AL-ADWA 41:29 1 The Campaigns of the Prophet The Campaigns of the Prophet and Execution of POWs Atiq ur Rahman* Zia ur Rahman** The Holy Quran neither gives orders relating to the execution of the captives and nor it shows any justification in this regard. The companions of were not in the favour of the execution of prisoners (ﷺ) the Holy Prophet the ,(ﷺ) of Holy Prophet ر( یض ا ہلل عنہ) of war. Out of the companions expositor (Mufasir) of Quran Hazarat Ibn-e-Abbas judged this act as was against the execution of war ر( یض ا ہلل عنہ) illegal(1). Not only Abbas (ﷺ) captives but there is consensus of Sahaba () of the Holy Prophet that the killing of prisoner of war is not legal(2). Most of the mufasireen are also not in favour of execution of the prisoners, these include the names like Hassan, Ata, Ibn-e-Sireen and Mujahid.(3) But on the other hand, during the we find some examples which show that the (ﷺ) era of the Holy Prophet teachings of Islam has kept the option of execution of captives according to the need of circumstances. If the numbers are counted with references from books of Hadith and books of Seerat, there are at maximum ten such people who were practically killed as the prisoners of war, under the decree of and the given numbers only occur when the levels of the (ﷺ) Holy Prophet authenticity of related references are not kept in mind. In other words, the number reached to ten only if the infirm references are also added alongside the correct and authentic references from the stock of books of Hadith and Seerat. -

VIII NLIU LAW REVIEW ISSUE II FEMALE GENITAL MUTILATION: HOW ISLAM AND FUNDAMENTAL RIGHT TO RELIGION STAMP OUT AND CONFUTE IT Deeksha Sharma & Kratik Indurkhya* Abstract Is the abolition of female genital mutilation (‘FGM’) another textbook feminist issue or does it merit a human rights violation perspective? Do religious crudeness and ignorance act as barriers to stamp out this practice in India? Should we continue to avoid doing anything about it on the grounds that it is a sensitive, religious issue beyond the realm of the judiciary and the Parliament? This article attempts to deal with all such questions about FGM. In India it is practiced by the Dawoodi Bohra community and according to them, FGM is a pre requisite for a woman to be truly female. But there is no valid basis for the belief that the procedure was advocated or approved by Mohammed, nor can it be considered as an essential part of the Islamic faith to that end. Hence, the research analyses the sources of Islam and substantiates that a barbaric cultural practice with a religious mask should not get protection under Article 25 of the Constitution. Additionally, FGM is classified as a “usage”, and should be held void under Article 13 to the extent it violates the fundamental rights. However, whilst there is a violation of a number of human and gender rights, both in international and national legal framework, in reality, there has been no comprehensive study of the epidemiology of FGM in India, and thus no reliable statistics is available on the number of girls mutilated. -

There is a mistaken belief that the debate on FGM/C is a new one, but this is not the case. As far back as 1940, in the Al-Manar Journal, Sheikh M. Rashid Rida responded to a question about FGM/C: "is FGM/C a Fard (compulsory practice of Islam) or Sunnah (Prophet’s recommended practice)?" Bismillah-ir-Rahman-ir-Raheem Islam Forbids Same Gender Marriages Introduction: There is simply no Ordinance in the Holy Qur’an allowing same gender marriage. Islam, through revealed Ordinances, in the Holy Qur’an, forbids same gender marriage. Further, Islam also forbids any description of immorality between two persons of the same gender. The Ordinances have also been supported by quotations of Prophet Muhammad (pbuh) in all of the six leading Hadith1. Almighty God has made men and women as paired for procreation and the laws of Almighty God must never be breached for sake of sinful lust between two persons of same gender. Islam is clear in its prohibition of homosexual acts. Islamic scholars cite these reasons for condemning homosexuality, based on teachings of the Holy Qur'an and Hadith: It clashes with the "natural" order in which Almighty God created human beings. Further, it brings destruction to the family and the institutions of marriage. Furthermore, it leads people to ignore Almighty God's guidance in other areas of life. In some countries, a few of their leading politicians are leading the charge to amend their countries’ laws to allow same gender marriages. Marriage between persons of the same gender is becoming so widespread in modern societies that some countries are in the process of amendments to their country’s national Constitution. Islam forbids same gender marriages, regardless of country. Discussion: 1) The Holy Qur’an makes clear to mankind that Almighty God created humanity to continue to procreate in opposite gender pairs, through the process of marriages. Pairing means that both male and female have same type of souls; but only the material human body has gender differences; and this fact became operational with Adam and Eve, then subsequently downstream to wider humanity. -

The Methodologically: The researcher used the Descriptive and methodologically approach on the renewal of Islamic Studies. The results: The meaning of Objectives of Shariah: Allah orders us to try to achieve it. There are many Guides in Holy Quran and the Prophetic hadith to keep our life. The way to Protection of life in Islamic law: marriage, eating, drinking, clothing and housing, forbidden killing of Mu'ahid , no retaliation or punishment stipulated in the Quran on Pregnant, forbidden fighting, exceeding bounds, extravagance, transgression, keeping public health, forbidden suicide, breaking the fast, giving up fasting, Forbidden Abortion, Retaliation, Diya ( blood money(,( Compurgation )by oath taken by some people of the tribe of a person who is being accused of killing some body .Recommendations: Renewal of intention throughout our lives, and the establishment of conferences on Objectives of shariah. -
