We hoped the companies, who have spent the last decade collecting new and increasingly detailed points of information from their customers, would realize the importance of implementing meaningful privacy protections. But this year’s Cambridge Analytica scandal, following on the heels of many others, was the last straw. Corporations are willfully failing to respect the privacy of technology users, and we need new approaches to give them real incentives to do better—and that includes updating our privacy laws. EFF welcomes the opportunity to work with the Department of Commerce in crafting the federal government’s position on consumer privacy. The Request for Comment published in the Federal Register identifies seven main areas of discussion: Transparency, Control, Reasonable Minimization, Security, Access and Correction, Risk Management, and Accountability. These discussion points have been thoroughly analyzed by academics over the past decades, leading to recommendations like the Fair -

SWIMMERS, SURFERS, AND SUE SMITH PERSONALITY RIGHTS IN AUSTRALIA1 Therese Catanzariti2 It is somewhat of a misnomer to talk about personality rights in Australia. First, personality rights are not “rights” in the sense of positive rights, a right to do something, or in the sense of proprietary rights, property that can be assigned or mortgaged. Second, personality rights are largely a US law concept, derived from US state law relating to the “right of publicity”. However, it is common commercial practice that Australian performers, actors and sportstars enter endorsement or sponsorship agreements.3 In addition, the Australian Media and Entertainment Arts Alliance, the Australian actors union, insists that the film and television industrial agreements and awards don’t cover merchandising and insist film and television producers enter individual agreements if they want to use an actor’s image in merchandising.4 This paper considers Australian law5 relating to defamation, passing off, and section 52 of the Trade Practices Act,6 draws parallels with US law relating to the right of publicity, and considers whether there is a developing Australian jurisprudence of “personality rights”. Protecting Personality Acknowledging and protecting personality rights protects privacy. But protecting privacy is not the focus and is an unintended incidental. Protecting personality rights protects investment, and has more in common with unfair competition than privacy. Acknowledging and protecting personality rights protects investment in creating and maintaining a carefully manicured public image, an investment of time labour, skill and cash. This includes spin doctors and personal trainers and make-up artists and plastic surgeons and making sure some stories never get into the press. -

Large- scale clinical studies found that COVID-19 vaccines prevented most people from getting COVID- 19 illness, but like most other vaccines, they are not 100 percent effective. This means some fully vaccinated people will still get infected with SARS-CoV-2. These individuals may or may not develop COVID-19 symptoms. Vaccine breakthrough occurs when someone gets infected with an organism they are fully vaccinated against. For the COVID-19 vaccine, this means someone tests positive for SARS-CoV- 2 two weeks or more after receiving the full series of an authorized COVID-19 vaccine. Since millions of people in the United States are getting vaccinated, we expect to see some breakthrough disease. Fortunately, there is evidence from research studies that the COVID-19 vaccine reduces the risk of people getting really sick and needing to go to the hospital or dying from COVID-19. -

TIED UP IN KNOTTS? GPS TECHNOLOGY AND THE FOURTH AMENDMENT * Renée McDonald Hutchins Judicial and scholarly assessment of emerging technology seems poised to drive the Fourth Amendment down one of three paths. The first would simply relegate the amendment to a footnote in history books by limiting its reach to harms that the framers specifically envisioned. A modified version of this first approach would dispense with expansive constitutional notions of privacy and replace them with legislative fixes. A third path offers the amendment continued vitality but requires the U.S. Supreme Court to overhaul its Fourth Amendment analysis. Fortunately, a fourth alternative is available to cabin emerging tech- nologies within the existing doctrinal framework. Analysis of satellite-based tracking illustrates this last approach. The Global Positioning System (GPS) allows law enforcement officials to monitor an individual’s precise movements for weeks or months at a time. GPS technology not only is substantially different than anything the Court has previously considered, but also is a substantial threat to fundamental notions of privacy. By illustrating how, with only minor tweaking, existing Fourth Amendment law can effectively rein in intrusive applications of this one emerging technology, this Article begins to construct an analytical framework that can be applied more broadly to future technological enhancements. This Article begins by reviewing the science and capabilities of GPS- enhanced surveillance. It concludes that satellite-based tracking is a powerful investigative tool that enables authorities to monitor the movements (both indoors and out) of an unlimited number of people for weeks or months at a time. This Article then examines the Court’s historical treatment of techno- logically enhanced surveillance, and shows that the intrusiveness of an emerging technology is critical to its constitutional treatment. -

Under the Radar: NSA’s Efforts to Secure Private-Sector Telecommunications Infrastructure Susan Landau* INTRODUCTION When Google discovered that intruders were accessing certain Gmail ac- counts and stealing intellectual property,1 the company turned to the National Security Agency (NSA) for help in securing its systems. For a company that had faced accusations of violating user privacy, to ask for help from the agency that had been wiretapping Americans without warrants appeared decidedly odd, and Google came under a great deal of criticism. Google had approached a number of federal agencies for help on its problem; press reports focused on the company’s approach to the NSA. Google’s was the sensible approach. Not only was NSA the sole government agency with the necessary expertise to aid the company after its systems had been exploited, it was also the right agency to be doing so. That seems especially ironic in light of the recent revelations by Edward Snowden over the extent of NSA surveillance, including, apparently, Google inter-data-center communications.2 The NSA has always had two functions: the well-known one of signals intelligence, known in the trade as SIGINT, and the lesser known one of communications security or COMSEC. The former became the subject of novels, histories of the agency, and legend. The latter has garnered much less attention. One example of the myriad one could pick is David Kahn’s seminal book on cryptography, The Codebreakers: The Comprehensive History of Secret Communication from Ancient Times to the Internet.3 It devotes fifty pages to NSA and SIGINT and only ten pages to NSA and COMSEC. -

Preface This booklet provides the background for a better understanding of the Traffic Alert and Collision Avoidance System (TCAS II) by personnel involved in the implementation and operation of TCAS II. This booklet is an update of the TCAS II Version 7.0 manual published in 2000 by the Federal Aviation Administration (FAA). It describes changes to the CAS logic introduced by Version 7.1 and updates the information on requirements for use of TCAS II and operational experience. Version 7.1 logic changes will improve TCAS Resolution Advisory (RA) sense reversal logic in vertical chase situations. In addition all “Adjust Vertical Speed, Adjust” RAs are converted to “Level-Off, Level-Off” RAs to make it more clear that a reduction in vertical rate is required. The Minimum Operational Performance Standards (MOPS) for TCAS II Version 7.1 were approved in June 2008 and Version 7.1 units are expected to be operating by 2010-2011.
