L 151/8 EN Official Journal of the European Union 8.6.2016 DECISIONS COUNCIL IMPLEMENTING DECISION (EU) 2016/894 of 12 May 2016 setting out a recommendation for temporary internal border control in exceptional circumstances putting the overall functioning of the Schengen area at risk THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) (1) and in particular Article 29 thereof, Having regard to the proposal from the European Commission, Whereas: (1) The EU is facing an unprecedented migratory and refugee crisis following a sharp increase of mixed migratory flows since 2015. This has led to severe difficulties in ensuring efficient external border control in accordance with the Schengen acquis and in the reception and processing of migrants arriving. Wider structural deficiencies in the way the Union's external borders are protected have also become evident in this crisis. (2) The Hellenic Republic is, mainly due to its geographical situation, particularly affected by these developments and has faced a dramatic increase in the number of migrants arriving on the Aegean islands. (3) In accordance with Council Regulation (EU) No 1053/2013 (2) and the annual evaluation programme for 2015 (3), an unannounced on-site visit was carried out from 10 to 13 November 2015 to evaluate the implemen tation of the Schengen acquis in the field of the management of the external border by the Hellenic Republic at its land border (Orestiada, Fylakio, Kastanies, Nea Vyssa) and sea border (Chios and Samos Islands) with Turkey. -

International Political Sociology (2015) 9, 53–69 The Humanitarian Politics of European Border Policing: Frontex and Border Police in Evros1,2 Polly Pallister-Wilkins University of Amsterdam This paper explores humanitarianism in the practice of Frontex-assisted Greek border police in Evros and of Frontex at their headquarters in Warsaw. Building on the increase in humanitarian justifications for bor- der policing practices as well as the charges of a lack of humanity, the paper analyzes the relations between humanitarian responses and bor- der policing where humanitarianism is used for framing and giving meaning to institutional and operational practices. In offering an inter- pretive view of border policing undertaken by people in their working lives across sites and scales, it builds on the critical literature addressing the multifaceted nature of border control in Europe today. At the same time, it speaks to wider debates about the double-sided nature of humanitarian governance concerned with care and control. It argues that while humanitarian motivations have implications for operations in the field and help to frame “good practice” at the policy level, humani- tarianism should not be seen as additional or paradoxical to wider bor- der policing operations within forms of governance developed to address the problems of population. Conflict arises in the paradox of protection between the subject of humanitarianism and policing, the population, and the object of border control, the territorially bounded state or regional unit. My role is very specific, it is to face the problem of illegal migration, however, when we need to save people, of course! Human life is the highest thing. -

Strasbourg, le 4 février 2009 CommDH(2009)6 Or. anglais RAPPORT de Thomas Hammarberg Commissaire aux droits de l’homme du Conseil de l’Europe à la suite de sa visite en Grèce du 8 au10 décembre 2008 Question examinée : Les droits de l’homme des demandeurs d’asile CommDH(2009)6 Résumé Le Commissaire aux droits de l’homme du Conseil de l’Europe Thomas Hammarberg et sa délégation se sont rendus en Grèce du 8 au 10 décembre 2008. Au cours de sa visite, le Commissaire a eu des échanges de vues avec les pouvoirs publics et des organisations non gouvernementales nationales et internationales sur certaines questions relatives aux droits de l’homme, et notamment la protection des réfugiés. Il a également visité le poste de surveillance de la police des frontières de Ferres, le centre de rétention pour migrants en situation irrégulière de Kyprinos (Fylakio) et une zone minée dans le département d’Evros. Il a notamment rencontré le ministre de l’Intérieur, Prof. Pavlopoulos. Après une description succincte des principales caractéristiques du système d’asile grec, le présent rapport du Commissaire se penche sur les questions suivantes, touchant à la protection des droits fondamentaux des demandeurs d’asile : I. Entrée des demandeurs d’asile sur le territoire et accès à la procédure d’asile, en particulier dans le département d’Evros : tout en se félicitant de la législation récente visant à offrir un régime de protection global aux demandeurs d’asile, le Commissaire note la persistance de lacunes structurelles graves dans la pratique grecque en matière d’asile, lacunes qui mettent en péril le droit fondamental de demander et de bénéficier de l’asile et requièrent la mise en place d’un plan d’action cohérent et doté de ressources adéquates pour la protection des réfugiés. -

CONTEXT OF THE PROPOSAL • Reasons for and objectives of the proposal Introduction The EU is facing an unprecedented migratory and refugee crisis following a sharp increase of mixed migratory flows since the summer of 2015. This has led to severe difficulties in ensuring efficient external border control in accordance with the Schengen acquis and in the reception and processing of migrants arriving. Wider structural deficiencies in the way the Union's external borders are protected have also become evident in this crisis. The Hellenic Republic is, mainly due to its geographical situation, particularly affected by these developments and has faced a dramatic increase in the number of migrants arriving on the Aegean islands. The massive inflow is of a nature that would put the external border control of any Member State under severe pressure. Schengen Evaluation Mechanism In accordance with Council Regulation (EU) No 1053/20131 and the annual evaluation programme for 20152, an unannounced on-site visit was carried out from 10 to 13 November 2015 to evaluate the implementation of the Schengen acquis in the field of the management of the external border by the Hellenic Republic at its land border (Orestiada, Fylakio, Kastanies, Nea Vyssa) and sea border (Chios and Samos Islands) with Turkey. On 2 February 2016 the Commission adopted an implementing decision establishing a report of the evaluation of the Hellenic Republic on the implementation of the Schengen acquis in the field of the management of the external border3 concluding that there are serious deficiencies in the carrying out of external border control that must be overcome and dealt with by the Hellenic authorities. -

Strasbourg, 4 February 2009 CommDH(2009)6 Original version REPORT by Thomas Hammarberg Council of Europe Commissioner for Human Rights following his visit to Greece 8-10 December 2008 Issue reviewed: Human rights of asylum seekers CommDH(2009)6 Executive Summary Commissioner Thomas Hammarberg and his delegation visited Greece from 8 to 10 December 2008. In the course of this visit the Commissioner held discussions with state authorities and non- governmental, national and international organisations on certain human rights issues, including refugee protection. The Commissioner also visited the Feres border guard station, the Kyprinos (Fylakio) holding facility for irregular migrants and a mined area in the Evros department. Among the state authorities that were contacted was the Minister of Interior Prof. Pavlopoulos. In the present Report, following an overview of the main features of the Greek asylum system, the Commissioner focuses on the following major issues relating to the protection of the human rights of asylum seekers: I. Asylum seekers’ entry and access to the asylum procedure, especially in the Evros department: Whilst the Commissioner commends the latest legislation aimed at providing a comprehensive protection regime for asylum seekers, he notes the persistence of grave, systemic deficiencies in the Greek asylum practice that put at risk the fundamental right to seek and to enjoy asylum and call for the establishment of a coherent and adequately resourced action plan on refugee protection. The Commissioner calls upon the authorities to effectively incorporate in asylum practice international and Council of Europe standards on foreign nationals’ detention and forced return and to revisit the existing readmission agreement with Turkey in order to fully align it with the Council of Europe human rights standards. -

L 151/8 FR Journal officiel de l'Union européenne 8.6.2016 DÉCISIONS DÉCISION D'EXÉCUTION (UE) 2016/894 DU CONSEIL du 12 mai 2016 arrêtant une recommandation relative à la réintroduction temporaire du contrôle aux frontières intérieures en cas de circonstances exceptionnelles mettant en péril le fonctionnement global de l'espace Schengen LE CONSEIL DE L'UNION EUROPÉENNE, vu le traité sur le fonctionnement de l'Union européenne, vu le règlement (UE) 2016/399 du Parlement européen et du Conseil du 9 mars 2016 concernant un code de l'Union relatif au régime de franchissement des frontières par les personnes (code frontières Schengen) (1), et notamment son article 29, vu la proposition de la Commission européenne, considérant ce qui suit: (1) L'Union européenne est actuellement confrontée à une crise des migrants et des réfugiés sans précédent, consécutive à une forte augmentation des flux migratoires mixtes depuis 2015. Cette crise a entraîné de graves difficultés pour assurer des contrôles efficaces aux frontières extérieures, conformément à l'acquis de Schengen, et pour accueillir et prendre en charge les migrants qui arrivent dans l'Union. Elle a également mis en évidence des défaillances structurelles plus étendues dans la manière dont les frontières extérieures de l'Union sont actuellement protégées. (2) Du fait de sa situation géographique, la République hellénique est particulièrement touchée par cette crise et a dû faire face à une augmentation spectaculaire du nombre de migrants arrivant sur les îles de la mer Égée. (3) Conformément au règlement (UE) no 1053/2013 du Conseil (2) et au programme d'évaluation annuel pour 2015 (3), une inspection sur place inopinée a été réalisée du 10 au 13 novembre 2015 en vue d'évaluer la mise en œuvre, par la République hellénique, de l'acquis de Schengen dans le domaine de la gestion des frontières extérieures, à sa frontière terrestre (Orestiada, Fylakio, Kastanies, Nea Vyssa) et à sa frontière maritime (îles de Chios et de Samos) avec la Turquie. -
