3. Period for within search title :

I caused the search to have been taken in respect of the said property in the office of the Sub Registrar, Mulshi No. 2 vide Application No. 1471t2013 dated 1411112013 for the period of last 30 years i.e. from 1984 to 2013. During the search, from the available registers (excepting the one given for binding in torn condition or simply not available), I did not found any other transaction except as mentioned therein. I have also taken search from the revenue records in respect of the said property in the concerned Talathi Office.

(3) Thereafter, the said Mr. Balkrishna Gopal Kanetkar was expired on 9/2/1999 leaving behind legal heirs, wife 1) Smt. ShreeSai Developers through partner 1) Mr. Sanjay Sadashiv Harpale, 2) Mrs. Savita Babasaheb Sakhare, 3) Mrs. Amrut Navin Patel, 4) Mr. Tushar Dattatray Zende, 5) Mr. Amit Sahebrao Undre on 0711212012 and the said Sale Deed was registered in the Office of Joint Sub Registrar, Mulshi No. 2, Hinjawadi, Pune at serial No. 707212012 and also executed power of attorney which was registered in the Office of Joint Sub Registrar, Mulshi No. 2, Hinjawadi, Pune at serial No. 7073t2012.

(20) That I have gone through the zone certificate, which clearly shows that the said properties are in residential zone.

Therefore on the basis of the search taken, documents made available and

information given to me, I am of the opinion that : The title of M/s. Shree Sai Developers through partner 1) Mr. Sanjay Sadashiv Harpale, 2) Mrs. Savita Babasaheb Sakhare, 3) Mrs. Amrut Navin Patet,4) Mr. Tushar Dattatray Zende, 5) Mr. Amit Sahebrao Undre in respect of the above mentioned properties viz. 1) s. No. 141r2t4, area 00 H. 02 R, 2) s. No. 1411215, area 00 H. 03 R, 3) s. No. 141t2r2, area 00 H. 02 R, 4) s. No. 14112114, area 00 H.02 R, 5) s. No. 141t2t15, area 00 H. 03 R, 6) s. No. 14112116, area 00 H. 02 R, and 7) s. No. 141t2t23, area 00 H. 02.5 R, is clear and marketable and the said properties are free from any encumbrances or no one has created any right or interest in the said land. M/s. Shree Sai Developers had full rights of entrusting the said property.
