Ramesh s/o Krishnan v AXA Life Insurance Singapore Pte Ltd [2016] SGCA 47 Court of Appeal — Civil Appeal No 112 of 2015 Sundaresh Menon CJ, Chao Hick Tin JA and Steven Chong J 25 November 2015 27 July 2016 Judgment reserved. Sundaresh Menon CJ (delivering the judgment of the court): Introduction 1 Employers often require potential hirees to provide references from their former employers. Such references may serve as a basis for the prospective employer to assess the applicant’s character and abilities, and will likely have at least some, if not significant, bearing on the applicant’s chances of obtaining employment. For this and other reasons, which we will elaborate upon in the course of this judgment, it is important that employers prepare such references, when called upon to do so, in a fair and accurate manner to avoid unjustifiably prejudicing the former employee’s prospects of obtaining fresh employment. Before us, it was accepted that an employer has a duty of care when preparing such a reference.

  • Career Options with Your LLM
Career Options with your LLM Introduction Every student will have individual reasons for undertaking the LLM qualification. These may include enhancing or broadening career opportunities or adding value and depth to their CV. This leaflet aims to outline the main job opportunities open to LLM students, provide information on how to research opportunities and signpost further support. What skills does an LLM develop? As well as intellectual skills and professional expertise in a specialist area of law (e.g. Maritime, International Commercial Law) the LLM course also enables you to develop a range of transferable skills which are useful in whatever career path you choose to pursue. These include legal research and writing, analysis, critical evaluation and logical thinking as well as written and verbal communication. What types of careers can LLM graduates consider? UK Legal Market As every student has a different background and experience there is no single route to qualifying or working in the UK legal market. You will have to research the routes available and determine which of these is relevant and appropriate for you. Solicitor Qualifying as a solicitor currently requires completing a Legal Practice Course (LPC) followed by a two-year Training Contract. Depending on your previous experience and qualifications, you may have to complete a conversion course known as a Graduate Diploma in Law (GDL) before undertaking the LPC. However, you should note that the GDL and LPC will be replaced by a super-exam, the Solicitors Qualifying Examination (SQE), due to be introduced in 2020. The SQE will introduce a more flexible approach to work-based experience and will no longer require students to sign up for the GDL or LPC.

  • Insurance Law Committee Response to the Law Commission and Scottish Law Commission's Consultation on the Draft Insurable Interest Bill
Insurance Law Committee response to the Law Commission and Scottish Law Commission's consultation on the draft Insurable Interest Bill The City of London Law Society (“CLLS”) represents approximately 15,000 City lawyers through individual and corporate membership including some of the largest international law firms in the world. These law firms advise a variety of clients from multinational companies and financial institutions to Government departments, often in relation to complex, multi-jurisdictional legal issues. The CLLS responds to a variety of consultations on issues of importance to its members through its 19 specialist committees. This response in respect of the Law Commission and Scottish Law Commission's consultation on the draft Insurable Interest Bill has been prepared by the CLLS Insurance Law Committee (the "Committee"). The Law Commission and the Scottish Law Commission have published a draft Insurable Interest Bill (the "Bill") and notes to accompany the draft Bill, together with a list of questions for consultees. The Committee's responses to the questions are set out below. CLAUSE 1: DEFINITIONS Q1. Do consultees agree that personal accident critical illness, disability and other insurances dependent on human life be subject to the same insurable interest rules as life insurance? The Committee has no comments on this question. Page 1 Q2. Do consultees consider that the definition of “life-related insurance” works for insurance-linked investment products, and annuities? The Committee considers that the proposed definition of the “insured” is unnecessarily restrictive and might disqualify contracts taken out by a person on behalf of another, for example where pension fund trustees contract through a common investment fund or where there is a requirement for the insurance contract to be issued to a depositary.

  • OPENING of the LEGAL YEAR 2021 Speech by Attorney-General
OPENING OF THE LEGAL YEAR 2021 Speech by Attorney-General, Mr Lucien Wong, S.C. 11 January 2021 May it please Your Honours, Chief Justice, Justices of the Court of Appeal, Judges of the Appellate Division, Judges and Judicial Commissioners, Introduction 1. The past year has been an extremely trying one for the country, and no less for my Chambers. It has been a real test of our fortitude, our commitment to defend and advance Singapore’s interests, and our ability to adapt to unforeseen difficulties brought about by the COVID-19 virus. I am very proud of the good work my Chambers has done over the past year, which I will share with you in the course of my speech. I also acknowledge that the past year has shown that we have some room to grow and improve. I will outline the measures we have undertaken as an institution to address issues which we faced and ensure that we meet the highest standards of excellence, fairness and integrity in the years to come. 2. My speech this morning is in three parts. First, I will talk about the critical legal support which we provided to the Government throughout the COVID-19 crisis. Second, I will discuss some initiatives we have embarked on to future-proof the organisation and to deal with the challenges which we faced this past year, including digitalisation and workforce changes. Finally, I will share my reflections about the role we play in the criminal justice system and what I consider to be our grave and solemn duty as prosecutors.

As a class, tumor suppressor genes were the most commonly hypocellular/hyalinized (46 cases, range 5-80%), staghorn vessels (35 cases, range mutated loci, including TP53, mutated in 36% of cases (9/25). The loss of key tumor 5-30%), myxoid (27 cases, range 5-40%), keloid (24 cases, range 5-50%), nodular suppressor genes is consistent with our observations that CNV was present in 85% of fasciitis-like (15 cases, range 5-40%), and hypercellular (6 cases, range 5-20%). Tumors leiomyosarcomas. While no common therapeutically targetable gene was identified with keloid areas, as well as those with prominent staghorn blood vessels, mimicked across these cases, future large cohort sequencing studies of leiomyosarcomas may entities such as solitary fibrous tumor. Those cases with nodular fasciitis-like areas raised provide a means for the molecular classification of these tumors and identify new the possibility of nodular fasciitis and reactive processes. Hypercellular foci led to the treatment paradigms. consideration of spindle cell sarcoma, while the differential diagnosis of hypocellular/ hyalinized areas was broad. By site, the greatest variation of patterns was observed in 107 Identification of a Novel FN1-FGFR1 Genetic Fusion as a Frequent intra-abdominal lesions, and men showed more morphologic variability than females. • OPENING of the LEGAL YEAR 2019 Speech by Attorney-General
OPENING OF THE LEGAL YEAR 2019 Speech by Attorney-General, Mr Lucien Wong, S.C. Monday, 7 January 2019 Supreme Court Building, Level Basement 2, Auditorium May it please Your Honours, Chief Justice, Judges of Appeal, Judges and Judicial Commissioners of the Supreme Court, Introduction: AGC in Support of the Government, for the People 1 2018 was a fast-paced year for the Government and for the Attorney-General’s Chambers. The issues occupying the thoughts of Singapore’s leaders were complex and varied, with several key themes coming to the fore. These themes shaped our work over the past year, as we strove to be a strategic partner in support of the Government’s plans and initiatives, for the benefit of our country and its citizens. I will touch on three of these themes. 2 The first theme was our Smart Nation. This initiative aims to tap on the ongoing digital revolution in order to transform Singapore through technology. The Smart Nation vision is for Singapore to be a world-class leader in the field of digital innovation, resting on the triple pillars of a digital economy, digital government, and digital society. The Smart Nation revolution will play a critical part in ensuring our continued competitiveness on the world stage, powered by digital innovation. 1 3 Data sharing was and continues to be a critical aspect of this initiative. To this end, a new law was passed in 2018 which introduced a data sharing regime among different agencies in the Singapore Government. The Public Sector (Governance) Act 2018, which was drafted by our Chambers in support of this initiative, underpins and formalises a data sharing framework for the Singapore public sector.
