MANICKADEEPAN, Subdivisional Magistrate (South). M.C. No. 364/2013 ORDER UNDER SECTION 144 of Cr. P.C. Whereas, the Tahsildar, Taluk Office, Puducherry has reported that on 24-9-2013 at about 9.30 a.m. he received information from the Village Administrative Officer, Pandasozhanur that the cadres of Vanniar Sangam were blocking the road at Kariamanickam and Kalmandabam in view of alleged tearing of their sangam banner at Pandasozhanur and tension prevailing in the area due to enmity between Vanniar Sangam cadres and Vidhuthalai Chiruthaigal Katchi (VCK) cadres. As per the information, Tahsildar rushed to Pandasozhanur and found that about 200 persons from the Backward Class locality and about 200 persons from the Scheduled Caste locality have gathered in the area in two groups but with a distance of about 500 metres and Police was having the situation under control. At about 12.00 noon additional Police force arrived and the trouble makers were chased away by the Police; [ 803 ] 804 LA GAZETTE DE L’ETAT [ PART-I Whereas, the local enquiry revealed that the trouble had started at about 8.00 a.m. on 24-9-2013 at Mandaiveli Thidal at Pandasozhanur. The cadres of Vanniar Sangam had placed a flag post and a banner at Mandaiveli Thidal at Pandasozhanur last week to commemorate the Death Anniversary of their party cadres. Enquiry revealed that one Thiru Sivakumar, S/o. Mannagatti, Thiru Andavar and six to seven other persons of Pandasozhanur colony area belonging to VCK party allegedly had torn the banner placed by Vanniar Sangam and destroyed the flag mast of Vanniar Sangam. This was objected by the local youth of BC area. The local elders of the Backward Class side pacified the two groups which gathered there and the issue was settled at that time with a decision to file a complaint before the Police. While the people from BC area went to Police Station simultaneously the Vanniar Sangam cadres heard about this incident and involved in road roko at Kalmandabam, Nettapakkam, Maducarai and Sooramangalam. While this was going on, it was alleged that some miscreants had pelted stone on the house of one Thiru Ramalingam of BC area. Hearing this news the cadres of Vanniar Sangam who had already assembled at Kalmandabam, Nettapakkam, Maducarai and Sooramangalam reached Pandasozhanur and there was a tensed situation at Pandasozhanur. Since, the Police force was meagre, the Inspector of Police, Nettapakkam Police Station opened fire in the air to chase away the mob at around 10.00 a.m. At about 12.00 noon additional Police force arrived and the situation was brought under control. In this incident no casualty was recorded. It was noticed that the leaders of Vanniar Sangam from nearby areas, namely Kalmandabam, Nettapakkam, Ariankuppam and Villianur participated in the incident; And whereas, the Police has placed picketing at Pandasozhanur. The VAO and VA have been instructed to stay in the Village Office to watch the situation and pass information. In order to curtail the spreading of such events in future the banners, festoons and posters in and around Pandasozhanur viz., Kalmandabam, Kariamanickam, Nettapakkam, Eripakkam have been removed by the Nettapakkam Commune Panchayat along with Police and Revenue officials; Whereas, there have been past incidents of clash between SC and BC areas in Maducarai, Kariamanickam and Nettapakkam. Since the situation is communally volatile some small incidents may lead to bigger violence. Hence, the situation needs to be controlled by way of prevention of illegal assembly within the limits of Nettapakkam Police Station comprising Maducarai, Kariamanickam, Nettapakkam, Eripakkam and Pandasozhanur Revenue villages; Whereas, I, S. Manickadeepan, Subdivisional Magistrate (South), Villianur satisfied, based on the information placed before me and other facts which are available to me that the situation in the villages within the limit of' Nettapakkam Police Station is likely to endanger public tranquility; And whereas, in my opinion there is sufficient ground for proceeding under section 144 of the Code of Criminal Procedure, 1973 and immediate prevention is desirable; PART-I ] LA GAZETTE DE L’ETAT 805 Now, therefore, I, S. Manickadeepan, Subdivisional Magistrate (South), Villianur hereby prohibit the assembling of five or more persons in public streets or thoroughfares or in public places and prohibit the carrying of weapons, sticks, banners and placards, etc., by any person and also prohibit the shouting of slogans and acting in any other manner detrimental to public peace and tranquility within the limits of Nettapakkam Police Station comprising Maducarai, Kariamanickam, Nettapakkam, Eripakkam and Pandasozhanur. This order does not apply to purely religious functions, marriages and funerals. At Puducherry, dated this 24th day of September 2013. S.
