American Veterinary Medical Association Legislative Scorecard 112th Congress 6/30/2011 The American Veterinary Medical Association Governmental Relations Division advocates for the AVMA’s policies and positions on federal legislative issues that influence animal and human health and advance the veterinary medical profession. The AVMA has five classifications for legislative priorities or issues: The following federal legislative scoring system will be used for legislation and executive branch rule- making (regulations): Active Pursuit of Passage – This means that the bill or regulatory action will be placed on the AVMA legislative agenda for the current session of Congress and that a high priority application of AVMA human resources will be expended to pass the bill or adopt the regulation. Support – This means that the AVMA supports the bill or regulation; however, it is not a high priority and is not listed on the AVMA legislative agenda for the current session of Congress. A low priority application of AVMA human resources should be expended on the bill or regulation. However, if asked, the AVMA is on record for supporting the bill or regulation. Non-Support – This means that the AVMA does not support the bill or regulation as written, it is not a high priority, and it is not listed on the AVMA legislative agenda for the current session of Congress. A low priority application of AVMA human resources should be expended on the bill or regulation. However, if asked, the AVMA is on record of not supporting the bill or regulation. If applicable and appropriate, the AVMA may identify areas of the bill or regulation that would need to be changed for support of the bill or regulation to be a consideration. Active Pursuit of Defeat – This means that the bill or regulation will be placed on the AVMA legislative agenda for the current session of Congress and that a high priority application of AVMA human resources will be expended to stop the bill from becoming law or the regulation becoming adopted. No Action – This means that the AVMA makes no recommendation on the bill or regulation and the AVMA does not have a position on the bill or regulation. The Governmental Relations Division Staff will continue to monitor the legislation and advise the LAC should the legislation's status change. We are pleased to provide you with this legislative scorecard for the 112th Congress, which gives you a snapshot of your Member of Congress’ support for AVMA legislative initiatives. House of Representatives H.R. 4 Comprehensive 1099 Taxpayer Protection and Repayment of Exchange Subsidy Overpayments Act of 2011 amends the Internal Revenue Code to: (1) repeal requirements for the reporting to the Internal Revenue Service (IRS) of payments of $600 or more to corporations that are not tax-exempt and of gross proceeds paid in consideration for any type of property; (2) repeal requirements for reporting payments made with respect to rental property which is not part of a trade or business; and (3) increase, for taxable years ending after December 31, 2013, the advance applicable dollar amount of the tax credit for health care premium assistance for taxpayers whose household income is less than 400% of the poverty line. This legislation, which was passed by the House and Senate and signed by the President (P.L. 112-9) will repeal the onerous 1099 reporting requirement that was part of the Patient Protection and Affordable Care Act(Healthcare Reform). A “▼”means that the legislator took an anti-AVMA position and voted against the bill. H.R. 525 Veterinary Public Health Amendments Act adds veterinary public health as an eligible grantee for public health workforce grants (authorized by Section 5206 of PL 111-148), and makes veterinarians studying public health eligible for Public Health Workforce Loan Repayment Program to assure an adequate supply of public health professionals to eliminate critical public health workforce shortages in federal, state, local, and tribal public health agencies. A “▼”means that the legislator took an anti-AVMA position and voted against the bill. HR 965 Preservation of Antibiotics for Medical Treatment Act would amend the Federal Food, Drug, and Cosmetic Act to purportedly preserve the effectiveness of medically important antibiotics used in the treatment of human and animal disease. The stated purpose of the bills “is to preserve the effectiveness of medically important antibiotics used in the treatment of human and animal diseases by phasing out use of certain antibiotics for nontherapeutic purposes in food-producing animals.” AVMA Position: Active Pursuit of Defeat Legislative Scorecard: A “▼”means that the legislator took an anti-AVMA position on the bill and cosponsored H.R. 965 H.R. 1406 Fairness to Pet Owners Act would impose new stipulations on veterinary prescriptions. The bill requires a veterinarian to 1) write a prescription whether or not he/she will dispense the product; 2) provide a written disclosure that clients may fill prescriptions at the veterinary clinic or at an off-site pharmacy; and 3) verify a prescription electronically or by other means consistent with applicable State law.
