe Golf Club and a limited number of residential properties to the south.

The subject land and adjoining recreational land are located within the Open Space Zone (Recreation Policy Area 4) as shown within Figure 2 below. The land to the north of O’Halloran Street is located within the Residential Character Zone and Historic Conservation Area.

2.0 PROPOSED DEVELOPMENT

The proposed development envisages the construction of a telecommunications facility on the north western corner of the Robe sports oval consisting of the following elements:

• 30-metre-high monopole; • panel antennas enclosed within a shroud at the top of the monopole; • 3 flood lights at a height of 16.5 metres; • bollards; and • 1 metre high access gate from Morphett Street.

The monopole is to be located approximately 12 metres from the eastern boundary (Morphett Street) and 90 metres from the northern boundary (O’Halloran Street). The proposed location has been pegged upon the land as shown within Figure 3 below.

No fencing or equipment compound is proposed with all equipment to be located within the base of the monopole.

It is understood that the applicant has negotiated the location of the proposed facility with the Robe Sports Club with the proposed flood lights upon the pole to be utilised by the Robe Football Club for training. It is further understood that all costs of the facility will be borne by the applicant with the rent from the lease of the land paid to the Sporting Clubs.

4.0 PUBLIC NOTIFICATION

The proposed development is a merit form of development within the Open Space Zone as a telecommunications facility/mobile phone tower is not contained within the list of complying or non-complying development within the zone. Telecommunications facility/mobile phone tower is not designated as a Category 1 or Category 2 form of development within the Zone or the Development Regulations and as such is a Category 3 form of public notification.

The applicant has provided a response to the representations, a copy of which is attached. The content of the representation and the applicant’s response are summarised in the table below:

Summary of Representations Concern Raised Applicant’s Response Impact on O’Halloran Street and traffic There will not be any traffic impact post generation construction, with limited traffic during the construction phase. Limited traffic will be generated during maintenance of the facility which will occur two to three times per year. Construction and maintenance access is proposed from Morphett Street with no access from O’Halloran Street Potential health impacts from An assessment of the likely levels of electromagnetic energy (EME) from the EME has been undertaken. The EME facility levels will satisfy the relevant World Health Organisation Standards and relevant Australian Standards. The EME report considers potential impacts within 500m of the site. It is advised that the maximum level of EME at 1.5 m above ground level is 1.15% of the mandated ARPANSA public exposure limit.

The facility will operate in compliance with the mandatory standard for human exposure to EME. Visual impact upon adjoining dwellings, It is necessary to have a golf course and from Main Road telecommunications facility of a height which is adequate to maintain unobstructed views of the surrounding area. As such some level of visual impact is unavoidable.

Visual impact has been minimised by: o Locating the facility in an area with existing light poles around the sports ground; o Selecting a special monopole and shroud that screens the antenna and associated equipment rather than a lattice tower; o Locating the facility more than 100 metres from any existing dwellings; and o Limiting the height to 30 metres

It is noted that the facility will be visible to people on adjoining streets, the golf course and some dwellings. Due to operational requirements it is unavoidable. The photomontage provided shows that the proposal will not have a significant adverse impact.

Impact on historic character of the Robe The proposal is located outside of the Township Historic Conservation Area and heritage listed places.

Robe Sports Ground does not have any historic significance. Location and design was finalised with consideration of the historic character of Robe.

The site is well removed from Victoria Street and Smillie Street.

Proximity to dwellings The nearest dwelling is located 100 metres away from the facility.

Generally, telecommunication facilities of this nature are located in proximity to residential areas and there is no legislative requirement to separate telecommunication facilities from residential properties.

Proximity to residential areas assists in providing high quality services to these areas.

The proximity of the facility to the target market along Victoria Street/Main Road allows the power level of the signal, and receiving handsets, to be reduced.

Devaluation of property Property values are subjective and influenced by a wide variety of factors including access to telecommunication services. Alternate locations Investigations into other potential candidate sites and co-location options has been undertaken.

Given the location of existing Optus facilities and the desired target area within the centre of the township, the proposed site is the best option in terms of balancing network and technical constraints and impact.

Changing the location will eliminate the lighting benefits provided by the facility which will increase the usability of the Sports Ground.

There is an existing Optus facility on Evans Cave Road. The proposed location has been selected to be as close as possible to the centre of Robe.

The matters raised by the representors and community members are considered further below within the assessment section of this report.

6.0 DEVELOPMENT ASSESSMENT

The subject land is located within the Open Space Zone and Recreation Policy Area 4 as illustrated on Zone Map Ro/7 and Policy Area Map Ro/7 of Council’s Development Plan.

6.1 RELEVANT PROVISIONS

In assessing the development proposal, I have had regard to the relevant provisions of the Open Space Zone, Recreation Policy Area 4 and Council Wide section of the Development Plan.

Those provisions which are of considered to be most relevant to the assessment of the proposal are as follows:

6.2 ASSESSMENT Open Space Zone

Objective 1 of the Open Space Zone seeks a zone: (a) in which the open space character is preserved to provide a visual contrast to the surrounding urban area (b) comprising open space that accommodates a range of public and private activities in an open and natural setting, including: (i) passive and active recreation land uses (ii) habitat conservation and restoration. The intent of the Zone Objective for the retention of an open space character is supported by the Desired Character Statement for the Zone which notes that ‘Development will maintain the natural character of the zone and incorporate low-scale buildings principally associated with existing recreation activities’. The desired use of the zone for recreational facilities and community uses is enforced by Zone Principle of Development Control (PDC) 1 which lists the following forms of development as envisaged in the zone: • conservation work • recreation area • sporting club facility • toilet block and barbeque facility. The proposed telecommunications tower is not a land use which is envisaged within the zone. It is a use which is neither anticipated/supported or discouraged within the zone. Mobile phone tower/telecommunications facility is not listed as a non-complying form of development within the zone and as such is to be assessed on its merits against the provisions of the Development Plan as a whole. It is noted that the proposal will provide lighting for the use of the football club and other users of the oval. The lights are to be attached to the tower at a height of 16.5 metres above the ground. The lights are to supplement the existing lighting located on 4 existing towers around the oval and on top of a lattice tower structure on the roof of the club rooms. It is noted that PDC 1 of the Recreation Policy Area 4 does specifically list ‘lighting for night use of facilities’ as an envisaged use within the Policy Area. As such this element of the proposal is supported and will assist in the achievement of the broader desire of the Zone and Policy Area for recreation use. Whilst the telecommunications facility will not of itself achieve the desired intent of the zone for open space and recreational uses the small footprint of the facility and its location between the edge of the oval and Morphett Street is such that is will not prevent or obstruct the remainder of the zone being used for such uses. The oval will still be able to function as a sports ground, with the improved ability for night-time use on account of the lighting proposed. In terms of built form within the zone PDC 7 notes that ‘buildings should be: (a) restricted in size and number (b) sited so as not to detract from the open natural character of the policy area’.

The applicant is proposing to utilise a narrower, more slender form of tower than is usually proposed for such a facility. The antennas at the top of the tower are to be encased within a shroud close to the tower rather than located on a head frame out from the tower structure. The proposal does not seek to locate any additional structures or equipment at the base of the tower, nor is any security fencing proposed. This will result in a reduced level of visual impact and less obstructions at ground level. Whilst the height of the tower (30 metres) is greater than the existing light towers (approximately 20 metres) the form of the tower and location is such that it is considered to achieve the general intent of PDC 7 for buildings to be restricted in size and number, particularly in this instance in terms of building footprint. The proposed location of the tower at the edge of the oval, amongst other structures of similar visual appearance/impact including the existing lighting towers and goal posts (albeit the proposed tower is of greater height than those structures) is considered to satisfy PDC 7 b). Overall the proposal, whilst it does not propose a use which is envisaged within the zone (other than the inclusion of the lights), is considered to be acceptable as it does not unreasonably impede or restrict the broader use of the zone for open space and recreational purposes. Impact on Residential Amenity Council Wide Interface between Land Uses PDC 2 states that: ‘Development should be sited and designed to minimise negative impact on existing and potential future land uses considered appropriate in the locality’. Council Wide Infrastructure Objective 4 also notes that: ‘The visual impact of infrastructure facilities minimised’. The proposed tower is located within the north eastern portion of the subject land and as such will be visible from the adjoining residential land on the northern side of O’Halloran Street. The extent to which the proposed tower will be visible to those nearby residential properties will range depending on the separation distance and extent of vegetation within the road reserves, around the oval and within the golf course. The proposed tower is approximately 90 metres from the northern boundary of the subject land to O’Halloran Street. As such the closest dwelling at 21 O’Halloran Street directly opposite the subject land is approximately 120 metres from the facility. The proposed facility will be visible from the majority of O’Halloran Street fronting onto the subject land and along the golf course as well as Davenport Street to the east across the other side of the golf course. The facility is likely to have limited degree of visibility from Sturt Street to the north with some limited views between buildings and landscaping where the topography allows. The facility will eb visible to users of the sporting complex as well as the adjacent golf course. Whilst the proposal will be visible from many locations an assessment must be made as to whether the visual impact is considered to be unreasonable and at an extent to which the amenity of the adjoining residential area or surrounding recreational uses is negatively impacted upon. In this regard it is noted that there are already a number fo similar structures within the locality which are likely to be viewed at the same time and within the same context as the proposed tower. These include the light poles around the oval, goal posts, the tower on top of the club rooms, the existing mobile phone

tower on Evans Cave Road to the south and the CFS tower on O’Halloran Street. Whilst the proposed tower will be taller than the existing light poles and goal posts it will be set amongst these existing structures, which is likely to limit the extent to which it is noticeable upon the skyline. The extent of views within the locality is also a consideration. The open nature of the subject land and golf course is such that the dwellings along O’Halloran Street have a wide range of views to the south. The setback distance and intervening landscaping and topography are also considerations. The proposed location of the tower is lower than the land along O’Halloran Street which will partially reduce the visual impact. The setback distance of more than 120 metres also assists in reducing the immediate impact upon the closest dwellings. Overall whilst it is acknowledged that the proposed tower will be visible from dwellings within and outside of the locality the potential impact upon amenity is not considered to be unreasonable given the setback distances and presence of other similar structures. Telecommunications Facility The Council Wide Telecommunications Facilities provisions provide some specific guidance in relation to the location and design of mobile phone towers. All the provisions within this section are reproduced below for the Panel’s reference: OBJECTIVES 1 Telecommunications facilities provided to deliver communication services to the community. 2 Telecommunications facilities sited and designed to minimise visual impact on the amenity of the local environment. PRINCIPLES OF DEVELOPMENT CONTROL 1 Telecommunications facilities should: (a) be located in a co-ordinated manner to deliver communication services efficiently (b) use materials and finishes that minimise visual impact (c) have antennae located as close as practical to the support structure (d) be located primarily in industrial, commercial, business, office, centre and rural zones (e) where technically feasible, be co-located with other telecommunications facilities (f) incorporate landscaping to screen the development, particularly equipment shelters and huts (g) be designed and sited to minimise the visual impact on the character and amenity of the local environment, in particular visually prominent areas, main focal points and significant vistas. 2 Telecommunications facilities in areas of high visitation and community use should use innovative design techniques (e.g. sculpture and other artworks) where possible and where the resulting design would positively contribute to the character of the area.

3 Telecommunications facilities should be located in residential zones only if sited and designed to minimise visual impact by: (a) using existing buildings and vegetation for screening (b) incorporating the facility within an existing structure that may serve another purpose (c) taking into account the size, scale, context and characteristics of existing structures, landforms and vegetation so as to complement the local environment. 4 Telecommunications facilities should not have a direct or significant effect on the amenity, character and settings of Historic Conservation Areas, local heritage places, State heritage places or State Heritage Areas.

The proposal is considered to achieve the general intent of telecommunication facilities to provide communication services to the community and to be designed to minimise visual impact with the antennas located close to the tower within a shroud and no ground mounted equipment or fencing proposed. At 30 metres in height the proposed tower is considered to be a standard height for telecommunication facilities across the State with towers generally ranging from 30 to 50 metres, with towers at the upper end of that range generally found in rural areas and smaller rural towns. The proposal does not satisfy PDC 1 (d) in that the subject land is not located within an industrial, commercial, business, office, centre and rural zones. This provision seeks that such facilities by ‘primarily’ located in such zones. Whilst the Open Space Zone is not listed it is not a residential zone and does provide some separation to the nearest residential neighbours. As noted below the applicant has considered alternative sites for the facility including co-location on the recently approved Telstra Tower out on the . The applicant has confirmed that co-location is not possible in this instance and I accept the applicant’s comments in this regard. Objective 2 and PDC’s 1(g), 2 and 4 seek to minimise the visual impact of telecommunication facilities, particularly in visually prominent areas and within the Historic Conservation Area (HCA). The proposal is not located within the HCA nor is the location considered to be visually prominent. Whilst the location is visible from many vantage points it is not a main focal point or within a significant vista. The applicant has provided a series of photomontages of the proposed tower. The photomontages show that the tower will be visible from along O’Halloran Street but will not be prominent given the level of screening from existing vegetation and the setback distances involved. The slender design of the tower and removal of the equipment shelter and fencing is considered to be a positive and satisfies the desire for facilities in areas of community use to have a more tailored and thoughtful approach. Alternative Sites The applicant has detailed several sites that were considered within the site selection process. It is also noted that several representors and community members have commented on, or suggested, potential alternative locations for the facility. The applicant has also provided additional information regarding the potential co-location

of the facility on the recently approved Telstra Tower on the Southern Ports Highway, which is attached. The Development Plan does not require the consideration of alternative sites. It is noted that infrastructure should not be developed ahead of a need for the service provided. In this instance the applicant has indicated that there is a need with an increase in mobile phone usage across the general population and specifically within the main street of Robe. The Environmental, Resources and Development Court has repeatedly confirmed that the lodgement of an application by a mobile phone carrier satisfies the needs test, that is if there was not a need no application would be lodged. The applicant has also confirmed a need for the facility within their broader network and specifically to target users within the central portion of the township. The applicant already has a tower within the Industrial Zone on Evans Cave Road to the south of the township. They have indicated that the proposed facility is required to supplement and extend the range and capacity of the existing tower. The applicant, through their own radio frequency modelling, has determined that the subject site meets all the technical requirements of their network. It may be that there are other sites which also satisfy those requirements however the application has been lodged for the subject land and therefore Council are required to assess it and make a determination as to the merits of the proposal in accordance with the Development Act. It is not Council’s role within the assessment process to review other potential sites once an application has been lodged and a determination requested by the applicant.

7.0 CONCLUSION The applicant seeks to development a telecommunications facility on the edge of the Robe Sports Ground. The facility will incorporate flood lighting for the benefit of users of the oval and be sited amongst several existing light towers and structures. The proposed tower will however be approximately 10 metres taller than any other structure around the oval. As such consideration has been given to the potential visual impact of the facility. Ultimately it has been determined that the visual impact cannot be considered unreasonable on account of the setback distances to the nearest sensitive land uses and the level of existing vegetation/screening within the locality. The design of the tower and removal of any ground mount infrastructure assists in minimising the impact of the facility, both on users of the oval and the broader visual impact. Whilst the proposal is not a land uses envisaged within the zone it will not unduly impact or restrict the ongoing use of the land for recreational purposes on account of the limited footprint. The inclusion of lighting will aid the use of the oval with lighting structures an envisaged use within the Policy Area. On balance the proposal is considered to provide an increasingly important public utility for the township whilst mitigating the potential impacts that such facilities can have upon the amenity of a locality.

8.0 RECOMMENDATION

That Development Application 822/041/20 for a telecommunications facility at 6 O’Halloran Street, Robe is not seriously at variance with the District Council of Robe Development Plan, Consolidated 15 December 2016.

That the Council Assessment Panel grant Development Plan Consent to Development Application 822/041/20 subject to Council’s standard conditions of approval.

May 2020 Executive Summary Optus seeks consent to install a new mobile phone network Application telecommunications facility at 6 O’Halloran Street, Robe SA 5276. The proposed development consists of: • One (1) 30m high ‘Tubestar’ monopole; • One (1) 7.7m long cylindrical shroud attached to the upper portion of the monopole;

1 Introduction

Mobile telecommunications play a central role in society and are becoming increasingly integrated into our day-to-day lives. It shapes how people communicate, access information and complete daily tasks. Individuals, families, businesses and society are all benefiting from the improved connectivity facilitated by mobile phone technologies. In addition to its personal and social value, the evolution of mobile phone and wireless broadband technologies has delivered significant benefits to the Australian economy by improving productivity, business management and customer engagement.

As such, the demand for effective telecommunications services and infrastructure has increased considerably. An increasing number of people are demanding more mobile services from more locations nationwide. People are also demanding coverage to be uninterrupted in their houses, places of work and while they move around the country.

To cater for the growing demand for mobile phone network services, Optus has embarked on a nationwide rollout to deliver an improved and more reliable telecommunications network to the Australian public. The rollout will provide improved mobile coverage, increased capacity and enhanced services in metropolitan, regional and rural areas throughout Australia. This rollout consists of the upgrade of existing telecommunications facilities and where required the installation of new wireless telecommunications facilities called mobile phone base stations, to expand the coverage footprint, increase capacity, provide the latest technology and offer seamless mobile services.

2.1 What is a mobile base station and how do they work?

A mobile base station is a facility that provides mobile telecommunications network services to a geographical area. A mobile phone network is made up of base stations which operate together to provide service to users within a coverage area and for people moving from place to place within multiple coverage areas. A mobile base station typically consists of the following components: antennas, support structure, base station and transmission equipment. The antennas are connected by cable to radio equipment usually housed in a room, shelter or outdoor equipment cabinet. In this instance, the radio equipment is housed within the pole structure. Base stations are connected to the core network by a radio transmission link or telecommunications optical fibre.

Mobile phones network base stations work by sending and receiving low power radio signals, much like a 2-way radio system. The signals are sent to and received from antennas that are attached to radio transmitters and receivers, commonly referred to as mobile phone base stations. The base stations are linked to the rest of the mobile and fixed phone network and pass the signal/call on into those networks.

2.2 Purpose of the Proposal

Additional mobile base stations are required when existing facilities cannot provide sufficient coverage, signal quality and capacity to a target area due to capacity, obstructions and distance limitations of the existing network and the terrain of the area. As mentioned above, new facilities may also be required when existing base stations are fully utilised or close to operational capacity and cannot serve additional users or increased network demand within an area.

Optus has undertaken an analysis of its mobile network within Robe and the surrounding areas, identifying areas where coverage, capacity and network quality needs to be improved. If these investments are not made, two main issues arise:

• Users may have difficulty connecting to the mobile network or the call may drop out. This impacts businesses, residents and visitors to the area and the ability of users to contact emergency services.

• Users may experience reduced data speeds, longer download times and poor network performance at busy times of the day with data intensive and time sensitive applications (e.g.

District Council of Robe CAP Agenda 28 July 2020 44 newscasts, social media, mobile banking, weather forecasts, sports highlights etc.) due to the available capacity being shared across too many customers or an area that is too large.

Having identified the need for improved network performance, the optimisation of existing Optus facilities throughout the region was explored and has been undertaken where possible. In some instances, these activities can resolve the network deficiencies in an area, however, on this occasion, the optimisation of existing facilities in the area has not been able to deliver a satisfactory outcome for the network in the Robe township and immediate surrounding areas.

As part of its deployment process and industry ‘best practice’, Optus seeks to co-locate on other existing telecommunication infrastructure wherever possible. An investigation into the use of other carrier and broadcast facilities within the area did not identify any candidates that meet the network requirements or coverage objectives or were located within the target area.

In the Robe township and surrounding area, Optus is already co-located on the existing 63 metre high Telstra tower located at the water treatment plant at Evans Cave Road which is over 1.4km from the main commercial centre of Robe. The next closest existing Optus telecommunications facility is at Mt Benson that is located approximately 15.4km from the commercial centre of Robe. Optus has or will be upgrading these facilities, however there remains network performance, coverage and capacity deficiencies in the Robe Township.

Optus considered co-location on the new Telstra mobile telecommunications facility (3.46km east of the proposed site) at 4057 Southern Ports Highway. Co-location is a preference for Carriers however in this case co-location will not meet the Optus network requirements for coverage and capacity in the Robe township.

3 Site Selection

3.1 Site Selection Process

Optus has been working on the development of new wireless telecommunications infrastructure in the Robe area for several years commencing in 2016. During this time, Optus and their consultants have investigated several options in Robe to satisfy the network requirements and the demands of current and future customers. In February 2019, Optus lodged a development application for a proposed telecommunications facility on the property at 6 Main Road, Robe. In June 2019, the Council refused the application. As a result of the refusal, Optus lodged a appeal with the South Australian Environment Resources and Development Court and in conjunction with the appeal process, Optus has been working with their consultants, Council and the Community it identify a suitable alternative to the

District Council of Robe CAP Agenda 28 July 2020 45 proposal at 6 Main Road, Robe that would potentially better satisfy the expectations of the Council and the community in relation to new telecommunications infrastructure. Following consultation with Council and some community stakeholders, along with the assessment of several options by Optus and their consultants, a potentially suitable location and proposal has been developed at Robe Sports Oval. This proposal at Robe Sports Oval is the subject of this development application.

As part of Optus’ deployment procedure, a comprehensive site selection process has been undertaken in order to identify a suitable location for a new facility in the Robe township area. This has included looking for ‘co-location’ opportunities, in accordance with Chapter 4 Part 3 Clause 4.13 of the Telecommunications Code of Practice 1997, as well as ‘Low Impact’ solutions, in accordance with the Telecommunications (Low-impact Facilities) Determination 2018 and new greenfield locations.

In addition to this, Optus also assesses the technical viability of potential candidates through the use of computer modelling tools that produce predictions of the coverage and predict potential network performance that may be expected from a potential candidate, as well as the technical expertise of the Radio Engineers.

There are a number of other important factors that Optus uses to assess and select potential sites and take into account factors other than the technical performance. These include:

Planning:

• Compliance with the EME standards mandated by the Australian Communications and Media Authority (ACMA). • Opportunities to co-locate facilities. • Proximity to sensitive community uses such as schools, childcare centres, hospitals and aged care facilities. • Regulatory compliance and the ability to obtain relevant planning approvals. • The ability to minimise any environmental, heritage and visual impacts. • Acceptability of the proposal to council and the community. • Visual aspect and amenity.

Property:

• Willingness by the owner to enter into a tenure agreement and provide access during construction and operation. • Impacts upon the existing use of the property.

Engineering:

District Council of Robe CAP Agenda 28 July 2020 46 • Feasibility of construction and the provision of utilities (power, access to the facility and transmission links etc.). • Cost of developing the telecommunications facility.

Radio frequency coverage and objectives:

• Ability to be linked to the existing Optus network and meet the radio frequency coverage objectives for the area. • Ability to provide high quality services to the target coverage area; • Ability to provide the network capacity for current and future customers in the area.

During the detailed site selection process for the new facility, Optus carefully considered the above factors. This analysis is detailed in the following sections.

3.1.1 Opportunities to Co-locate

Federal, State and Local government legislation encourages the use of existing telecommunications infrastructure for the co-location of new antennas in order to minimise the proliferation of telecommunication towers. As such, Optus’ site selection process flags potential co-location opportunities during the initial stages of candidate selection. The existing telecommunications tower at the water treatment plant off Evans Cave Road already hosts an Optus facility. Coverage from this facility is insufficient to provide reliable and high quality wireless telecommunications services to the Robe township and is therefore not suitable for the proposal.

There is also a radio tower used by the SA Emergency Services at 16 O’Halloran Street. This radio communications tower was considered, but it did not have the height and structural capacity to support the proposed facility and the location and tenure aspects of this option were not supported by the landowner.

As stated above, Optus has also considered co-location on the new Telstra mobile telecommunications facility at 4057 Southern Ports Highway. Co-location on the Telstra tower would not meet the Optus network coverage and capacity requirements for a proposal aimed to deliver high quality services to the Robe township. The Telstra tower is located over 2.5km from the town centre and as a result of the position, an Optus telecommunications facility in this location would not satisfy the network requirements for service quality, capacity and coverage in the township of Robe.

As a result of these investigations, it was concluded there are no suitable co-locations options to achieve Optus’ service and coverage objectives. The existing Optus facility at the water treatment plant does not provide sufficient service quality, coverage and capacity to the township of Robe, especially

District Council of Robe CAP Agenda 28 July 2020 47 when inside buildings. Therefore a new facility is required within close proximity to the town centre so as to provide reliable, high quality telecommunications services that the population of Australia expects.

3.1.2 Low Impact Solutions

A low impact solution typically involves the installation of telecommunications infrastructure on an existing structure. There were no suitable buildings or structures present with sufficient elevation, location, structural capacity and owners support to be considered as a viable candidate for a low impact facility.

3.1.3 Greenfield Solutions

When the site selection process reveals that a greenfield solution with a new antenna support structure is the only option, preference is given to properties in open space, industrial, infrastructure or commercial land use areas. Properties with a residential zoning or within close proximity of community sensitive uses are avoided where possible. As discussed in Section 3.1, there are many characteristics that determine the suitability of a potential location for a wireless telecommunications facility.

3.2 Site Selection Conclusion

The candidate sites that were considered as part of the site selection process are summarised below in Table 1.

The Candidate was not selected as a development application for this proposal was refused by the Council. C CFS Tower, 16 31m Tower The tower is located on the outskirts of the Robe O'Halloran township. This location is not centrally located Street, Robe within the Robe township. The land is Crown land and the tower owned by the SA Government. An agreement with Crown lands and Emergency Services is required. The property is zoned Open Space. There is an existing tower on the property that is of lightweight construction. The existing tower is not expected to have the structural capacity to accommodate Optus’ equipment. The candidate potentially satisfies some of the radio network objectives for this project, however due to the structure not being structurally adequate and the lack of support from the land owner and structure owner, this candidate was not selected as the preferred option. D 30-32 Victoria New 21m Tower The landowner was not supportive of the Street, Robe proposal. The site is zoned Town Centre and contains a local heritage item. The site is suitable from a design and constructive perspective. The candidate meets the majority of the radio network service objectives. E 6 O'Halloran St, New 26m Tower Lease required for site which is owned by the Robe District Council of Robe. The site is zoned Open Space and located on the outskirts of the township and removed from main Robe Township area.

The candidate is located outside the target area and not centrally within the Robe Township. A facility in this location would not satisfy the majority of radio frequency network service objectives. The property contains a Telephone Exchange and is owned by Telstra. The site is located in the Historic Conservation Area and within close proximity of multiple heritage items. The site is acceptable from a design and construction perspective. The candidate achieved the radiofrequency coverage objectives but was not supported by the landowner and therefore not a viable option. G 18 - 20 Banks New 26m The potential location is located within the Water Road, Robe monopole Reservoir property near the western edge of the target coverage area. From a design and construction perspective the site is capable of accommodating the proposed facility. A proposal in this area would satisfy the some of the network service objectives, however not perform as good as other candidates. The property owner was not supportive of the proposal and therefore the candidate is not a viable option. H 73 Morphett St, New 26m Robe Golf Club is located on the outskirts of the Robe monopole Robe township. This location is not centrally located within the Robe township. The land is owned by the Golf Club and the Golf Club were not supportive of a proposal to use a part of their land for a telecommunications facility. The property is zoned Open Space. The candidate potentially satisfies some of the radio network objectives for this project, however due to the lack of support from the land owner this candidate was not selected as the preferred option. I 73 Morphett St, New 26m Robe Golf Club is located on the outskirts of the Robe monopole Robe township. This location is not centrally located within the Robe township. The land is owned by the Golf Club and the Golf Club were not supportive of a proposal to use a part of their land for a telecommunications facility.

J 4057 Southern Co-locate on The Telstra tower is located more than 3km Telstra tower from the commercial centre of the Robe Ports Highway, Township. This location is not centrally located Robe within the Robe township. There is an existing 50m tower on the property. The existing tower is expected to have the structural capacity to accommodate Optus’ equipment. The candidate does not satisfy the radio network objectives for this project was not selected as the preferred option. K 6 O'Halloran St, New 30m Tower Robe Sports Oval. Lease required for land Robe which is owned by the District Council of Robe. The site is zoned Open Space and located on the outskirts of the township however this location to the north of the oval is closer than the other option in the rear south western corner. The proposal involves a dual-purpose structure that will be used for telecommunications and lighting purposes. Lights on the structure will illuminate part of the oval and work in conjunction with existing light poles to provide better lighting of the sports field. There is adequate vehicle assess to the selected location and the land is relatively flat. The candidate is located on the edge of the target area and is not within the Robe Historic Conservation Area. A facility in this location will satisfy the majority of radio frequency network service objectives. Although not the best candidate from a network performance perspective the proposal is not expected to have a significant adverse impact on the visual amenity of the area and no significant impact on the heritage significance of the Robe township. As a result of this and many other factors, this proposal was selected as the preferred option.

Optus has selected the proposed location and design following a review of many factors including a thorough assessment of potential options in the area and consultation with Council and other community stakeholders. The assessment of the area and the potential candidates was carried out again between June 2019 and May 2020 following the refusal of the Development application for the proposal at 6 Main Road, Robe and the feedback on that proposal from the community and Robe Council. The location and design carefully consider the radiofrequency objectives, network requirements, town planning and environmental constraints, proximity to potential community sensitive uses, engineering criteria, buildability, accessibility and the ability to obtain a suitable agreement for the use of the land as noted in Section 3.1 of this report.

The selected candidate is at 6 O’Halloran Street, Robe SA 5276 and the proposal involves the installation of a new telecommunications facility comprising a monopole with an overall height of 30m.

There are many reasons for selecting the location including the following:

• The selected location is within a large recreation reserve where the site is setback from sensitive land uses.

• The proposal meets the majority of Optus’ radio frequency coverage objectives and network requirements to meet the current and future demand in the area for people using the Optus mobile phone network, providing the quality of service expected by people who live, work, visit and travel through the area.

District Council of Robe CAP Agenda 28 July 2020 52 • The selected property is zoned ‘Open Space’ and there are four existing lighting poles within the oval.

• The property is utilised as a football / recreation oval which can continue to function without any interference. The proposed pole is set in a gap between two of the existing light poles near the goal posts on the northern side of the oval. The proposal includes additional lighting to be installed on the monopole that will provide lighting to the north eastern section of the Oval. Therefore the proposal will provide additional community benefits in addition to the improved telecommunications services.

• The property is large, relatively flat, has good access and has all the required utilities for the telecommunications facility.

• The site is well separated from heritage listed items and is not within the Robe Historic Conservation area.

• The site is well separated from community sensitive uses such as schools and child care centres.

• The land owner is supportive of the proposal and willing to allow part of the property to be used for a telecommunications facility.

The subject land at 6 O’Halloran Street Robe is formally identified in Certificate of Title Volume 5686, Folio 73 as Section 128 Hundred of Waterhouse, Robe SA. It is entirely within an Open Space Zone of the Robe Council Development Plan. The subject land is a rectangular parcel of land bounded by O’Halloran Street to the north and Morphett Street to the east and the Golf Course to the south. The property has a frontage to O’Halloran Street of approximately 225.3 metres and an eastern boundary to Morphett Street of approximately 280.8 metres. It has a total area of approximately 6.33 hectares and is moderately undulating then rises more steeply in elevation from the northern boundary of the football oval to O’Halloran Street and the north western corner of the subject land.

The subject land contains the following:  Football oval, amenities building and associated clubrooms on the western side of the football oval, player rooms on the southern side of the oval and four light poles approximately 17metres high surrounding the sports oval;  Children’s playground and two cricket training nets in the south western corner of the subject land;  Two netball courts, coaching boxes and light poles surrounding the netball courts;  Community hall and squash courts;  Six tennis courts on the western boundary; and a  Skate park in the north western corner of the subject land.

Vehicular access to the subject land is from O’Halloran Street and informal car parking is located north and west of the football clubrooms and east of the tennis courts. During football games spectators also park around the oval.

There is a dense row of conifer trees on the southern boundary of the subject land and a stand of remnant vegetation in the north western corner of the land around the skate park.

The land is fenced with very low post and rail fencing and power lines run along the O’Halloran Street and Morphett Street boundaries of the land and into the subject land between the formal access and the skate park.

The selected location for the telecommunications facility is near the eastern boundary of the subject land, some 94.3 metres south of O’Halloran Street, between the Robe football oval and the Robe golf course.

The Robe retail and commercial land uses are generally along Main Road and Victoria Street and the remainder of the Robe township is predominantly residential. The subject land is surrounded by a mix of land uses including:

East: The Robe Golf Course extends from Morphett Street, some 280 metres east to Davenport Street. Its northern boundary borders O’Halloran Street and it extends approximately 400 metres south where the Robe Golf Clubhouse sit on land elevated approximately 5 metres above the subject site. Dwellings on the eastern side of Davenport Street are oriented toward the golf course.

South: The Robe Golf Course abuts the southern boundary of the subject land. There are two fairways (approx. 100 metres in width) that extend to sand dunes in the Coastal Conservation Zone. Land further south is also within the Open Space Zone.

West: The Robe Sports Oval, Tennis Courts, Skate Park are located immediately to the west and then the Robe CFS which also fronts O’Halloran Street. Further to the west is the Golf Course and then West Beach. The Robe Cemetery is located south of the Robe CFS land. The Robe Cemetery is a State Heritage listed place.

North: Robe Sports Oval externs approximately 100 metres to the north of the facility and then the residential properties on the north side of O”Halloran St. Land to the north of O’Halloran Street is primarily residential and is within a Residential Character Zone in Council’s Development Plan. Dwellings fronting the northern side of O’Halloran Street are oriented south toward the football oval, golf course and recreation area.

The proposed site is 122 metres south of the nearest dwelling which is located at the north western corner of O’Halloran and Morphett Streets.

There are a number of Local and State heritage listed items to the north and west of the subject site. The nearest is located approximately 190metres away to the north on the corner of Sturt Street and Morphett Street. Please refer to the maps below.

There are no heritage listed items or areas within the subject land and the proposed development will not significantly adversely impact on the heritage value or integrity of heritage listed items in the locality. Figure 3 above displays heritage items within the locality of the subject site. The nearest heritage listed items are:

 Robe Cemetery, Sect 590 Burr Street, Robe which is listed on the SA Heritage Register. Robe Cemetery is approximately 260 metres south west of the subject site, separated by the football oval and netball courts.

 St Peters Anglican Church, located at the corner of Morphett and Sturt Streets is Local Heritage listed. The church is oriented to the north, away from the subject site and elevated views of the church are also taken from the east.

The proposed development will not detract from these Heritage listed items.

District Council of Robe CAP Agenda 28 July 2020 58 The site is well separated from key features of the area such the Commercial Centre along Main Road and near the Soldiers Memorial, Lake Charro, Lake Butler, Dunn Lake, Lake Fellmongery, West Beach and the main town beach.

The three (3) nearest residential dwellings to the site are detailed below:

- 21 O’Halloran Street – approximately 120m north;

- 23 O’Halloran – approximately 125m north; and

- 17 O’Halloran - approximately 135m north.

5 The Proposal

In general terms, the Development Application seeks consent for the establishment of a telecommunications facility on the eastern side of the Robe Sports Oval property at 6O’Halloran Street Robe SA 5276 (the ‘Application’).

Design plans showing the location of the facility, type, location and configuration of monopole, lights, shroud and associated infrastructure is provided at Appendix 1.

The Application specifically comprises the following works:

• The installation of a 30m monopole with a shroud at the top;

• Installation of three (3) Optus panel antennas and remote radio units (not more than 2.8m in length) within the shroud;

• Installation of a parabolic antenna (0.6m diameter) on a mount at a height of 21m on the monopole;

• The installation of three (3) lights and associated mounts on the monopole at a height of 16.5 metres

• Installation of transmission and electronic equipment within the bottom section of the monopole;

• Installation of ancillary equipment and associated infrastructure to ensure the safe and efficient operation of the facility, including access gate, cable trays, bollards, cabling, safe access infrastructure, lightening protection and electrical works.

6 Environmental Planning Assessment

6.1 Commonwealth Legislation – The Telecommunications Act

The Telecommunications Act 1997 has been operative since 1 July 1997. This legislation establishes the criteria for ‘low impact’ telecommunication facilities. If a proposed facility satisfies the requirements of a ‘low impact’ facility, the development is exempt from planning approval.

Further clarification of the term ‘low impact’ is provided in the Telecommunications Act 1997 and the Telecommunications (Low Impact Facilities) Determination 2018, which was gazetted subsequent to the Act. The Telecommunications (Low Impact Facilities) Determination 2018 establishes certain facilities, which can be considered “low impact facilities”.

The proposed monopole is not considered a “low impact” facility under the definitions contained in the Commonwealth legislation. The proposed monopole is therefore subject to state and local planning legislation and in this instance, development approval is therefore required for the proposed tower.

6.2 Robe Council Development Plan Consolidated 15 December 2016

The key environmental planning instrument that applies to the subject site is the Robe Council Development Plan (the ‘Development Plan’). Under the Development Plan, Telecommunications Facilities are not listed as ‘complying development’ or ‘non-complying development’ in the Open Space Zone. The Application therefore requires a merit-based assessment in accordance with Clause 35(5) of the Development Act 1993, having regard to the provisions of the Development Plan. The relevant provisions of the Development Plan are assessed against the Application below.

Open Space Zone

The relevant provisions of the Open Space zone are considered with respect to the subject Application.

District Council of Robe CAP Agenda 28 July 2020 60 5. Development should not be undertaken unless it is consistent with the desired character for the zone.

The Application is considered to be consistent with the desired character of the Open Space zone. The land is used for recreational facilities and the proposal will enhance this but providing lighting of the sports field and improved telecommunications services that are used by the people using the Robe Sports Oval. This includes sporting participants and spectators. The proposal has not adverse impact on the ability of the property to continue to be used for open space and recreational activities. The proposal does not involve any vegetation clearing an therefore has no adverse impact of the green belt the property provides around the Robe Township. The proposal enhances the recreational activities on the property.

Due to the nature of telecommunications facilities and the need for antennas to be well elevated and to enable the antennas to have unobstructed views of the surrounding area, it is necessary to have a structure that has a total height of 30 metres. The selected land is not well elevated above sea level and therefore a structure to support the antennas between a height of 20 – 30 metres is necessary to enable high quality wireless telecommunications services to be provided to the Robe Township area.

Telecommunications Facilities

1. Telecommunications facilities should:

(a) be located in a co-ordinated manner to deliver communication services efficiently

As detailed in the ‘Site Selection’ section of this report, no other viable candidates were available that met the network requirements, radiofrequency network objectives and satisfied other site selection factors such as the environmental [planning impacts, Council and community attitudes and the support of the land owner. A proposal at 6 Main Road, was considered suitable, however the development application was refused. The proposed telecommunications facility is positioned on the southern edge

District Council of Robe CAP Agenda 28 July 2020 61 of the Robe Township and it is important to be as close as possible to the centre of the Robe Township to maximise the benefit and performance of the telecommunications facility. The proximity to the town centre is important due to the need to provide communications services to the main Commercial centre of the Robe township and therefore address the existing network deficiencies. The proposed candidate is considered to be a suitable option considering the Council and Community attitudes, the environmental planning assessment, potential adverse impacts and the ability of the proposal to satisfy the network requirements and coverage objectives. Although other candidates were identified in the wider surrounding area of Robe, that potentially achieved a higher proportion of the network requirements and coverage objectives , Optus aimed to achieve a balance between network performance and the potential environmental impacts and the attitudes of the Council and local community. The proposed facility will operate in conjunction with other existing telecommunications infrastructure in the area to deliver high quality wireless telecommunications services to Robe Township and the surrounding areas. On this basis, the selected candidate is considered to be the most appropriate solution for efficiently delivering communications services in the Robe Township.

(b) use materials and finishes that minimise visual impact

The proposed facility utilises non-reflective materials and a neutral grey and off white colour tones in order to reduce visual impact. The equipment cabinets used on typical telecommunications facilities of this nature have been replaced by a special monopole design called “TubeStar” that enables the telecommunications equipment to be housed within the bottom section of the monopole and within the shroud at the top section of the monopole. Please refer to the photo in figure 5 showing a similar facility using the “TubeStar” monopole.

(c) have antennae located as close as practical to the support structure

The proposed design incorporates a slim mounting arrangement and a shroud on the monopole that will screen the visibility of the antennas. This proposal also minimises the size and bulk of the proposed infrastructure. Whilst a traditional headframe and a more traditional monopole or lattice tower would have a greater capacity for supporting telecommunications equipment and more operational flexibility and better performance, it would also have a bulkier appearance and therefore not minimise the visual impact. The slim antenna mounting arrangement and shroud results in the antennas being positioned as close as possible to the support structure (the monopole) and minimise the bulkiness of the infrastructure.

(d) be located primarily in industrial, commercial, business, office, centre and rural zones

District Council of Robe CAP Agenda 28 July 2020 62 The subject site is zoned Open Space and used for recreational purposes. Given the main objective is to provide telecommunications services to the Robe Township, it is therefore important to be a close as possible to the centre of the Robe Township. Given the spatial restrictions and the limited opportunities in commercial, industrial or rural zoned land, it was not possible to locate the facility in these zones and the Open Space zone is considered suitable and compatible with the proposal, especially given the existing light poles, the Sports Club building and the amenities building and the dual purpose of the proposal with both lighting and telecommunications purposes. The telecommunications facility is considered to be compatible with the use and zoning of the land and the objectives.

(e) where technically feasible, be co-located with other telecommunications facilities

A new telecommunications facility is required as there were no existing co-location opportunities within the Robe Township due to the lack of existing telecommunications infrastructure as further detailed in the Site Selection section of this report.

(f) incorporate landscaping to screen the development, particularly equipment shelters and huts

Landscaping is not proposed in this instance as the location of the monopole is within the sports ground and any trees or other landscaping would have a detrimental impact if the recreational uses of the property. There is not equipment shelter proposed for this facility and therefore it is not necessary to providing a visual screen around the shelter.

(g) be designed and sited to minimise the visual impact on the character and amenity of the local environment, in particular visually prominent areas, main focal points and significant vistas.

The siting and design of the facility sought to minimise visual impact on the local environment. The selected location avoids the core areas of the township, focal points and significant vistas. The location is also outside the Historic Conservation area. A strong effort has been implemented by Optus to minimise the visual impact through the implementation of the “TubeStar” monopole and the shroud that will cover the antennas. The facility is sited near the eastern boundary and is positioned to provide the maximum benefit in relation to lighting the Sports Field because it will work in conjunction with the existing lights to better service the entire field. The selected location has no heritage value and the facility is sufficiently separated from surrounding heritage buildings. The selected location has a relatively low ground elevation and is surrounded by trees and 4 existing light poles that will reduces its visual prominence.

Telecommunications facilities in areas of high visitation and community use should use innovative design techniques (eg sculpture and other artworks) where possible and where the resulting design would positively contribute to the character of the area.

The subject site is not considered to be of high visitation or community use. Nonetheless, the facility incorporates an innovative design, which seeks to reduce its bulkiness and visual impact.

3. Telecommunications facilities should be located in residential zones only if sited and designed to minimise visual impact by:

(a) using existing buildings and vegetation for screening

(b) incorporating the facility within an existing structure that may serve another purpose

(c) taking into account the size, scale, context and characteristics of existing structures, landforms and vegetation so as to complement the local environment.

The subject site is zoned Open Space, not residential. Nonetheless, the siting of the facility takes into account existing buildings and vegetation on the subject site and surrounding areas and the design has aimed to minimise the visual impact as far as practicable from residential areas.

4. Telecommunications facilities should not have a direct or significant effect on the amenity, character and settings of Historic Conservation Areas, local heritage places, State heritage places or State Heritage Areas.

There are no heritage items registered at the subject property and the location and property are not within the Historic Conservation area. The facility is considered to be sufficiently separated from nearby local heritage items so as not to significantly adversely affect their heritage values.

The site is located outside the Historic Conservation Area of the Robe Township and is well separated from the core areas of the conservation areas such as Smillie Street. The siting and design of the facility are considered to be sufficient so as to not to have an unacceptable impact on the amenity, character or setting on the area. The built form on the subject site is a large area of open space used for recreation and makes no significant contribution to the heritage conservation area. On this basis the facility is considered to be consistent with the character of the subject site.

Provision 1 of this section recognises the importance of telecommunications infrastructure as essential infrastructure and states that development should not occur without the provision of adequate utilities and services including, inter alia, telecommunications services. The Application addresses the lack of essential telecommunications infrastructure in the Robe Township. Further to this, case law dealing with telecommunications facilities also recognise telecommunications infrastructure as ‘essential infrastructure’ as stated in the following case, Development Assessment Commission v 3GIS Pty Ltd [2007] SASC216.

The fourth objective of the Infrastructure provisions of the Development Plan is to ensure that the visual impact of infrastructure is minimised. As detailed in the Site Selection section of this report, a thorough site selection process was undertaken and of the nominated candidates, the selected candidate is the most appropriate and viable option from a property, radiofrequency and environmental perspective. The detailed visual impact assessment provided at Section 7.1 of this report considers the impacts of the proposed facility on the locality. The visual impact assessment coupled with the detailed site selection process reveal that all attempts were made to minimise the visual impact of the proposed telecommunications facility from a siting and design perspective.

Interference between Land Uses

1. Development should not detrimentally affect the amenity of the locality or cause unreasonable interference through any of the following:

(a) the emission of effluent, odour, smoke, fumes, dust or other airborne pollutants The proposed telecommunications facility will have no adverse impact on adjacent land uses with respect to emissions of effluent, odour, smoke, fumes, dust or other airborne pollutants. The telecommunications facility is unmanned and does not consume any water or gas and does not emit any solid, liquid or gaseous waste.

(b) noise The operation of the telecommunications facility will not generate noise emissions that will adversely affect adjoining land uses. The only noise is generated by small air conditioners located within the base of the monopole and these generate less noise than typical residential air conditioning units.

(c) vibration There will be no vibration impacts from the operation of the proposed telecommunications facility.

(e) light spill There will be no light spill impacts from the operation of the proposed telecommunications facility. The Lights to be installed on the monopole are directed at the sports field and the adjacent land uses are a road reserve and then a golf course.

(f) glare The telecommunications facility will be made of non-reflective materials that will not adversely impact adjacent properties with respect to glare.

(g) hours of operation The proposed telecommunications facility is unmanned and continuously in operation. The operating hours of the facility will have no adverse impact on adjacent properties.

(h) traffic impacts As detailed in section 7.4 below, the traffic impacts from the proposed facility will be negligible as it is unmanned and will only require approximately 2 - 4 maintenance visit per year.

2. Development should be sited and designed to minimise negative impact on existing and potential future land uses considered appropriate in the locality.

The proposal will not significantly effect the current or future uses of the property. The use of the property for open space and recreation will be enhanced by the improved lighting and the improved telecommunications services. The property is used predominantly for organised and passive sporting activities. The proposed telecommunications facility and lights will not cause any significant restriction on the current and future used of the property. . As detailed in Section 7.1, the siting of the proposed telecommunications facility aimed to minimise any potential impacts on the land by selecting a location on the eastern edge and also selecting a design that requires a small foot print. Simultaneously, the design of the facility seek to reduce the visual impact on the surrounding land uses.

3. Development adjacent to a Residential Zone or residential area within a Settlement Zone should be designed to minimise overlooking and overshadowing of nearby residential properties.

The operation of the proposed telecommunications facility will have no significant adverse impact on adjacent residential land uses or the operation of the existing land uses within the Town Centre zone.

7.1 Environmental Impacts

The land selected to host the telecommunications and lighting facility has no significant ecological value and no significant vegetation clearing is required as part of the Application.

The visual impact of telecommunications facilities is generally considered to be the highest point of contention by the public, Council and Optus. This section of the report assesses the visual impact of proposed facility on any sensitive nearfield or distant vantage points.

The height of structure means that it will be inevitably visible from a number of locations within the surrounding area. Unfortunately, due to the nature of telecommunications facilities, the antennas must be located at an elevated position to gain the best coverage possible. This has the unfortunate consequence of increasing the visibility of the infrastructure.

A number of methods to reduce the visibility of the structure have been implemented into the siting and design of the facility.

Tower Design

The use of the “TUBESTAR” design solution with the circular shroud and the storage of the associated equipment in the base of the monopole will significantly reduce its visual impact. Optus has made a strong effort to minimise the visual impact.

There are a range of structures that can be used for the antenna support structure including lattice towers and guy masts. Lattice towers are bulkier than a monopole and create additional visibility from far (over 300m) and close (under 300m) distances.

Whilst a lattice tower would have created additional benefits including ease of maintenance and the ability to install additional equipment in the future, monopoles, and in particular the TubeStar solution, have been specifically chosen for this proposal due to their comparatively low visual impact on landscapes and amenity of the area.

Limitation of height

Limiting the height of the monopole to 30m will have the benefit of reducing the visibility of the facility from the surrounding landscape. Whilst an increased height would have produced greater coverage and improved telecommunications services, this has been balanced with the need to minimise the visual impact of the structure.

The proposed facility is located outside the commercial and residential centre of the Robe Township in order to reduce its prominence in areas of high heritage significance and visitation. As previously mentioned, it was important not to locate the facility too far from the town centre as this is the target area that the facility is intended to cover and the primary objective of the project.

Locating the facility on a site with a low ground elevation, assists in reducing the visual prominence of the facility and shields it from certain vantage points in the township. The terrain, existing light poles and mature vegetation on the property and surrounding areas assist in screening some views of the facility.

Setbacks

The facility is well setback from O’Halloran Street on the subject property with a distance of over 80 metres from O’Halloran Street. This will reduce its visibility and prominence. The overall effect of the setbacks is to reduce the visibility of the proposed telecommunications facility from the main commercial and tourist areas of the Robe Township.

Visual Impact Assessment

Whilst numerous measures have been implemented to lessen the visual impact of the facility, due to the overall height of the structure it will remain visible at particular vantage points in the area. The proposed structure is considered to be of an appropriate scale based on the site context. This is taking into consideration site specific factors such as the size of the lot, the existing structures on the property and the surrounding ground elevation. Based on these factors, the proposed structure is considered to be consistent with the existing character of the locality and is not expected significantly affect the amenity of the locality.

The visual impact of the proposed telecommunications facility from the key near field and distance viewpoints, as mapped in Figure 4, is assessed in detail below. Note: Viewpoints are considered from an average height person at ground level.

Viewpoint 1: Location: on O’Halloran Street near the 15 O’Halloran Street Viewpoint 1 is considered to be of moderate significance as it forms part of the vista of the approach to the Oval and the road heading west. O’Halloran Street is a local road and not considered to have a high traffic volume. The built form in this viewpoint is predominately across the open space of the Robe Sports Oval and the Golf Course. As can be seen in the photo, there are other vertical elements in the view including electricity poles and light poles. The photo location is well elevated and has a higher elevation than the location of the monopole. The streetscape has limited aesthetic qualities. There are no heritage buildings in the viewpoint. The proposed telecommunications facility will be visible from this viewpoint, however its visual impact on the amenity of the area is not considered to be overbearing or unacceptable given the natural colours, slim and inobtrusive design and the location away from the town centre.

Viewpoint 2

Location: Corner of O’Halloran Street and Morphett Street ( South of 21 O’Halloran Street) facing south. Viewpoint 2 is considered to be of moderate significance as it forms part of the vista when travelling south on Morphett Street and is also a similar view to that experienced from some residential properties. There are no heritage items in this view and no part of the Historic Conservation Area is visible. Morphett Street is a local road with low traffic volumes. The existing built form in this viewpoint is predominately open space with the view dominated by the Sports Oval and golf course. The urban landscape is considered to have no significant aesthetic qualities. The proposed telecommunications facility will inevitably be visible from the viewpoint because the land is open space and there are no trees or buildings obstructing the view and the ground elevation where the photo is taken to higher than the position of the monopole. The proposal is considered to assimilate well with the existing light poles and power poles. The photo was taken approximately 100 metres from the location of the monopole. . As a result, the proposal is not considered to significantly affect the visual qualities of the landscape and does not significantly affect the amenity of the area. The minor visual impact of the proposed facility from this viewpoint is considered to be acceptable and the proposed telecommunications infrastructure will not dominate the views of the surrounding area.

Viewpoint 3

Location: O’Halloran Street ( South of 25 O’Halloran Street) facing south south west. Viewpoint 3 is considered to be of minor significance because the views of the proposed telecommunications facility will be predominantly blocked by existing vegetation.

Viewpoint 4

Location: Robe Golf Club – Morphett Street, Robe Viewpoint 4 is of low significance as it is located approximately 253 metres away and there are several other vertical elements in the area and there is a ridgeline of houses and other buildings in the background. The Golf Course is used for recreational purposes and the proposed telecommunications facility is not expected to significantly alter the experience of people using the golf course or the golf club. The visual impact of the proposed telecommunications facility from this viewpoint is considered to be low. The land has a higher ground elevation than the subject site. The proposed telecommunications facility blends in well with other existing vertical elements and the proposal does not dominate the landscape given it is less than 2 metres wide. Based on the assessment and the photo, the visual impacts arising from the installation of the proposed telecommunications facility from this viewpoint is considered to be insignificant.

7.2 Social and Economic Impacts

Access to high quality and reliable mobile telecommunications services is well understood to be a necessity in Australia’s modern economy. This is important in rural towns such as Robe, where it is increasingly important to have access to high quality mobile telecommunications services through the development of telecommunications facilities such as the proposed. The demand for greater data and mobile connectivity is evident in the need to provide additional facilities such as this one. Locating this facility within the Robe area addresses Optus’ goal of providing greater services to regional areas. The proposal will provide people who live, work or visit the area with much needed wireless telecommunications services to access information, socially and economically interact and complete daily tasks. Individuals, families, businesses and society are all benefiting from the improved connectivity facilitated by mobile technologies. In addition to its personal and social value, the evolution of mobile technologies has delivered significant benefits to the Australian economy by improving productivity, business management and customer engagement. There is also a wide range of community safety benefits with mobile phones often being used in emergency events such as bush fires, car accidents and domestic incidents.

7.3 Health and Safety

In relation to public safety and specifically Electromagnetic Emissions (EME) and public health, Optus co-operates within the operational standards set by the Australian Communication and Media Authority (ACMA) and Australian Radiation Protection and Nuclear Safety Agency (ARPANSA). ARPANSA is a Federal Government agency incorporated under the Health and Ageing portfolio and is charged with the responsibility for protecting the health and safety of both people and the environment from the harmful effects of radiation (ionising and non-ionising). All Optus installations are designed and certified by qualified professionals in accordance with all relevant Australian Standards. This ensures that the telecommunications facility will not result in any increase in the level of risk to the public. This facility is to be operated in compliance with the mandatory standard for human exposure to EME – currently the Radio communications (Electromagnetic Radiation Human Exposure) Standard 2003. The EME Report associated with this site is provided at Appendix 2. The report shows that the maximum predicted EME levels will equate to 1.15% of the maximum exposure limit, which is well below the allowable exposure limit under the Australian Standard (100% - which is still considered to be safe). Moreover, all Optus equipment has the following features, all of which minimise the amounts of energy used and emitted: • Dynamic/Adaptive Power Control is a network feature that automatically adjusts the power and hence minimises EME from the facility; • Varying the facilities transmit power to the minimal required level, minimising EME from the network; and • Discontinuous transmission, a feature that reduces EME emissions by automatically switching the transmitter off when no data is being sent. The proposed facility will also have restrictions aimed at preventing public access, including an anti- climbing device and warning signs placed around the facility.

7.4 Traffic Generation

After the construction period, the only traffic generated by the base station will be that associated with maintenance vehicles. In this respect, it is estimated that maintenance of the facility will generate only two to four visits per year and it will remain unattended at all other times. The traffic generation will therefore be minimal and not sufficient to create any adverse impacts in this regard or by creating a demand for parking facilities.

7.5 Utility Services

All services required for the ongoing operation of the base station are capable of being provided to the facility without impacting on the supply or reliability of these services to any existing consumers in the locality. No stormwater, sewerage or waste management facilities are required.

The proposed Optus telecommunications facility at Robe Sports Oval, on O’Halloran Street, Robe will form an integral component in the ongoing development of mobile telecommunications infrastructure in Robe and regional SA. The facility will provide an important community and economic benefit by providing access to critical mobile telecommunications infrastructure, and therefore greatly improved mobile coverage and capacity in the area and therefore improving the quality of telecommunications services. The proposed development is considered appropriate following consideration of the relevant legislative, environmental, technical, radio coverage and public safety requirements and is considered acceptable in social, economic and environmental terms as demonstrated in this report. There are no significant adverse environmental impacts likely to occur which could render the construction and operation of the proposed facility unacceptable, and the proposal satisfactorily meets the requirements of the relevant state and local planning instruments and policies.

The wide ranging benefits that will result from the installation and operation of the facility are considered to far outweigh any of the potential adverse impacts on the local environment. These benefits include: • Improvements in community safety with people, emergency services and other stakeholders being able to communicate on their mobile phones; • Economic improvement with higher quality telecommunications services and enhanced ability to communicate, work in all areas, faster internet, higher workplace efficiency, the ability to work while mobile and greater productivity; and • Improved social interaction from high quality telecommunications services with the ability to call, text, email or use social media in more areas of Robe and with greater network capacity so there will be higher speeds and less drop outs. For these reasons, it is respectfully requested that Council looks favourably at this application and that it be progressed to a positive resolution.

We are writing to Council in response to the representations received during the Council notification period that ended on the 24 June 2020. We have been advised that Council received 18 representations from adjoining land owners and community members/ratepayers.

We have provided a table below that summarises the comments made in the representations and have provided additional information to address the comments. Also attached are Fact Sheets that will assist Council and the Community obtain a better understanding of the way mobile phone networks operate and information about electromagnetic energy (EME) and the perceived adverse impacts on health.

It is important that Council also consider the Infrastructure section of the Development Plan. Telecommunications infrastructure and telecommunications services are included as utilities and services that should be provided for the community.

Based on the representations, the main areas of interest are:

• The location selected and the potential re-location to another location; • The potential visual impact and associated effects on landscape and scenic values; • The potential effects of the telecommunications facility on the health of people.

We understand that the potential visual impact of the proposal is one of the main topics raised by the representors. As stated in the Planning Report and other discussions and correspondence with Council, there has been significant effort and thorough consideration of the potential visual impact of the facility and extensive measures have been implemented to alleviate or minimise any potential adverse impacts of the proposal. Please refer to the table below. If Council considers it necessary to implement further measures to mitigate the visual impact, Optus is happy to consider such measures as tree planting or other landscaping.

In relation to the selected location of the facility, we would like to refer to the relevant sections of the planning report that discuss the site selection process and previous discussions with Council and other members of the community regarding the thorough investigation of several potential locations and various different properties. We can assure Council and the community that Optus and its consultants have completed a thorough investigation of the Robe area and have assessed a number of potential locations for the facility. The conclusion of that assessment is that the selected location and the selected design represents the most suitable solution to enable the provision of high quality wireless

telecommunications services to the township of Robe and to those people who live in, work in, visit or travel through the Robe Township.

In relation to electromagnetic energy ( EME) and concerns about the health of people we can assure Council and the community that Optus will always comply with the current legislation relating to EME or any future modifications of that legislation. The maximum predicted levels of EME produced from the proposal represent a small portion of the public exposure limit. Please refer to the information supplied in the table below.

It is important for Council and the community to consider the benefits of the proposal. It is important for there to be high quality telecommunications services within the Robe Township and this proposal will enhance and maintain the social, economic and tourism features of the area as well as service the permanent residential population in relation to their telecommunications needs including working home, education, medical assistance, and the wide ranging social activities. Without high quality wireless telecommunications services, the commercial, residential and tourism activities may decrease and the area becomes less used, less functional with less economic activity.

The installation and operation of the proposed telecommunications facility is an important element of the Development Plan and the prosperity of Robe because the provision of high quality wireless broadband and mobile phone services is an important service to support all retail, commercial, community and residential land uses as well as significantly support tourists as they are likely to rely on their mobile phone and wireless internal services to communicate, obtain information and enjoy their holiday experience. In a similar manner to water infrastructure and electrical infrastructure; telecommunications facilities are considered to be an essential service and are needed in all populated areas of Australia. Given there are more mobile phones than people in Australia, the demand and need for the service is well demonstrated. There is also the community safety benefit. Research indicates that over 70% of emergency phone calls are made from a mobile phone.

Summary of issues raised in Applicants Response submissions from Adjoining Land owners

O’Halloran Street is busy and people In relation to the amount of traffic and pedestrian use of O’Halloran Street, we can advise Council that the proposed cross O’Halloran St including children telecommunications facility is unmanned and therefore not a significant generator of traffic or pedestrian movements. Once using skate park. the construction activities are completed and the facility is operational, the only traffic generated by the facility will be that associated with annual maintenance activities or other visits to carry out repairs or deal with faults or electricity outages. In this respect, it is estimated that maintenance of the facility will generate only two or three visits per year. The facility will remain unattended at all other times. It is also noted that the facility is located off Morphett Street and is approximately 90 metres away from O’Halloran Street. Construction and maintenance access are primarily proposed from Morphett Street and therefore there are unlikely to be any activities post construction near the O’Halloran Street entry to the subject site.

Effects of EME on nearby residents Optus acknowledges that some members of the community have concerns about the possible health effects of and houses and potential impacts on electromagnetic energy (EME) from mobile phone base stations, and Optus is committed to responsibly addressing these health. concerns.

All mobile base stations must comply with EME regulations established by the Australian Radiation Protection and Nuclear Safety Agency (ARPANSA). The Australian standard is known as the Radiation Protection Standard for Maximum Exposure Levels to Radiofrequency Fields – 3kHz to 300GHz. This Standard is based upon recommendations from the International Commission for Non-Ionising Radiation Protection which is an advisor to the World Health Organization. The Standard requires that the level of EME at all publicly accessible locations is less than the public exposure limit noted in the Standard.

Optus has provided an Environmental EME Report to Council and the community that predicts the maximum levels of EME at locations within 0 – 500 metres away from the facility. We advise that the maximum EME level at 1.5m above ground level is calculated to be 1.15% of the mandated ARPANSA public exposure limit.

The EME report has also considers some specific locations in the area surrounding the location for the telecommunications facility. These include some of the nearest houses on O’Halloran Street where the maximum predicted level of EME is 0.48% of the public exposure limit. Please refer to the Environmental EME Report provided to Council.

For further information regarding telecommunications facilities, EME and the health of people, please refer to the Fact sheets from the AARPANSA and the World Health Organisation (WHO) that have been provided to Council and are available on the internet. Optus thoroughly assesses all of its proposals for new facilities to ensure compliance with all the relevant Government legislation. Optus operates its telecommunications facilities within the operational standards set by the Australian Communication and Media Authority (ACMA) and in accordance with the Radiocommunications (Electromagnetic Radiation Human Exposure) Standard 2014 (the Standard) that has been prepared by the ACMA and adopts the Radiation Protection Standard for Maximum Exposure Levels to Radiofrequency Fields – 3 kHz to 300 GHz published by the ARPANSA and referred to as the ARPANSA Standard. ARPANSA is a Federal Government agency incorporated under the Health and Ageing portfolio and has the responsibility of protecting the health and safety of people, animals and the environment from the potential harmful effects of radiation (ionising and non-ionising). All Optus installations are designed and certified by qualified professionals in accordance with all relevant Australian Standards. This ensures that the Optus facility will not result in any increase in the level of risk to the general public. The proposed facility will always operate in compliance with the mandatory standard for human exposure to EME. We can assure Council and the community that the proposed telecommunications facility will always comply with the legislative requirements now and in the future. Proposal will be an eyesore. Optus acknowledges that the visual impact of telecommunications facilities of this type is a common concern raised by the Tower will be visually unpleasant for local community. For this particular proposal in Robe, Optus has thoroughly considered the feedback from Council and community and has implemented a number of measures to minimise the potential visual impact of the proposal. Some of the measures implemented including the following:

• Locating the facility outside the Robe Historic Conservation area;

• Locating the facility away from the centre of the Robe township such as Smillie Street or Victoria Street or Main Road; • Locating the facility is an area that contains existing vertical structures such as the light poles on the sports ground or the electrical poles on the street. • Locating the facility more than 100 metres from any existing houses; • The selection of a special monopole and shroud called “TubeStar” that screen the antennas and associated equipment

and alleviate the need for an equipment building; • Limiting the height of the facility to 30 metres; Based on many factors including the location, design, equipment selection and colour scheme, the proposed structure is not expected to dominate the visual landscape of the Robe Township or significantly adversely impact on the overall amenity of the area. The potential appearance of the proposed facility is shown in the photo illustrations provided in the Planning Report. We acknowledge that the telecommunications facility will be visible to people on the street, on the golf course and visible from some houses. Due to the purpose and operational requirements of antennas, this cannot be avoided. It is important for the antennas to be positioned so they have unobstructed views of the surrounding area and given the Robe Township is the primary service objective, having a structure or antennas visible from houses, open space and public streets is unavoidable. It would not be possible to have any radio or wireless telecommunications services anywhere in the Robe Township that was not visible.

The visual impact assessment concludes that the proposal is not likely to have a significant adverse impact on the scenic values of the Sports Ground, Golf Course or the scenic amenity of the wider Robe township. Please refer to the images provided below.

Too Close to houses and Historic part As mentioned in the DA Report submitted to Council, we have considered the provisions of the Development Plan and Robe Township acknowledge the significance and location of the Historic Conservation area. It is important to acknowledge that the telecommunications facility is located outside the Historic Conservation area and is not close to any individually listed heritage items. The Robe Sports Ground property does not have any specific heritage significance. The location and design of the telecommunications facility has been completed with consideration of the historic character of Robe as can be seen by the site selection and design. There is not expected to be any adverse impacts on the significance or value of the Historic Conservation area. The heritage significance of the conservation area focuses on Victoria Street and Smillie Street that are both well removed from the location of the telecommunications facility and there is not expected to be any significant adverse impacts on the amenity of these areas or specific items of heritage significance in the township.

In relation to the proximity to existing houses, as mentioned the nearest house is over 100 metres away. It is important to note that it is not uncommon for telecommunications facilities of this nature to be located within residential areas and there is no legislative requirement to separate wireless telecommunications facilities from residential properties. In more densely populated areas, it is common for wireless telecommunications facilities to be located on the rooftop of residential buildings or on the rooftops of hospitals. Given the Robe Township is the target for the telecommunications services and the Robe township is dominated by residential properties, it is not possible to locate the telecommunications facility where it would not be visible from residential land uses. In the site selection process, it is also important to consider the proximity of the telecommunications facility to the customers the proposal intends to serve now and in the future. In relation to the proposal Robe, the target customers are the people who live in, work in, visit or travel through the Robe township. It is important for the proposed facility to be close to the location of target customers to ensure the quality, speed and capacity of the telecommunications services is maximised. It is also important to enable the power levels of the radio signal to be minimised because the proposed facility operates better and more efficiently when it is close to the areas where the customer or users are located. This can result in a reduction in the power levels of the telecommunications facility and the power levels of the

users’ device or mobile phone. This is achieved through the power adaptive features of the proposed telecommunications facility and also the power adaptive features of mobile phone handsets. The proximity of the facility to the common user and the power adaptive features of the facility are an important factor in the network design, site selection process and satisfying the precautionary approach to the operation of the telecommunications facilities.

Devalue property Property values are subjective and influenced by a wide variety of factors. One of the many factors impacting property values is the quality of services including telecommunications services such as internet and mobile phone services. Relocate further away from residents We have provided Council with a list of the properties that have been specifically investigated for the proposed and tourist attractions to such telecommunications facility in Robe. There is also a map provided. In the representations it mentions the use of the Telstra locations to the south or at the south tower on Evans Cave Road. We can advise Council and the community that Optus has an existing facility on this tower and it shares the infrastructure with Telstra. With consideration of the network objectives, a thorough investigation of the area has east corner of Sports Ground or been completed and many options have been reviewed. The majority of alternative locations mentioned by the community have been previously considered including the south western corner of the sports ground, the Country Fire Service Property, the golf course, the sewage treatment facility and the western side of the Sports Ground. All these sites have all been considered. The consideration of the Country Fire Service property considered the development of a new tower, the use of the existing tower and potential extension of the existing tower. It is also important to understand that any significant change to the location of the facility would reduce or eliminate the benefit of the facility in relation to lighting for the Sports Ground which will improve the usability of the Sports Ground for formal and passive recreation. It is important to understand the location of the existing Optus telecommunications facilities in the wider surrounding area and in particular, the existing Optus facility near the water treatment plant at Evans Cave Road. As a result of the telecommunications services

provided by the existing facility, the potential locations of the new facility are focused on the Robe Township and being close to the commercial and residential areas of Robe. The proposal is considered to be a good solution to meet the requirements of the proposed infrastructure and the network objectives. Please refer to the map provided at the bottom of this correspondence and the information in the Planning Report.
