Nicholas KASIRER est doyen de la Faculté de droit de l’Université McGill à Montréal depuis 2003 et professeur titulaire de la chaire James McGill. De 1997 à 2003, il fut directeur du Centre de recherche en droit privé et comparé du Québec à l’Université McGill où il enseigne depuis 1989. Diplômé des universités McGill, Toronto et de Paris I, M. Kasirer est un membre titulaire de l’Académie internationale de droit comparé et Membre de la Société Royale du Canada. Il enseigne et poursuit ses recherches dans les domaines des rapports entre langues et droit ainsi qu’en droit des obligations, des biens et de la famille, à la fois dans les traditions de la common law et du droit civil. Il a reçu le Prix de la Fondation du Barreau et le Prix Hessel Yntema de la American Society of Comparative Law pour ses travaux scientifiques. M. Kasirer est également secrétaire du comité de rédaction du Dictionnaire de droit privé et du Private Law Dictionary ainsi que rédacteur du Code civil du Québec: Édition critique. Ses articles récents sont parus dans des revues telles le American Journal of Comparative Law, le Tulane Law Review, le Oxford Commonwealth Law Journal, la Revue internationale de droit comparé, la Revue de droit de McGill, ainsi que dans d’autres publications parues au Canada et ailleurs. A plusieurs reprises, il fut professeur invité de droit comparé à Université de Paris I. Nicholas KASIRER is Dean and James McGill Professor at the Faculty of Law, McGill University in Montreal. From 1997 to 2003, he was Director of the Quebec Research Centre of Private and Comparative Law at McGill where he has taught since 1989. A graduate of McGill, the University of Toronto and the Université de Paris I (Panthéon-Sorbonne), Prof. Kasirer is a titular member of the International Academy of Comaparative Law and a Fellow of the Royal Society of Canada. He teaches and conducts research on the relationship between law and language as well as in Family Property Law in both Civil law and Common law. He has been awarded the Prix de la Fondation du Barreau du Québec and the Hessel Yntema Prize of the American Society of Comparative Law for his scholarly research. Professor Kasirer is also secretary of the editorial committee of the Dictionnaire de droit privé and of the Private Law Dictionary and an editor of the Civil Code of Québec: A Critical Edition. In recent years he has published in the American Journal of Comparative Law, the Oxford Commonwealth Law Journal, the Tulane Law Review, the Revue internationale de droit comparé, the McGill Law Journal, as well as other scholarly and professional publications in Canada and abroad. He has been a Visiting Professor of comparative law at the Université de Paris I on several occasions. .

Bussey, represented the CCCC at the Supreme Court of Canada’s virtual hearing today (Dec 9) in the case of Ethiopian Orthodox Tewahedo Church of Canada St. Mary Cathedral, et al. v. Teshome Aga, (39094). CCCC was granted the opportunity to intervene in the case, and to file a brief, but was not given time for oral argument. Brief fact summary Several members of the Ethiopian Orthodox Tewahedo Church St. Mary Cathedral were on a committee that investigated a movement within the congregation. The committee reported to Archbishop Dimetros that the movement was heretical. The committee recommended action, including purging of heretics. When Archbishop Dimetros did not follow their recommendations, the committee members were robust in their opposition – to the point that they were warned of church discipline. Finally, they were suspended from membership. In response, they then sued in court. The church in return asked for summary judgment to dismiss the lawsuit. The Ontario Superior Court of Justice agreed with the church and dismissed the disgruntled members’ lawsuit, noting that the courts have no jurisdiction to hear such cases. However, the members appealed to the Ontario Court of Appeal. The Court of Appeal stated that courts could hear the case because there was a contract between the members and the church.

He is a graduate of the McGill University Faculty of Law, where he served as an editor for the McGill Law Journal, and where he later served as a Professor (1989-2009) and Dean of the Faculty (2003-2009). The topic: The Civil Law in English has a distinctive sound, setting it apart lexically and conceptually from the vocabulary of the Common Law. In jurisdictions connected to the French civilian tradition such as Quebec, this distinctiveness is in part the result of the imprint of French legal ideas and of the French language on legal parlance. The language of the law is also distinctive in other mixed jurisdictions – there appears to be a “New Orleans Sound” and an emerging “Eurobeat” for the Civil Law in English – where the influence of French, as a matter of historical and social fact, is felt differently.

Based on a qualitative analysis of participant interviews and legal documents in three decisions of the Supreme Court of Canada, this dissertation explores the social processes at play in that litigation. At issue in the three cases were, respectively, (1) the right of Jewish condominium co-owners to install ritual huts (succoth) on their balconies; (2) the right of a Sikh student to wear a ceremonial dagger (kirpan) in a public high school; and (3) the right of a Hutterite group to be exempted from the photo requirement on driver’s licences for religious reasons. This dissertation adds to the existing academic commentary by looking beyond the judicial decisions and incorporating firsthand accounts of lawyers, litigants, and expert witnesses in these cases. The substantive analysis is divided in three sections. First, the dissertation examines themes of overlapping legal systems in participant narratives. Litigants understood themselves to be subjects of both state and religious laws, and the particular interactions between these legal systems help refine theories of legal pluralism.

Judgment of November 5, 2020 | On appeal from the Court of Appeal of Quebec Neutral citation: 2020 SCC 32 The Charter only protects human beings—not corporations—from cruel and unusual treatment or punishment, the Supreme Court has ruled. 9147-0732 Québec inc. was a corporation. It was found guilty of doing construction work without a licence. Quebec’s Building Act set out a minimum fine as punishment. It was fined over $30,000. The corporation said that the minimum fine was cruel and unusual punishment. It said this made the fine unconstitutional. The Canadian Charter of Rights and Freedoms sets out the rights and freedoms that Canadians have. It is part of Canada’s Constitution. Section 12 says that everyone has the right “not to be subjected to any cruel and unusual treatment or punishment.” This means certain treatments or punishments are unacceptable and not allowed. A corporation is a “legal person.” A legal person is treated like a physical person (a human being) for some purposes under the law. It has its own “legal personality,” meaning it has its own rights and duties. For example, it can sign contracts and own property, just like a human being can. Corporations can benefit from some Charter rights. For example, corporations are protected against “unreasonable search and seizure” under section 8. The state can’t search or take something private from a corporation without permission, unless the law specifically allows it, like when police have a warrant.
