We analyze a wealth tax at corporate and personal level that is designed as an AMT as proposed by the German Green Party. This wealth tax is imputable to profit taxes and is hence intended to prevent multiple (multistage) taxation. Referring to data from annual reports and the German Central Bank we model enterprises of different structure, industry, size and legal status. We show that companies in the service sector which generally maintain rather high gearing rates are more frequently subjected to the wealth tax than capital intensive industries. This result runs counter to well-known effects of a common wealth tax. Capital intensive firms, e.g. in the metal industry, are levied with definitive wealth tax only if they have large loss carry-forwards or extremely volatile profits. -

It puts the current tax structure in its historic context, showing that there has been a steady movement towards simplification. The personal income tax has a lower than average number of bands and, taxes capital income at an unusually low rate. Such a structure favours saving, especially since consumption taxes are particularly high. Nonetheless, there are a number of additional taxes on capital income that serve to raise the overall tax on assets, notably the tax on net wealth. The paper concludes that, if the current budget surplus persists over the medium-term, priority should be given to further reducing corporate taxes and the net wealth tax. At the same time, a number of discriminatory indirect taxes should be replaced by a uniform tax, and the diesel tax reformed. Consideration should also be given to the gradual introduction of a resource tax or to auctioning fishing quotas to help fund the other tax reductions. Taxation in Islam The following article is based on the book Funds in the Khilafah State which is a translation of Al-Amwal fi Dowlat Al-Khilafah by Abdul-Qadeem Zalloom.1 Allah (swt) has revealed a comprehensive economic system that details all aspects of economic life including government revenues and taxation. In origin, the permanent sources of revenue for the Bait ul-Mal (State Treasury) should be sufficient to cover the obligatory expenditure of the Islamic State. These revenues that Shar’a (Islamic Law) has defined are: Fa’i, Jizya, Kharaj, Ushur, and income from Public properties. The financial burdens placed on modern states today are far higher than in previous times. When the Caliphate is re-established it will need to finance a huge re-development and industrial programme to reverse centuries of decline, and bring the Muslim world fully into the 21st century. Because of this, the Bait ul-Mal’s permanent sources of revenue may be insufficient to cover all the needs and interests the Caliphate is obliged to spend upon. In such a situation where the Bait ul-Mal’s revenues are insufficient to meet the Caliphate’s budgetary requirements, the Islamic obligation transfers from the Bait ul-Mal to the Muslims as a whole. This is because Allah (swt) has obliged the Muslims to spend on these needs and interests, and their failure to spend on them will lead to the harming of Muslims. Allah (swt) obliged the State and the Ummah to remove any harm from the Muslims. It was related on the authority of Abu Sa’id al-Khudri, (ra), that the Messenger of Allah (saw) said: “It is not allowed to do harm nor to allow being harmed.” [Ibn Majah, Al-Daraqutni] Therefore, Allah (swt) has obliged the State to collect money from the Muslims in order to cover its obligatory expenditure. -

CONVENTION BETWEEN THE GOVERNMENT OF IRELAND And THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA FOR THE AVOIDANCE OF DOUBLE TAXATION AND THE PREVENTION OF FISCAL EVASION WITH RESPECT TO TAXES ON INCOME AND ON CAPITAL GAINS The Government of Ireland and the Government of the Republic of Slovenia, desiring to conclude a Convention for the avoidance of double taxation and the prevention of fiscal evasion with respect to taxes on income and on capital gains, have agreed as follows: Article 1 PERSONAL SCOPE This Convention shall apply to persons who are residents of one or both of the Contracting States. Article 2 TAXES COVERED 1. This Convention shall apply to taxes on income and on capital gains imposed on behalf of a Contracting State or of its political subdivisions or local authorities, irrespective of the manner in which they are levied. 2. There shall be regarded as taxes on income and on capital gains all taxes imposed on total income or on elements of income, including taxes on gains from the alienation of movable or immovable property. 3. The existing taxes to which the Convention shall apply are: a) in the case of Slovenia: (i) the tax on profits of legal persons; and (ii) the tax on income of individuals, including wages and salaries, income from agricultural activities, income from business, capital gains and income from immovable and movable property; (hereinafter referred to as "Slovenian tax"); b) in the case of Ireland: (i) the income tax; (ii) the corporation tax; and (iii) the capital gains tax; (hereinafter referred to as “Irish tax”). -

Nicola Severini1 1 Social-Economic Observatory of Fisheries, Chioggia (VE), Italia [email protected] Paper prepared for presentation at the 2nd AIEAA Conference 6-7 June, 2013 Parma, Italy The paper focuses on some aspects concerning the organization and management of fisheries in the Adriatic sea, in particular in the Northern and Central part, identified as Geographical Sub-Area 17 (GSA 17 – High Adriatic sea). This area includes Italy, Slovenia and Croatia and it has a high environmental importance due to the presence of the lagoon and high eco-biological ecosystems. The Northern-Central Adriatic area is one of the most productive areas of the Mediterranean Sea and one of the major fishing ground in Southern Europe. The good management of the area implies a cross-border collaboration between countries and a common regulation in order to avoid market distortion, stocks overexploitation and unevenly conservation of natural resources. The creation of a Fishing District between the two sides of Adriatic Sea could help to find a common governance of the area and could be a good solution for the implementation of the Common Fishery Policy in future. The Social-Economic Fishing and Aquaculture Observatory of Chioggia (VE) is one of the members of the Technical Group and plays an important role in this cross-border collaboration. Why a Federal Wealth Tax Is Constitutional
WHY A FEDERAL WEALTH TAX IS CONSTITUTIONAL ISSUE BRIEF BY ARI GLOGOWER, DAVID GAMAGE, AND KITTY RICHARDS FEBRUARY 2021 INTRODUCTION The 2020 Democratic presidential primaries brought national attention to a new direction for the tax system: a federal wealth tax for the wealthiest taxpayers. During their campaigns, Senators Elizabeth Warren (D-MA) and Bernie Sanders (I-VT) both introduced proposals to tax the wealth of multimillionaires and billionaires, and to use the revenue for public investments, including in health care and education. These reforms generated broad public support—even among many Republicans1—and broadened the conversation over the future of progressive tax reform. A well-designed, high-end wealth tax can level the playing field in an unequal society and promote shared economic prosperity. Critics have argued, however, that a wealth tax would be unconstitutional because of the Constitution’s apportionment rule, which requires certain taxes to be apportioned among the states according to their populations. These critics advance maximalist interpretations of the apportionment rule and reconstruct the rule as a significant limit on Congress’s constitutional taxing power. In response to these objections, this brief explains why these critics misinterpret the role of the apportionment rule, and why the Constitution grants Congress broad taxing powers that allow for a wealth tax, whether it is apportioned or not. The maximalist interpretations misapprehend the role of apportionment in the constitutional structure, and improperly elevate a peripheral rule into a major barrier to tax reform. This brief explains why constitutional history and Supreme Court precedents instead support a measured interpretation of the apportionment rule. -

Introduction In recent years, we have seen the rise of the anti-liberal democracy politics in Eastern European EU member states. In the meantime, those trends are becoming visible in some Western European Countries but also USA. The situation in Poland and Hungary is maybe the best example of such politics where citizens are giving support to political parties whose political objectives are against the EU rule of law principles and against some fundamental human rights. Recent refugee crisis has also deepen those concerns. This is a clear sign that the citizens of Eastern European EU member states are willing to give up of some of the fundamental human rights values such as freedom of expression, freedom of assembly, free media, civil society or independent judiciary. Those trends are seriously harming EU rule of law principles but also are derogating human rights and democratic standards.
