    EIOPA-IRSG-19-09 7 June 2019 IRSG Feedback Statement on EIOPA’s Questionnaire on the 2019 Consumer Trends Report 1. Background EIOPA is required under its Regulation to collect, analyse and report on consumer trends1. To date, EIOPA has produced seven Consumer Trends Reports. The term ‘consumer trend’ is not defined in EIOPA’s Regulation. EIOPA therefore devised the following working definition: “Evolutions in consumer behaviour in the insurance and pensions markets related to the relationship between consumers and undertakings (including intermediaries) that are significant in their impact or novelty” The term ‘trends’ is understood in a broad sense: it covers, for example, evolutions in volumes of business or in the relationship between customers and undertakings/intermediaries, as well as the emergence of new products or services, or other linked financial innovations. The trend may already be consolidated for a number of years, but it may also be only emergent, with the possibility of becoming significant in the future. The report aims to inform EIOPA in the identification, prioritisation and development of targeted policy proposals; EIOPA seeks to identify possible consumer protection issues arising from identified trends. Nevertheless, positive developments are also identified and highlighted. 1 Article 9(1)(a) of the Regulation 1094/2010 establishing EIOPA 1 2. An Analysis of Insurance Product Ratings in Germany Patricia Born, Stephanie Meyr and Sharon Tennyson MRIC Working Paper No. 31 April 2015 ABSTRACT Product market transparency suffered from relaxed regulation following deregulation of the European insurance market in 1994. Instruments such as insurance product ratings can contribute to foster consumers’ orientation in such market environments. However, the capacity of these ratings to promote market transparency and consumer awareness depends critically on whether they are credible. This article provides the first empirical investigation of insurance product ratings, with an emphasis on the potential sources of bias that could undermine rating credibility. The analysis employs a panel data set containing ratings for German disability insurance products from two rating agencies over a fifteen year period. Using the existing literature on other rating types as a guide, we test a series of hypotheses regarding factors that may explain the variation in rating outcomes over time and across rating agencies. Even if conspicuous differences between rating agencies can be revealed, our results suggest no major concerns regarding the credibility of insurance product ratings. Patricia Born Center

Mann and the conference participants for their helpful comments and suggestions, and David Pinzur for research assistance. 1 INTRODUCTION The three central postulates of the Legal Theory of Finance (LTF) developed by Pistor in this volume (Pistor 2013 @@@) are the hierarchical nature of finance, the role of law in both ensuring and subverting the stability of credit markets, and the differential enforcement of laws (elasticity) with the core afforded much more consideration than the periphery. The need for elasticity follows from true uncertainty, and the way elasticity is distributed is related to the power each actor wields. The source of this power can be structural position in the hierarchy of finance, political influence or both. In this paper, we apply some of the ideas of LTF to an area that is at the bottom of the hierarchy of finance in not one but two ways. Consumer credit in Eastern Europe is situated on the periphery both geographically, as the rules of international finance are written far away from Budapest, Moscow or Warsaw, but also because retail lending and individual borrowers are on the outer edges of the world of finance dominated by stock exchanges, currency markets and government debt. In fact, retail customers are at the bottom of the pecking order facing the hardest liquidity constraints. We will illustrate Pistor’s theoretical arguments with empirical data from East European credit card markets, and then point to their limitations offering a set of complementary ideas.

It analyses three institutional systems in Europe, like Hungary, the United Kingdom and Germany as typical examples of the three specific institutional structures. The study introduces the European practice of governmental subsidies in consumer protection. It analysis the public’s judgement on the operating institutional systems on European level, assuming relationship among the amounts of state subsidy devoted for consumer protection by the European Union member countries, the level of trust laid in the institutional systems of consumer protection and the degree of satisfaction with them.
