    March 12, 2014 President Barack Obama The White House 1600 Pennsylvania Ave, NW Washington DC 20500 Dear Mr. President, We, the undersigned organizations, are writing to urge you to expedite the declassification of the report by the Senate Select Committee on Intelligence (SSCI) on the interrogation and detention practices of the Central Intelligence Agency (CIA). The necessity of disclosing this report is underscored by indications that CIA has interfered with the Committee's work. On March 11, SSCI Chairman Dianne Feinstein confirmed reports that the CIA conducted surveillance on computers used by SSCI staff and detailed additional agency interference with the Committee’s investigation into the CIA’s rendition, detention and interrogation (RDI) program. CIA Director John Brennan subsequently denied any impropriety. The conduct Chairman Feinstein described would violate constitutional separation of powers and is deeply troubling. During a SSCI hearing in January, Senator Ron Wyden (D-OR) asked CIA Director John Brennan about whether the CIA was subject to the Federal Computer Fraud and Abuse Act (18 U.S.C. § 1030), which prohibits accessing government computers networks without authorization. Director Brennan later admitted that the statute does apply to the agency. Allegations of unlawful CIA surveillance of the computers used by SSCI staffers to prepare their report on the RDI program require a thorough, independent investigation. Chairman Feinstein noted that the surveillance “was followed by an allegation which we now have seen repeated anonymously in the press, that the committee staff had somehow obtained the document through unauthorized or criminal means.” She described the document as an internal agency review of interrogation practices named for former CIA Director Leon Panetta.

    CHAPTER 9 Ike’s Dystopian Dream, and How It Came True Shahid Buttar This January marked the sixty-fifthfifty anniversary of a speech by the last victorious military commander to occupy the White House, President Dwight D. “Ike” Eisenhower.1 His visionary warning holds crucial implications for the US today, and has been overlooked in debates across a range of policy areas, from mass surveillance to police accountability. Ike was elected to the White House after playing a key role in World War II as supreme commander of the Allied forces in Europe. In his farewell address, he warned the American people of a threat that he had helped create. Even before winning office, then-General Eisenhower coordinated a world-historical industrial mobilization that enabled the US to liberate Europe and defend democracy from the global threat of fascism. But as he retired, Ike expressed concerns about its future consequences. FORGOTTEN: A PRESIDENT’S PRESCIENT WARNING In his departing speech to the American people before leaving the White House,2 Eisenhower described the necessity of creating a defense industry intertwined with secret government agencies, while predicting—in no uncertain terms—that they would together come to present a threat to democracy in America. President Eisenhower said, [W]e have been compelled to create a permanent armaments industry of vast proportions. 341 This conjunction of an immense military establishment and a large arms industry is new in the American experi- ence. The total influence—economic, political, even spiri- tual—is felt in every city, every State house, every office of the Federal government.

    Senate Intelligence Committee Chairman Dianne Feinstein Remarks on Committee Report on CIA Detention, Interrogation Program March 11, 2014 Over the past week, there have been numerous press articles written about the Intelligence Committee’s oversight review of the Detention and Interrogation Program of the CIA, specifically press attention has focused on the CIA’s intrusion and search of the Senate Select Committee’s computers as well as the committee’s acquisition of a certain internal CIA document known as the Panetta Review. I rise today to set the record straight and to provide a full accounting of the facts and history. Let me say up front that I come to the Senate Floor reluctantly. Since January 15, 2014, when I was informed of the CIA’s search of this committee’s network, I have been trying to resolve this dispute in a discreet and respectful way. I have not commented in response to media requests for additional information on this matter. However, the increasing amount of inaccurate information circulating now cannot be allowed to stand unanswered. The origin of this study: The CIA’s detention and interrogation program began operations in 2002, though it was not until September 2006, that Members of the Intelligence Committee, other than the Chairman and Vice Chairman, were briefed. In fact, we were briefed by then-CIA Director Hayden only hours before President Bush disclosed the program to the public. A little more than a year later, on December 6, 2007, a New York Times article revealed the troubling fact that the CIA had destroyed videotapes of some of the CIA’s first interrogations using so-called “enhanced techniques.” We learned that this destruction was over the objections of President Bush’s White House Counsel and the Director of National Intelligence.

    Constitutional Conflict Escalates between US Senate and CIA By Patrick Martin Region: USA Global Research, March 22, 2014 Theme: Intelligence, Police State & Civil World Socialist Web Site Rights In twin letters sent Wednesday to the Justice Department and the Central Intelligence Agency, Senate Majority Leader Harry Reid renewed charges of unconstitutional CIA spying on the Senate, first made in a speech March 11 by the chair of the Senate Intelligence Committee, Dianne Feinstein. Reid’s letters represent a significant escalation of the constitutional conflict that has erupted since the public exposure of CIA spying on the Senate committee, which is charged with the legal responsibility of overseeing the intelligence agency. The CIA was seeking to track down how the committee came into possession of an internal CIA report, the so-called “Panetta Review,” which acknowledged CIA torture in secret overseas prisons, and a subsequent cover-up by CIA operatives that has also implicated the White House. The Senate panel has prepared a 6,300-page draft report on the torture program, which began in 2002 under Bush and was officially ended under Obama in January 2009. The CIA has been fighting to prevent publication of the report for more than a year. In the letter to Attorney General Eric Holder, the top official of the Justice Department, Reid noted the CIA’s own admission that it had accessed files on a computer network reserved for the use of the Intelligence Committee staff. He then declared: “The CIA’s decision to access the resources and work product of the legislative branch without permission is absolutely indefensible, regardless of the context.

Introduction After the terrorist attacks of September 11, 2001, President Bush signed a secret memorandum authorizing the CIA to “undertake operations designed to capture and detain persons who pose a continuing, serious threat of violence or death to U.S. persons and interests.”1 In 2002, Bush signed a memorandum stating that the Geneva Conventions do not apply to the global conflict with Al-Qaeda.2 Over the following seven years the CIA, with varying levels of collaboration and approval from the Bush Administration, created an interrogation and detention program for foreign terrorism suspects that employed methods that would be characterized by many as torture and as violating the Geneva Conventions. During this period, it was unclear exactly what methods the CIA was employing and on whom, how much the CIA was keeping the White House or Congress informed, whether there was any oversight of the program, and whether and how much of the information coming from the CIA about the program was accurate. After it became known that in 2007 the CIA had destroyed tapes of interrogations of detainees, the Senate Select Committee (“the committee”) on Intelligence became interested in investigating the Interrogation and Detention Program.3 The investigation officially commenced in 2009, and the committee finished the report in 2012, but an executive summary of the report was not released until December 9, 2014.
