Haley School of Law A sweeping proviso that protects basic or fundamental interests of a legal system is known in various names – ordre public, public policy, public order, government’s interest or Vorbehaltklausel. This study focuses on the concept of Indonesian public order in private international law. It argues that Indonesia has extraordinary layers of pluralism with respect to its people, statehood and law. Indonesian history is filled with the pursuit of nationhood while protecting diversity. The legal system has been the unifying instrument for the nation. However the selected cases on public order show that the legal system still lacks in coherence. Indonesian courts have treated public order argument inconsistently. A prima facie observation may find Indonesian public order unintelligible, and the courts have gained notoriety for it. This study proposes a different perspective. It sees public order in light of Indonesia’s legal pluralism and the stages of legal development. -

This research was conducted in nine residential buildings in Semarang City. The research was carried out with two meth- ods: building inspection and wood-feeding method by using Pinus mercusii wood measures 2 cm x 2 cm x 46 cm. The results found four types of termites that attack wood feeds namely Macrotermes gilvus, Microtermes inspiratus, Odontotermes javanicus, Coptotermes curvignathus and Cryptotermes sp.. Based on interviews and building in- spection, it was known that the condition of the building in the category of “moder- ate” was occupying the most position (74.44%), good (17.78%) and lightly damaged (7.78%). -

KETUA MAHKAMAH AGUNG REPUBLIK INDONESIA (1945-SEKARANG) 1. Prof. Dr.Kusuma Atmadja, SH (1945-1952) Kusuma Atmadja lahir di Purwakarta, 8 September 1898 dan meninggal di Jakarta, 11 1 Agustus 1952. Beliau memperoleh gelar diploma dari Rechtsschool pada tahun 1913. Kariernya di dunia pengadilan dimulai sebagai pegawai yang diperbantukan pada Pengadilan di Bogor (1919). Pada tahun 1919, beliau melanjutkan pendidikan hukumnya di Universitas Leiden, Belanda dan mendapat gelar Doctor in de recht geleerheid pada tahun 1922. Kembali ke Hindia Belanda, beliau dipercaya menjadi hakim di Raad Van Justitie (setingkat Pengadilan Tinggi) Batavia dan setelahnya diangkat menjadi Voor Zitter Landraad (Ketua Pengadilan Negeri) di Indramayu. Pada masa penjajahan Jepang, beliau pernah menjabat Ketua Tihoo Hooin (Pengadilan Negeri) di Semarang, Hakim Pengadilan Tinggi Padang dan Hakim Pengadilan Tinggi Semarang. Kusuma Atmadja selaku Ketua Mahkamah Agung pertama menghadapi tantangan- tantangan zaman revolusi dimana hukum bukanlah prioritas utama. Pada masa-masa awal kemerdekaan, masih belum ada kejelasan tugas Mahkamah Agung, selain bekerja sebagai panitia penyusunan perundang-undangan baru. Pada tahun 1946, perkara Sudarsono menjadi perkara pertama yang bermuatan politis yang ditangani oleh Mahkamah Agung. Kasus penculikan Perdana Menteri Sjahrir pada tahun 1946 oleh anasir tentara yang kecewa dan didukung oleh beberapa pemuka politik, kemudian disebut sebagai perkara Sudarsono. Dalam perkara ini Kusuma Atmadja menentang tekanan politik dari Presiden Soekarno. Ada dugaan kuat Presiden Soekarno menekan Mahkamah Agung karena kedekatannya dengan beberapa terdakwa. Namun Kusuma Atmadja dengan tegas menyatakan bahwa Mahkamah Agung adalah lembaga mandiri yang harus bebas campur tangan politik yang berasal dari lembaga manapun. William Liddle, Adviser Professor Richard Gunther ____________________________ Adviser Professor Timothy Frye Political Science Graduate Program ABSTRACT The choice of political institutions is a critical aspect of a democratic transition. Significant amendments to the 1945 Constitution have transformed it into a more democratic framework with extensive separation of powers and checks and balances. Despite the introduction of the “difficult combination” of pure presidentialism and multipartism to Indonesia, consensual patterns of elite behavior should contribute to the further consolidation of democracy. This study examines the impact of the first four amendments on executive- legislative relations and presidential power. The use of the 1945 Constitution by two authoritarian regimes for four decades gave rise to the perception that it inevitably created a dominant presidency. Thus Indonesian political elites set out in 1999 to curtail presidential power. Paradoxically, by the end of the process three years later they created a comparatively very powerful president, primarily due to the introduction of direct election and the narrowing of the grounds for impeachment. In addition, although the president’s residual powers have been restricted, only slight reductions were made in her specific powers. This study utilizes concepts from political economy and political psychology to analyze the struggle between two broad camps in the constituent assembly (MPR): conservatives, led by Megawati Soekarnoputri and her Indonesian Democracy ii Party-Struggle (PDI-P) and progressives from most of the other major political parties. -
