CHAPTER5 ELIGIBILITYAND DENIAL OF ASSISTANCE Definition of Family Program Requirements

Each applicant for assistanceunder the housing choice voucher program must meet the PHA's definition of family. Within guidelines provided by HUD, a PHA has discretion in its definition of what constitutes a family.

A family is either a singleperson or a group of personsand includes: r I householdwith or without children.A who is temporarily away from home due to placementin foster care shouldbe considereda memberof the family. . An elderly family, which is defined as a family whosehead, co-head, spouse, or sole member is at least62 yearsof age;or two or more persons,each of whom are at least62,living together;or one or more personswho are at least62 living with one or more live-in aides. r { disabled family, which means a family whose head, co-head, spouse,or sole member is a person with disabilities; or two or more personswith disabilities; or one or more personswith disabilities with one or more live-in aides. r d displacedfamily, which is a family in which eachmember or the sole member is a persondisplaced by govemmentalaction, or whosedwelling hasbeen extensively damaged or destroyedas a result of a disasterdeclared or otherwiseformally recognizedby federaldisaster relief laws. r d remainingmember of a tenantfamily is a family memberof an assistedtenant family who remainsin the unit when other membersof the family have left the unit. . To receivetenant-based assistance, the participantor family selects a suitable unit or home. The participant or family is free to chooseany housing that meets the requirementsof the program and is not limited to units locatedin subsidizedhousing projects. After approving the tenancy, the public housing authority (PHA) entersinto a contract in which a housing subsidyis paid to the landlord directly by the public housingauthority on behalf of the participating family. The family then pays the difference betweenthe actual rent chargedby the landlord and the amountsubsidized by the program.The PHA contractwith the owner/landlordonly coversa single unit and a specific assistedfamily. If the family moves out of the leasedunit, the contract with the owner terminates.However, HUD is aware that a family's housingneeds change over time with changesin family size,job locations,and for other reasons.The housingchoice voucher program is designedto allow families to move without the loss of housingassistance. Moves are permissibleas long as the family notifies the PHA aheadof time, terminatesits existing leasewithin the leaseprovisions, and finds acceptablealternate housing. Under certaincircumstance, the PHA may set limits on moves for a given family. Under certaincircumstances, if authorizedby the PHA, a family may use its voucherto purchase a modesthome.

$ 982.314Move with continuedtenant-based assistance. (a) Appticabitity. This section stateswhen a participant family may move to a new unit with continued tenant-based assistance:(b) Whenfamitymay move.A family may move to a new unit it (l) The assistedlease for the old unit has terminated.This includesa terminationbecause: (i) The PHA hasterminated the HAP contractfor the owner's breach;or (ii) The leasehas terminated by mutual agreementof the owner and the tenant. (2) The owner has given the tenant a notice to yacate,or has commencedan actionto evict the tenant,or has obtaineda courtjudgment or other processallowing the owner to evict the tenant.(3)The tenanthas given notice of leasetermination (if the tenanthas aright to terminatethe leaseon notice to the owner, for owner breach or otherwise). (c) How mqny moves.(l) A participant family may move one or more times with continued assistanceunder the program, either inside the PHA jurisdiction, or under the portability procedures.(See $ 982.353) (2) The PHA may establish: (i) Policies that prohitit any move by the family during the initial leaseterm; and (ii) Policies that prohibit more than one move by the family dwing any one year period. (3) The PHA policies may apply to moveswithin the PHA jurisdiction by a participantfamily, and to movesby a participantfamily outsidethe PHA jurisdiction under portability procedures.(d) Notice thatfamity,oants to move.(l) If the family terminatesthe leaseon notice to the o*n"r, the familymust give the PHA a copy of the notice at the sametime. (2) If the family wants to move to a new unit, the family must notiff the PHA and the owner beforemoving from the old unit. If the family wants to move to a new unit that is locatedoutside the initial PHA jurisdiction, the noticeto the initial PHA must specif, the areawhere the family wants to move. This subpartdescribes program requirements for specialhousing types. 2 982.620(a).(c)Family choice of housing and housing type. The PHA may not set aside program funding for special housing t)?es, or for a specificspecial housing type. The family chooseswhether to rent housingthat qualifies as a specialhousing type under this subpart,or as any specificspecial housing type, or to rent other eligible housingin accordancewith requirementsof the program.The PHA may not restrictthe family's freedomto chooseamong availableunits in accordance with$ 982.353.(d)Applicability of requirements.Except as modified by this subpart,requirements in the other subpartsof this part apply to the specialhousing types. "Shared Another option available to roommates is the Housing" option in which a participant or "family" can share a or unit with another resident. The other resident(s) with whom the participant sharesthe unit does not have to receive Section 8 assistance,as the landlord executes separateleases with each participant or family. Each participant may use their own voucher for the shared unit, which "common" covers use of their own private bedroom(s) as well as accessto and use of a shared or public space (kitchen, living room, etc.). A 0-bedroom or 1-bedroom unit cannot be used for shared housing.

SHAREDHOUSING [24CFR 982.615 through 982.618] I5-IV.A. OVERVIEW Sharedhousing is a singlehousing unit occupiedby an assistedfamily andanother resident or residents.The sharedunit consistsof both commonspace for useby the occupantsof the unit andseparate private space for eachassisted family. An assistedfamily may sharea unit with otherpersons assisted under the HCV programor with otherunassisted persons. The ownerof a sharedhousing unit mayreside in theunit, but housingassistance may not be paidon behalfof theowner. The residentowner may not berelated by bloodor marriageto theassisted family. If approvedby the PHA,a live-inaide may residewith thefamily to carefor a personwith disabilities.The PHA mustapprove a live-inaide if neededas a reasonable accommodationso that the program is readilyaccessible to andusable by personswith disabilities.When providing HCV assistancein sharedhousing, a separatelease and HAP contractare executed for eachassisted family, andthe standardform of the HAP contractis used.

15.IV.8. PAYMENT STANDARD,UTILITY ALLOWANCE AND HAP CALCULATION Thepayment standard for a family in sharedhousing is the lowerof thepayment standard for thefamily unit sizeor the proratashare of the paymentstandard for the sharedhousing unit size.The proratashare is calculatedby dividingthe number of bedroomsavailable for occupancyby theassisted family in theprivate space by thetotal number of bedroomsin theunit. TheHAP for a familyin sharedhousing is the lowerof thepayment standard minus the TTP or thegross rent minus the TTP. Theutility allowancefor anassisted family living in sharedhousing is theprorata share of theutility allowancefor theshared housingunit. The rents paid for familiesliving in sharedhousing are subject to generallyapplicable standards for rent reasonableness.The rent paid to theowner for theassisted family must not exceedthe pro-rata portion of thereasonable rent for theshared unit. In determiningreasonable rent, the PHA shouldconsider whether sanitary and food preparation areas are privateor shared.

Is-IV.C. HOUSING QUALITY STANDARDS ThePHA maynot giveapproval to residein sharedhousing unless the entire unit, including the portion of theunit available for useby theassisted family under its lease,meets the housing quality standards. HQSrequirements described in Chapter8 applyto sharedhousing except for therequirements stated below. c FacilitiesAvailable for theFamily: Facilities available to theassisted family, whether shared or private,must include a living room,a bathroom,and food preparation and refuse disposal facilities. . Spaceand Security: The entire unit must provide adequate space and security for all assistedand unassisted residents. Theprivate space for eachassisted family must contain at leastone bedroom for eachtwo personsin the family.The numberof bedroomsin theprivate space of anassisted family must not be lessthan the family unit size.A 0-bedroomor l-bedroomunit maynot be usedfor sharedhousing.

Eligibility for Section8 assistanceis determinedby income of all adult family members.Income limits vary amongparish and cities in Louisiana. Generally,a PHA usesthe o'verylow income" table (50% of median income) to determineeligibility for a voucher. (Seetable attachment)

HUD studies show that many assistedfamilies pay the incorrect amount of rent. The primary causesare: 1) Under-reportingof income by residents 2) PHA's not grantingexclusions and deductionto which residentsare entitled

Annual Income:

"Annual Income" refers to all amounts,monetary or not, which go to, or on behalf of, the residentsliving in the home (incomepaid to children are not counted). This includes: . the full amount of wages/salaries(before deductions) t commissions,fees, tips, and other compensationfor personalservices . the full amount of amounts received from Social Security, annuities, insurancepolicies, pensions,disability or deathbenefits, unemployment benefits, disability or worker's compensation,welfare assistance,alimony, child support payments

"Annual Income" doesnot include: . Amounts receivedthat are specificallyfor, or in reimbursementof, the cost of medical expensesfor any family member r Income of a live-in aide . Full amount of financial assistancepaid directly to the student or educational institution r Amounts received under training programs funded by HUD: r Amounts receivedby personwith a disability that are disregardedfor a limited time purposesof SSI eligibility and benefitsbecause they are set asidefor use under a Plan to Attain Self-Sufficiency(PAS S) . Amount receivedby a personin other publicly assistedprograms which are specifically for, or in reimbursementof out-of-pocketexpenses incurred (special equipment, clothing, tlansportation,child-care, etc) and which are made solely to allow participationin a specificprogram . Earning in excessof $480 for eachfull-time student18 yearsor older (excludinghead of householdand spouse) . Deferred periodic amount from supplementalsecurity benefits that are received in a lump sum amount or in prospectivemonthly amounts

Deductions/Allowancesresulting in Adjusted Income:

Mandatory deductions (amounts subtractedfrom the family's annual income to produce the "adjustedincome") allowed:

. Dependentallowance: $480 for eachmember of the family (excludinghead of household or spouse)who is lessthan l8 yearsold or who is a studentor personwith a disability. "head (the roommotenot considered of household" could get this) . ElderlyDisabled Householdallowance: $400 for any elderly family or disabledfamily "head (this amount is per family, not per person infamily)(the of household" roommate could get this) . Disability assistance:families are entitled to a deduction for unreimbursedexpenses to cover care attendantsand auxillary apparatus(i.e., wheelchairs,ramps, adaptationsto vehicles, or special equipment to enable a blind person to read or type) for any family memberwith disabilities,to the extendthese expenses are necessaryto enablea family members(including the family memberwith disabilities) l8 or older to be employed The sum of the expensesnoted aboveis allowableto the extentthe sum exceeds3Yo of annual family income. . Medical expenses:medical expensesof all family membersmay be counted. Medical expensesare expensesanticipated to be incurred during the 12 months following certification or reexamination which are not covered by an outside source such as insurance. This allowance is intended to give a family an allowance to anticipate regular ongoing and anticipated expensesduring the coming year. Medical expensesmay include: servicesofdoctors or other healthcareprofessionals, services ofhealth care facilities, medical insurancepremiums, prescription/non-prescription medicines (prescribedby physician),transportation to treatment(cab fare, bus fare, mileage), dentalexpenses, eyeglasses, hearing aids, batteries, live-in or periodic medical assistance,monthly paymenton accumulatemedical bills (regularmonthly paymentson a bill that was previously incuned). The sum of the expensesnoted above is allowable to the extent the sum exceeds3o/o of annual family income

Permissivedeductions: PHA's may establishother deductionsas they wish, howeverHUD does not provide any additional operating subsidy and the PHA must establish a written policy for the deductions

q Hardship: PHA's must waive the minimum monthly rent requirement for any family unable to pay due to financial hardshipsas describedin PHA's wdtten policies. A family paying flat rent may at any time request a switch to payment of income-basedrent if the family is unable to pay flat rent becauseof financial hardships. Financial hardshipsinclude : - Decreasein income becauseof changedcircumstances including loss or reduction of employment, death in the family, ore reduction in or loss of earnings or other assistance - Increasein expenses,because of changedcircumstances, for medical costs, child care, transportation,education, or similar items - Other situations determinedby the PHA to be appropriate

Maximum Initial Rent Burden (Housing Choice Voucher Only): The family's sharemay not exceed40o/o of the family's monthly adjusted income when the family initially moves into the unit or signs the first assistedlease for a unit. This applies only when the grossrent for the unit exceedthe applicable payment standard.

lo Use of SupplementalNutrition AssistanceProgram (SNAP) by roommates: This program was formerly called the Food Stamp program. Per SNAP federal regulations, a "householdo'is composedof one of the following individuals or groupsof individuals: 1) An individual living alone 2) An individual living with others, but customarily purchasing food and preparing meals for home consumption separateand apart from others; or 3) A group of individuals who live together and customarily purchasefood and preparemeals together for home consumption. "" #2 is an example of two separate living together but each is responsiblefor purchasing and preparing their meals apart from the other household.Consequently, each "household" or roommate can apply for SNAP benefits separately,even if living together. In these circumstances, each applicant must note on their application that they will be purchasing and preparing their meals separatelyfrom the others who live in the household. #3 is an exampleof one singlehousehold which would consistof everyoneliving in the home (i.e.,2-3 roommates)and applying together for SNAP benefits. In the application, one of the roommateswill be "head designatedas of household". In the event of one or more of the roommatesmoving out, then the "head of household"will needto inform the SNAP agencyof the changein householdcomposition and income. The person who moves out will need to reapply for SNAP benefits on their own application, which may take up to 30 days. Any changesin income, amount paid in rent, amount received via voucher or other housing assistance, or number of people in the householdmust be reported to the SNAP agency within 10 day of the chanse.
