Abstract The French Revolution of 1789 was instrumental in the emergence and growth of modern nationalism, the idea that a state should represent, and serve the interests of, a people, or "nation," that shares a common culture and history and feels as one. But national ideas, often with their source in the otherwise cosmopolitan world of the Enlightenment, were also an important cause of the Revolution itself. The rhetoric and documents of the Revolution demonstrate the importance of national ideas. -

WEST BANK AND GAZA 2020 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY The Palestinian Authority basic law provides for an elected president and legislative council. There have been no national elections in the West Bank and Gaza since 2006. President Mahmoud Abbas has remained in office despite the expiration of his four-year term in 2009. The Palestinian Legislative Council has not functioned since 2007, and in 2018 the Palestinian Authority dissolved the Constitutional Court. In September 2019 and again in September, President Abbas called for the Palestinian Authority to organize elections for the Palestinian Legislative Council within six months, but elections had not taken place as of the end of the year. The Palestinian Authority head of government is Prime Minister Mohammad Shtayyeh. President Abbas is also chairman of the Palestine Liberation Organization and general commander of the Fatah movement. Six Palestinian Authority security forces agencies operate in parts of the West Bank. Several are under Palestinian Authority Ministry of Interior operational control and follow the prime minister’s guidance. The Palestinian Civil Police have primary responsibility for civil and community policing. The National Security Force conducts gendarmerie-style security operations in circumstances that exceed the capabilities of the civil police. The Military Intelligence Agency handles intelligence and criminal matters involving Palestinian Authority security forces personnel, including accusations of abuse and corruption. The General Intelligence Service is responsible for external intelligence gathering and operations. The Preventive Security Organization is responsible for internal intelligence gathering and investigations related to internal security cases, including political dissent. The Presidential Guard protects facilities and provides dignitary protection. -

Human Rights Watch Submission to the Office of the High Commissioner for Human Rights Resolution 43/1 Report on the Promotion and Protection of the Human Rights of Africans/People of African Descent against Excessive Use of Force March 9, 2021 Human Rights Watch is pleased to offer this submission to the Office of the High Commissioner for Human Rights (OHCHR) as background information for the preparation of OHCHR’s report on the Promotion and Protection of the Human Rights of Africans/People of African Descent against Excessive Use of Force. We have compiled published reports of our investigations and legal analysis, congressional testimony, and related materials in the United States and France beneath each of the relevant headings from the OHCHR’s request for information. OHCHR has requested information on, “measures taken to identify, address, reform and remedy systems, institutions, structures, mechanisms, legislation, policies and/or practices that give rise to, perpetuate, entrench and/or reinforce systemic racism, racial discrimination and associated human rights violations against Africans and people of African descent, including those resulting from historical legacies, as relevant.” Human Rights Watch would like to draw OHCHR’s attention to current efforts to provide reparations to people of African descent within the United States. Human Rights Watch, alongside several local and national activists and groups, has been a part of efforts to call for reparative justice for racial discrimination and human rights violations against people of African descent, including those resulting from historical events, such as the Tulsa Race Massacre of 1921 and from the legacy of slavery in the United States. -

CHOOSING A LAW TO LIVE BY ONCE THE KING IS GONE INTRODUCTION Law is the expression of the rules by which civilization governs itself, and it must be that in law as elsewhere will be found the fundamental differences of peoples. Here then it may be that we find the underlying cause of the difference between the civil law and the common law.1 By virtue of its origin, the American legal profession has always been influenced by sources of law outside the United States. American law schools teach students the common law, and law students come to understand that the common law is different than the civil law, which is prevalent in Europe.2 Comparative law courses expose law students to the civil law system by comparing American common law with the law of other countries such as France, which has a civil code.3 A closer look at the history of the American and French Revolutions makes one wonder why the legal systems of the two countries are so different. Certainly, the American and French Revolutions were drastically different in some ways. For instance, the French Revolution was notoriously violent during a period known as “the Terror.”4 Accounts of the French revolutionary government executing so many French citizens as well as the creation of the Cult of the Supreme Being5 make the French Revolution a stark contrast to the American Revolution. Despite the differences, the revolutionary French and Americans shared similar goals—liberty and equality for all citizens and an end to tyranny. Both revolutions happened within approximately two decades of each other and were heavily influenced by the Enlightenment. -

Geography Part Two: How and Why is the Territory Developing Chapter 5: Development of Overseas French Territory Key ideas French overseas territory is spread around all the continents and oceans. This means that France has the second largest exclusive economic zone in the world after the USA. An exclusive economic zone (EEZ) is the maritime zone that extends 200 nautical miles (370km) from the coast of a territory and is reserved for the exclusive use of that territory. Particular thanks are owed to many Forum réfugiés-Cosi colleagues who have shared their practical experience on the right of asylum in France – which have been key to feed concrete reality-checks and observations into this report; to the two lawyers who have taken the time to share their views on the French system; to the staff of France terre d’asile, the Anafé and the UNHCR Paris office for their expert and constructive feedback provided for the initial report and finally to ECRE for its support throughout the drafting process. Caveat: In France, asylum policies – including reception procedures – are largely under prefectural execution. This review of practice is mostly based on observations in the departments of Ile de France, Rhône, Puy-de-Dôme, Haute- Garonne and Alpes-Maritimes. However, the conclusions presented in this report on the concrete implementation of asylum policies have been cross-checked and triangulated with observations of these practices in other regions and are supported by findings presented in other reports – be they official or drafted by civil society organisations. -
